Dear [redacted],Please note that the Educational Funding Company made a very sincere and an honest attempt to resolve the pending issue between [redacted] & the [redacted] Boxing Academy so far. This is in spite of the fact that the school is no longer an active client of Educational Funding Company (meaning any monies refunded comes out of EFC's pocket)However it is apparent [redacted] intentions are somewhat differs from ours. One example is - it was conveniently ignored that even if we were to consider receiving that cancellation request on May 03rd, the contract clearly states a 30 day cancellation policy for ANY reason. The list can continue.Please note that we are just a third party billing company and all monies collected on behalf of the school from students shall be transferred to the respective school every month. However at this point in time, EFC is not in position to pursue this matter any further with a sincere hope of resolving the issue fairly and reasonably to all parties concerned.Therefore we shall be closing this case administratively at our end and allow [redacted] to pursue his demands and litigation threats with the school in concern.Thank you for your understanding and cooperation in this regard.Susika D[redacted]

To whom it may concern, I am disputing the request, for the following reason there
were two accounts

For the account [redacted] there was two late fees add to
the payment of $15.00 each a total of $30.00. Here is the Math the class is $114.48
a month with a $15.00 late charge fee per month. So 114.48 + 15.00 = 129.48 +
129.48= 258.96
For the account [redacted] that bill came to be 235.83
The total came to 512.79 and please ensure that this issue
is not on my credit report at well. I have attached the billing and fax to the company.

In spite of clear factual explanations to [redacted]'s previous response, it is apparent that we are not in a position to amicably resolve this matter.
The Educational Funding Company clearly explained our offerings in this regard to resolve the matter and also conveyed the stand of [redacted]'s MA. Therefore we would like to state that EFC is neither authorized nor in a position to customize the exit clauses of a contract that [redacted] himself has signed to suit the "other" needs arose at a later stage for the same signee.
Moreover now that we have exhausted all Alternative Dispute Resolution methods available, please note that the [redacted]'s MA retain the right to escalate this to a civil matter to be litigated at the small claims courts and will do so if it deemed necessary.

At [redacted]’s, a student can cancel their contract if any of the following criteria is...

met. 
Within the first 2 days of signing. The contract agreement can be cancelled- no questions asked.
Medical notice- if it specifies that the student cannot train for 3 or more months- cancellation is immediate.
Move- if the student moves over 20 miles from the school’s location, they may cancel the agreement with proof of move with a 30-day notice payment.
If the student’s cancellation request does not fall under any of the aforementioned criteria, then they agree to cancel the contract by paying $199 plus 1-month’s tuition fee. 
In spite of [redacted]'s claim of "moving" more than stipulated distance from the school, the contract he signed proves that [redacted] in fact has been living at the address at the time of signing of the contract. Therefore [redacted] is not eligible to cancel his contract under point (3) above. (Please see attached copy of the signed contract).
Therefore [redacted]’s cancellation request fell under the 4th criteria. He was informed of this requirement, and that he had to be in good standing with his payments at the time of the request. However [redacted] was past due on 2 of his payments at the point of requesting cancellation. He was duly informed of all of this, however, refused to make any further payments because he had chosen not to attend the school and take classes. 
[redacted] considered he was not liable for those payments because he “chose” not to make use of the services rendered by the school per their contractual obligations. However the school firmly believes that [redacted] is legally obligated to make those payments since he needs to hold his end of the contract agreement. Hence the school is more than happy to cancel this account upon receipt of $616.00 (2 months past due @139.00 per month + cancellation fee of $199.00 + one month's notice @ $139.00).

I am rejecting this response because: I have read many cases which make it clear that EFC have more control over the contracts than they are acknowledging here, as in cases where they refuse to cancel contracts EVEN THOUGH the school is okay with it.
It is counterintuitive to hold us to ransom when we are unable to meet the demands, if there is no hope of resolving the issue, which there isn't while charges continue to mount, then there is little incentive to start paying towards it.
I gave two options which result in us being able to pay the balance and move on and that is being rejected, this is not of benefit to any party.
