I acknowledge the position of Midway Nissan, but stand firm on the fact that I accepted a legitimate offer made by their sales staffAny confusion in the actual amount of the vehicle is because their sales staff was misleading, heard what they wanted to hear, or played with the numbers after the fact and failed to clearly spell out the true cost during the 6-8 email and telephone conversations that occurred.I responded to an ad on their website for a vehicle advertised at a starting price of $9,and made it clear from the beginning what I was looking for and what I was willing to payIn the end the deal was some $5,000+ more than we ever discussed.So, in an effort to wash my hands of this, I will accept a payment of $to cover the $in fuel and $in meals incurred on the mile, 2-day round trip; not to mention the additional wear and tear on my aging truck (purchased from Midway Nissan)This amount takes into consideration the $in fuel that Midway Nissan put in my tank on the evening of February 28.Regards,*** ***

March 9, 2015We are in receipt of the complaint *** *** filed with your office. *** *** was working off of an estimated price from a vehicle he had put together himself online, Midway Nissan didn’t have that specific vehicle in stockWe had arranged a "dealer trade" with
another dealership, that dealership sold the vehicle before we were able to obtain it We then had to arrange another trade with a different dealer.When *** *** built his vehicle on line, the "estimated" invoice price was $29, The vehicle *** *** purchased had and MSRP of $35,and an invoice price of $33, *** *** purchase the vehicle for $29, The price listed did not include taxes, tiltle, license and doc fees, as well as any dealer adds.*** *** came in and all the numbers were broken down for himAt that point there was a $1,difference which was for a warranty he purchasedWe offered to cancel the warranty but *** *** declinedWe would be happy to sit down with him again and review all of the numbers.Sincerely,*** ***Compliance Director- Midway Nissan

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.I tried to send this e mail on Tue,Mar 10,2015 but I think it went to the wrong address. Evidently your sales staff did not tell you that I was buying the [redacted] using the Build and Buy program on 1/7/15. I'm pretty sure that they will say that they did not know that. I have all the paperwork for the car I was trying to buy (the bait car) and the switch car. They did not show me how they came up with the Amount Financed and the Finance Charge until I signed the paper work. [redacted] gave me two pages of back up data the next day but it took me many hours to find out that they added $4031 to the Amount Financed and the Finance Charge.[redacted] told me on 1/7/15 that I had to finance the car in order to get a $4000 rebate. [redacted] told me on 1/7/15 that I had to buy a Mechanical Protection Plan (Extended Warranty) in order to get 2.9% financing.I offered to settle for $650 on 1/8/15 but [redacted] only offered me a $100 [redacted] credit.I checked the Build and Buy web site on 3/9/15. I asked for the Midway Nissan dealer price for the same 2014 [redacted] SV that they switched me too. Same color,same options and same MSRP. The dealer price was $29,143 including total dealer fees and [redacted]. It is noted that [redacted] and [redacted] are offering 2014 [redacted] SV's for less than $30,000. Using Midway Nissan cost data, the sales tax,title,license and registration would be $2689 and the total cost to me would be $31,832. The next day (3/10/15) I got an e mail from [redacted] at Midway to sell me this [redacted] for the dealer price of $29,143.Sincerely,[redacted]

to extend our apology to Mr. [redacted] for any inconvenience he experienced on theday that he visited our dealership. The vehicle Mr. [redacted] inquired about was pushed on line with a stock photo, not the actual photo. It typically takesabout 3-5 days for the real photo to be added to our website because of the number of vehicles that we sell.  It was not nor has it ever been our intent to mislead a customer or hide any damage on a vehicle that is for sale. As a gesture of customer goodwill we would like to send Mr. [redacted] a restaurant gift card to make up for lost time and the experience.  We regret that Mr.[redacted] did not receive the customer service he expected or deserved.
