investigation of this matter indicates that Midland Credit is the servicer of
an account belonging to another consumer with a name similar to *** *** During a search for the correct consumer, *** *** phone number was provided to Midland Credit representatives by a third
party. In reliance on that information,
Midland Credit attempted to contact the consumer regarding the referenced
account.
Midland
Credit was notified that it was calling the wrong party on November 28, *** *** phone number was marked “Do Not
Call” in Midland Credit’s computer system for the referenced account at that
time and no calls have been attempted since November 28, *** *** will continue to not receive calls
from Midland Credit representatives regarding the referenced account. Additionally, *** *** phone number *** *** has been added to an exclusion list to prevent it from being called in
the future regarding the referenced account

Dear Revdex.com:
I have reviewed the response made by the business in reference to complaint ID#***, and have determined that this proposed action would not resolve my complaint because Attorney *** *** never mentions a resolution. Attorney *** *** clearly indicates that Midland Credit Management has permissible purpose when they do not have permissible purposeI want the proof that they have permissible purpose. Check your records, verify the last 4-digits of the social security number and I am 1000% confident that you will come back confirming that it is not ***; which is the last 4-digits of my social security number. Attached you can see clearly that the Account Review section of my credit report has the permissible purpose reason listed as a "Collection". So if I do not have any collections on my personal credit history, and I do not have an account with Midland Credit or any of its clients that it may collect on under my social security number then I would appreciate knowing why the heck Midland Credit Management is appearing on my credit report for any reasonI spoke in extreme detail with *** regarding this inquiry and they advised me clearly that I would have to have an account with a creditor that is in collections who has possibly assigned my account to Midland Credit Management in order for Midland Credit Management to appear like this on my credit reportsSo what I am saying clearly here to Attorney *** ***, is tell me the reason why Midland Credit Management is on my credit report and show me the proof or at least confirm the last 4-digits of the social security number that Midland Credit Management is using to access my personal credit reports for this so-called "permissible purpose" reason is being allowed. You cannot just write a novel reply and have no point of original with a resolution. Therefore, I am challenging you and your client to check your records and verify the last 4-digits of the social security number that Midland Credit Mangagement is using that allows them permissible purpose for this "collection" inquiry that does not belong to me.I do not care what data *** gave you, I do not care what the reasons why I see it there; I need you to show me proof as to the reasons that would allow Midland Credit Management to appear on my personal credit report when I do not have any collections and one way you can do this is just looking at your records and verifying the last 4-digits of the social security number that you are using to access my personal credit reports. How hard is this?, and I do not feel I am asking for alot here considering this is my credit, my life I am talking about and I take it very seriously; and I am not easily intimidated by an attorney letter so believe me I am not standing down!!!! Show me the proof in your next reply, tell me the last 4-digits of the social security number in your records that allows the access to my credit report. It's OK if you cannot tell it to me via this portal; but at least you will see it for yourself and no that you DO NOT HAVE THE PERMISSIBLE PURPOSE THAT YOU THINK YOU HAVE!!! Simply speaking Just verify the information Attorney *** -- how hard is this of a request? From where I stand this is not difficult and in a court of law you would be asked to do the same thingSo please check your clients records and I guarantee you that my social security number ending in *** is not in your record clients records and if it is for any reason; I have a right by law to know what the heck you are on my credit reports with permissible purpose labeled as a "collection".My fico scores are well over 790+ on all credit bureaus and I have never had a collection account in my entire life so answer the question as it is being addressed. You wrote your page reply in detail Yes, but no where in your reply confirms, proves or allows Midland Credit Management to appear on my credit report with permissible purpose, and you gainly wrote without proof, or an acknowlegement that you would remove the inquiry nor can you show any permissible purpose so where do you get off writing pages that do not say anything as it so relates to the facts to prove permissible purpose or that you are accessing the correct consumer's personal credit reports????? That's my questionIf Midland Credit Management dig hard enough through their records they will NOT discover my social security number, they do not even know my date of birth so somewhere here you should be able to prove permissible purpose no matter what data was transmitted to you -- the information has to be verified!!! You have the wrong person and Midland Credit Management should not be showing on my credit report and I want the inquiry removed and that's the bottomline. To aide you in your research, the last 4-digits of my social security number is *** as mentionedNow would you please have your client confirm their records because they have to have a social security number in order to review or access my credit reports whether correct data was given or notCheck your records and I guarantee you, your client Midland Credit Management DOES NOT HAVE MY SOCIAL SECURITY NUMBER ON FILE!!!!!!!!!!!!!!!!!!!!!!!Secondly, since you keep screaming that your client has not called me, I am attaching a copy of my cellphone; where I have taken a picture of my call log and you will clearly see that telephone # *** has called me several times as of 03/11/2015. My home telephone # is *** that's correct and this is not the number I said they called me onI reported these excessive telephone calls to the Revdex.com and advised them that the calls were coming in on my cellphone number; which I am not providing to you. You continue to state that they did not call me, but a call log never lies Mr***. (See it attached for yourself.)Now this is not a difficult situation to administer and remedy and I feel that you and Midland Credit Management are taking this matter lightly although you claim that you take Revdex.com complaints seriously; well I will gladly tell you what; this will not be the last letter you reply to because I am taking the matter further if you do not show me the proof that Midland Credit Management has my correct social security number on file that grants them access to my personal credit reports and if they do have my social security number on file I need to know why they are reviewing my credit history and I do not care about all the "why's and why's not" that are not accompanied with a direct answer! I need proof no matter how you twist it and I am not asking alot here.1. Confirm the last 4-digits of the social security number that Midland Credit Management has on file that grants them permissible purpose.2. Hello, I’m responding to Midlands responseThey stated that they sent me an attempt to collect a debt letter, and I failed to respond. I never received those letters so how can they say that they met the FDCRA requirements? Can you please ask them to provide me with proof that they sent and I received the attempt to collect a debt letters? If they can’t provide the proof, then they must either send me the following documentation:
(1)Full accounting for this account:
(2)Copy of the assignment of purchase from the creditor
(3)Every charge and what was purchased, fee, payment, credit, interest
(4)How you calculated what you claim I owe
(6)Full chain of assignments from charge off to present
(7)Proof that you own the debt with full clear title
(8)Proof that you were on the original contract
If they can’t send what I’m requesting, they have to stop reporting these inaccurate items until they can provide me with the list of documentation

