Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below Regards, [redacted] In response to: [redacted] came in and was attempting to finance a Hummer Hfrom the East County PreOwned Superstore on or about 03-17-A Hummer vehicle is not accepted by most banks for financing so getting [redacted] financed was more difficult than expectedOnce we had exhausted the few banks that would accept the financial obligations, we had asked [redacted] to return to the dealershipAfter being stood up we had no choice but to have the vehicle in question returned as we had no way to obtain financing for [redacted] in a Hummer vehicleOnce it was apparent he was not going to return the vehicle, the dealership was left with no other choice but to have the vehicle picked up by a licensed company in where they specialize in returning vehicle to the banks or dealerships to whom they belongThe problem here is I was asked to come in to the dealership on two occasions one was to sign additional documents to further there chances of obtaining financing, the second time I was asked to come in by Mr ***.I was given the impression that it was to resign our contract I then sent a e-mail to [redacted] there finace manager stating that I will not be coming in to resign any contract, I understand that we have had a contract that gives them days right to cancel, this day right had expired Still they had had the H improperly repossessed I did not receive a phone call and the letter I received for this action was not received till the 2nd day after, to which is in violation of the terms of our agreement This does not come free of charge and per California DMV regulated law, the only portion of the down payment that was not returned to [redacted] was the exact amount that was spent in the return of the Hummer and the charge for removing the aftermarket stereo he had installed, bringing the Hummer back to factory specifications [redacted] did return the factory radio and the third row but the running boards are no longer on the vehicleThe dealership has decided to cut its losses and leave this matter as it isIn [redacted] ***'s original response complaint to the Revdex.com he mentions that he makes a habit of recording conversations that are otherwise privateIf you would advise and pass along that he should be aware of CalPenal Code § It may be in violation to recrd a phone call per PC sited, but it is not illegal to video in a public place It may or may not be admissible butI had felt it was worth mentioning given the honesty this dealership lacks

I have looked up the deal where the customer purchased the Fback 5-29-I have ran three reports as of today and they show nothing to report***see attached [redacted] To first answer the first statement, They were purchasing a fleet vehicleWe do not sell fleet vehicles so this statement gets a little confusingThen she claims that this vehicle was a flooded vehicleFor that to have been possible, an insurance company would have to be involved and by law they report all findingsAs you can clearly see in all three reports, this vehicle was serviced at Perry Ford every three thousand miles with only maintenance reportedIf there were anything to be listed, then you would have seen it on the Carfax, Autocheck or the NMVTISIt has been over a year and we have not spoken to this customer for any of the claims madeIf you are so unhappy with claims of being sold a Flood vehicle, why would you return? I am not sure what to say but I do not think the claims are fully factual Thank you ***

We have spoken to [redacted] multiple times with her about her vehicleIn our initial conversation she was less than happy with regards to a sales manager and a salesmanI assured her that I would address this issue that day once I arrived at workI did that very thing right awayHer last request was of a secondary keyI have checked with our service department and asked them to make arrangements to have this secondary key madePer her statements of the dealerships lack of servicing, especially with regards to safety and brake systems, I had our records pulled for this vehicle to verify her claimsNot only are these brakes good, they are factory replaced brand newIt is sad when customers think that they can bluntly lie about the experiences they have had just to be able to have others listen to themWe will honor the secondary key to be completed as a customer serviceIf you have any further questions, please feel free to contact me via email at [redacted] can reach our service manager to make arrangements for this secondary key by calling [redacted] [redacted] (GM)

I remember [redacted] very wellShe purchased a Jeep Grand Cherokee with 65k miles on 12-10-She wanted to make sure that the vehicle she had purchased had Bluetooth (hands free phone option)She came to service about a week after her purchase asking how to use the BluetoothShe met with [redacted] (Service Manager) and Myself (General Manager) and we informed her that the vehicle does in fact have Bluetooth, but as with all Jeep products you must subscribe to the U-connect serviceWhen you purchase Jeep product brand new from the factory they provide a one year subscription for free to get you used to how it works She refused to do this so I called a stereo installation service shop and inquired about and aftermarket Bluetooth unit that would not have a service fee attached to itAs a customer service and to try to assist in making her a happy customer, I offered to cover $of this aftermarket Bluetooth deviceShe refused my offer and said we should pay for the whole installationI am sorry that she did not accept my offer but the fact remains, she has the requested Bluetooth already in her vehicleIf there are any further questions, please feel free to contact meI will still leave my offer on the table until 4-6-if [redacted] decides to accept our offer [redacted]

