The customer placed the order on 11/7/14. This is when they paid the initial $4.95 for shipping and handling and this began the trial period to sample from the initial 30 day supply they were sent. Since there was no notification of a request for cancellation and/or a returned product during the allotted time, the customer was automatically billed for the 30 day supply on 11/22/14 as explained in the terms and conditions which they agreed to. The customer was then billed for the 2nd shipment on 12/22/15, the 3rd shipment on 1/21/15, the 4th shipment on 2/20/15, and the 5th shipment on 3/22/15. At no time during the months of November through March did the customer contact us to cancel. The consumer contacted BellaLabs on 4/5/15 with a request for cancellation and stated that they returned two products back to us. We did inform the customer at that time that we would refund those two products once we received them, as there was no authorization prior to that for the customer to return products. The account was cancelled immediately as instructed and the customer was sent a cancellation confirmation via email. Unfortunately, it seems the items were not refunded as the customer was informed they would be. We will be contacting the customer to verify an address to mail a check to in the amount of $175.26 for the two products they returned.

We attempted to look up call records by the phone number provided by the consumer: [redacted] and [redacted]. We were unable to locate any calls. We operate seven days a week, and have not had any issues receiving phone calls. We have refunded the remainder of the amount $87.63, due to this complaint, however we stand by our policies and we would like to reiterate that our customers accept the terms and conditions two separate times to process their order. We state the terms and conditions clearly, and send a synopsis card with our contact information, with each order. Since there was no notification of a request for cancellation and/or a returned product during the allotted trial period, the consumer was automatically billed for the 30 day supply on 08/04/14 as explained in the terms and conditions for which they agreed to. The consumer contacted our company on 08/11/14 with a request for cancellation. The account was canceled immediately as instructed and they were sent a confirmation email confirming the cancellation. Based on the nature of the call, the customer service agent transferred the call to a supervisor. The supervisor authorized a partial refund of $43.82 off of the charge of $87.63 on that same day. The consumer would have received an e-mail confirmation of the cancellation and refund. The refund will take three to seven business days to credit back. We do not require our consumers to read the full two to three pages of our terms and conditions, although it is recommended. We provide a synopsis on the website, in a high-lighted paragraph right next to where they input their credit card information. It specifically outlines the 14-day trial basis and recurring monthly membership. 
 
We have refunded the remainder of the amount due to this complaint, however we stand by our policies and we would like to reiterate that our customers accept the terms and conditions two separate times to process their orders. We state the terms and conditions clearly, and send another synopsis, in the form of a terms card, attached to each and every package. Terms and conditions are also located on all ordering websites. While the bare bones of Bella Labs response are accurate, it does not begin to explain the roadblocks we have encountered trying to unravel this situation.  name is [redacted] is my wife, I am writing this response in her behalf.She must have  supplied her credit card number and pushed the right buttons to have the product shipped.   I would contend that the agreement and details of the trial period  are in very small print.When my wife ordered the facial cream she also ordered Encante eye wrinkle reduction.  Both items were shipped from San Diego in the same bag.  When we started to work on cancelling the shipments we used the Bella Labs customerservice phone #.  Dealing with customer service was difficult.  Being able to understand the agent was a trying experience  at times, getting any kind of help took several calls.  We subsequently we found out that we would have to call a separate number to cancel the agreement with encante.  When my wife challenged the charges on her card the Bella customer service agent said she could not help us because we had challenged the charges.    At some point we started receiving identical product from Santa Ana, California.  (this is where Encante apparently conducts business).  At first we assumed this was just the original order still being shipped.  Then we found out the Santa Ana orders were being charged against a different credit card.  I cannot offer an explanation as to how the second credit card got involved in this situation at this time.  We have challenged the charges with the second credit card company to figure out how the Santa Ana charges got started.  We kept calling Bella labs to stop the shipments but they said they did not know anything about product coming out of Santa Ana.   When we finally noticed the charges on the second credit card, there were phone numbers attached to the charges, there were two phone numbers, one in Rhode Island, [redacted] for face serum and one in Oklahoma, [redacted].  I would note these phone numbers are completely different from the two original customer service numbers for Bella and Encante. Again we had to call both unique numbers to stop the shipments.It is my impression that the credit card companies are the only ones who are wiling to assist us with gathering enough facts to resolve this issue.  We are still waiting to hear from the second credit card company.That is one reason I do not wish to consider our complaint as resolved.The second reason is that my wife is starting to  receive phone from someone who is difficult to understand but appears to trying to interest my wife in talking about facial products.  To me this implies Bella Labs is sharing their customerinformation.  [redacted]