Thanks for your continued support, I have reached out to *** *** *** in the event reaching a settlement offer, however the initial credit line was $and with interest and fees I was told the account is up to $now, it is obscure on my behalf coming close to making a settlement offer anywhere close to that amount, I did however set out a figure in the amount of $but I was told I would have to come up in full if offer was accepted, I cannot come up with $in full, not in these times and was looking forward to a break up in payments after offer is acceptedI don't like he fact I'll be loosing money and paying for a account I already did but shame on me for not keeping my proof, none the less willing to stop this financial nightmare before it end up costing me way more in the futureI am hoping to reach a settlement with them and one that is doable and acceptable in the event the Payments have to be broken up

The business still has not provided proof of the debt All I am asking is that they provide me with the signed document(s) associated with this debt that prove it to be mine In my opinion, a response of "we sent him a letter' does not provide proof of the debtI never received any such letter and they have no proof of delivery or receipt of said letterThey simply refuse to provide documents to validate the debt I know of no business that would loan someone 5-or thousand dollars without a signed contract of some sort They leave me with the option of paying them to get it off my record with no proof of debt, hiring an attorney to fight it or filing an affidavit of fraud I do not wish to pay for a debt that I do not think is mine I do not think I should have to pay an attorney to prove a negative and I do not wish ti file an affidavit of fraud if the debt is in fact a valid debt that I oweI find it inconceivable that a company can treat a consumer in this manner with nothing more for proof than "we sent him a letter in 2010" Please assist me in simply getting document to prove it is my debt or getting this company to remove the negative information from my credit reports I am not a wealthy man and I am being seriously injured by this company when all I ask is for a simple copy of a document before they continue their activities which are damaging me financially and causing me extreme anguish I feel I have no where to turn and that there is no agency that can compel these people to prove anything