*** and *** purchased two vehicles from the East County PreOwned Superstore in April of On their way home the customers found thatthere was a light on the dashboardthat they were unfamiliar withThey immediately called the salesman that had sold them the vehicles and asked for
his
adviceOnce they had describedthe shape of the symbol that was illuminated,he was able to explain to them that it was the Tire PressureSystem and it was showinga faultThe system was reading a or loss of signal from one of the tire pressure sensorson the vehicleThey were instructed to contact*** (Service Manager)to set an appointmentThis was just after a tent sale weekend in where the store had just sold over vehiclesThis is why the customersare instructed to contactservice and set an appointment sothat they are able to be addressedas soon as they arrive.Once they had contacted *** and set an appointment to bring in the vehicle,they also mentioned that the vehicle had a noise coming from the front endThe vehicle in question was under the current full factory warranty and it was a simple part replacementWhen the vehicle is being serviced,if the fault does not occur, then the servicedepartment will not addressitas they were unaware of the problemThe component must fail during inspection for them to replace itOnce the customers brought thevehicle in to be serviced, they asked to see the managerThey were introduced to *** (General
Manager) and were stating that they just didn't want the vehicle anymoreDuring the sales processthey were given a very low rate of interest, but still wantedto contact theirown credit union to try to get an even lower rate of interest
This is known as an "Option Contract" in where the dealership will postpone the funding of the contract
for a few days to allow the customers to go to their own bank of choiceIf they are unable to beat the rate of interest or no longer wish to use their own bank, then the dealership would then just cash the contract with the original bank at the contracted rate of interestThis if fully optional and is done as a
courtesy for the customerAll contracts used in the State of California are "Simple Interest" and can be paid off at any time with no penalties
or additional fees, so if even they were unableto secure the lower rateif interest right away,they could stilldo this at a later date and just transferthe loan to their own bankThe customer wanted to just return the vehicle and hand the keys backThey said they would not give us the check from their bank to pay for the vehicle.So it was again explainedto them that in California there is "NoCooling Off Period" which means that you are not allowed to just "return" a vehicle because you simplychange your mindThere is a new legal
form that is required by the State of California that allows customersto purchase an option to return a vehiclewithin a time and mileage restrictionThis form was filled out by *** and *** Wilson, and that option wasdeclinedThe customers were referencing that the Genera! rv'!anager vJas talking about his nevv' 65k Lexus, and had no interest in what they were saying
The fact of that matter isas followsI am the General Managerand I did just purchasea brand new Lexus from El Cajon LexusI had explainedto the customer that I had the vehicle for less than miles and I have already had a failurewith the Navigation system and the Backup Camera systemI was trying to explain that even brand new cars can have problems,but if the dealership that sold it was repairing the vehicle with no charge to the customer,then the problem
was just a minor inconvenience andnot out of the ordinaryItwas also mentioned that it was a goodthing that the problem had occurred rightaway and not months down the line becausethe vehicle has a day or mile Buyers GuideWarranty thatwould cover certainfailures if they happened right awayHowever,if it were months later, the coverage would have
expiredSo it was a good thingthat this had happened right awayThe East CountyPreOwned Superstore has an onsiteservice department and is contracted with many 3rd party service shops,so that we may be able to assist our customers to the best of our abilitiesIn this case,the customers' problems were addressedright away and with no additional chargesThey were even given a ride home and arrangements were made to have the shuttled back once the repairswere completed.Thank you

I am absolutely fine with the SERVICE DEPT, after receiving my spare tire, and jack yesterday, but I still have not received a resolution (from the finance dept.) for the $they charged me for something I had repeatedly said I did not want, and was assured would be refunded when they received the funds from my credit unionBUYER BEWARE

Having the money refunded would resolve things, but I have no faith that it will get done if I accept the offerThe payment that they claim to be sending is still MIAThis will be the 4th time that these people will have "lost" our checkOn the second matter regarding the tracar I'm going to go ahead and assume that, since it was all but stolen under the table, there probably wouldn't be a paper trail with the fake offer*** told us the dealership would only offer us $for our 'Ford Focus & that we would be better off selling to him personally for $He wrote us a check for $because he 'cut us such a deal'It was later learned that my car would have been worth $at any real business

I have replied directly to the consumer and have asked to have a time set up where we can get together face to face and discuss these mattersWe are trying to work with her but I have not been able to get a responseIf there is a way we can get together with the Revdex.com office and have a sit down, please let us knowI have been able to show the consumer that there was no safety issue, as the original complaint stated, once I let her know that the brakes were all brand newThe complaint changed to the dealership being able to get her deal financed without a pay-stub or verifying with her about her jobNot all banks or deals need all the extra paperwork to get funded, so I am not sure why this was even mentioned. We always try to work with each customer in the best way possibleI remember this deal very clearly, so I will be able to give many details to respond properlyThe day this customer came in she was looking around and she took an extended test drive with the salesman in such a way, we had to call
him to make sure he was still with herI looked into the deal to verify the discount she mentionedI do see that the internet listed and advertised price was $more than what she paid on her contractAfter this deal was made, a week later the customer came back to the office complaining that the breaks were all badWanting to verify this potential safety problem, we took the vehicle back to service to have it inspectedThe breaks were not only good, they were newSo then she said that she only wanted a cylinder SUV vehicleWe tried to assist her with her request but all three vehicles she test drove were four cylinders and of them were cars, just like the one she purchasedThe two trades she used as down payment were recently purchased from a public auctionThis is where our "paperwork" problem existThe finance person kept the copies and accidentally gave the originals to the customerNot only did we give the customer what she wanted for the trade vehicles, we gave her more then she had just paid for them at this public auctionIf she can bring in cash for the amounts listed for both trade vehicle, we would be more than happy to allow her to buy them both back for what we gave herWe have been in contact with her about the paperwork mistake and have offered to go to where she is located to make this easyNow she refuses our phone calls

