I am writing this letter in response to case number: [redacted] complaint. I understand that the Revdex.com fairly reviews the situation from the consumer and merchant point of view to make a fair judgment.

The customer agreed to the following terms upon purchase by checking the box that states, “Yes, I am at least 18 years old and agree to the Terms and Conditions” (see attached pages). In addition to the terms and
conditions on the site, we ship the product with a copy of terms and conditions. Upon receipt customer has an opportunity to read the terms one more time before deciding to keep the product. The customer placed their
order on 09/22/2014 05:48pm to participate in our trial offer where she had 14 days from her order date to try our product. Customers are responsible for cancelling and returning the product within their trial period if they
wish not to be billed for the product already received. Per terms and conditions, Ms. [redacted] was billed $87.50 at the end of her trial period. Her trial expired on 10/05/14. Under normal circumstances, we allow customers to return
the products back postmarked 14 days within their trial period. We have cross checked with our returns department and the customer has yet to return the product. Unfortunately, with no product returned, we are unable to issue credit.
I understand the Complaint Involves: Billing or Collection Issues When placing her order, the customer checked “Yes, I am at least 18 years old and agree to the Terms and Conditions." Had the customer not checked the agreement box,
their order would have not been placed successfully. We show record of Ms. [redacted] contacting our call center on October 12, 2014. Please see below the notes taken from our CRM:When placing her order, Ms. [redacted] was redirected to our website where she inputted her personal information. In order to successfully place her order, Ms. [redacted] inputted her credit card information. Our terms
and conditions is located in multiple areas and also a hard copy was sent to Ms. [redacted].
Ms. [redacted] contacted our call center on October 12, 2014, about a week past her trial. Ms. [redacted] was explained how the charges came about and was offered multiple options to stay on recurring. She declined all the offers
and received confirmation her account has been closed.

Had Ms. [redacted] cancelled her recurring transactions within her 14 day trial period, we would have provided her a Return Merchandise Authorization number to include in the package when returning the remainder 50% of the product. Had she returned the product postmarked, her account would not have been charged further. No RMA number was ever authorized for Ms. [redacted]. No cancellation email was ever sent to Ms. [redacted] until 10/12/14, when receiving this complaint.
 
 
 
We have cancelled the customer's recurring subscription on 10/12/14 . They will no longer receive any products or charges from us. Again, the customer has yet to send the product back. We have positive AVS and tracking confirmation to the customer. To cancel recurring services, the customer had to notify us, the merchant, of the cancellation. The customer's cancellation email was sent on 10/12/14 per her request.

We have cross checked with our returns department and the customer has only returned one product within the return policy. We have attached a positive AVS record on file. Unfortunately, with no product returned, we are unable to issue credit. She never contacted our call center with any questions or concerns We have cancelled the customer's recurring subscription on 01/25/15 per her request . They will no longer receive any products or charges from us. We have positive AVS and tracking confirmation to the customer.   To this day, the customer still has possession of the other products sent. She returned the most recent product and was issued a full refund on 02/04/15. I thank you for your time in taking into consideration documents provided to help resolve this issue. We apologize for any inconvenience Ms. [redacted] is going through. We want to assure all of our valued customers that we are here to assist them with anything they might need.
 
I understand Ms. [redacted] was attempting to obtain an RMA to send the product back for a full refund. Since the customer was unhappy the first time our representative assisted her, to value her business, I have credited her in full of $87.50. Please allow 5-7 business days for her bank to process. The customer may keep the product so that she can actually see the benefits of the product. She is more than welcome to continue her purchases with us if the product is the right fit for her.

Had we received her return sooner, we would have issued her a refund.I understand the Complaint Involves: Refund or Exchange IssuesWhen placing her order, please notice the following paragraph on the same webpage where the customer inputted their credit card:Your credit card will be charged $2.95 for shipping and handling of a one month supply of Beaute MD Anti-Wrinkle Moisturizer. You will have 14 days since the order date to try Beaute MD and decide if it is right for you. If by the end of your trial you are enjoying Beaute MD, simply keep the jar and your credit card will be charged in the amount of $89.95 for the item received. To see full terms and conditions please click here. In addition to the statement above, the customer had to check the box where it states I am at least 18 years old and agree to the Terms and conditions.  Also, the customer was sent a hard copy of the terms and conditions so that when the customer received the product, she has another chance to read and understand our policy.We have cancelled the customer's recurring subscription on 02/02/15. They will no longer receive any products or charges from us. Again, we have yet to receive the product back. trial period. We have cross checked with our returns department and the cu has yet to return the product resulting in the trial
charge of $87.50.

