cancel the ACH on November 30, 2016, and it was cancelled; however, this was not sufficient time to make the change for his December 1, 2016 payment, as the payment information for this payment was already in transit to his bank. Therefore, the payment was processed as agreed. The reimbursement Mr. [redacted] requested was processed on December 05, 2016. The amount of $1,769.66 was reimbursed to his bank account via ACH. Mr. [redacted] should contact his bank to verify receipt of the reimbursed funds. I am rejecting this response because: only because  though it does seem all paper work is now in order they in their response seem to indicate that the only issue was with the vin number being wrong the real problem came when it took 7 requests to get this fixed  phone calld did not help faxed information including the copy of the title was sent and yet they kept sending incorrect information.Seems to me others need to know they simply did not care they were holding up my sales transaction and putting me at risk

Ditech unscrupulous act is disturbing in that they have not employed their own
policies to establish my loan modification Trail Payment Paln
Let me start out
by noting, it was under Ditech writings in the contract the set forth payments
and dates of my trail payAs the monies were received on time for the months
in question, it was never disclosed I
would need to make a full payment during
the trail pay whereas it was required to count to process the loan's postings, for the months in question. This was not listed in the written agreement,
upon accepting the trail pay but instead omitted by Ditech. However, I had made an inquiry to my
representative Ms[redacted] in June in which she mentioned "if I
initiated any further payment I would then be disqualified from the loan
modification programGiven the opportunity I would have provided the
shortage. Seems to me this act is orchestrated
in terms of a catch 22, under these circumstance Ditech has used. But looking back now MsKelsey
[redacted] has been deceitful with me
before by making me supply doctor's certification of disability to disclose my
health concernDitech failed to initiate the propose amount that would
eliminate this mishap, but made a way to blemish my record during this business
transaction
It is unsettling
knowingly, I made timely payments under a contract to then be subjected to
postings that result to a blemish on my Ditech account, as a result of the lack
of communication to sustain accurate posting, Therefore as It would be
consistence with the non-late fees charged publication listed under this modification
However, the standards implied on my account are posted in the negtiveAs it
does not reflect the definition of late charge which incurs a mandatory late
feeThis language was not encouraged
during my efforts to qualify but instead I was penalized. The contiguity of this act does not employ the
behavior of postings established for a loan modification written in the
contract. This backwards behavior represents
a long time effect of sabotaging and penalizing my account to incorporate their
scam to generate capital off my funds
Secondly, I find
it rather particular my bankruptcy filed in September 2010, than transposed to
the discharge status in October 2011, would move Ditech in January to implement
a write off on my credit status reportAfter
six years of consecutive postings find it deem necessary to change and omit my
business activities with DitechThis completely promotes poor business
practices and unethical behavior in handling my fileThis horrendous act calls
for further investigation, surely this
is not Ditech's first occurrence in
demonstrating their pitfalls while handling my account unprofessional, but instead, in a reply will label it is as an isolated case ( as in my
past disputes)They have still continued to impede at each stage on my account
with errors
Surely, my
mortgage was exhibited to the credit bureau by Ditech since the date of
transfer listed aboveThey are alleging an affirmation needs to be in
place. But furthermore, Detach would
need to justify all previous writing to the credit bureau of these prior posting
set forth from there onAnd suddenly out of the blue after three approved consecutive
modification since the purchase, Ditach this
flaw have been presentedDitech has in adversely chosen to stop reporting to Transunion,
Equifax, and Experian report my payment history. After six year Ditech has decided to remove
these writings from my account when I have filed and approved for several
modifications within the time frame described above
Clearly, the readings
have always been vivid on my credit report upon and after the purchase,
transfer and/or trade of my mortgage loan by Ditech, since May until
January Nonetheless with this knowledge Ditech still displays their underhanded
practices to bring forth my application to initiate a loan modificationWith that said there would be no reason for me
to contact my attorney regarding the reaffirmation for this loan in the matter
of Ditech trying to build and get it right.The attach copy shows Green Tree had been established on my credit report the whole time I was in bankuucy and discharge, Ditech has a tendency to make up rules as they go along and I have been victimized numerously by their pattern in the past and it still continues todayIt leaves me without an open door to terminate our business relationship unless with penalty

