Review: This complaint involves:

(1) three glass sinks made by [redacted] and sold by Blackman, Blackman Quotation # [redacted] and [redacted] complaint # 2495276

(2) Blackman’s sale of Brizos clicker drains connections to those sinks,Blackman sales order [redacted]

(3) master bathroom shower items made by [redacted] and sold by Blackman, Blackman Quotation Order [redacted]

Three Glass Sinks

The three whisk sinks turned out to be see through so that the pluming in the vanities

can be seen by the user of the sink. When we bought the whist under mount sinks the

saleslady ([redacted]) in Blackman’s Bohemia location, did not have a [redacted] whisk glass sink as a model. We were shown a different glass model sink that was not see through. We bought the sinks and paid in excess of $309.93 for each one. When the installation took place on December [redacted] 2014, the plumber brought to our attention that the sinks he was installing were see through, that is you can look through the sink and see the pluming and inside of the vanity. While the plumber was installing the sinks, he informed us that the sprout connections for Brizos which were supplied by Blackman are incompatible with an unmounted glass sink. Blackman’s sales associate had sold the sprout connections as correct for the whist sink.

Clicker drain w/o overflow

We called Blackman and the plumber spoke to the Blackman associate explaining the

mix up. Blackman denied any responsibility but offered to provide three correct clicker drains

for glass sinks unmounted. They charged us $187.70 for replacements of what Brizos sent us.

They also said it was Kohler’s problem.

Master Bedroom Shower

This involves the malfunction of the following items: Rite Temp press bal vlv, Lourerite Temp Valve, Loure Trandsfer valve and transfer valve master bathroom made by [redacted] and sold by Blackman, Blackman Quotation [redacted]. When the master bedroom shower handle is turned to the left, it becomes limp and will not provide the range of hot water or consistency which it should do if not defective.

Attempts to Resolve

Blackman denies all responsibility for any of the above. [redacted] offered under complaint # [redacted] a convoluted gesture that involved taking back the sinks, paying $ 300 for the extraction and installation of three replacement sinks. This offer is not satisfactory since the whisk sink samples presented to us as substitutes are all see through sinks. In addition, the removal of the current sinks involve pluming charges and alterations of the vanities that exceeds Kohler’s offer. Kohler’s offer was made without accepting liability.

Kohler’s liability is for manufacturing glass sinks that are see through, that is these whisk

sinks are not fit for the purpose for which they are sold by Kohler. Blackman’s responsibility is

for selling these sinks by withholding and concealing the fact that they are see through. As for

the Brizo clicker drain w/o overflow being incompatible with a glass unmounted sink that is

specifically Blackman’s liability. Blackman’s employee advised the use of this item and took

the orders on one form and knew or should have known that they were

incompatible.

I attempted an amiable resolution of these issues. Blackman denies all responsibility for any of the above. [redacted] offered under complaint # [redacted] a convoluted gesture that involved taking back the sinks, paying $ 300 for the extraction and installation of replacement sinks. This offer is not satisfactory since the whisk sink samples presented to us as substitutes are all see through sinks. In addition, the removal of the current sinks involve plumbing charges and alterations of the vanities that [redacted] will not reimburse.

Solutions

The solution for these problems are:

a refund of the costs of the three whisk sinks , that is $929.79. I have no problem with

Kohler or Blackman retrieving the sinks from the vanities. Both [redacted] and Blackman are jointly

responsible for additional pluming expenses caused by their defective products.

(2) Refund by Blackman of the $187.70 which was the paid for the clicker drain w/o overflow

(3) [redacted] and or Blackman refunding $572.93 for the defective master bedroom shower

temperature control handle and associated pluming expenses to fix same.



For record keeping purposes Blackman sold these products under account # [redacted] to

[redacted] our GC for the work on our house.Desired Settlement: Refund and payment of plumbing expenses

** & [redacted] visited our Hicksville showroom yesterday and saw a sample of the sink we are offering as a replacement. I am still waiting for the color samples, since the sink comes in 3 different colors. As soon as I have them, they will be able to choose a color and we will place an order for them thru Kohler.

Review: In April 2014, our Superstor water heater developed a leak. We contracted with a local plumber to replace it. A call to HTP products verified that the unit was under a lifetime warranty and would be replaced at no charge. We had to obtain a new unit and we did so through Blackman Plumbing on [redacted] in [redacted] I called Blackman to order the unit so my plumber could pick it up. I was told that I had to buy a new unit and when the old unit was returned to HTP I would be refunded the cost of the unit and that I had to go to the store in person because they did not do credit card transactions by phone. I went to Blackman Plumbing on April **, 2014 and purchased the Superstor water heater and had a charge of $1,109.91 placed on my credit card. I was told that after the unit was accepted by HTP that the amount would be credited back to my card. I was told this could take a month or 2. In the meantime, I had to pay the amount on my credit card or be responsible for finance charges. On June [redacted] I called Blackman to find out the status of my return since I had heard nothing from them. A man named [redacted] told me he would look into it and call me back. A few days later I called Blackman Plumbing again, and the representative I spoke to said after checking their computer that the credit was in there, they just didn't know who to credit it to and that my credit card would be credited. Today, July **, 2014 I got my credit card statement in the mail to find that I was credited $1,006.71 by Blackman Plumbing on June **, 2014. This was $103.21 less than the amount I paid on deposit for the unit. I called Blackman and spoke to [redacted] who told me that that there was a $95 charge for returns. I thought that was from the manufacturer, so I called HTP products. I spoke to a representative named [redacted] who told me she was the account rep for Blackman Plumbing and that Blackman was never charged anything for product returns. I called Blackman Plumbing back, spoke to [redacted] again and she told me that Blackman Plumbing charges $95 for returns. I said that I didn't return anything, this was a defective product sent back to the manufacturer. She said that Blackman charges $95 on returns. I told her that I was never told at anytime that I was going to be charged for a return, and that my credit was short by $103.21, not $95. She said this would be a tax amount. I wondered why a return fee would be subject to a sales tax. She told me that Blackman charges the fee and she was sorry that no one ever told me about that charge, that they should have. I am dissatisfied in their service and feel that being charged $95 for a return, that Blackman is never charged in the first place, and then having a fee taxed with a sales tax is absurd. If this is their company policy, then all customers should be told this in advance.Desired Settlement: I would want the full amount of $103.21 credited back to my credit card. Blackman Plumbing is not charged any fee by the manufacturer, I was never told by any employee of Blackman Plumbing at any time that I would be responsible for a $95 fee for a manufacturers warranty return, and having a sales tax applied to a return fee is ridiculous.