We offer a FREE 14 day trial from their order date. Due to thousands of shipments being shipped every day, we are unable
to track when each customer receives their product. We allow customers to call in and request their trial period to be extended
depending on how long shipping took or if customers need extra time to try the product. 
Customers are responsible for contacting our call center to cancel prior to their trial ending to not be billed at the end of the trial.

I have attached screenshots of our order page where it states our terms and conditions and where the customer agreed to it.
In addition of our policy being on the order page, we also attach a hard copy of the terms on the OUTSIDE OF THE PACKAGE.
Customers have another chance to read and fully understand how the trial period works. If customers do not agree, they may
simply refuse/return to sender the package.  As a courtesy, the package will be sent back to us at NO COST TO THE CUSTOMER. 
I also understand that the customer claims she ordered a “sample.” Unfortunately, we do not offer any samples. Nowhere on our
website says “Sample.” We offer a trial period, which might confuse some customers.  The trial allows the customer to get the
product and try it out. Again, if they do not want to be billed, they are responsible for sending it back within trial. If they chose
to keep the product, customers do nothing and at the end of their trial, they are billed for the PRODUCT ALREADY RECEIVED.
The trial products we ship to customers are actually 30-day supply. We ship 30-day supplies so that customers that chose to
continue with our product have no discontinuity in using. Many customers find this convenient since our product requires
everyday use to maximize benefits. 
We have record of the customer contacting our call center on 03/30/2014 01:13pm, past her trial period. At this moment,
the customer still had possession of the product and contacted our call center past their trial period.
Please take a look at the notes below taken from our CRM:
03/30/2014 01:13pm - [redacted] - cci wants to cx acct, cust stated she didn’t mean to order product. waived cx fee
not to upset cust. Offered cust 40% discount cust declined cx acct.
The representative offered a discounted rate which was declined and cancelled the customer’s recurring subscription per
request. The customer did not request for a Return Merchandise Authorization number to return the product.  At this point,
the customer was already billed for the product she still currently has possession of. 
The customer contacted our call center once more on 04/08/2014 02:27pm.
 Dianne Smith - cci to verify acct closed, confirmed with cu account stopped 3/30/14.

When I originally requested the free trial sample, I believed that is what I would received.  What part of the sample was free?  I believed a recurring shipment would be sent and that is when I would have 14 days to return the product and cancel the product.   They make a point that they sent the terms I agreed to on line with the product, but they do not want you to read it in print.  Otherwise, they would have inserted it in the box with the product along with an invoice for the product.  Beauty MD may be operating legally, but are deceiving people (Shame on me for being fooled.)  Please see attached document of product I received. 
Also they say I did not return the product back to them so they cannot issue a refund.  They refuse to give me a RMA # for a product I have not opened!  What respectable company does not accept returns?

The customer placed her order
on 10/05/2014 at 04:20pm to participate in our trial offer. (Please take a look at the order confirmation sent to the
customer's email). Our records indicate that the customer only contacted
our representatives, via email, on October 25, 2014. Our...

representatives then
responded to Ms. [redacted]’s email with our contact information and hours of
operation so that we may better assist her with the situation at hand. Ms. [redacted]
never attempted to communicate with our representatives past the initial email
sent. I understand that Ms. [redacted]’s
complaint involves Billing or Collection Issues. The product for which
Ms. [redacted] has submitted a complaint is for a product not serviced by our company.
The product in dispute is from Ayur Cream. In addition, further review of Ms.
[redacted]’s account shows that she was never
charged past the initial shipping and handling charge of $2.95. Her account
was automatically terminated on 10/27/2015
due to the email received. Furthermore, we have cross checked our call logs
and show no record of Ms. [redacted] having communicated with our representatives via
phone. Had she communicated with our representatives directly, we would have
provided our best efforts to remedy the situation. I thank you for

That is not free.  They send you bottle of 60 pills and say you have 14 day free trial. But they charge you for the whole amount. How's that free. False ad is what it is

Offer on internet was 14 day free trial, with paying only for shipping. LATER 5 find on my credit card bill a charge from
Lab Genix for $87.50 I had not ordered more product. I had given no permission to charge for item. Did get through and cancelled any future shipment, but I could not get a refund, only because I had not used product and they gave me permission to return it did I get some money back , but it cost me $30 fee to restock. This is a scam out-right. No correspondence at all until you have already been billed. Learned a lesson, DO NOT give credit card info to unknown companies....I am out $30 for nothing at all to use. This all was done by them in less than a month with my credit card number available to them. Bad company

This company has finally posted a full refund after I informed them of the Revdex.com complaint. Thank you

The customer placed their order on 10/04/2014 05:30am to participate in our trial offer where she had 14 days from her order date to try our product. The customer received her order confirmation on Sat, Oct 4, 2014 at 5:30 AM. Customers are responsible for cancelling and returning the product within their trial period if they wish not to be billed for the product already received. Per terms and conditions, the customer was charged $87.50 for the product already received AFTER the end of her trial period ending on 10/17/14. Under normal circumstances, we allow customers to return the product back postmarked within their trial period. We have cross checked with our returns department and we have yet to receive any product back from the customer. 
After the trial, customers are put into a recurring service which they may cancel at any time.