[For this man *** to say that I bluntly lied, is exactly why I regret, and no longer want to do business with them. I called and spoke to him once. He never returned my call till this day! We never talked on numerous occasions. I have been trying to speak to someone, with no luck. The sales man ***, and ** are the worst, ** threatened me, that if I didn't sight the paper work for a car that was in the shop, I would not be able to purchase it later. *** told me to get a life, and hung up on me. When I called the office to speak to the owner Tony I was transferred to **, who pretended to be the owner. When I mentioned I knew this was **, he quickly either tried to transfer meor just hung up on me. Then I finally call ***, *** the owners secretary, she is yelling at me about how does she know what I'm saying is true. I tell her because I'm telling you. then she goes on to promise me she will call me back by the end of the day. to this day I have not heard from her. This company approved me for a 26,dollar loan with no paycheck stubs, or verify my employment. I wish I would of read all the negative comments on your site before doing any business with this company. They got paid for the car alreadyand washed their hands, like they have done to so many other people. I know they are avoiding me, so they don't have to honor the day warranty. You would think if the owner, or this *** who is in charge would contact me, if they cared about their business reputation. Noone from there side has ever contacted me.. I have always been the one to try to contact them with no success, just the run around, hang ups, and broken promises,

I have looked into this deal to find out what the claims areFirst to address the $3,refund to the bankThe customer canceled the Gap Insurance ($500.00) and the Extended Service Contract ($2,500.00), totaling $3,the check was written and sent to the bank (*** ***) and after
days they had not cashed the checkThe dealership placed a stop payment on that check and reissued a replacement the same dayThe day after the bank cashed the check which was already stopped so obviously the check did not go throughThe second check has not yet been cashedEither way this will shortly be resolved as we also bank with Wells Fargo bankThe second issue is more difficultThe claim of paying less for a trade vehicleI had to pull the original paperwork to verify the claim of low payment value of a travehicleThere was no trade vehicle on the 4-square paperwork at all(this is the document used by all dealers to work vehicle deals with the customers) If there was a trade vehicle, it would have shown up here as we would have listed its value on the 4-square and if the customer was not happy with the value listed then they would have removed the trade from the transactionI can not verify any preexistence to there ever being a vehicle offered to be traded inI hope this was able to clear up any misunderstandings about this transaction.If there are further questions, please feel free to contact me directly at *** *** (General Manager East County PreOwned Superstore)

We will be moving forward with legal action against this company The General Manager failed to state it took them almost a week to replace a "simple" part; this is AFTER we were initially told by their service person *** that he was "too busy" *** supposedly "fixed" the problem with the vehicle only to find out the problem was NOT fixed, the part he was waiting for was NOT new, AND to make things even crazier, he DISABLED the tire pressure system so it wouldn't read - we went to independent Ford Dealerships to confirm this THAT IS ILLEGAL AND A SAFETY HAZARD TO MYSELF AND MY FAMILY The extended warranty we purchased, guess what?, doesn't cover these issuesAfter making a recent inquiry into registration issues which we were also lied to about, I was given the pleasure of finding out that my vehicle was a "repossessed" vehicle and they "legally did not have to tell me that." WowWe have requested a cancellation of the extended warranty policy which was personally taken to the dealership today, and since this company won't take back this piece of garbage they sold us, as they should We will be moving to the next level

I am unsure how there was any confusion on the purchase of the extended service contract, tax and licenseThe East County PreOwned Superstore has been at the same location for about yearsThe only time that there would be no tax and license to be charged would be if the vehicle were being
shipped out of state or if the customer was a native American living on the reservation with the consent of the tribal counsel members for the tax exemptionAs far as the extended service contract, that is a additional product that is purchased in finance from a 3rd party company and there is no way the dealer could "throw it in"And there is also no way to not know about the extra product and the charge as there are separate documents that must be signed by the customer to let them know about additional product and its costI can understand that there would be some frustration having a problem so soon, but in a used vehicle there is no clock that states the vehicle will or will not break at a certain timeI would ask if the customer has contacted our service managerIf not, please contact *** at 877-958-7563.In the complaint the customer also never specified what the exact problems wereCould we get that information as well?

For the customers satisfaction and the ability to be driving a car for financing, we are pleased to hear that she was able to find a vehicle to suit her needsCarmax is a large company and has their own bank for financing their own vehicles at higher rates for challenged creditThat does not change our abilities nor lack of abilities to secure financing for herIt sounds like the customer has what she wanted and seemed to already have had it lined up but just wanted to look around for a better dealSince there wasn't a better deal out there, it is good that she was able to go back and secure the vehicle