I am rejecting this response because: in April 2016, according to the contract I paid $2,220.00 because that was the month my new payment came effective.The dispute all along was that I was short for the month of March 2016; however for the month of March my payments was stil $1,93205 per the HAMP agreement, which I paid.In Feb. 2017 I received a bill from Ditech stating my escrow overage for the year was $898 and they wanted to divide it up over a 12 month period.  I placed a call to Ditech to let them know I would pay in full; however it was mailed after March 1st 2016.   Nevertheless it was paid in full and Ditech determined the amount.If my mortgage was $1932.05 for March in 2016 and you divide that by 12 months the money in the suspense fund would be more than enough; however the records will show I paid in full.  When they paid my escrow on 4/4/16' I had more than enough left over.Maybe they can re-do their calculations and explain how they came up with me owing $2.220 for March.  In addition, the records will show I paid the full amount in April.I am requesting that Ditech clear this matter up, re-do their math and take the negative amount off of my credit report.  The $2.155.00 in my suspense fund will more than cover the March mortgage and any overage for property tax.  Please review the escrow records attached.I will also scan you a copy of the most recent letter they sent me and I would like you to compare, and let me know if their figures are calculated correctly, and  if the letter match the response they gave.If I can pay my own escrow directly effective April 2017 I would like to do so because I would just pay the amount actually due by 12/10/17 and in April 2018 and this will eliminate any future problems width Ditech.Thank you for your attention to my request, and I will scan the letter from my home computer because I am on my iPad.Sincerely,[redacted]

I am rejecting this response because on 7/7/16 at 2:30pmET, I called the number provided (###-###-####), asked to speak to either Diesha W. or Bradley L. (the contact who were provided), neither were available nor could I leave a voicemail for either one. The customer service representative I spoke with said that she would e-mail Bradley and have him call me back. It is now 11/11/16 at 3:14pmET and I have not received any call back.

following response is provided.         On June 11, 2015, our third party vendor, CoreLogic, verified with Franklin county website the parcel number [redacted] was correct for the property address of [redacted] Columbus, OH 43229. It was then determined that due to a pending apportionment, we were unable to disburse tax payment from the escrow account, and Mr. [redacted] was notified that the 2015 taxes had become the homeowner's responsibility until a corrected legal description was submitted. Records indicate that a payment for property taxes due was disbursed to Mr. [redacted] on June 15, 2015, in the amount of $1,470.60. Please note, our records indicate that a corrected property description was never submitted. Pursuant to the correspondence received, the parcel number [redacted] was verified for the property located at [redacted] The property taxes due were confirmed and payment for parcel number [redacted] was disbursed to Franklin County on April 7, 2016. Please be assured that any penalties and/or interest charges that may have resulted from the delay in payment will not be assessed to escrow and will paid by Ditech. On June 13, 2013, proceeds from the sale were applied to the account. The remaining balance of the loan was transferred back to the loan investor, Fannie Mae.On April 1, 2016, Ditech completed an internal system upgrade to enhance and expand our services. We recently became aware of a credit reporting error in which a duplicate tradeline was indicated as a result of the system upgrade. We have quickly identified all affected accounts and have been working diligently to correct the issue. On July 7, 2016, Ditech submitted the updated information to the major credit reporting agencies (Equifax, Experian, Innovis, and Trans Union) to correct the double reporting issue. June 17, 2016, Mr. [redacted] called and spoke with Customer Service Supervisor Marcia R. who contacted our Escrow Department and requested to know the status of Mr. [redacted]'s request to cancel PMI. However, Marcia R. was advised that Mr. [redacted]'s request to cancel his Private Mortgage Insurance (PMI) was not received. Our Escrow Department advised Marcia R. that in order to review the account for cancellation of PMI Mr. [redacted] would need to send a signed request with authorization for Ditech to obtain a current appraisal and assess the cost of the appraisal to Mr. [redacted]'s account. In addition, if the appraisal value came back at $60,066.00 the PMI would be cancelled. On June 30, 2016, Marcia R. called Mr. [redacted] and left him a voicemail advising what she was told by our Escrow Department. We apologize if Mr. [redacted] did not receive Marcia R.'s message. Please be advised that Mr. [redacted] did not receive a letter denying his request for cancellation of PMI as we never received a signed request from Mr. [redacted] requesting cancellation of PMI. Mr. [redacted] may submit a signed request to cancel the PMI to the below address or fax number. As previously stated the request must contain authorization for us to obtain a current appraisal and assess the cost of the appraisal to Mr. [redacted]'s account. After several phone calls. Ditech was still unable to tell us why the bank draft had been cancelled and unclear on the balance of our loan.  They kept us confused and anxious about the status of our mortgage which was paid in full at this time.  This should never have been reported to the credit bureaus and Ditech should act quickly to remove that from my credit history.  They told me they would not remove it.

