On December 22, 2014, I mailed Midland Credit requesting validation of debt and received no response from them in regard to that request. Further, Midland Credit states that they will not report the account to the three major credit reporting agencies until they are able to provide verification of debt is not the case. The three credit reports attached as exhibits will show they have reported the account delinquent with Equifax with out providing me validation/verification of debt as stated in their rebuttal letter. theft or fraud Midland Credit mailed [redacted] separate and unique validation letters – on October 6, for account no [redacted] , and on October 17, for account no [redacted] These letters informed him that Midland Funding had acquired the accounts, and of his rights pursuant to the Fair Debt Collection Practices Act, U.S.C§ et seq (“FDCPA”) Please note that the letters were mailed to [redacted] via the United States Postal Service, and were not returned as “undeliverable” – satisfying the requirements set forth within the FDCPA Midland Credit’s business records indicate that it did not receive any correspondence disputing the debts or requesting validation from [redacted] in response to the letters In fact, no correspondence was received directly from [redacted] prior to the complaint filed through your office, which cannot be considered timely The FDCPA specifically states that, unless a consumer provides a debt collector with notice of such a dispute within days of receiving the initial validation letter, “the debt will be assumed to be valid by the debt collector.” U.S.C§ 1692g(a)(3) Because Midland Credit did not receive such notices in a timely manner, Midland Credit appropriately proceeded with efforts to contact [redacted] and collect the debts Although his requests are not timely, a copy of the verification information provided by the seller is enclosed for [redacted] records Please note that the verification information provided by the seller meets the requirements of the FDCPA The original contract, complete payment history, and a full set of billing statements are not required under the FDCPAChaudhry vGallerizzo, F.3d (4th Cir1999) Upon receipt of his complaint, Midland Credit inquired with [redacted] about the above-referenced accounts and, in both instances, the seller advised that they were never made aware of a fraud claim Additionally, [redacted] ***, as the original creditors, may be reporting the accounts They may [redacted] continues to expresses concern that an account review inquiry has been placed on her credit report, and states that Midland Credit does not have permissible purpose to do so. [redacted] also provides the last four digits of her social security number and writes that she does not have a collection account being serviced by Midland Credit matching her social security number. Midland Credit ran a search against [redacted] ’s social security number, which provided a match to her name as being [redacted] . Midland Credit business records therefore indicate that it was the servicer of account nos. [redacted] and [redacted] , which match the last four digits of [redacted] ’s social security number. However, these two accounts were sold in 2006. Midland Credit is also currently servicing two additional accounts belonging to [redacted] , account nos. [redacted] and [redacted] . Midland Credit became the servicer of account no. [redacted] on September 27, 2001. Information provided by the seller, [redacted] ***, at the time of acquisition indicates this account was originated on April 1, 1997, as a [redacted] account number ending in ***, in the name of [redacted] , under the last four of the social security number ***. Subsequently, the account was charged-off as an unpaid delinquent-debt on December 31, 1997. The balance at the time of purchase was $428.98. Pursuant to Section 604(a)(3)(E) of the Fair Credit Reporting Act, Midland Credit has permissible purpose to inquire upon accounts for the purpose of potential investment. Midland Credit pulled [redacted] ’s credit when determining whether to invest in a portfolio of accounts which contained an account belonging to [redacted] . The inquiry she sees on her credit report was solely related to the determination of potential purchase of accounts, which may or may not have been purchased. [redacted] may contact the credit reporting agencies to dispute the inquiry. [redacted] additionally writes that she received calls from Midland Credit on her cell phone, and states that she is not providing her cell phone number. Midland Credit understands [redacted] ’s concern in providing her cell phone number, however, this is the best way for Midland Credit to locate her cell phone number and ensure that no further calls are placed to that number. Without being provided that information, Midland Credit is unable to determine the phone number to cease calling. In order to cease the calls [redacted] mentions, please have her call Midland Credit’s Consumer Support Services team at [redacted] to provide her cell phone number so that Midland Credit may further investigate this claim. Information provided by the seller, [redacted] ***., at the time of acquisition indicates this account was originated on October 19, 2010 as a [redacted] credit card account number ending in *** in the name of [redacted] , under the last four of the social security number ***. Subsequently, the account was charged-off as an unpaid delinquent-debt on August 9, 2011. The balance at the time of purchase was $287.95. [redacted] expresses a concern that his validation requests have been ignored. On March 15, 2013, Midland Credit mailed [redacted] a validation letter, which informed him that Midland Funding had acquired the account, and of his rights pursuant to the Fair Debt Collection Practices Act, 15 U.S.C. § 1692 et seq. (“FDCPA”). Please note that the letter was mailed to [redacted] via the United States Postal Service, and was not returned as “undeliverable” – satisfying the requirements set forth within the FDCPA. Midland Credit’s business records indicate that it did not receive any correspondence disputing the debt or requesting validation from [redacted] in response to the letter. A review of Midland Credit’s business records indicates that it received the first correspondence requesting validation from [redacted] on July 14, 2014, which cannot be considered timely. I have reviewed Midland's response. Unfortunately, the information that they have submitted is incorrect. They have stated that they will not report Acct*** as I responded in a timely manner. A timely manner is within days. They stated that they sent a letter regarding the validation of debt on 12-16-13. They said I responded on 7-28-with regard to this letter. I sent a certified letter , receipt number *** *** *** *** *** after retrieving a copy of my credit report with three accounts being reported by Midland which I knew were not mine. The date of this letter sent certified mail was 8-28-14. Receipt number *** *** *** *** ***
The letter was not in response to anything that Midland had sent to me. The letter that Midland supposedly sent to me would have had to have been returned to them if it was sent 12-16-13, as I had not been at that address for some time. I did not receive the correspondence
Midland states that it is looking for validation of the debt. That is what I am requesting from them for all three accounts. I did not send a separate letter for each account as it is expensive to send certified mail. I did include three separate dispute letters for each account in the one letter sent certified mail.
With regard to validation letter allegedly sent on 4-24-for account number ***, I am in contact with *** *** bank regarding this issue. As of today, September 26, 2014, they have not been able to validate this debt but they are looking into it. I sent them a certified letter regarding this matter on 8-28-14, receipt number *** *** *** *** ***. *** *** sent me a letter last week stating that they are looking into this matter. I did not receive the letter from Midland dated 4-24-
With regard to validation letter allegedly sent to me for account number ***, dated 1-25-13, I am in contact with *** *** *** regarding this debt. I sent them a certified letter dated 8-28-14. the receipt number is *** *** *** *** ***. I have yet to hear from them. I did not receive the letter from Midland dated 1-25-13.
I am asking that this company be held accountable for the incorrect information that they have reported to the credit bureaus. They cannot verify that the debts are mine. I expressly stated in the credit dispute letter that I was entitled to a copy of the bill paying history on each of these accounts and a copy of the credit application showing that I owned these accounts. They cannot or will not provide this information. They are using the validation letters and the day timely response as an excuse to pepper my credit report with these debts. This violates my rights as a consumer.
I can see from the complaints that are posted on the internet, that I am not the only victim of their folly. I think that have a nice sandy beach upon which to play with consumer's credit files. I am going to be a very large pebble on that beach for a very long time. They are not going to extort money from me. I think a lot of people give up. I will not do that
Please advise. Thank you
I am asking that they delete this information from my credit file or prove the debts
