Business responded one time and offered to split the balance but I did not agree as they committed fraud with my
membership.

The following constitutes the response of Equinox Holdings, Inc., in response to the consumer complaint filed by Melissa Schilling *** *** signed a membership agreement with Equinox on December **, (the “Agreement”)All indications are that *** *** voluntarily signed the
membership agreement and fully understood its terms The Agreement provides for a 12-month obligation period, and thereafter, the membership becomes a month-to-month membershipThis obligation is clearly and conspicuously stated on pages and of the AgreementParagraph of the Agreement on page provides for additional cancellation rights during the obligation period should a member (1) provide a doctor's note stating that she cannot physically receive the services of the club for a period in excess of six (6) months; (2) pass away; (3) move her residence more than miles from any health club operated by Equinox; and (4) be involuntarily terminated from her employment without cause (and provide documentation from her employer confirming the termination and the reason for such termination) *** *** is currently still within her obligation period, as it has not yet been months since she activated her membershipShe has not provided any of the documentation necessary to cancel her membership within the obligation period, nor has she indicated that any of these rights are applicable to her While it is unfortunate that *** *** is unsatisfied with the terms of the contract that she agreed to, there can be no doubt that the terms are clear.

The stated policy in Eduardo's response does not align with their practice1.During the membership siprocess, I was verbally assured that I was not held to a contract due to signing up through a corporate membership My wife, whom I signed up under the same membership, cancelled prior to a year passing without having to provide a formal letter or other documentation to cancelThis was all completely conveniently through email, with confirmation also coming through emailI am dumbfounded that this simple process has turned to lies and misleading statements in order to retain a membership payment for months longer. See the attachment, "Membership Change," for the final notice that Michelle's membership was cancelled within a year of joining. See the attachment, "Membership," confirming Michelle's account was cancelled, as well as a statement regarding why she was allowed to cancelIn fact, Michelle had a month gap before joining Equinox again under her own corporate membership; she did not enroll directly into that planThey were two seperate occassions.

was refunded on 3/*/to the original form of paymentAs she was not eligible to freeze when this was requested, we would not be able to refund the requested $No further steps or payments are required as the account is set to cancel at the end of the month