I am rejecting this response because: 10 calendar days does not give enough time to make sure that all credit bureaus have been updated to show NO late payments on my loan. I would like 30 business days to check my credit reports.

I am rejecting this response because:
The fact is that the DITECH corrected the problem, almost 2 months after the payment was sent and received by them.  During that time I received numerous phone calls, two or three times a day for three weeks straight from Ditech, demanding that I pay again.  One agent even lied to me that the payment was returned to me.  Then I started receiving letter two a day informing that the house was going to foreclosure.  Finally, after I files numerous complaints, DITECH decided to correct the problem.  NOT ONCE did DITECH apologized for this.  This is not how a mortgage company should treat customers.  This should be criminal act and I'm waiting for class action lawsuit to join.  This appears like a tactic DITECH tried to employ to force home owners into foreclosure.  Refusing to posts payment, demanding same payment twice, lying to customers, assessing late fees.  THIS IS CRIMINAL and not one apology!

regarding his account with Ditech Financial LLC ("Ditech").
Enclosed is a copy of the FNMA MI Annual Disclosure Notice dated January 1, 2016, which advised [redacted] of his rights to cancel or terminate the private mortgage insurance (PMI). The PMI is scheduled for automatic termination when the loan reached 78% of the original payment terms not property value. The automatic termination date is scheduled for April 2017. We can review the request to cancel the PMI prior to the automatic termination date; however, certain requirements need to be met as indicated in the FNMA MI Annual Disclosure Notice. Records reflect we previously reviewed the request to cancel the PMI and the request was denied because the value of the property declined below its original value. A copy of the denial notice dated February 28, 2014, is enclosed.
To review the request to cancel the PMI prior to the automatic termination date, we will require a signed letter of authorization giving us permission to obtain a current appraisal and assess the cost of the appraisal to the account. In addition, the loan-to-value needs to be at 80% and the appraisal value at $20,412.00 in order for the PMI to be removed.

for the April 01, 2016 due date had not been applied to her account. Account records indicate that Ms. [redacted] payment of $855.85 was received on April 06, 2016 and inadvertently posted to an incorrect account number. Due to our system upgrade in April some of our internal processes, including reallocations were delayed. On August 18, 2016, the referenced payment correctly posted to Ms. [redacted] account. The transaction was backdated to April 06, 2016 to ensure proper credit to her account. A late fee of $42.79, assessed as a result of the misapplied payment, has been waived. In addition, we did not report the April payment as delinquent to the credit reporting agencies. We apologize for the inconvenience this matter has caused Ms. [redacted]. The reallocation completed for Ms. [redacted] account caused a system-generated letter to be mailed advising that Ms. [redacted] could cure the default on her account for $0.00. This letter was generated in error and we apologize for any confusion it may have caused. Please be advised, while the reallocation was in process we were unable to provide a payoff for Ms. [redacted] account. However, a payoff quote good through September 13, 2016 was mailed to Ms. [redacted] on August 30, 2016. A copy of the payoff quote has been enclosed for your reference. After reviewing Ms. [redacted]'s account, records indicate a Solicitation Letter was mailed on...

