RE: Case ***
Dear ***:
Thank you for the opportunity to respond to the
complaint filed by*** regarding her account with Green Tree Servicing LLC ("Green Tree")
We understand Ms***'s concerns and regret any dissatisfaction this matter causedMs***'s correspondence has been reviewed with the appropriate department management and the following response is provided
Due to delinquent taxes, escrow was forced on the account pursuant to our servicing agreement with Fannie Mae, the owner of the loanThe delinquent taxes, in the amount of $542.90, were paid to *** on November 26, The enclosed escrow analysis, which was processed on December 5, 2014, provides information regarding the calculation of the monthly escrow payment that was effective with the February 1, payment
Upon further review of Ms***'s concerns, Green Tree has confirmed that $was credited to the account on April 29, as Ms*** advisedAlso, we have verified with the tax office that the exemption Ms*** referenced in her correspondence was for the taxes and the taxes were due in the amount of $
At this time, Green Tree has agreed to remove escrow from the account for taxesA copy of our correspondence dated May 18, approving the removal of escrow for taxes is enclosedAlso, a final analysis has been processed and is being sent under separate cover along with a surplus check for $
Going forward, Ms*** will need to review the exemption requirement with the county to determine if she must reapply each year to get this creditAlso, if the taxes become delinquent again, escrow will be force placed for the remainder of the loan
Please also be advised that funds received are automatically applied to the oldest amount(s) due, then to current amounts dueAlso, full amounts due must be received in order to credit funds to the accountWhile payments fell behind as Ms*** was only remitting the regular home payment amount, please be assured no derogatory information has been reported to the credit bureau as a result of this matterAlso, Green Tree has not assessed any late fees to the account to date; however, there is an outstanding late fee balance of $from the prior servicer
Currently, the account is reflecting $due for the May 1, paymentThe amount of $is being held in suspense, which is $short of the amount dueMs*** may cash the escrow surplus check, in the amount of $once received and submit those funds back to Green Tree in order to satisfy the May 1, paymentThe acquired late fee balance of $is also due
If Ms*** has any further questions regarding the account, she may contact her Account Representative *** at (800) ***, extension ***, or *** at extension ***She may also contact our Customer Service Department at (800) ***, Monday - Friday, a.mto p.m., and Saturday a.mto p.mCT with any further questions

Dear ***:
Thank you for the opportunity to
respond to the complaint filed by *** regarding his account with Ditech Financial LLC ("Ditech")
Please be advised, it is the customer's responsibility to pay the Homeowner's Association duesHowever, on July 2, 2015, we did advise *** that we would review the request for us to pay the delinquent dues via the escrow accountOur review determined Minnesota is a Super Lien state; therefore, the Homeowner's Association sale would be subject to our lienAs such, we did not pay the delinquent dues on ***' behalf and he was advised of our decisionIn addition, the foreclosure by the Homeowner's Association was filed against ***, not Ditech, so we were not required to have an answer filed with the courts because a suit was not filed
According to the Notice of Assessment Line Foreclosure Sale, the sale would occur on July 31, However, *** was allowed a six (6) month redemption periodIf the dues were not paid or the property redeemed, the property needed to be vacated on or before January 21,
As of today, we have not initiated foreclosureBecause our lien is superior to the Homeowner's Association lien, the mortgage foreclosure will wipe out their lien, but the delinquent dues will remainThe Homeowner's Association may continue to try to collect the delinquent dues through other methods
The requests for compensation, to be paid equity and/or to bring the account current have been deniedIn addition, records reflect a Chapter bankruptcy was filed and discharged before the transfer of servicing to DitechBecause of this, we have not reported account information to the credit reporting agencies
Ditech may monitor or record telephone communications for quality purposesThis information is considered proprietary and is not released to the publicProprietary information may only be released as demanded by a court subpoena
If you have any further questions or concerns, please do not hesitate to contact our Customer Service Department at (800) ***, Monday - Friday, a.mto p.m., and Saturday a.mto p.mCT

Thank you for the opportunity to respond to the complaint filed by *** *** regarding her account with Ditech Financial LLC ("Ditech")
We would like to apologize for any dissatisfaction Ms*** has encountered in dealing with our associatesOur mission is to provide exceptional
levels of servicing and we continuously strive to recognize opportunities for improvement
Records indicate $was inadvertently applied to Ms***'s escrow account on July 8, 2015, which caused the monthly escrow payment to be paid aheadDue to this matter, the account was only showing due $1,for the August 1, monthly home and escrow paymentTherefore, Ms*** authorized a payment by phone for this amount on July 22,
On November 30, 2015, it was found that the $previously applied to the escrow account on July 8, 2015, was applied in error and it was removed, which made the monthly escrow payment short by $Due to this matter, each of Ms***'s payments received from December 2015, to March were showing $short
However, on March 18, 2016, we adjusted the escrow payment to remove the $short paymentTherefore, Ms***'s account is next due for the April 1, monthly home and escrow payment of $1,Ms*** should be aware that this adjustment may potentially create a shortage in the escrow account

I am rejecting this response because:
As of October 19, 2017, my Equifax credit report still shows Ditech's tradeline. Please see attached file. Therefore, Ditech's letter dated October 20, is inaccurate and they are still out of compliance. I am also attaching Ditech's letter dated June 20, stating they had sent letters to the major credit reporting agencies to delete the Ditech account information
