Review: We contracted with Cleary Builders in December 2013 with original context of building a home. We put down 20% of estimated home cost on December 31st, 2013. ($14,191) During the process to secure financing we were alerted that due to location of our lot (city limits, changes in mortgage underwriting starting in 2014 we would be unable to secure financing for this structure as a residence). We contacted Cleary Builders to let them know our situation, we agreed to move the funds into a barn structure. We were charged a extra for administrative fees due to change in building type and contract, we made a complete change in contract to a farm building. *** from Corporate threated me (***) that we needed to have our new Building permit by end of August. We completed this process in less than 1 week. Our original build date was to be in October 2014, we have been ignored, lied to & mislead. We needed this barn up in fall 2014, so we could put up fencing, connect to water and electric. We have had 2 salesmen leave the company during this process, every week starting end of Oct, November we requested an update to build and each week it is pushed back a week and today (November 25th, 2014). We were given a the previous week that they were confident it would be erected during the first week of December. Today I called the Jay (Cleary Contact) and informed that we have been pushed back 2 more weeks. We have asked repeatedly for a refund so we can hire another builder to erect this barn. I (***) was verbally threatened and lied to by *** that He as a Cleary Rep. Lied about about the entire first build was ready and sue us to pay for it, Cleary does not order any materials until the site inspection is completed. *** lied to my Husband *** as well. He stated "Do you really want to make this happen, Cleary can make you pay" "I can say the entire building is her and make you pay for it", we changed the contract to the barn and *** stated: "You better have the new building permit within a week" (for barn build), we had this permit within 5 business days. Since then we have been sitting in limbo and Cleary holds our money with no services or building! We have to board our horses for the winter at our expense!Desired Settlement: We want Cleary to refund our funds immediately so we can find a reputable builder who now is not meeting our needs and is costing us money! Cleary is has had these fund ($14,191) since December, we paid this as a promotion to "hold pricing" for the initial home build. We want to be done with Cleary as they have proved they have no intention of putting up our structure this year, costing us considerable hardship for location of our horse stock, Hay and equipment we need to store. We have repeatedly requested a refund so we can move forward and Cleary will not consider this request. We feel cheated and consider the threat by *** from Corporate as criminal. ***We want out - no building -*** return our money!!!!!! This type of treatment is not acceptable!!!

We have remained in constant contact with the client regarding the building changes and building timeline. The original order was revised due to a lack of financing. The building was redesigned to utilize materials ordered on the initial building design, and then rescheduled with our production department. Unfortunately, the latest weather patterns have delayed construction across the Midwest. The building is scheduled to ship on 12/2, and start on 12/3. The client is aware, as we now communicate daily on this project. I have spoken with our corporate sales manager who had contacted the client here and he stated that the allegations of mistreatment are false. The client did not like the options at hand, but was not mistreated. We look to get this building constructed for the client to utilize as soon as possible.

Me and my husband purchased a building from cleary this year. We signed our initial contract May 29 with a salesman. 2 salesman later we finally got word of our building finally being delivered. This came more than 3 months after we signed..when we were told 2. Sept 15 a crew arrived without notice from a salesman. We were at work and couldn't be around, had we known we would have been here. Supposedly the salesman is to lay out the building prior to the crew arriving which wasn't done. So not only were we not home the building wasn't put exactly where we wanted. I'm done dealing with cleary and honestly am just sick of the lies and then the confrontational salesman(Doug from Ohio) who act like they are victims. Building crew was great had it up in 3 days but tin was not placed on the outside of the sliding doors. Apparently it was not with the rest of supplies so who knows when that will arrive. My advice stay away from cleary building corp in Ohio and Pennsylvania.

