I was given an estimate of 7200$ for work and carpet. We cut up the floor, only some shims went in floor went down easy as pie. my wall got hand prints all over it and spackle was needed where a mark was made. I was told 500$ but because he had a license *** would only except 2400$ for the work done. I had no choice but to agree. In talking to the contractor he proceeds to tell me *** is over charging me for carpet and to be careful. He remeasured for me, told me the sq yards. He tells me to SUE abbey carpet because they have no license and the contract is void is *** tries to rip me off. I also find out HIS license is expired so he doesn't technically have one. AT this point I am mad. But I just want to get done with all this crap. The last time I talked to ***, I told him when I was ready for carpet I would call. He had my order and my money. I get a phone call from ***. He said my workers are getting impatient. I said ***, I am going to have to install the carpet myself. Some things have come up and I believe it would be better for my budget. He said he would call me back. He calls back says I owe him 987$ more. I ***, How much carpet are you charging me for? He said 87 sq yards. I said there is not 87 sq yards in this house. He proceeded to argue with me, even after I told him *** his contractor measured for me. I had everything written down. I also told him about the white walls that needed repainting and the wall that needed spackle. He said he would have *** call me and that was it. I got no phone call. No explanation as to why I was paying for 87 sq yards when I only had 74.55. I had not even gotten into No on having a license and over charging me . Its been over a week and I have heard nothing.

Desired Outcome

Full refund all the money I have paid. all my deposits and other money paid on bill. I believe it was 3300$

In late May / early June I received a phone call from Ms. *** asking for our help. She had contacted many contractors because she had a problem with her subfloor and needed someone to come out to look at it and give her an estimate. She told us she was trying to sell the house and move to Tennessee. 3 different contractors came out but none gave an estimate or even responded to her repeated calls to them. She also stated that she would need carpet and wanted an estimate for that also. I told her that my subcontractor and myself could come out and look at it and give her an estimate. She wanted me to give her an idea of the price range sight unseen but I told her I could not estimate it this way.

We came out on June 4 and looked the job over and I measured the house for carpet as my subcontractor looked over her subfloor problem. He looked at the room in question, found the problem to extend to the next room and went outside to try to look into her crawl space. He could not see anything at this time and would only be able to give an exact price once the floor was ripped out. We decided to give her a worst-case price that could be reduced if the condition was not as bad as we might suspect.

The estimate for the carpet and padding with installation and tax came to $2560.00 and would require 87 square yards of carpet. She also said she would take up and remove the old carpet so we did not add that to the estimate.

Carpet is manufactured on a roll that is 12 feet wide. When Ms. told me, she needed 74.55 square yards of carpet I explained this to her and that the square feet of rooms are not the amount of carpet necessary. A 10 x 10 room still needs a 12 x 10 piece of carpet.

We came up with a worst-case scenario of $4600.00 for the subfloor repair, with the carpet totaled to $7160.00. She left a deposit of $2400.00, ($900.00 by check and 1500.00 in cash) and signed a contract on June 15, 2018. All prices for labor and material were fair and reasonable.

This contract stated that the carpet is special order cuts not subject to cancellation which she initialed showing that she understood that. She called after the contract went in force to change the carpet color which we did for her.

The carpet was ordered June 18 and arrived June 23.

I also explained that the worst-case scenario could go down and that we would make any changes necessary to the contract. She was very happy with that.

We discussed various ways the subfloor could be repaired with Ms., and Ms. was told that my subcontractor would be shimming the joists to smooth the transition of the subfloor so that carpet could go in and make the house salable said she would be comfortable paying $2400.00 for the subfloor repair. We then reduced the cost of this portion of the job to $2400.00. Ms. agreed to this and we adjusted the contract to $4960.00.

I called and asked for an additional check when my subcontractor finished his portion and she gave us 900.00 leaving a balance upon completion of 1660.00. Ms. stated that she would be installing the carpet herself and we again reduced the contract cost to $4287.32 with a balance due of $987.32.

