Revdex.com:
I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

The business's response regarding description of the warranty is incorrect. The user manual referenced by the business is attached, and the direct warranty exclusions are quoted below: ITEMS WARRANTOR WILL NOT PAY FOR: 1. Service calls to correct the installation of your appliance, to instruct you how to use your appliance, to replace or repair fuses or to correct wiring or plumbing. 2. Service calls to repair or replace appliance light bulbs or broken shelves. Consumable parts (such as filters) are excluded from warranty coverage. 3. Damage resulting from accident, alteration, misuse, abuse, fire, flood, acts of God, improper installation, installation not in accordance with electrical or plumbing codes, or use of products not approved by warrantor. 4. Replacement parts or repair labor costs for units operated outside the United States. 5. Repairs to parts or systems resulting from unauthorized modifications made to the appliance. 6. Expenses for travel and transportation for product service in remote locations. 7. The removal and reinstallation of your appliance if it is installed in an inaccessible location or is not installed in accordance with published installation instructions.
The items closest to the exlusions the business is misrepresenting are #3 and #5 above. However, in this specific instance, these exclusions do not apply. Exclusion #3 only absolves the manufactuer if the damage is a RESULT of alteration. The modification did not result in the damage I have requested be repaired, and this fact would be very obvious if the manufacturer was willing to inspect the unit.Similarly, item #5 implies that the manufacturer is only absolved from responsiblity under the warranty if the defective part is due to the modifcation. In this case, the refrigerator was not properly charged with coolant, or was manufactured defective allowing the coolant to drill out. The modification to the unit is not near the coolant system or lines and therefore could not have caused the damage.

Unit was purchased in June, unit stopped working and Summit Appliance was contacted in April. Summit sent a technician to my home to inspect the unit and determined that the unit could not be fixed. Summit appliance contacted me and offered me a replacement or full refund, I chose the full refund. They are now going back on that offer and telling me that they will only refund me cost of the unit, not retail. I would like a full refund of $714.54, the retail cost of the unit as promised.
Sincerely,
[redacted]

Consumer drilled a hole in the side of the beer cooler (reason unknown to us) compromising the performance of the unit. The owners manual for the unit clearly specifies any attempt by the user to repair or perform any cosmetic modification to their unit (unless recommended by the owner's manual or...

Summit Appliance directly) voids the warranty on the unit

Revdex.com:At this time, my complaint, ID [redacted] regarding Felix Storch Inc. has been resolved.

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

Unit is advertised and sold as a commercial lockable unit. Therefore the lock mechanism should be substantial not break, especially after about 4 months. I have had other locks on
numerous appliances that have worked properly for years.

We've already replied to this and explained to the customer. We treat locks generally as a matter of use by customer since warranty covers functional parts and issues only. If it occurred immediately after the unit was put in use, then it would be one thing.  But after four months of use, we would consider it caused by customer use...or misuse".

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted],...

and find that this proposed resolution is satisfactory to me. However, Summit Appliance has already once failed to deliver the promised refrigerator - after agreeing to call me 24 hours in advance of the scheduled delivery, they instead showed up with no notice, and nobody was home. We presently have a delivery *scheduled* for Friday the [redacted]. I hesitate to agree that 'the matter has been resolved', when so many times Summit's failures have come down to the specifics of their actual on-site conduct.
Sincerely,
[redacted]

I have spoken with the consumer on this date and agreed to replace the refrigeratorCustomer fully satisfied with this resolution Ken C[redacted]Director of Operations- Felix Storch, Inc.

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory as long as the replacement door is found to be without defect and the company [redacted] who is representing the company, Felix Storch Inc. is satisfied and or compensated for their time by the company they represent and I am under no financial obligation to them for their services as this is a warranty replacement. If all the stated conditions are met then I will consider that this matter has been resolved.
Sincerely,
[redacted]

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

It is obvious this company has no intentions of resolving this issue. Just as the many other complaints from other customers in the past. They will continue to produce and sell SUB-STANDARD products.

Consumer/customer placed these units improperly in a high heat locationResult was to damage the units and there is no warranty coverage for this type of situationCustomer called our office and we did agree, as a courtesy, to provide any needed parts which we thought the customer agreed toHowever,...

they never got back to us until our receipt of this complaintWe remain willing to send parts but nothing further

Normally we keep spare parts available for 3 years after a model is discontinued. Though our factory is not able to produce the need part for the repair, we called [redacted] and have offered to sell a new unit at our cost to her. We discussed over the phone and we're still awaiting a return call...

back from her.

The service company contracted by Summit to do this Job did try to get a hold of the customer last week but no answer. We just called them and they advised that the customer can call the Technician directly at ###-###-#### so they coordinate a repair date & time.
