[In the beginning of December I spoke with him I have also since then called the office multiple times and submitted a quote for the work from a contractor I have done everything I was asked to do there is no reason he would be reaching out again there is nothing left to talk about I was told we were bypassing the insurance since it was such a small amount and then weeks ago I was told we were still waiting on the insurance process the story is never the same with you people *** has not reached out since the beginning of December it seems to me your company has no intentions of resolving this issue which will leave me no choice but to take the legal route to be refunded for you ruining my home .]

I am requesting reopening my complaint as I have been going back and forth with the response from the consumer which is unclear of what exactly is Bernie and Phyls offering as a resolutionI was told I could go pick out another living room set but I would have to pay the differenceIs it the exact difference with what I already have paid into the living room set I haveAlso the triple price was through Acceptance Now which is hired by Bernie and Phyls to coordinate paymentAs stated, the manager who I worked with has been fired and at the time he never gave me my signed agreement, I didn't recieve it till I went in the store to complain when I was told my balance was triple the price after I assumed I was done payingAt that time another manager gave me a copySo am I suppose to file another complaint for Acceptance NowAnd Bernie and Phyls offer to pick out another sofa is what I already paid going towards thisPlease give me a clear answer. The customer did purchase chairs in MarchThe chairs did not come with any pillowsThe pillows were added to the chairs by the customer, purchased elsewhereThe red and brown that is transferring onto the chairs is from the pillows, not purchased from Bernie & Phyl's furnitureWe did offer
to split the cost of the parts for the customer as a good faith gesture to our customerHowever the color that is transferring is not from our product and therefore is not a warranty issue

The technician was out to the home and found accumulation of damageThe warranty was refunded back in May

I see there has been a rebutal, however with no further comments*** does have year warranty protecting against defects in manufacturingAlthough this set is outside of the year warranty we have ordered those cores at our costWhen the cores come in we will contact the customer to install those cores

resolve my issues and/or concerns in reference to complaint # ***Please add your rejection comments belowI never spoke to *** ***The loan was negotiated by the salesman at Berni & Phyls and all paperwork was done by themThe sales pitch for financing was that if I made my payments on time there would be no interestOn paperwork attached is the phrase "Term ; No interest option if paid with minimum payments" To me that says if I make the minimum payments on time, no interest will be appliedI would have never agreed to a loan with even the slightest possibility of a 27% interest chargeI feel Berny and Phil's are using deceptive sales practices and they are crooks!

[Thank you for your apology As previously stated, I allowed for more than double the time advertised and Bernie & Phyl's did not fulfill their part of the contract entered into on August I've also lost trust and confidence in Bernie & Phyl's because of the mis-leading advertisement and employees who repeatedly ignore their customers, which forced me to contact the Revdex.com As I told *** *** (Mgr Customer Care) on the phone and her (and multiple colleagues via email) on November 21, I do not trust what Bernie & Phyl's would or would not include in the box of "pillows" I would have gladly accepted the pillows from *** during the timeframe originally promised In fact, I made my purchasing decision on August baed on these promotions Again, it's not okay for Bernie & Phyl's to advertise one promotion and not deliver it as advertised This violates consumer protection laws I again respectfully request fair compensation for the promotions ($spa and $pillows) I did not receive as advertised Thank you.]

We have had technicians out to the customer's homeBoth technicians have stated the set has no defects, but rather settling of the cushionsThe back cushions of the set have loose fill and therefore can be fluffed and may require some fluffing to maintain the shapeThere are multiple
stains and the parts have been ordered and are in the customer's home

[Regarding the comment that all promotions have been sent to me -- Once again, they were not sent in the timeframe advertised The advertisements given to me by Bernie & Phyl's on the date of purchase (August 20) is what I relied on for my purchasing decisionIt's not okay for businesses to promise something (in writing) and to not deliver on that promise The store manager left one message for me I returned his call the same day (left a message) and left another message for him the next day It was only after I continued to reach out to Bernie & Phyl's that the Manager of Customer Relations contacted me I have still not received the promotions as promised and advertised on August Bernie & Phyl's still has the opportunity to make this right with their customer by providing fair compensation for the products not received in the timeframe advertised and for all of the time and effort their customer has had to expend to try to resolve this I remain hopeful that Bernie & Phyl's will make this right for their customer and not further damage their reputation Thank you

I appreciate the reply, this the most response I have received in weekshowever the folder in question is OBVIOUSLY illegible under the naked eye. One cannot read it without the use of a magnifying glass (and one was not provided)The folder was also handed to me after my money was taken and the sale was closed. It should have been provided and discussed before or during the sale by the associate who helped me There is no question that the folder is impossible to read in it's existing form, there fore as far as I'm concerned it is useless as a disclosure of terms to the consumerI'm confident that any authority would agree that this method of disclosure is poor business practice, perhaps even a form of entrapment clearly we have different opinions on the folder, but I have clearly stated my positionIf we cannot come to a settlement, I am prepared to escalate this matter to Small Claims Court. There we can see what the presiding judge or Magistrate will ruleI have obtained a Statement of small claims and notice of trial and will file it this Monday

[Yes there were stains that were in the couch the solution that was provided to me didn't workI knew there might be a possibility that they would not clean them which was fineI brought my own attachment to my vacuum cleaner to clean them which I didMy issues is that the disrespect of the staff that I was given as a customerThere was paper work that was left in my home with remarks that wasn't trueAlong with someone telling me that the whole in the couch could not be fixed because you no longer deal with the companyHow is that fair has a customer no one tired to help when it came to that it was just we don't deal . When the whole was put into the couch I called them within the time I should haveIt was stated that I had broken the pieces on the chairI don't remember ever stating That I was the individual who had broken the chairThat furniture had stayed in in storage well protectedOnce I moved into my homed the couches never got connected until the day I called them and realized it wouldn't attachAs far as the leg there was nothing wrong I had already been living in my home for months I went to move the chair to sweep and the leg came off. One of the worst companies I have ever dealt withWhen buying the protection they say all these great things but when dealing with the corporate they are very nasty***'s would of never treated there customers the way they treat there customersI really wish I could give these couches back it was a waste if my moneyI will never do business with this company again and I will not allow people I know to do business because the way I was treatedIt would be wonderful if this complaint could get to someone that mattersYour staff absolutely need better customer service training

The spa certificate was sent out within the time frame, however was either lost in the mail or discarded in error believed to be junk mailHowever we have provided the voucher number and the web address to redeem that voucherThe pillows, while yes we did have some difficulty from *** getting those pillows sent out, we have offered multiple times to have the pillows sent out from our stock direct to the customerThis morning again the customer refused saying she felt she could not be sure that we would be sending the correct pillowsI have emailed a customer a picture of the pillows just prior to being boxed to be shipped out to herWhile the person/s that the email was sent to did not respond, that information was forwarded to the store manager who did reach out multiple times in response to the customer

Our fleet manager has left a few messages for the customer to address the issues, however has not heard back from the customer

The fabric is poorly made and never looks cleanI also failed to mention in my letter that I have been tipped out of the chair when I was unable to shut the leg restI am deeply disappointed with these chairsThey were not inexpensive and should have looked like new for at least a year or more.
