Midland Credit has finished conducting its investigation regarding the alleged conduct of its employees, and has determined that no violation of company policy occurred A review of Midland Credit’s business records indicates that when asked about whether the account would be deleted in exchange for payment, the Midland Credit representative correctly advised of Midland Credit’s reporting policy, stating that the account would not be deleted

An investigation of this matter indicates that Midland Credit became the servicer of the above-referenced account on behalf of purchaser, Midland Funding LLC (“Midland Funding”), on November 29, 2012. Information provided by the seller, *** *** *** *** at the time of acquisition indicates this account was originated on September 24, as a *** cellular account number ending in ***, in the name of *** ***, under the last four of the social security number ***. Subsequently, the account was charged-off as an unpaid delinquent-debt on February 17, 2012. The balance at the time of purchase was $570.36. Final payment for the account was received July 9, 2014. *** *** has no further financial obligation to the account
While not the only item of concern referenced in her complaint, *** *** writes that she was advised that the account would be deleted if she were to settle the account. Please note that it is Midland Credit’s policy that all accounts are reported accurately. Once paid, the account will be reported as “Account paid in full, was a collection account.” Should the account be settled for less than the full balance, an additional memo would be reported, stating “Account paid in full for less than the full balance.” During the call in question, *** *** was advised how the account would be reported, and chose to pay the account in full. The topic of deleting the tradeline was not mentioned during the call. Midland Credit has reviewed its business records, and has determined that no violation of company policy has occurred.
Aside from the above, *** *** writes that the above-referenced account is reporting as “days past due” on her consumer credit files. Although Midland Credit submits updates to the reporting agencies each month, Midland Credit does not report accounts as “days past due” to the credit reporting agencies. Depending on the current condition of a given account, it will report as either “Account assigned to internal or external collections,” “Account paid in full, was a collection account,” or “Account paid in full for less than the full balance.” Midland Credit’s business records indicate that the account is reporting accurately to the three major credit reporting agencies
*** *** is encouraged to communicate directly with the credit bureaus should she have any further concerns about the nomenclature that Midland Funding is compelled to use in credit bureau reporting. Midland Funding has no control over said nomenclature assigned. In addition, if *** *** obtained her credit report from a compilation source, the information being reported may appear to vary. The credit bureaus have advised that it appears this way because they do not directly populate the fields on credit reports pulled from any source other than directly from the credit bureau itself

As I stated in my previous letter, I never received Midland's response to my validation request in the specified days. Nor did Midland cease collection activity as is made clear in FDCPA Section 809(b). A debt collector MUST cease collection activity until account is verified. They never ceased reporting to the credit bureau, and credit bureau reporting is considered collection activity. Furthermore, Midland did not take the steps to ensure proper delivery of the response they claimed to have sent. My request for validation was sent by certified mail. I would expect they would respond to my request with proper measures. I receive letters all the time in my mail box that was not intended for me. The post office does not claim a 100% delivery rate. At this point, I am respectfully requesting that Midland Funding, LLC delete this account promptly. I have made every effort to resolve this matter without presenting this matter to a courtroom before a jury

As I had mentioned in my initial complaint, unauthorized charges were made years agoIt wasn't until recent time that I knew of the account being a negative mark, as I had thought it was taken care of by the original company and closedSo there are no forms that were filled outTheir mark was immediately removed at my requestIt was never a valid debt and they corrected their mistakeI don't care who bought it, sold it or is currently claiming itIf it's not removed from the three bureaus within days, I'll be contacting my attorney general and seeking possible legal action

A review of Midland Credit’s business records indicates that on October 2, 2011, this account was outsourced to the law firm of *** *** *** *** ***(*** ***”) located at *** *** ** ** *** *** *** *** ** ***. Their phone number is (619) 275-4001. Final payment on the account was posted to the account on January 3, 2013. *** *** has no further financial obligation for this account
*** *** expresses a concern that after the account had been settled, he was advised that the credit reporting would be deleted from his consumer credit files. However, a review of Midland Credit’s business records for the account do not show a record of a conversation occurring with *** *** from the time the account was outsourced to *** *** until August 22, 2014.
As *** *** indicates, during the August 22, conversation he was informed of Midland Credit’s policy to report all accounts accurately. If Midland Credit were to delete the account, its correct and accurate status would not be reflected. A review of Midland Credit’s business records indicates that it is accurately reporting the above-referenced account as “Account paid in full, was a collection account.”

