Revdex.com: I have reviewed the response made by the business in reference to complaint ID# [redacted] , and have determined that my complaint has NOT been resolved because: Unit is advertised and sold as a commercial lockable unitTherefore the lock mechanism should be substantial not break, especially after about monthsI have had other locks on numerous appliances that have worked properly for years In order for the Revdex.com to appropriately process your response, you MUST answer the question above Sincerely, [redacted]

Dear [redacted] : I received your email directed to Mr [redacted] , and I am responding on his behalf I spoke with Mr[redacted] originally and informed him that he would be taken off the list I forwarded that request to the appropriate department There was an internal glitch in the way unsubscribe emails were handled, that resulted in Mr [redacted] receiving another email correspondence This problem has been corrected and Mr [redacted] has been removed from our system We apologize for this error as we strive to serve our customer’s in a timely manner If you have any further questions feel free to contact me directly Sincerely, [redacted] Customer Service Administrator Ziebart International Corporation [redacted]

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and find that this proposed resolution is satisfactory to meHowever, Summit Appliance has already once failed to deliver the promised refrigerator - after agreeing to call me hours in advance of the scheduled delivery, they instead showed up with no notice, and nobody was homeWe presently have a delivery *scheduled [redacted] for Friday the ***I hesitate to agree that 'the matter has been resolved', when so many times Summit's failures have come down to the specifics of their actual on-site conduct Sincerely, [redacted]

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and find that this resolution is satisfactory as long as the replacement door is found to be without defect and the company [redacted] who is representing the company, Felix Storch Incis satisfied and or compensated for their time by the company they represent and I am under no financial obligation to them for their services as this is a warranty replacementIf all the stated conditions are met then I will consider that this matter has been resolved Sincerely, [redacted]

[A default letter is provided here which indicates your acceptance of the business's response If you wish, you may update it before sending it Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and find that this resolution would be satisfactory to me I will wait for the business to perform this action and, if it does, will consider this complaint resolved Regards, [redacted] ***

Consumer/customer placed these units improperly in a high heat locationResult was to damage the units and there is no warranty coverage for this type of situationCustomer called our office and we did agree, as a courtesy, to provide any needed parts which we thought the customer agreed toHowever, they never got back to us until our receipt of this complaintWe remain willing to send parts but nothing further

Revdex.com: I have reviewed the response made by the business in reference to complaint ID# [redacted] , and have determined that my complaint has NOT been resolved because: Unit was purchased in June, unit stopped working and Summit Appliance was contacted in AprilSummit sent a technician to my home to inspect the unit and determined that the unit could not be fixedSummit appliance contacted me and offered me a replacement or full refund, I chose the full refundThey are now going back on that offer and telling me that they will only refund me cost of the unit, not retailI would like a full refund of $714.54, the retail cost of the unit as promised Sincerely, [redacted]

Normally we keep spare parts available for years after a model is discontinuedThough our factory is not able to produce the need part for the repair, we called [redacted] and have offered to sell a new unit at our cost to herWe discussed over the phone and we're still awaiting a return call back from her

New unit is being delivered today. 916.

RevDex.com: I have reviewed the response made by the business in reference to complaint ID# [redacted] , and have determined that my complaint has NOT been resolved because:Summit's response is disingenuous but unsurprisingThe assertion that the service company tried to contact me is (there was no missed call on my caller ID nor any message left)Note that there is no denial that I have had to repeatedly call Summit in order to try and get this resolvedOn the fourth day, a woman named Ramona did give me the office number to the service companyThe technician that has the requisite skill to fix the refrigerator was out of town last week (of course)I spoke with the woman at the office and she told me that I would be contacted early this weekIt should come as no surprise that I have not received a phone callI will call them tomorrow and see if I can get the technician to come outSo let's reviewA problem arises with the refrigeratorSummit hires a serviceman who fixes the first issue and then breaks my ice maker in the processI call Summit, who hires the same technician to do the workThat technician does not call me and I am forced to call Summit four times to get progressIn sum, it is on the sutomer to beg Summit to honor its warranty, and then Summit leaves the customer to the mercy of unresponsive and incompetent service companiesI don't expect anything to be resolved by this; my hope is that my experience is available for review by the publicI think that my only recourse is probably to sue Summit for breach of warrantyAlthough getting a judgment in my state and recording it in NY/NJ will be a pain and expensive, it will at least give me some satisfaction In order for the Revdex.com to appropriately process your response, you MUST answer the question above Sincerely, [redacted] ***

Revdex.com: I have reviewed the response made by the business in reference to complaint ID# [redacted] , and have determined that my complaint has NOT been resolved because: The business's response regarding description of the warranty is incorrectThe user manual referenced by the business is attached, and the direct warranty exclusions are quoted below: ITEMS WARRANTOR WILL NOT PAY FOR: Service calls to correct the installation of your appliance, to instruct you how to use your appliance, to replace or repair fuses or to correct wiring or plumbingService calls to repair or replace appliance light bulbs or broken shelvesConsumable parts (such as filters) are excluded from warranty coverageDamage resulting from accident, alteration, misuse, abuse, fire, flood, acts of God, improper installation, installation not in accordance with electrical or plumbing codes, or use of products not approved by warrantorReplacement parts or repair labor costs for units operated outside the United StatesRepairs to parts or systems resulting from unauthorized modifications made to the applianceExpenses for travel and transportation for product service in remote locationsThe removal and reinstallation of your appliance if it is installed in an inaccessible location or is not installed in accordance with published installation instructions The items closest to the exlusions the business is misrepresenting are #and #aboveHowever, in this specific instance, these exclusions do not applyExclusion #only absolves the manufactuer if the damage is a RESULT of alterationThe modification did not result in the damage I have requested be repaired, and this fact would be very obvious if the manufacturer was willing to inspect the unit.Similarly, item #implies that the manufacturer is only absolved from responsiblity under the warranty if the defective part is due to the modifcation. In this case, the refrigerator was not properly charged with coolant, or was manufactured defective allowing the coolant to drill outThe modification to the unit is not near the coolant system or lines and therefore could not have caused the damage In order for the Revdex.com to appropriately process your response, you MUST answer the question above Sincerely, [redacted]

*** *** *** I filed a complaint through the New York, New York Revdex.com office for Felix Storch Inc regarding a refrigerator I purchasedThey have since resolved the complaint satisfactorilyI do not have the complaint # and I would like to show the complaint as resolved

The chain of sale is from Summit Appliance to the dealer to the end userWe offered a credit to the dealer for the cost they paid to Summit Appliance including freightDealer refused this option as they were not prepared to refund/credit the end user. That being the case, a credit is not a viable option so we advised the customer we would ship them a new unit at no charge to them. This is in full compliance with our warranty and we remain agreeable to this course of action

I have spoken to the customer on this date and agreed to have the unit picked up Once it is in possession of our freight carrier, we will issue a refund to her credit cardThis matter is resolved

Summit Appliance has never shipped directly to this end consumerHe has been purchasing the unit from our dealers who have been shipping the unit out using their logistics chainI recommend getting in touch with whom the unit was purchased from and addressing directly with them

We have no further comment to this complaint