An investigation
of this matter indicates that Midland Credit became the servicer of the
above-referenced account on behalf of purchaser, Midland Funding LLC (“Midland
Funding”), on April 30, 2013. Information provided by the seller, *** *** ***., at the time of acquisition indicates
this account was originated on November 30, 2011, as
a *** ***
account number ending in ***, in the name of *** ***, under the last
four of the social security number ***.
Subsequently, the credit card account was charged-off as an
unpaid delinquent-debt on April 5, 2013. The balance at the time of purchase was $300.15. Final payment on the account was received on June 20, 2014.
*** *** has no further financial obligation for this account
*** *** writes that one credit bureau is listing Midland as the original lender. Please note, Midland Credit does not report
as the original lender. Midland Credit reports
as a “Debt Buyer” to the three major credit reporting agencies, and has no
control over the manner in which each credit reporting agency decides to
display that information.
*** *** also states that the credit bureaus all reflect different origination
dates, account numbers, comments and notes.
Midland Credit does not alter or modify any of the original account
information provided by the seller, such as the name of the consumer, the date
of origination, or the date of occurrence.
Midland Credit reports the information on the accounts it services based
on the business records maintained by the original lender/seller. Midland Credit reports the same information
to all three major credit reporting agencies.
In
addition, *** *** indicates that one bureau is reporting like a revolving
account as over days late. Midland
Credit does not report accounts as “days late” to the credit reporting
agencies. Because *** *** paid the
account on June 20, 2014, Midland Credit notified the credit reporting agencies
that the balance is no longer owed, and reflects a $balance. Midland Credit’s business records indicate
that it is appropriately reporting the above-referenced account to the three
major credit reporting agencies as “Account
paid in full, was a collection account.” *** *** is encouraged to communicate directly with the credit bureaus should she
have any further concerns about the nomenclature that Midland Credit is
compelled to use in credit bureau reporting.
In addition, if *** *** obtained her credit report from a compilation
source, the information being reported may appear to vary. The credit bureaus have advised that it
appears this way because they do not directly populate the fields on credit
reports pulled from any source other than directly from the credit bureau
itself

Midland Funding has engaged in a fraudulent reporting of this account and has violated Fair Credit Reporting ActIn spite of my cease and desist request to not be contacted, which has been acknowledged by the responder, I still get contacted by them which is a blatant violation of Fair Credit Reporting ActPlease see the attachment.
Now if Midland can violate a federal law regarding my account, what else is to be expected? Midland Funding says that it sent me a debt verificationHowever what they did not mention is that the debt verification they sent did not include any agreement that I had with the alleged ** *** ***More so when ** *** *** is contacted, they have no knowledge of any balance or account with them.
Midland Funding bought a bad debt with inadequate verification and documentation that would not convince any legal body of the United States to affirm that it is validI have several other correspondences and additional violations of the FCRA that I would be more than happy to present to Revdex.com that would clearly reveal who the real victim is in this scenario.
Midland has a clear choice to makeMy next steps are to contact California state attorney general along with litigating on the FCRA violations and debt validation in *** *** ***.
I need this incorrect information removed from my credit file for this issue to be resolved.

offered to resolve the account balance for $1,000.00, to be paid in
installments *** *** states his offer
was not accepted as the firm was only willing to accept if the $1,was paid
in one lump sum. Midland Credit has
forwarded a copy of *** ***’s complaint to the firm and inquired with them
regarding the matter.
The
firm has advised that it has not been contacted by *** *** to discuss a
resolution of the account balance However,
they are willing to accept the offer should *** *** still like to resolve the
account. Please note, the firm states
that in addition to the proposed $1,payment plan, there will be *** fees that will also be due and owing out of any settlement. Additionally, if *** *** defaults on his monthly payment
arrangement, the full original amount plus accruing interest less credits for
any payments made would be due and owing As indicated in previous responses, *** ***