While Midland Credit is pleased that it was able to assist *** *** in reaching a resolution which settled the balance for the above-referenced account, it is Midland Credit’s policy to report all accounts accurately. A review of Midland Credit’s business records indicates that it is accurately reporting the above-referenced account as “Account paid in full, was a collection account.” If Midland Credit were to delete the account, its correct and accurate status would not be reflected. Midland Credit must respectfully conclude that no violation of company policy occurred, and its representatives acted appropriately pursuant to applicable law.

However, provided with the first six digits of the account number, it was able to locate an account matching the account number and containing a substantially similar address
However, an investigation of this matter indicates that the referenced account being serviced by Midland Credit belongs to another consumer with a name similar to *** *** During a search for the correct consumer, *** *** address was provided to Midland Credit representatives by a third party and the supplied address contained an extra identifying character in the apartment number which was not included in the complaint. In reliance on that information, Midland Credit attempted to contact the consumer regarding the referenced account.
Please note that none of the letters sent by Midland Credit were returned as undeliverable, nor was Midland Credit notified or aware it may have been sending letters to the wrong address until receipt of the complaint filed through your office
The indicated address has been marked “Do Not Mail” in Midland Credit’s computer system for the referenced account. In her complaint, *** *** indicates Midland Credit continues to report the referenced accounts past the seven-year Federal Reporting period (“FRP”). A review of Midland Credit’s business records indicates that the FRP for account no.’s *** and *** will not expire until February and September 2016, respectively
For account no.’s ***, ***, ***, and ***, a review of Midland Credit’s business records indicates that the FRP expired in November 2008, December 2008, December 2013, and October 2011, respectively. Please note that expiration of the FRP does not extinguish the debts. Rather, it prevents the accounts from being reported to the credit reporting agencies. Upon the expiration of the FRP, the accounts remain collectible, due, and owing to Midland Credit. That being said, as referenced above, prior to receiving *** ***’s complaint through your office, Midland Credit made the business decision to close account no.’s ***, ***, and ***
*** *** also expresses a concern that Midland Credit has listed the accounts as current accounts on her consumer credit files. Midland Credit does not alter or modify any of the original accounts information provided by the seller, such as the name of the consumer, the date of origination, or the date of occurrence. Midland Credit reports the information on the accounts it services based on the business records maintained by the original lender/seller. In accordance with the Credit Reporting Resource Guide produced by the Consumer Data Industry Association, the open dates being reported on these accounts reflect the “dates that the accounts were purchased by the debt buyer or placed/assigned to the third party collection agency.” The open dates listed on *** ***’s credit report are in fact the dates of purchase by Midland Funding, LLC.
On September 26, 2014, Midland Credit received correspondence from *** ***’s attorney requesting validation for account no***. Upon receipt, Midland Credit acknowledged the dispute, ceased collection efforts, annotated the account as disputed, and began the process of verifying the debt, which continues to be on-going. Once Midland Credit has obtained verification of the debt, a copy will be forwarded to *** ***’s attorney. Additionally, Midland Credit will not report the account to the three major credit reporting agencies until it is able to provide verification of the debt
Lastly, if *** *** finds any accounts other than account no.’s *** and *** on her consumer credit files, please have *** ***’s attorney contact Consumer Support Services team at *** *** *** ***
With that said, if *** *** is ready to settle account no***, she may qualify for a reduction in her account balance. Please have *** *** call Account Manager *** *** at *** *** *** *** to assist her in reaching a resolution that will be both beneficial to her, as well as settle the account balance

*** *** expresses concern that *** * *** would not accept her repayment offer, and proceeded with litigation. *** * *** advises that *** *** was served with a Summons and Complaint on April 28, 2014, and subsequently called their offices on April 29, 2014. The representative spoke to her about the account, and offered her a three month payment plan on the balance, which at the time was $2,551.45. *** *** advised that she could only pay $a month, which was not an acceptable offer. The representative then advised her that any money sent in would be applied to the balance, however, legal action would continue if she was only going to pay $a month
Judgment was subsequently entered on June 23, 2014, in the amount of $2,751.45. While bank restraining notices were issued, and an information subpoena was sent to *** ***’s place of employement, wage garnishment has not yet commenced. A copy of the judgment, along with a copy of the verification information provided by the seller, is enclosed for *** ***’s records
That being said, *** * *** have indicated that they have reached a settlement agreement with *** ***’s attorney in which a payment of $1,is to be paid by November 12, 2014. It appears that *** ***’s concerns have been resolved

