Mr***,
I have reviewed the response offer made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
I contracted with Window Max to purchase & install replacement windows & wrap the windows I did not contract with *** I have already paid you once to wrap my windows If I understand you correctly you are saying you are not willing to stand behind your work even though the materials you used were defective It seems you are also stating that window wrap isn't expected to last more than years which is unheard of The materials you used on my home were defective! You even stated yourself that you received a bad roll of aluminum that was subject to peeling! It should not be my responsibility to pay for repairs when your company is the one that installed defective materials. At the time the first window trim peeled you stated that the trim was under warranty I stated at the time since the materials you used were defective shouldn't all the trim be replaced since it was defective You stated to myself & my husband that wasn't necessary as you would replace each window trim as it peeled If I understand your response correctly you are saying you are not willing to honor your word My husband & myself took you at your word I guess that was our mistake.I did not purchase the materials from*** I purchased the materials from Window Max with the guarantee that you only used the best quality materials While the trim was under warranty you wouldn't replace all the trim to prevent additional peeling even though you knew the material was defective I feel you should replace the trim at no cost as I paid you the first time in good faith. The attachment you sent did not open It was a login to AOL.Regards,

I paid extra for these window due to the fact that Mr*** promised to stand behind his work Mr*** informed me that the trim he had used was defective He should have replaced it at no charge due to the fact the material he used was defective I should not have to contact the company as he knew the materials were defective. The trim started peeling about or years ago I asked Mr*** at the time about replacing it as it was defective He stated to myself & my husband that he would replace the trim as it peeled I now have more windows that are peeling.Everyone I know who has had their windows replaced has never had this problem!!!As stated Window Max should stand behind their work especially since the materials they used were defective

Mr*** was aware of the windows peeling prior to the warranty expiration! He also informed us at that time the roll of trim he used on our home was defective & subject to peeling. At the time the first window peeled we requested all the defective trim be replaced Mr*** informed us that it wasn't necessary as he would re-trim each window as it peeled He NEVER informed us there was a time limit on the warranty on the trim He is just now saying the trim is no longer under warranty I called him for months& I never received a response until I contacted the Revdex.com!!At this point the only resolution to this problem would be a refund of $which we paid him to trim our windows Regards,

Estimates are just that - an estimate and that estimate was obtained over one year agoBecause of the additional time that lapse the estimate was no longer good and damage increasedI reject the offer and would like to ask Revdex.com to arbitrate a settlement between the partiesI am prepared with advance notification to have witnesses attend the arbitration and I will present my on case as both a owner and sworn law enforcement office of the Commonwealth of Virginia.

Window Max received the sashes from the manufacture but the mane on this order was misspelled on the labelWe have been calling the wrong number for several weeksWe received this compliant and delivered and installed the sashes the same business daySorry for the
confusion. Braden MilesWindow Max Inc

Mrs ***. Again I'm sorry your having a problem with the material we sue on your homeWindow Max is a state licensed contractorWe do not manufacture anythingThe state of Virginia requires us to provide a one year labor warranty on anything we installWindow Max normally extends this to five years to cover anything that is covered under warranty from the manufactures we useI have offered to fix your problems at rate that is 50% our standard charges since the manufacture is not covering this claimAgain if you would like to talk to the manufacture please call *** in Roanoke at *** *** *** *** ***Window Max

Mrs***I would first like to say I'm sorry that your project took so long to completeAs I have stated before, I have complete control over my crewsThe new siding and new windows, doors and railing and roofing were completed by my crewsI told you from the start I would have to sub out
the foundation concrete and brick workI do agree we had problems with those sub contactorsI trusted a long time sub of our company and he let me downWhen we both agreed to get rid of them the project went betterAgain Im sorry but I did do everything I could when I realized we had a problemMost of the delays were our fault but two weeks were from having a cleaning crew to come in and clean all the bat dropping out of our work area so my crews wouldn't get sick.I will try to address each issue you haveYour concrete has a couple of small service cracks and it is acceptable according to area concrete expertsThere are two things that concrete will doOne, get hard. Two, crackIt is also clearly marked on your contract that the finish on the porch was to be broom finished. The railing was installed correctly according to manufacture's directionsEnclosed is the copy of the installation instructions I mail to you a few weeks ago. The installers who installed the railing have been installing railing like yours for the last years for my companyThis is the first time somebody complained about there workThe vinyl railing is pre cut holes for the railing and it cant be installed wrong. Yes, I did agree to furnish you a gate however it was not on the contract nor agreed to do until the last day we were working on your propertyI am running into problems getting the gateA double gate takes up inches to installI only have inches between the two postIf I would have know sooner in the project I would have built the porch and made sure there was plenty of space for the porchI have ordered several items from the plant to try and make a gate workI believe I now have a solution to the gate problem but is does take time getting custom parts inI should have the solution in at any moment.I have also attached the letter that was sent to you several weeks agoYour copy of your contract and canceled checks is your receipt for the work done. Again, Thank you for your business and I should have the gate issue fixed very quickly now.Braden MilesWindow Max Inc

We reject the offer from Window Max still because of the following reasons:1) the issue is due to workmanship or lack thereof by Window Max and has nothing to do with building codes2)the issue is not due to improper siding as Window Max claims - hopefully pictures are attached showing the area that was uncovered is not where siding would occur but lies in the middle of a flat area of the roof.3)we mailed a certified letter to an address on a card provided by Window Max when the work was first completed in on 07/08/certified mail which was returned by the post officeWe again sent the letter to another address I obtained by calling their phone number and mailed again on 07/18/Window Max agents signed for the receiving the letter on 07/20/- not just the week before last as Window Max claimsI have copies of all mailing receipts SINCE THEY WERE SENT CERTIFIED MAIL4)We are prepared to move forward either with arbitration or through a warrant in debt filed with the courts for the amount it has cost us to fix the issueI have a roofer prepared to testify, and at least neighbors to testify that the issue has existed since and we are seeking $- cost of repairs.5)the issue is due to allowing water to drain through the roofing into a crack in the sheathing that not only caused water to seep through the soffit vents but also rotted out to areas of wood as hopefully you can see on the photos - I have at least photos and can provide some other way IF these do not come through.Again - we are seeking the cost of repairs which Window Max could have easily addressed earlier themselves IF they had only responded in a timely manner and as evidence that I have can show - Windown Max dodged addressing the issue for plus years since the work was completed by Window Max in

I do not ever remember receiving a quote of $1,to fix the issue and would like Window Max to provide where I so stated that amountWe have had another contractor fix the issue as of last Thursday which required to removal of all shingles on the front side (street side of the home) and once removed sections of wood were found to have rotted due to the poor workmanship from and the continual ignoring of our calls and e-mails since I have pictures of the damaged area and the fact that Window Max installed ice & water shield in the valley's but not on the flatter portion of the roof resulted in the areas failure and continual leaking leading to rotten woodAfter the roof was finally fixed this past Thursday no leaking is occurring nowOur cost to fix the issue was $and unless Window Max can produce an e-mail from me or other written quote from me we expect a refund of $- if Window Max can supply that e-mail quote then we will settle on the $1,refund being offered and expect any refund to be paid to us within the next days.
