Negligent and Fraudulent sales practices and customer service by realtor representing Domain Realty and Sellers agency - Jack *** Real Estate
In August of 2017, I enlisted the services of Derick *** a realtor with Domain Realty Group in Bonita Springs after being passed *** to him via another agent at his company. We previewed several houses which I requested to see and in the end were convinced by him to take a look at one which was not on our list and was also over our budget.
After showing us several similar homes in the same community, we were convinced this was the best one and that the higher price was justified by some of its features, one of which being the HEATED pool.
Unfortunately, a series of events have occurred which have left us in awe at the entire situation and disappointed in the quality of service realtors are apparently able to get by with. What has occurred will now also cost us over $5000. The realtor representing the Sellers, Jack *** of Mancini Realty, is also a participant of this fraud/negligence.
We wanted a heated pool if there was going to be a pool at all, which was absolutely imperative, because we have a 2 year old daughter, who will not go in the cold water. We are first time homebuyers in a sense that although we owned a small home in Pennsylvania, it was a much smaller purchase and was a condo with much less to worry about. We also made sure that Derick *** knew that we were very green at this as was clear in our questions asked.
After deciding on our house which was clearly advertised in all online listings and the official MLS report provided to us by Derick and Domain Realty as having a '...heated pool,' I followed up with Derick and asked him to confirm this and find out the condition of the heater. He said he will find out and then said the Sellers disclosure would tell us the condition. The sellers disclosure was not even filled out entirely. He then told us to wait until inspection. He was not present at the inspection other than to meet the inspector for a minute and advised that I at least be there for part of it. I was present for 1.5 hours of it, at which time the pool had not been inspected. When we got the reports back, there was nothing about the pool heater in it. Being new to this, we did not realize that this could mean there was not a heater present at all.
Upon closing, Derick told us we had to close at the end of the day because the sellers were not going to be ready until then. He told us we needed to do the walk through AFTER the closing in order for the paperwork to be able to be processed that business day. Little did we know that we were about to walk through a disaster. The sellers were frantically throwing their belongings into the back of trucks. Their pods were still in the driveway (until a day after closing and in the way of our moving truck), many bags of trash were lining the side of the garage (until we demanded that they were removed 2 days later), and the house was very dirty and marked up everywhere from the move. It was not in the condition we had seen it in before. In addition to all of this, the repairs which were supposed to be taken care of after the hurricane were not done. Derick poorly advised us to take a measly $1000 in escrow and give them 10 days to fix everything. He assured us it would be fine. Of course, the 10 days passed *** the agreed upon repairs were not entirely taken care of.
After we moved in and were ready to go swimming, I went outside to look for how to turn on the heater only to find out that there WAS NO HEATER! Being inexperienced with pools, I thought maybe it was built in somewhere. I had a pool repairman come to give us an estimate for cleaning services and asked him to verify where it was. To my surprise, he said there was definitely no pool heater. The selling broker advertised the house for sale with a heated pool. It was not that a simple box had been checked, it was clearly written in the description. Desired Outcome

Repayment for the purchase and installation of a pool heater which was supposed to already be there and we would like to stop these realtors from providing such poor service to their clients in the future.

I was contacted briefly by the agency and they said they wanted to make it right and would be in touch with me again, but they never called me again. The issue has not been resolved and I do not believe they are going to do anything to fix it. I would appreciate it if the Revdex.com files this complaint and makes it visible online in order for others to be warned.