I had to initiate all conversations with Ms. after the subfloor was finished and each time she brought up a question I answered or a situation I had to investigate I called her back only to leave a voice mail. All of her concerns were addressed. She never returned any of my 4 phone calls to her.

During 1 call in initiated to her, she said that I was â??ripping her offâ? She stated that she found the carpet on the internet for less. I checked this on the internet. I investigated this and found a lesser grade of carpet available on the net which I offered to her originally but she did not like the quality or color. My price was $0.12 per square yard less that the internet selling price. Her carpet was not priced on the web site.

I am including a copy of my business license which was renewed in April of this year. She was invited to come into my place of business to see my license but she has yet to come and look at it.

Ms. agreed to a price for this work, signed a contract and we have accommodated her repeatedly in reduction of cost due to her requests. We would like her to pick up the carpet and pay what is owed to us. The $987.32 is not an additional cost of the contract as was stated in the complaint but the balance due on the contract after many reductions.

Any minor installation marks were repaired or we are willing to repair if we are allowed.

hello. I did reply to this. and I sent an email I had not gotten a reply. I am waiting for a new company to remeasure for me. there is not 87 yes of carpet. the contractor doesn't have the license. *** keeps yelling at me he won't give me the name of the company for the sub contractor and he keeps saying it's a subcontractor who works under his license. can he do work on people's houses? cut up a floor with a trades license? don't u need a contact tors license for that work? I have to get zoning involved he keeps saying I am a bad person. I have witnessed to hi. saying I had to pay for the license his SUBcontactor has. I am so confused I am not good with words. mr. likes everytime I talk to him and changes his story. I am having panic attacks now just because of the texts I am getting from the subcontactor who started all this mess. mr *** said that I won't let.him in my house I told him anyday of the week. he disnt show instead I got messages about a relationship ship that didn't happen. there is so much more to this and everytime I talk to mr *** he changed gets his story to cover himself. I do think I need a lawyer. I am a single female and I have been taken advantage of. I have pages of texts. I can't copy receipt it's bad copy. but 4600 for worst I had best case and he charged 2400 to cut up a 12x12 room put in 10 shims and put 4 pieces of ply wood back down? that's over charging. the room was empty no carpet.or padding. and *** screams at me he is not hiring another contractor to fix wall because Greg was paid.
I am waiting for empire carpet now to tell me sq yes. and *** still says I signed a non refundable contract. I am so not happy. I have witnessed to the I have to pay so much because of license I have never been happy with price Mr *** knows that. he keeps changing his story to fit what I say. and I feel I am doing damage talking to him

On September 11 The customer Ms. called me and we started to have a conversation which escallated by her accusing me of bad business practices and that again I am ripping her off. She did tell me that she was having another company come out to measure on Tuesday Sept 12 and and she did not believe that my measures were correct. She stated that she physically installed carpet in her house before and that she needed less than I quoted. Continually she accused me of thngs I believe purposely to get me to raise my voice. I did respond with my voice raised but only after she was yelling at me and not allowing me to respond to any of her accusations as she talked over me and did not want to hear what I was trying to say. She hung up and I called her back.
The same set of circumstances occurred again.
When a person acts and sounds aggressively people will usually respond in kind.
She again hung up and I again had to call back.
She told me to stop calling her as she is getting anxious and I calmly asked her if we could speak without accusations and agression. I asked her to call me when she had a reputable company measure and to provide me with those dimensions and the cuts of carpet necessary do do her job.
She seemed a little flustered and I said that if less yardage could be used I would reduce her cost to that amount of carpet. She also said that she would not need the pad so I offered to take that off the balance also.
She stated in the complaint that she never met the contractor which is false. They went to school together and her brother and she were friends during that time. She told me that when I first measured that my contractor and I said it would cost $500.00 to fix her subfloor which was again an untruth. If this were a fact why would she sign a contract for over $7000.00 She said she had witnesses to that conversation. We did not quote any pricing as we were not sure of the extent of the repair and what a worst case senario would cost as we could not see the extent of the damage and would need a few days to get it together.
She originally claimed that I did not have a license and when I told her I did and invited her to come and see it and provided a copy with my original responce. She instead started this complaint process. There are many more instances of falsehoods stated by Ms. in this complaint.
I will remove the pad from her order and only charge her for the carpet. I will no longer reduce my cost any more. I have a legitamate contract signed by both Ms. and myself and she needs to pay for the carpet. It was ordered in room sizes and therefore is non cancellable and she acknoledged that with her initials on the contract. I have accomodated her repeatedly. Once she said that she would not have us install the carpet therefore the merchandise became cash and carry and our policy is to have all special order merchandise that someone other than us is installing be paid in full prior to order.
She is selling the house and moving out of state and I believe she is just continuing this so she can sell the house and run out on the contract. I will not give her any more accomodations. I want her to pay the contract off and get her carpet.
She threatened to get an attorny and I told her that might be a good idea as my attorney is now involved. At that she hung up again. I did not call back. I am awaiting the information about her measurements which according to her was to be on Tuesday 9/12 and I do not believe she will provide me with any measurements taken by a reputable company.