I purchased a 30x40 building from them 4 years ago and I havehad ongoing problems with this company, I have had more snow inside than there was outside, and this was after I paid extra for their so called " winter package " my service door every winter does not even close properly,I have had their salesman out a few times but nothing seems to get done. they told me they could fix my problems but it was going to cost me another $2000, the salesman that was out here looking at it even said to me that the workmanship was terrible, I won't let cleary build me a chicken coop

Review: I contracted Cleary Building Corp. in May of 2014 to construct a pole barn on my property in ***. I was promised a multitude of services and completion dates. I was told by witness of my own Son, that they are a general contractor and will handle everything, including obtaining the building permit, grading and prepping the build site (for additional cost). I gave them a $10,000 deposit for the $28,000 building, with a promise that the building would be completed by end of June to the beginning of July. As of date, it is not completed. In fact, I had to get the building permit. I had to contract and do all grading and prepping. They delivered the materials in August with a promise to start construction in a day or 2. As per the contract when materials were delivered I needed to pay an additional $12,000 towards the total. Construction started 2 days later but ended immediately due to more excuses. Since then they have managed to erect the poles in the ground. Since August, all the materials that are meant for interior use only have been exposed to the weather, getting sun faded and water logged, with no concern from the company. I have concerns as to this may jeopardize the structural integrity in the long term of the

building. I have contacted Cleary on multiple occasions just to get more excuses and run around. I am at the end of my rope and would like to file a complaint against them so no one else has to deal with there horrible business practices, lack of communication and outright lack of concern for there own customers safety and well being.Desired Settlement: Finish the job while replacing all the questionable materials left in the weather.

The issue at hand that delayed the project were the site conditions of the property where the building was to be constructed. The site was not buildable due to digging conditions at the start of construction. Per the terms of the contract the site conditions are the responsibility of the client.

This issue has since been solved after Cleary and the client agreed to a solution to proceed despite the difficulties with the building site conditions and the project has since been completed. Review: Since the shed was built in July of 2011, there were problems of water coming in through service doors. *** of the Wausau Branch was contacted on numerous occasions and no work has been performed. *** came out 3 weeks ago and said he can't do anything it is up to the *** to handle this matter. I haven't heard anything regarding this matter, and I have tried calling *** but it seems he must be screening his calls because I never reach him and I leave a message and he doesn't return any of my calls. This problem has existed since I had this building built and I made numerous phone calls and I can't get a resolution to this matter.Desired Settlement: Have Cleary come out and repair the defective doors

The reports that we have received state that the client has grading issues with his site which are causing the problem. The site and grade of the site are the responsibility of the cilent as per our contract. It has also been reported that part of the issue with the lack of response to the client was due to his behavior with our representative. To include becoming verbally abusive to Mr. *** and in the past it would seem that the behavior may escalate.

Review: My wife & I signed a contract to purchase a building from Cleary Building Corp on July 25, 2013. Before we signed the contract we had a lengthy conversation with the sales associate from Cleary, *** about the end of construction time line. We stated to him that we wanted the building to be completed on their end by the beginning of November 2013. We also stated to him our reasons for this time frame was that we wanted to get the ceiling & attic insulation installed before the frost settled into the ground. We also wanted to have the building heated before the frost settled into the ground. We were going to finish off the inside of this house ourselves with the help of friends during the winter months & to have the building finished by the end of March. We also explained to him that if he could not meet our demand that we would choose another contractor that submitted a bid to us. Before signing of the contract on July 25th, *** said to us that he totally understands our request & that there would be absolutely no problem meeting our demands. We signed the contract with *** whom is representing Cleary Buildings at the time to construct our building in our time frame as noted. The construction started on October 16th after several delays. The building inspector would not pass the plans because of a wall bracing issue with this type of post frame building. Cleary demanded a large portion of the contract sums before I was even able to get a building permit & even before I could get a set of plans to pass the inspection. After this there were also weather delays.

