Response:

eCAST Settlement Corporation, a subsidiary of JPMorgan Chase & Co., is in the business of purchasing accounts from credit card and other companies where the debtor has filed for protection in federal bankruptcy courts. We have not issued a 1099 in the name of [redacted]. We do not show any accounts where [redacted] is listed as a responsible debtor for an account. Information on any account can only be released to the responsible party on the account or to an authorized representative of the debtor. If [redacted] is inquiring about another account as an authorized representative, we would be pleased to furnish her any information in our possession related to such account upon receipt of evidence of her authorization to act as representative.

Review: On July **, 2014, I received a notice from the IRS stating that there are proposed changes to my 2012 taxes. I was informed by the IRS that this is due to a "Cancellation of Debt" from a company called ECAST Settlement Corporation. ECAST Settlement Corporation filed a 1099-C with the IRS. There was not a contact phone number for ECAST Settlement on the IRS notice, so I contacted the IRS to see if they had more detailed contact information, but they do not. All the IRS has on file for them is an address. The address that the IRS has listed is [redacted]. That business address is registered to [redacted]. I have contacted [redacted], and they are no way affiliated with ECAST Settlement Corporation, nor have I ever had an account with [redacted] or any of their affiliates. ECAST settlement corporation claims that my cancellation of debt is totaling $2,672.Desired Settlement: As a consumer, ECAST Settlement Corporation has a legal and moral obligation to properly notify individuals before filing the 1099-C form. I am alarmed that they are able to do this without informing consumers. I want ECAST Settlement Corporation to send me detailed information explaining what company or business that they are representing that is claiming my indebtedness, along with the amounts owed and corresponding dates.

Response:

This is in response to the Revdex.com complaint requesting information about the IRS 1099-C Forms issued to [redacted] on an accounts owned by eCAST Settlement Corporation (“eCAST”). Please be advised the accounts for which eCAST issued, or caused to be issued, a 1099-C were consumer credit accounts which eCAST purchased from Capital One in July 2008. The accounts were filed in bankruptcy case number [redacted] which dismissed September [redacted], 2009.

According to its records, eCAST received no payments on the accounts and did not charge any interest or fees. eCAST ceased pursuing collections on these accounts. In accordance with tax reporting obligations under Section 6050P of the Internal Revenue Code, eCAST issued the required 1099-C Forms to [redacted] and to the Internal Revenue Service. Please be advised eCAST is not pursuing collection of this debt. The Form 1099-C is a tax information report only.

eCAST will not publicly furnish sensitive personal information on the Revdex.com website. We have sent a more detailed response to [redacted] at her listed address.

Thank you,

Response:

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

[Your Answer Here]

ECAST corporation has never notified me of their intent to purchase my account from Capitol One, nor did they ever send me a 1099-C form. I still believe that their methods are fraudulent, especially given the time parameters. ECAST claims to have purchased my account from Capitol One in 2008, but yet they did not file it with the IRS until 2012. I am still arguing that ECAST did not notify me at any point in this process.

In order for the Revdex.com to appropriately process your response, you MUST answer the question above.

Sincerely,

Business

Response:

[redacted] has expressed two issues in this complaint. The first being that eCAST never provided notification of our intent to purchase the account from Capital One. Please be advised that the accounts were brought during [redacted]’s Chapter 13 bankruptcy. eCAST filed or caused to be filed proofs of claim with the court. These documents are publicly available online through PACER via the case’s Claim Register.

Regarding the second issue please note that at the time of mailing the copies of IRS Form 1099-C, eCAST used the most recent address listed in our records, which is now understood to be out of date. Please note that we will send copies of the IRS Form 1099-C to [redacted]’s updated address. Furthermore we abandoned collections on the accounts and we are required by law to meet certain tax reporting obligations under the IRS code. By making the 1099C filings in question eCAST met its obligation to the IRS. We consider this matter to be closed. Should [redacted] have any further inquires, she may contact our attorneys [redacted] at ###-###-####.

Review: I received a notice from the IRS that they received a Form 1099-C from Ecast Settlement Corporation, dated 8/**/11, and that I owe $885 to the IRS for 2011, for a cancellation of debt. I have received nothing from Ecast, don't know what this is for, and have gone back and looked at my credit reports for the last few years and nothing with this account number or amount shows up. I have no idea what this is for, and now supposedly owe the IRS because the amount of $5941 is considered income since the debt was cancelled. I am retired, live on a fixed income and cannot afford this.Desired Settlement: I want an explanation of what this is, because no matter what I say, the IRS will hound me on this till the day I die. They found me, why did I not receive a notice from Ecast?

Review: I received a notice from the IRS dated June **, 2014 for tax year 2012 in which this company reported on a 1099-C dated 06/**/2012 in the amount of 3,941.00 however, I did not receive a 1099 from them and I have credit reports from 2010 and from December 2011 in which no such charge can be found. I am indicating that I disagree with this charge on the forms the IRS has sent to me.Desired Settlement: If this company stands firm in that the information provided to the IRS is accurate, I would like an itemized statement of charges along with a 1099-C. I have combed through all of mhy records and I cannot find that amount anywhere on any statement from the 3 credit bureaus.