-I was originally billed $4600.00 per worst case scenario. After pulling up the floor, Mr. said that I did not have worst case scenario, but I had the best case, meaning nothing had to be done structurally.
I was then billed $2400.00 instead of $4600.00.
I was then told by Mr. that Mr. would not accept any less then $2400.00 because of his license.
This price of $2400.00 is for fixing the floor only. NOT carpet, or installation.
This being said, to fix the floor Mr. had to cut up existing floor, place shims, and replace flooring (4 uncut sheets of plywood). He then put pre-mixed floor leveler where the bedroom meets the hallway so you dont notice the dip in the floor so much as soon as you walk in.....
If he had fixed the dip in the floor like he was supposed to, then why did he need to level the floor?
During this process Mr. said that he understands that this job shouldnt cost $2400.00, but due to his license he cant charge less. BUT that he would add the installation of the carpet into the price for fixing the floor. In other words..."free installation" right?..
My issue with all of this is...
1. Mr. does not have a valid license because its expired.
2.im being charged for licensed work, when this is really a side job because he doesnt have a license.
3.I now have to go and pay someone else to come pull a permit and pull up my floor again and fix it properly, the unlicensed Mr. did not obtain a permit when he "fixed" my floor.
4. During the process of Mr. fixing my floor, my damaged the walls. Which were at the time freshly painted.
5. Yes, Mr. was also supposed to spackle the wall in the bedroom that he further damaged. But he did not. and now I am left with a wall that was freshly painted, that needed a few spots spackled and touched up, to now a few spackle spots some areas that have yet to be spackled, and black dirty hand/fingerprints all over the wall so now the whole wall needs to be repainted not just a few spots.

Moving on to the carpet...
I have already paid $900.00 for the carpet that Mr. is currently holding at his warehouse. Now he is requesting an additional $600.00 for the carpet unless I can get a reputable company to come out and give me a written estimate, which Mr. being the carpeting industry knows that no reputable company will leave you with a written estimate unless you put down a deposit. which I cant afford.
EVERY company I have had come out has given me a different square yardage.
Per the measurements Mr.s' subcontractor Mr., he added the extra inches for the waste factor. he only came up with 78 sq.yds. Mr. is claiming there is "" sq.yds. of carpet that needed to be ordered. I understand that he said the cut carpet comes in 12ft. When the sub-contractor tells you that you are being overcharged for carpet after you have already been overcharged for other work you want proof.

This one room is holding me back from finishing my house to be able to sell it. I have to keep telling realtors 3 more weeks.

this whole situation has just gotten out of hand and has set me back months on selling my house and at this point I feel as though I will have to get a lawyer.