05/27/2015, which requested that she contact Ditech for any Loss Mitigation options that may be available. In addition, a second Solicitation Letter was mailed on 06/03/2015, which included a Loss Mitigation Package to be fully completed along with a list of required documents needed in order to evaluate the account for a modification.
It has been identified that a Borrower Response Package was received on 06/12/2015. The Uniform Borrower Response Form received reflected that food stamps and child support are Ms. [redacted]'s only source of income. On page 2 of the form, it lists all the required information needed to verify this income. Upon review, it was identified that the loss mitigation application was incomplete. On 06/15/2015, an Incomplete Information Notice was mailed to Ms. [redacted] which requested that she submit the information listed below by no later than 07/15/2015:

A cease and desist was in effect on the account; therefore, we were unable to make any contact attempts via telephone calls to collect the missing information. Our records show that information was received on 06/25/2015, 06/29/2015, 06/30/2015 and 07/06/2015, but upon review it was determined that the child support income was still incomplete. In addition, the IRS 4506T form and the 2014 Tax Return reflects self-employed income. Therefore, a second Incomplete Information Notice was mailed to Ms. [redacted] on 07/23/2015, that requested a quarterly or year to date profit and loss statement by no later than 08/22/2015.
Our records reflect information was received on 07/24/2015, 08/07/2015 and 08/21/2015, but upon review it was determined that the profit and loss income was still incomplete. Please note that the listed business expenses are considered personal expenses. Per investor guidelines, a profit and loss expense must be a valid business expense. Additionally, records reflect that no other information was received in regards to the child support income. Therefore, a third Incomplete Information Notice was mailed to Ms. [redacted] on 08/25/2015, which requested a child support agreement by no later than 09/24/2015.
A divorce decree was received on 08/31/2015 and 09/26/2015. However, the profit and loss statement was still incomplete. Because a complete loss mitigation application was not received, a Disengagement Letter was mailed to Ms. [redacted] on 11/11/2015 advising, "You have not provided us with all of the required information within the time frame requested." Based upon our findings, the payment assistance review was accurately declined.
It has been identified that an Incomplete Information Notice was mailed to Ms. [redacted] on 11/17/2015, which requested the information listed below by no later than 12/17/2015:

Thank you for the opportunity to respond to the complaint filed by [redacted] regarding an account with Ditech Financial, LLC ("Ditech").
It had been identified, that an Incomplete Information Notice was mailed to Ms. [redacted] on November 17, 2015 and on December 11, 2015. Both documents listed the required information needed in order to be reviewed for modification assistance. According to both documents, the items listed below are required by no later than 12/17/2015:
Most recent utility bill
Quarterly or year to date profit/loss statement
Child Support Agreement
Public Assistance
Our records reflect that no other information was received. Because a complete loss mitigation application was not received, a Disengagement Letter was mailed on December 23, 2013 advising, "You have not provided us with all of the required information within the time frame requested." Based upon our findings, the payment assistance review was accurately declined. Enclosed is a copy of the Incomplete Information Notice and Letter for your review.
Based on Ms. [redacted]'s correspondence request, Ditech has updated the mailing address to [redacted], Frisco TX., 75034. We believe this resolved all concerns that Ms. [redacted] has expressed to Ditech. If she has any additional questions or would like to reapply for modification assistance, she may contact her assigned Single Point of Contact, Camry R., at 1-800-[redacted] extension [redacted].

Our records indicate that we sent Ms. [redacted] a letter on May 18, 2017 advising that Ditech has no objection to her renting the property located at [redacted] Newport, OR 97365. However, renting the property does not release Ms. [redacted] from her obligation to repay the debt, nor does it...

change the original terms of the loan agreement. We apologize if Ms. [redacted] did not receive the referenced letter. A duplicate letter was mailed to Ms. [redacted] on June 12, 2017.

I am rejecting this response because:The company states that the account terms have been corrected.  This is NOT correct.  We are still unable to pay the full interest amount due on the account.  Ditech is not accepting the full amount and is instead crediting us with unapplied funds (second to last paragraph of their response).  The balance of the full amount due is being taken from our principal, instead of our payments.  Since Ditech acquired our loan (they own Residential Credit Solutions, the previous owner of the loan), our principal amount due has steadily increased because Ditech has not applied our payments correctly.  I have called, emailed, faxed, and otherwise communicated with Ditech numerous times since April 2016 and they have still not corrected this situation.  This must be corrected as soon as possible.
