According to account records, Ms*** modified the terms of her loan on April 26, which increased the balance of the loan to $151,A copy of the modification agreement is enclosedThe new balance of the loan is the capitalization of all past due payments, escrow and any advances that may have been assessed to the loan prior to the date the modification was offeredBy increasing the balance of the loan, the date the PMI would automatically terminate also changedTherefore the original PMI disclosure is not applicable

Once again, the Escrow Deptis supplying erroneous information and/or not providing proof to support their claims
My loan was modified however Section Eand Fon page of the Modification Agreement that MsAnderson provided clearly states:
E: That the Loan Documents are composed of duly valid, binding agreements, enforceable in accordance with their terms and are hereby reaffirmed
F: That all terms and provisions of the Loan Documents, except as expressly modified by this Agreement, remain in full force and effect; nothing in this agreement shall be understood or construed to be a satisfaction or release in whole or in part of the obligations contained in the Loan Documents; and that except as otherwise specifically provided in, and as expressly modified by, this Agreement, the Lender and I will be bound by, and will comply with, all the terms and conditions of the Loan Documents
The only terms that we modified were the interest rate and balance, the rest of the loan documents that related to PMI, including the appraisal value on which it was based, remain intact
The Homeowner Protection Act (HOPA) states at that at the time of consummation of a residential mortgage transaction, the lender must give the borrower certain disclosures that describe the borrower's rights with regard to PMI cancellation and terminationI was not provided with any disclosures when the loan was modifiedIt is because these terms did not change with the modificationIf Ditech is claiming that they changed, then they need to provide a copy of the disclosures that HOPA states that I should have received
HOPA also states: If a servicer determines that a borrower in a residential mortgage transaction does not qualify for cancellation or automatic termination of PMI, the servicer must provide to the borrower a written notice on the grounds relied on for making that determinationIf an appraisal was used in making the determination, the servicer must give the results of the appraisal to the borrowerDitech is claiming a home value of $146,but has failed to provide the source of that number after numerous attemptsIn order for a loan value to be determined, an appraisal must be performedDitech must provide a copy of the appraisalTo date, Ditech has not provided this information
Lastly, the breakdown provided by Ditech is also inaccurate based on the very numbers they provided in their response letterLet's review:
146,x 80% is 117,which occurs on 12/01/not on 12/01/
146,x 78% is 114,which occurs on 08/01/not on 08/01/
It shouldn't be that difficult to do this simple math and apply it against the amortization schedule which is why I'm pushing for further investigation into this matter by the Revdex.com

In review of Ditech's response, it is clear that they are attempting to change the terms of my loan themselves outside of the modificationThey have attached a completely different amortization schedule than the one that they sent me originally
Also, Section part O of the modification agreement states that PMI "MAY" increase and the termination dates "MAY" changeThe wording "MAY CHANGE" doesn't equal to "WILL CHANGE"So how do we know that the modification DID NOT change these things? Because the modification doesn't list these changesHowever section Eand Fon page of the Modification Agreement CLEARLY states:
E: That the Loan Documents are composed of duly valid, binding agreements, enforceable in accordance with their terms and are hereby reaffirmed

Ditech should offer an explanation or documents for each question below
Please provide the monthly PMI payment amount before modification
Please provide monthly PMI payment after the modification
Please provide a copy of the PMI termination date disclosure that is required by HOPA showing the new effective termination datesThis would have been included with the modification agreement IF these terms were modified

The modification of a loan modifies the terms of the original loan in order to assist the borrower to make the payments affordable and usually to keep them in their homeThere is not a requirement to provide a new disclosure or an appraisalAs previously stated, the value used is an automated estimate of the propertyA modification agreement is not required to list the terms of the Private Mortgage Insurance (PMI)
Please note the modification to Ms***'s account was completed by Bank of America, NAin 2010; which is prior to transfer to Ditech on June 1, Therefore, we are unable to further speak in regards to the property value used in the previous servicer's modification reviewThe loan is serviced according to the terms of the modification

I am rejecting this response because: They are claiming that we where delinquent and that was not the caseWe where told that we could skip a payment and it just be tacked on to the endThen when I called in I was informed by there customer service that there where only payments deferred and the rest was interest occurring from the time they deferred till now so some one is lyingEither way I am selling this home which is how I found out about these charges and will make sure that it is plastered on every social media site how Ditech does business

statement, which were faxed to Mr*** a short time laterSeptember 18, 2015: Mr*** contacted Ditech to confirm receipt of bill pay payment of $1,033.63, sent on September 1, 2015, to the prior loan servicer Ocwen, at which time he was informed that the monthly payment had increased to $1,An additional payment of $was promisedMr*** also expressed his desire to cancel escrowSeptember 20, 2015: Ditech contacted Mr***, at which time he stated he had sent an email to cancel escrowSeptember 21, 2015: An email was received from Mr***, dated September 14, 2015, which stated he had set up bi-weekly electronic bank bill payments of $500.00, and it was to be applied to the regular payment of $840.80, with all additional funds to principalThe email requested confirmation of payment correspondence is entered into his account for responseMarch 17, 2017: The balance of funds in escrow, placed there as the result of the lender placed insurance policy, were refunded to Mr*** on March 17, A breakdown of amounts paid for lender placed insurance, refunded, and application of funds received to escrow during this time period are listed below for Mr***'s convenienceYearly Cost of Lender Placed Insurance Policy: $1,238.00, with a monthly payment of $The insurance costs were assessed to the account as follows: $as initial payment for the time period from August 1, 2016, through October July 10, 2013, which states in Section 3, Subsection A, entitled, Time and Place of Payments: "I will pay principal and interest by making a payment every monthI will make my monthly payment on the The loan is the second lien and the balance was in a charged off status at the time of transferWhen an account balance is charged off, interest no longer accrues and additional fees/costs are not assessedHowever, the balance may remain dueThe balance due at the time of transfer was $33,and payments have not been received by usAlthough Mr*** may have paid the 1st lienholder in full, our lien was not paid and remains due