We offer a FREE 14 day trial. Customers are responsible for contacting our call center to cancel prior to their trial ending to not be billed at the end of the trial. Had the customer contacted us within trial, they would have not been charged nor put into a monthly subscription. The customer placed her order through a two part order page. First, they filled out their personal information including their name, address, phone number, and email address. Second, they input their credit card information. Directly below the credit card form, it states:
Your credit card will be charged $2.95 for shipping and handling of a one month supply of Beaute MD Anti-Wrinkle Moisturizer. You will have 14 days since the order date to try BeauteMD and decide if it is right for you. If by the end of your trial you are enjoying BeauteMD, simply keep the jar and your credit card will be charged in the amount of $87.50 for the item received. In addition, the terms and conditions is posted in multiple areas of our webpage. Lastly, the customer is send a physical hard copy of our terms and conditions on the outside of the package. Had the customer not agreed to the terms, they could have refused the package and the package would have been sent back to us at no cost to the customer.
We have record of the customer contacting our call center on 10/20/14  past her trial period. At this moment, the customer still has possession of the product and contacted our call center past their trial period.

After speaking to our representative, the customer understood how the charges came about. The representative offered the customer a refund of 35% which she declined. Again, the customer still has possession of the product. To better assist our valued customer, our representative offered a 50% refund along with a complementary product to outweigh the cost. The customer acknowledged and agreed to the $45.00 refund and a complementary Moisturizer was shipped to her which valued at $87.50. At this point, the customer received two month supply of our Anti Aging Solution Moisturizer, was refunded $45.00 and her account has been terminated per her request on 10/20/2014.

Review: This company offers a free trial for shipping @ $6.95.BEWARE they start the clock ticking at this point for the "free" 2 week trial.It doesn't matter that you don't receive the product for a week or more. Then when I cancelled from within my 2 week trial period (once I received the product and could actually use it) they charged me $87.50 for this product. When I called after realizing the fee had been billed, I dealt with a rude and ignorant sales person who kept insistently there was nothing she could do for me. I requested to speak to a manager/ supervisor and was told none were available.Obviously this is a call center in which the lowest possible standards are maintained. DON'T DEAL with them. If you want the product it can be ordered numerous other places (Amazon.com) BEWARE your Pocket Book.That's ALL they want is your $$$. The customer ordered our Xtreme Muscle Pro product from

LabGenix on 07/08/2013 09:35am.

The customer ordered our trial promotion where you pay $2.95

shipping and handling to

have our product sent to you to try for 14 days. We send a

full size 30 day supply bottle for

customer's convenience. If the customer likes the product,

they have no disruption in use. Per terms and conditions, Mr. [redacted] was charged

$87.50 for the product already received after the end of his trial period,

07/22/2013.

The customers concern on the complaint was Advertising

Issues.

As a company, we try our best to fully inform

our customers of our terms and conditions. First, customers opt in our trial

offer. Going onto our Xtreme Muscle Pro website, no where on the site it states

that they will receive a 'free sample.' Following the order page, customers are

required to input their credit card number. On that form, customers are

required to check an agree box stating that they are at least 18 years or older

and have read and agreed to our terms

and conditions. Without this box

checked, their orders cannot be placed. Not only the word “terms and

conditions” is a hyperlink but also right underneath the form box, there is a

paragraph which states how our trial offer runs:

“Try Xtreme Muscle Pro Today, just pay a small shipping and

handling fee. Your credit card will be charged $2.95 for shipping &

handling for a 1 Month Supply of Xtreme Muscle Pro. You will have 14 days from

your original order date to decide if Muscle Pro is right for you. If you are

enjoying Muscle Pro, do nothing and at the end of your 14 day trial period you

will be charged $87.50 for the bottle received.”

In addition to our trial explained on the same page where

customers input their credit cards, we attach a hard copy of our terms and

conditions on the outside of the package. This company policy is done so

customers have one more chance of understanding what they had singed up for. If

they disagree, they can simply return to sender the package. The package will

be sent back to us at NO COST to the customer.