We have had nothing but problems with the construction of this building. There were many broken promises by our sales representative, Also many false e-mails stating that crews were on site when they actually were not. I do know this first hand because I was on site when a few days are in question. There were also statements by *** that he was going to place 2 full crews on site to finish this building quickly, which never did happen. One of the crew members on site responded by saying "heck, we do not even have 1 full crew here most of the time let alone 2 crews", when I told him what was said to us. The building was poorly constructed with dents in the steel, interior garage steel not covering up the wood, & steel trim missing in the garage. There was a cracked truss installed, & 3 high clearance trusses were not even built with the correct pitch. Cleary engineers had to redesign the issues the the trusses. They had to be rebuilt on site. The building did not pass code with the inspector for the exterior wall insulation & vapor barrier because of very sloppy craftsmanship. The inspector had to reinspect 3 times (with a charge of $45 each time) due to the inability to construct & finish the walls correctly the first time. I can list much more in this section about failed promises, sloppy & very messy building practices, misleading information thru e-mails & pictures, but it is getting lengthy already. The building did not get finished until mid March 2014. This is when we were expecting to be completed with the interior, not just starting. The building needed a fire rated door replaced back in December of 2013. The door was ordered & it took several weeks to come in. It was the wrong swing & had to be reordered. After several more weeks, Cleary purchased a fire rated door from a local hardware store & installed it. It does not match the 4 other doors on the building as the 4 other doors have a steel jam & are painted in Hickory moss. This door has a wood jam & when installing it the frame is not even sealed against the wall. This construction is a house not a barn. After complaining about this door to *** & I could tell that he was not going to correct it. He gave me the excuse that the frame out is different. But when I called the door manufacturer I was told otherwise. I told him that I would accept it as is, just to get this contract finished up. This is really sad that I do not even receive the doors that are on the contract. We also had a problem with the large overhead door. That door was to have a panel with windows in it. It is even on the first set of drawings supplied by Cleary. We decided to trade that panel for a window less panel in return to add a second garage door opener to our smaller back garage door when signing of the contract. *** stated that to eliminate the window panel in the large door the cost savings would cover the second opener. We received neither! The large door was to have an opener from the beginning.

On December 2- 2013, I received an e-mail from *** from Cleary asking when I would be available to do a walk thru with ***. In that e-mail it was stated that the final payment was due. The building was not even complete at the time because the fire rated door was not even installed, & the building was not even inspected by the inspector. The inspector did not pass the building because of the poorly installed insulation & vapor barrier. The inspector had to re-inspect a few times before the situation was corrected. On March 21-2014 I received a call from *** from Cleary asking for the final payment. I told him that I had a problem with paying it & that I would not be paying it because of all of the issues with the building process. I explained to him that I wanted a 20% discount of the total sale & that Cleary should be held responsible for the promises made by his sales associate *** since he is representing Cleary with the sale of the building. I explained the promise that was made by *** back on July 25th before signing the contract. All *** did say was that Cleary did complete the contract as stated. He did not seem to care about all of the other items that I had explained to him. He said that Cleary was sending a notice of intent to lien the property. *** called me the following Monday, 3-24-14 & said that he would like to get the contract settled, but he didn't even offer any solution other than I pay the final payment because Cleary did meet all contract obligations. He did not care that Cleary took 5 extra months with the construction, & that I had to cancel other subcontractors several times because of the extremely late finishing of construction.Desired Settlement: Since *** whom is representing Cleary Building Corp did not follow thru with the finished construction timeline, I am requesting a 20% adjustment to the total building sale price. There were to many promises made by Cleary that were not upheld. The construction was very sloppy. The building inspector reported to me that he has not been around such a sloppy constructed building as this one in many years of inspecting buildings. I am only able to start with the finishing of the interior & now since so much time has passed I have to hire a contractor to get the building finished to plan. The 20% is to be used to correct issues with the building (insulate around the fire rated door & trim out the wood jam), add the second garage door opener, re key all doors because of finding the keys hanging in the locks in the doors over weekends (this is not a normal construction practice), pay the extra inspection costs & to help offset the added cost incurred with the very very late finish. The building was according to *** be finished in 2 to 2-1/2 weeks. Even with some weather delays it should not have taken an extra 5 months. Also keep in mind that I was not offered a final walk thru with *** & the crew forman as I was originally told would happen by *** before *** issued the intent to lien the property notice!