An investigation of this matter indicates that Midland Credit became the servicer of the above-referenced account on behalf of purchaser, Midland Funding LLC (“Midland Funding”), on August 26, 2011. Information provided by the seller, *** *** *** *** ***, at the time of acquisition indicates this account was originated on August 29, as a *** *** *** *** line of credit account number ending in ***, in the name of *** ***, under the last four of the social security number ***. Subsequently, the account was charged-off as an unpaid delinquent-debt on February 21, 2010. The balance at the time of purchase was $4,035.46.
*** *** expresses a concern that the account had been settled with the original creditor and that Midland Credit has ignored those concerns. A review of Midland Credit’s business records indicates that it did receive correspondence from MrsChavez which included a letter from the original creditor stating an account was settled in September 2010. The account number on the letter did not match the original account number provided by the seller to Midland Credit and so it was not accepted as supporting her claim at that time.
Upon further review, Midland Credit identified an additional account number associated with this debtBased on this review, Midland Credit recognizes that the account was settled previously with the original creditor and should not have been sold to Midland Funding in 2011. There will be no further collection activity, credit reporting or sale of this account. In addition, the three credit-reporting agencies have been notified to delete all reference to the account in question from *** *** consumer credit files

provided to Midland Credit representatives by a third party. In reliance on that information, Midland
Credit attempted to contact the consumer regarding the referenced account.
Please
note, Midland Credit had no information that it was contacting a wrong number
for the consumer until a phone conversation on February 8, 2015, presumably
with *** ***. Their phone number was
marked “Do Not Call” in Midland Credit’s computer system for the referenced
account at that time. No phone calls
have been attempted to the number provided in the submission since February 8,
2015. *** *** will no longer receive
calls from Midland Credit representatives regarding the referenced
account. Additionally, *** ***’s phone
number (*** has been added to an exclusion list to prevent it from
being called in the future regarding the referenced account

A review of business records indicates that no calls have been made by Midland Credit to *** *** *** *** *** ***, since March 14, 2013. The phone number was marked “Do Not Call” in Midland Credit’s computer system for the referenced account at that time*** *** address has now been marked “Do Not Mail.” He will no longer receive calls or correspondence from Midland Credit representatives regarding the referenced account. Additionally, his phone number has been added to an exclusion list to prevent it from being called in the future regarding the referenced account

Credit provided all of the account identifying information in its previous
letter response to your office dated January 26, *** *** writes that he has not been
provided any information regarding Midland Credit, but expresses frustration
that Midland Credit contacted him for another individual. Midland Credit maintains its position
regarding its policy to verify information with whom it is speaking to ensure
it does not disclose personal information to the wrong individual and to
protect the privacy of those with whom Midland Credit conducts business.
As
stated in its previous response, Midland Credit conducted a search for the
correct consumer and *** *** phone number was provided to Midland Credit
representatives by a third party *** *** is not the correct consumer for the referenced account and Midland
Credit respectfully apologizes for any inconvenience *** *** will continue to no longer
receive calls or correspondence from Midland Credit representatives regarding
the referenced account.

that Midland Credit is the servicer of an account belonging to another consumer with the same name as to *** ***’s. During a search for the correct consumer, *** ***’s phone number was provided to Midland Credit representatives by a third party. In reliance on that information, Midland Credit attempted to contact the consumer regarding the referenced account.
Please note that Midland Credit had no information that it was contacting a wrong number for the consumer until a phone conversation, presumably with *** ***, on March 16, 2015. While the phone number that the call was received from does not match the phone number indicated by *** *** in the complaint, the phone number was marked “Do Not Call” in Midland Credit’s computer system for the referenced account at that time. Additionally, Midland Credit does not have record of placing any calls to *** ***’s phone number, *** ***, and the number does not appear to be in Midland Credit’s system
*** *** also expresses concern that Midland Credit representatives refused to disclose information to her because she declined to verify her social security number. Please note that it is Midland Credit’s policy to verify a consumer’s information on each call to ensure it does not disclose personal information to the wrong individual, as well as to protect the privacy of those with whom Midland Credit conducts business. Because *** *** refused to verify her information, the Midland Credit representatives with whom *** *** spoke were unable to disclose information to her

*** *** address has been marked “Do Not Mail” in Midland Credit’s computer system for the referenced account. *** *** will no longer receive correspondence from Midland Credit representatives regarding the referenced account. *** *** was previously advised of this remediation during a phone call that he placed to Midland Credit. *** *** was advised during the call that the appropriate steps to remove his address from the account had been taken Although *** *** did not state that the account had appeared on his credit, in keeping with its Consumer-First policy, Midland Credit has proactively taken the appropriate steps to request the account be removed from his consumer credit files based on his address.