A review of Midland Credit’s business records indicates that *** *** has retained an attorneyGoing forward, all communication about the matter should be handled by his attorney. If *** *** is no longer represented by an attorney, please provide Midland Credit with written notice so it may update its records and allow its representatives to communicate with him directly
An investigation of this matter indicates that Midland Credit became the servicer of the above-referenced account on behalf of purchaser, Midland Funding LLC (“Midland Funding”), on September 8, 2009. Information provided by the seller, *** *** *** ***, at the time of acquisition indicates this account was originated on May 29, as an *** *** *** *** *** account number ending in *** in the name of *** *** under the last four of the social security number ***. Subsequently, the account was charged-off as an unpaid delinquent-debt on August 7, 2008. The balance at the time of purchase was $752.77.
*** *** questions whether the above-referenced account may be reported on his consumer credit files, due to an order issued by the Federal Trade Commission (“FTC”), which he states applies to the credit reporting of the above-referenced account
After reviewing both the account information, as well as a copy of FTC order 1:08-CV-1976-BBM-RGV, please note that while the FTC may have issued an order against the *** *** and *** *** *** *** providing restitution payments to certain defined consumers, it does not render all accounts ever issued by *** *** *** invalid or unenforceable. Part II of the FTC order provides that only affected accounts in which the restitution payments were greater than the balance due were to be removed from a consumer’s credit files. Accounts in which a balance remained after an adjustment for restitution payments were allowed to be updated in the consumer’s credit files under the FTC order
*** *** expresses a desire to have the above-referenced account deleted from his consumer credit files upon resolving the balance. Please note that it is Midland Credit’s policy to report all accounts accurately. Midland has been sued many times for violating the credit protection lawsI have read that I have the same complaints I do not doubt that in some way things are being manipulated to make themselves sound better I shall be happy with this debt of my ex husbands is paid off and I am done with them

which Midland Credit Management, Inc(“Midland Credit”) received
February 10, 2015. Midland Credit appreciates the opportunity to
answer your questions
An
investigation
of this matter indicates that Midland Credit became the servicer of the
above-referenced account on behalf of purchaser, Midland Funding LLC (“Midland
Funding”), on January 25, 2012. Information provided by the seller, *** ***, at the time of acquisition indicates
this account was originated on June 4, 2007, as
a *** *** *** *** *** *** *** account number ending in ***, in the name of *** * ***, under the last four of the social
security number ***. Subsequently, the
account was charged-off as an unpaid delinquent-debt on August 31, 2009.
The balance at the time of purchase was $7,938.95.
*** *** writes that she entered into a payment plan to settle the balance for
$3,115.12, which she indicates included a down payment of $1,and monthly
payments of $until the settlement balance is met. She also states that the second monthly
payment was received by Midland Credit past the due date due to a delay with
the post office, which voided the payment plan and raised the balance owed on
the debt. Finally, *** *** expresses a
desire to have the payment arrangement honored again
Please
note that Midland Credit has no control over the post office and the timeframe
in which it processes and delivers mail.
A review of its business records indicates that it agreed to a payment
plan during a phone call with *** *** on October 24, 2014. The agreement was for a $1,down
payment, with monthly payments of $due the last day of each month until a
total of $3,was received.
In
accordance with the agreement, Midland Credit received $1,on October 24,
2014. It then mailed MsNelson a letter
on October 27, confirming the terms of the agreement and stating that in
the event that she failed to make all payments on time and as agreed, the
agreement would no longer be valid
The
first monthly payment of $88.13, which was due by November 30, 2014, was
received on December 1, 2014. As the
payment was received within a hour period of the deadline, and because Midland
Credit attempts to allow for a reasonable time to process payments, it
continued to honor the payment agreement.
However,
the next monthly payment of $was due December 31, and was not
received until January 6, 2015. As this
payment was received six days late, and *** *** made no contact with Midland
Credit for an explanation of the delay or a request for an extension of the
deadline, Midland Credit voided the payment plan
Midland
Credit acted appropriately pursuant to the payment arrangement. However, in keeping with its Consumer-First
policy, it will re-honor the payment agreement.
If *** *** plans to continue mailing payments, Midland Credit respectfully
recommends allowing a reasonable time for processing by the post office so that
payments may be received in accordance with their respective due dates *** *** may call Midland Credit Account
Manager *** *** at *** *** *** *** to reestablish the
agreement.

the credit-reporting agencies to remove its tradeline from *** ***’s
consumer credit files on August 14, 2014.
The credit reporting agencies have advised that they may require up to
days for processing. There will be no further collection activity, credit
