The bike has been repaired and available for delivery back to
the customer as of 9/21/15, however the customer has been
unresponsive to us and the repair facility to arrange
redelivery of the repaired bike.

On October 15th, we made contact with the customer at which
time the customer stated that in order for her to accept
redelivery of the repaired bike, we will need to sell the bike
to her at a price of $350 dollars. Given that the original price of the bike was $1045.91, it was explained to her
that we cannot accept such and unreasonable offer.

On October 19th, the customer accepted the condition of us
refunding to her the actual return shipping costs for this
bike of $122.36. We agreed to refund this amount to the
customer. However, since the customer had filed a chargeback
for this transaction, we cannot process the refund until the
credit card chargeback has been canceled by her. She requested that we cancel the credit card chargeback on our
end, so that she can make re-payment of the bike. It has been
explained to her that we do not
have any ability to cancel the chargeback. We explained to her that she
will need to cancel the chargeback so we can refund the
payment of $122.36 to her. She had indicated that at that time that she had an issue with trusting that we will refund her the payment of $122.36. We than offered to refund the $122.36 to her prior to her canceling the chargeback claim. However, she denied this offer. We also sent her a signed letter which stated the agreed upon resolution, however she did not accept that, requesting that the letter be notarized. The letter is attached for review.On Oct 24th, she then changed her mind and requested that we ship the repaired bike back and send out black bike. It was explained to her that as she had already agreed to have the bike repaired, now that the bike has been repaired and paid for, we are unable to do such an exchange.We have done everything in our power to satisfy the customer's needs. This includes:1. Making arrangements with a local repair facility to pick up the bike at her residence, repair the bike and deliver the bike at her residence. We paid $70 for this repair. 2. Offer her an extension to our warranty for the bike.3. Offer a courtesy refund of $122.36. However, at this time, we do not believe we can satisfy the customer's unreasonable requests. The bike is being returned to us.

I feel if you advertise your product for sale even if was a mistaken price, you need to be obligated to sell it at that price until the mistake has been corrected.  Not my fault the price was wrong, I was just looking to purchase the item at that price.  It felt to me like a bait and switch situation.  Not good business practices.

I have attempted to contact you 2X. When I've called, and dial your extension, a recording indicates I've reached different mailbox. I decided on the second try to leave a message - glad you received it.  We feel putting your offer in writing through the Revdex.com will provide the simplest and quickest way of getting this matter settled. As I suggested in my last email, please provide the following information:PriceTerms of guaranteeAs I said in my recent voice mail message, the repair shop took the packaging the bike was shipped in with them. You assured me in a previous phone call that if we decided to return the bike  in lieu of a suitable offer after it was repaired,  I wouldn't be responsible for the shipping charges (you estimated this charge was about $280 ).  Considering the bike shipped was the wrong color, arrived damaged, has a charger that seriously overheats, a damaged rim, etc., and there's little opportunity left this season to even use the bike until next Spring, I think it's reasonable to expect a substantial decrease in price in addition to a guarantee and a new charger for the battery. If your offer is acceptable we'll set up a delivery time with the bike shop. If not, I suggest the bike be directly shipped back to you from the shop.

In investigating your issue, I do see that you had sent a manual direct [redacted] payment to us in the amount of $290. As this was a manual payment made 19 days after your original order, we had no way of linking this payment to your original order. I have gone ahead and refunded this manual payment back to your [redacted] account at [redacted] Regarding the shipping costs. I do see that you had selected USPS Priority mail as your shipping option at checkout in the amount of $63.40. Due to the dimensions of the item you purchased, this item cannot be shipped via USPS Priority mail and therefore in order not to delay your order, your order was shipped to you via UPS the next business day via UPS [redacted]. There is a difference in cost of the USPS Priority and UPS shipping of $40.34. I am happy to refund the additional payment of $40.34, however when I attempted to make the partial refund payment, it appears that you have placed a chargeback for the full amount of $353.39 and therefore we are unable to issue a partial refund. I have worked for weeks with Jack Lin, Manager of Bikeberry to resolve this issue. I spoke with him 10/26/15. He promptly rescinded the amount of his original refund offer and demanded I take immediate delivery of the bike, which I declined to do. However, we eventually reached a tentative agreement for purchase conditioned on Mr. Lin accepting the full [renegotiated] price paid full through a new charge for the agreed on price, or, if he preferred, via a cashiers check sent directly to his place of business. In lieu of the many difficulties I've experienced in dealing with Mr. Lin, I also asked for a simple notarized statement of his agreement to the terms of the sale. Mr. Lin flatly refused the payment options, and also to provide a notarized statement due to the fact he said it wasn't cost effective to obtain this, or something he considered to be necessary. He demanded I cancel the dispute on my credit card, allow him to have full payment, and then trust him to issue a refund. As you can imagine - this was completely unacceptable considering my experience with him in honoring any verbal agreements.I also offered to exchange the bike for a new one at full price, which he said wasn't possible because the color I originally ordered isn't in stock. However, he never asked me to wait to exchange the bike when a new shipment arrived, or even consider accepting a different color. Obviously, he actually wasn't interested in this option to begin with, and his offer was disingenuous to begin with.I've made monumental, sincere attempts to work through this since August 2015 when the bike was delivered and accommodate Mr. Lin, but I now consider the matter closed because he's refused to sell the bike. Therefore, it remains his property, and his responsibility to have it returned to his business if he chooses to do so. At their request, I've forwarded all correspondence to the legal department of my credit card company that will now take over dealing with Mr. [redacted]. this carburetor, it does require a lot of time to tune it properly. Please be aware of this and understand that this is not a plug and play carburetor. This is a plug and play carburetor and is factory adjusted to perform optimally with the 66/80cc Flying Horse Engine kits. I do understand that one of the carburetor clamps have broken. In most cases, we do require that the carburetor be sent to us for warranty replacement.