We do apologize if Mr. [redacted] had a misunderstanding on how

trial offer ran. He did contact our call center to discuss his account. Please

take a look at the notes below taken from our CRM:

stated he didnt sign up for our services. went over t/c and told cu how his

order would not have processed without chekcing the box. cu was very rude and

kept yelling over me. I had to stop speaking several times since he kept

inturruping. asked [redacted] if I could issue refund. she said refund -$20HF. cu

declined told cu he will have to return product post marked tomorrow and we

will issue full refund when we get his product. cu stated no. he will return it

his own time and we will issue refund in full now. told cu we cant do that he

will have to speak with my mamager. cu said he will charge back. told cu we are

issuing a full refund for him once he returns it so theres no reason for him to

charge back. [redacted] took call and told cu as long as it is post marked 8/5 and

half full we will issue full COURTESY refund. cu then said we should refund him

now or he will charge back. [redacted] then again said. sir we are offering you a

full refund. like any other business..

07/31/2013 04:17pm - [redacted] - ..we need to return

product to issue a refund. she even offered as a courtesy to issue a 50% refund

now and the other 50% when we get return. cu declined again. said he will have

it post marked by 8/5 and send it back half full for his full refund when we

get his return. accnt stopped and issue full $87.50 refund when we get product.

Mr. [redacted]'s trial

expired on 07/22/13. He contacted our call center on 07/31/13. To fully cancel

from our trial, we need to receive the product back postmarked within the trial

period with at least 50% of the product remaining. Though Mr. [redacted] was contacting

our call center way past his trial period, we were still willing to assist him.

To resolve the issue, with manager's approval, our representative offered Mr.

[redacted] a refund of $67.50 without receipt of the product. Mr. [redacted] declined any

offers made. Our manager got on the phone and confirmed with Mr. [redacted] that as

long as the package is postmarked by August 5, 2013 and half full, we will

issue him a FULL REFUND. Again, he was already contacting our call center PAST

his trial period.

As of today, August 8, 2013, we still have yet to receive

the product back from Mr. [redacted]. We believe our manager has assisted Mr. [redacted]

in full by still accepting his return for a full refund.

Again, there are multiple areas on the website where it states that it is a

trial period. In addition, Mr. [redacted] received a hard copy of the terms. Mr.

[redacted] has yet to return the product back. Had he provided a tracking number

showing the product was sent back, we would of issued him his credit. Had we

received the product already, we would of issued him a full refund. Our returns

department has verified that Mr. [redacted] has yet to send ANYTHING back.

Unfortunately, with no product returned, we cannot issue credit.

I appreciate your time in address this matter. Mr. [redacted] was

fully aware of how to receive his credit. He still has possession of the

product. We apologize for the misunderstanding Mr. [redacted] had with our trial

offer. We have already made an exception to still accept his return and issue

him a full refund. He still has yet to return the product.

Review: I purchased face cream on line for $2.95 and recieved no email or any invoice confirmation of this sale. 14 days later I was charged $87.50 and didn't realize it, then approx 60 days later was sent another cream with no notification and another charge$87.50. I then found a generic terms & conditions onthe bottom of 2nd box stating the information, so I called and canceled. They do not offer a refund after 14 days except a$30.processing fee. I am returning all items and letting my credit card company handle this, per credit card company I am tosend back certified with signature required.Desired Settlement: I would like a full refund of shipping $2.95, $87.50 & $87.50. She has been credited in full for the product returned within the 30 day return policy. The customer was charged a handling

fee due to returning the product past our return policy. We believe we went above and beyond measures to make sure the

customer received the correct funds.

I contacted my bank today and I did receive my $175.00 but not shipping of $2.95 & $12.95 that I paid to return certified mail. There is a few false statements in they're what I would call a FORM LETTER response since in the end of the letter they refer to ME as Ms. [redacted]? 2xs. Also they claim to have emailed me, that is a bold face lie, there NEVER EVER EMAILED ME! Also I don't recall any of there policy of 14 days to respond on the order form online, it is on the BOTTOM OF THE SHIPPING BOX, which I never saw until 2mths later when 2nd shipment came, this is when I contacted them to cancel. They then would not give me a RMA #,they told me they would give me a partial refund if I stop the collection procedures through my bank. Of course I didn't I didn't trust them. I used the moisturizer. I received it from work as a gift. I reordered with them. Customer service gave me 30% off everything I bought. I was really happy I'm surprised to read these bad reviews maybe people should read what they sign up for the have a trial and a straight sale I choice onetime I had no problem