Review: I had a Cleary Building built by cleary and within the contract was concrete placed from Clear and concrete was placed by the building salesman under cleary. No subcontractor was hired. The concrete was improperly place with over 1000 sq feet and no expansion joints cut before the concrete was hardened. THe concrete flooring in the garage cracked from end to end both directions and diagonally with in 7 months of placement. The concrete is under the the same warranty and contract of the building and clearys only resolve is the cut expansion joints after the fact the cracks are there and will continue to increase because none were placed initially. I have had estimates done that estimate the removal and replacement of the concrete being 9500 to be done correctly. After having the concrete inspected by the Concrete contractor it was also discovered the edges were not finished by the original concrete person. The excess concrete appears to have been piled up in the edges and not smoothed only thrown.Desired Settlement: I would be willing to accept a refund on what it cost me to have the concrete placed at the time of the placement (labor and const of concrete what I was charged) or replacement including labor and increase in concrete cost at this time.

I have reviewed the response made by the business in reference to complaint ID ***, and find that this resolution is satisfactory to me.

In December of 2013 we entered in to a contract with Cleary Building Corp, Wisconsin with a branch in Desoto IA to design and possibly build a pole structure to be used as a residence. We gave Cleary $5,000 to do the design work. As part of the design, to get the building to look the way we wanted it to there were parts of it that we were required to be in charge of. Both parties knew of these items and agreed to them before designing commenced. If we used Cleary to build they would apply the 5000 to the cost of the building.
In March of 2014 we signed a building contract and paid the required down payment of another $35,000. When the contract was signed we had engineered stamped prints and were told by the salesman that construction would begin the middle of June. We completed all the dirt work for the project, lined up all the permits, had a well dug and lined up the needed contractors for the project that were are responsibility. We were ready for construction to begin the 6/1/14. From June until the middle of August we were told by Cleary that the project was going to be delayed 5 times.
On 8/18/15 Cleary’s concrete subcontractor showed up to pour the needed slab with footings. The work that was being completed was not to print but I was assured by Cleary’s supervisor and by the concrete subcontractor that the way they were doing it was better than the prints. Right before they were to pour the concrete I was informed that the subcontractor had the wrong prints and needed another $3000 to finish the pour. Cleary’s supervisor asked me to pay the amount since we would have to put in a change order to correct the issue and that would stop the pour. Since we were already behind I paid the contractor and thought the amount would be trued up at a later date. We were informed that construction would begin 9/2/14 after the concrete had dried.
Late in the week of 8/25/14 we were informed that construction would not start. In September and October were delayed 4 more times. The last delay would have put the start date out until 11/5/14. Due to the parts of the construction that we were responsible for that would be affected by bad weather we told Cleary that the start date was unacceptable and not to start the project. We needed to review where we were at and how we were going to proceed. As it turned out the week of 11/10/14 it snowed and the temps went below zero. After a couple of calls with Cleary’s Management we decided to terminate the contract. I asked for a refund of my deposit less the amount that the slab was worth. I sent Cleary’s concrete print to a local contractor and asked for a bid to use as the cost basis. This was point blank turned down by Cleary. At this point I went to a lawyer to seek advice. The lawyer indicated that going to court was not a very good option (and was reiterated by another lawyer) but that if we could find something wrong with the design we would possibly have some more leverage. The contract I signed was very much in Cleary’s favor and that it is hard to get a court to terminate and return moneys on a construction contract.
I hired a Professional Engineer with an extensive construction background to review the full set of plans. He came back with four significant deficiencies. The trusses were not sufficient for the structure, the posts were overloaded, and the footings in the concrete slab would not hold the load and the assumptive load carrying capacity of the dirt at the site under the footings were way over stated. The contract says that the site owner is responsible for the load capacity of the dirt. Cleary never asked for a soil compaction test, merely assumed load carrying capabilities. The load capacity that they “assumed” was that the building was setting on rock. I then sent the building and truss prints to three different truss manufacturers and all three said they would not build them. We presented Cleary with all the information and their response was we designed a solid building and the load capacities for the ground were your responsibility.
There were several conversations between parties in January. At one point Cleary’s manager even told me in an email that he was inclined to take my original offer to return the down payment less concrete. After a week though he backed out of that and went back to we were not going to give anything back.
In February my attorney had several discussions with Cleary’s management about a reasonable settlement. We finally got $7900 returned out of $43,000 that we paid them. Cleary never would even acknowledge that we paid their subcontract the $3000 for the concrete that was their mistake.
We have a concrete slab with 20” footings that cost $20,000 that is no better than a 6” poured floor that we could have done for $7500. We are working with a new builder and we will be able to use the concrete but have to do a lot of rework to make it usable. It will only be used as a floor and the footings are not needed. We spent an extra $12,500 that’s not usable.
Cleary Building Corporation took us for $36,000 dollars. They charged us $5,000 for design work that was not worth the paper it was printed on. They had no interest in constructing a building in a timely, cost effective manner. Their design was flawed; they knew it and didn’t care. They didn’t care about meeting any time lines they set. The only item that was truthful that they ever told me was that they would pour the concrete on August 18th.
I would recommend that anyone who wants to do business with them contact an attorney and have the contract reviewed. Make any and all changes to the contract that your attorney recommends. If they won’t agree to it, you don’t want to do business with them. I would also recommend if you are getting anything built you have some that is capable of looking at the prints determine whether they are satisfactory in design specifications. After over a years’ worth of hassle with Cleary Buildings I have to say it is the poorest ran company that I have ever came across. I would not recommend doing business with them at all. Buyers be ware and be smarter than I was and get others involved up front.