Gentlemen:
While I appreciate your issuing a credit card credit for the
bottle of facial cream I returned as soon as it arrived, our dealings are still
not satisfactory. Our dealings have been complicated by my being mislead by my
credit card company. I will deal with them separately. They encouraged me to
file a dispute without telling me to try to contact you first. I had just been
through an experience in which I tried to contact the merchant and his phone
was never answered. They said I could file a dispute and they would take it
from there. I didn’t know you would be charged a dispute charge until my
husband found out from your customer service agent.
Let’s settle this equitably. I have returned the original bottle.
Please refund $87.63 after deducting any charges I’ve caused you to incur.

Per those same terms and conditions, the customer was billed for their next 30 day supply of BellaLabs on 3/14/15, as there was not a cancellation notice received by our company. The consumer contacted BellaLabs on 3/19/15 with a request for cancellation. The account was cancelled immediately as instructed and the customer was sent a cancellation confirmation via email. Based on the nature of the call, the customer service agent refunded the amount of $87.63 that day for the charge on 3/14/15. Please note I did not hang up on the customer service rep. [redacted].  She was exceedingly rude, spoke in a superior tone and highly unprofessional.  Nor would she let me talk, she would just speak over me.  The card which was enclosed in the envelope and the only documentation in the envelope other than the bottle (which was attached with the original complaint), does not state anything about returning the bottle.  Also since I went through a promotion from a another company than yours I immediately when to the print receipt and never went to your webpages.  I have also contacted the company whom you linked with and was advised that they did not authorize for your product or anything to be linked to them.  Therefore, you do not operate ethically and are sneaky.  I do consider this matter closed and resolved.

The customer has to also click "I agree to the terms and conditions"  twice before the order is processed. If the customer does not "agree" to the terms, the order will not process. The terms and conditions are disclosed directly on the ordering website not only on the bottom of the first page, but also highlighted in a large white box on the second page where the customer inputs their card information, as well as sent out with the product. The consumer placed the order on 3/19/14. This is when they paid the initial $4.95 and this began the 14 day trial period to sample from the initial 30 day supply. Since there was no notification of a request for cancellation and/or a returned product during the allotted trial period, the consumer was automatically billed for the 30 day supply on 4/3/14 as explained in the terms and conditions for which they agreed to. The consumer contacted our company on 4/7/14 with a request for cancellation. The account was canceled immediately as instructed and they were sent a confirmation email confirming the cancellation. Based on the nature of the call, the customer service agent refunded 25% of the charge on that same day. The consumer would have received an e-mail confirmation of the cancellation and refund. We value customer satisfaction so we have issued the remainder of the refund in the amount of $65.73. The refund will take three to seven business days to credit back.

The customer placed the order on 4/27/2015. This is when they paid the initial $4.95 for shipping and handling and this began the trial period to sample from the initial 30 day supply they were sent. Since there was no notification of a request for cancellation and/or a returned product during the allotted time, the customer was automatically billed for the 30 day supply on 5/11/2015 and again on 6/11/2015, as explained in the terms and conditions which they agreed to. The consumer contacted BellaLabs on 7/20/2015 with a request for cancellation. The account was cancelled immediately as instructed and the customer was sent a cancellation confirmation via email. Based on the nature of the call, the customer service agent refunded the amount of $87.63 that day. Since receiving this complaint, the consumer has reached out to our company and the resolution request made in this complaint has been mutually agreed upon. However, the refund will not be sent electronically, but rather in the form of a company check. The check has been made out for the requested $87.63, has shipped USPS Priority Mail and the consumer can track its whereabouts using the following USPS tracking number: [redacted]. The consumer should expect to receive this refund check in 3 business days to the shipping address on file. Since there was no notification of a request for cancellation and/or a returned product during the allotted trial period, the consumer was automatically billed for the 30 day supply on 04/27/14 as explained in the terms and conditions for which they agreed to. As the customer admits, they read the terms on the website and the terms card inside of the package. And the customer still has not contacted us to cancel. As we value our customers, we will issue a credit of $87.63. The refund process takes 3 to 7 business days. The customer will receive email confirmation of the refund and cancellation.

Once a customer contacts us to cancel, their account is closed. We do not continue to charge any customer, after their account is cancelled. Ms.[redacted] paid $1.99 for shipped and handling. As a courtesy from our company, we've refunded her $1.99 shipping charge. Please allow 3 to 7 business days for the refund to process. Ms.[redacted]'s account has been closed since 04/29/2014.