Review: We decided to with this company to build our pole shed. The salesman told me they could start September 26 2014 then it was October 6th than October 16 to the 20th which is when it finally started. The salesman said it would take 3 to 4 days to complete but we are now around the 70th day. They have been back multiple times to repair steel which they screwed up multiple times. They have been working without safety glasses, fall protection, hard hats most of the time. They left ruts around the job site besides garbage blowing in the trees in my neighbors yard, steel laying around that me and my wife had to pick up. They didn't do some of the footings the way the they were supposed to. Besides the shed still is not done as of 12/29/2014. Alot more to mention but could take all day. ***Desired Settlement: To get my pole shed done and warn others of this company

Review: I have a contract with CBC for a airplane hangar. The original date of contract was 6/13/13 as of 6/12/14 it is still incomplete.

The original building plans that were submitted to the state for approval did not indicate the building would be heated. This omission failed to trigger a state request for HVAC/mechanical plans. This has lead to the removal of several desired elements from the building design half way through the project when I was financially committed. I due to this error/omission I am unable to run a business as planned out of this hangar.

The concrete was incorrectly placed on 6/11/14. The joint at the front door, the rebar spanning the door joint and the footing were omitted... The building inspector shut down the project due to incorrect construction and a lack of plans on site. The cement pour is of unknown strength and durability due to the contractors error.Desired Settlement: I want an offer of refund of at least the cost to fully replace/fix the cement floor.

I am attempting to solve this through the Revdex.com before resorting to the legal system where the damages may be much more severe.

A permit was not

received for the project until the latter part of 2013. Per the

terms of the contract the permit is the responsibility of the

client. Along with this there were change orders executed with the

client involving the sub contract, and along with the winter weather, and not

being able to pour concrete, there certainly have been delays.

Involving the concrete

itself that was poured last week, we have solutions at this point that are

being reviewed with our client. I expect that we will be able to

conclude all current open matters on this project by 6/27/14.
