Review: I pre-ordered a product from Evolution Gaming online on October 17th, 2013 after speaking to them through an email address posted on their website. They sent me a link to pre-order the product, which I used to order, expecting my order to be sent or fulfilled close to the release date scheduled on November 1, 2013. After I did not receive any word on shipment no any delivery by November 17th, I messaged Evolution Gaming asking about my order status. They responded promptly apologizing for the delay, explaining that demand was great and that they required another shipment to come in before they could send out my order, which was scheduled to arrive on Nov 25th - 30th. They offered to cancel my order and refund my purchase if I did not want to wait the extra time. I thanked them for offering, but explained that I was appreciative that they got back to me and I would wait for the second shipment to arrive. By December 23, 2013 I still had not received any word from Evolution Gaming about the status of my order. By this point I am no longer interested in waiting so I emailed the store asking them to simply cancel my order and refund my purchase as they had offered. I still not have heard back from them. It has been 10 days. Multiple emails have been met with the same silence. Now when I go to their website it seems it has been taken down. Desired Settlement: I would simply like my order cancelled and a full refund issued. The full amount was for $139.99 usd.

Review: I placed two pre-orders of the product "Commander 2013 box set of 5" in October 2013. They took full payment immediately and promised to ship the product on November 1st when the manufacturer released it. The product was released by the manufacturer Wizards of the Coast on November 1st 2013, but I never received a shipping confirmation. I contacted Evo Gaming several times over the next two months, and they repeatedly made excuses that they did not have enough product to fulfill their pre-orders. I eventually asked that they refund the orders, but they never responded to my email. I have attempted to contact them again, but their website seems to be down and my emails sent to the same address they used before are bouncing back.Desired Settlement: I would like Evo Gaming to refund the ($139.99x2) $279.98 that I paid them.

Review: I ordered a prerelease item of two MtG Commander 2013 sets which were set for a release date of November 1st 2013. On November 23rd I emailed the store to inquire about my purchase and was told that they did not receive the full stock they had expected and would ship out another batch between November 29th and December 5th. At this point I was offered a refund but declined as I wanted to give the seller the chance to make good on our deal. I emailed them again on December 17th without a response. I emailed them again on December 27th without a response. I emailed them a final time on January 3rd letting them know that if I did not hear back from them by today that I would be filing a complaint with the Revdex.com.

Review: The estimated arrival date for an online purchase from this company has come and gone. Contact with a business representative has been unsuccessful.

I placed an online order with this company on 10/18/2013 (order [redacted] The shipping date was set for 11/1/13. November is now coming to a close and I have not received the package or any correspondence from the company. I filed an email through their contact page on their website, and I have called numerous times only to receive an automated message informing me that the person associated with #XXX-XXX-XXXX cannot take the call, regardless of the time of day. There are numerous reviews of this company with similar complaints. I am not concerned with the package so much as I would like to get a refund in full because I do not wish to support this business after my experience so far.Desired Settlement: I would like a refund in full and an apology for having my money tied up for as long as it has been.

Response:

Initial Business Response

As stated in numerous emails sent, we are waiting on the distributor to fill the rest of our order. Customer was refunded as requested.

Final Consumer Response

(The consumer indicated he/she DID NOT accept the response from the business.)

I have no evidence of a refund; there is not a pending deposit in my bank account, nor have I received any email or mail correspondence.

Review: I pre-ordered a the product "Commander 2013" (A set of 5 trading card decks for the game "Magic the Gathering") from evolution gaming through ebay, and the transaction succeeded. I submitted this order on October 15th for $139.99. After a month after the product came out, I have yet to receive the product. I sent an email (their email is: [email protected]), and did get a response that they were waiting on another shipment. I was offered a refund but chose to receive the product instead. After another month has passed. I chose to email them again and determine why I have yet to receive my product. I have yet to hear back from them again, after sending a few emails stating I wanted a refund and would be inquiring outside assistance if the business did not refund me or send me my product. I have yet to hear another response from them.Numerous others have shown complaints, as evident by a simple google search of "Evolution Gaming Store" about not receiving their products as well. I attempted to call the store during their business hours (the store number is: ###-###-####) and was met with a "full inbox" message. The phone call won't even go through. I noticed the signature on emails from this store mentioned "[redacted]" and am assuming that is the owners name. In all, the problem is that I ordered a product, paid for the product, and never received the product or a refund. I also cannot contact the store to resolve this issue.Desired Settlement: I would like a refund for the $139.99 I paid to this store.

Review: Never shipped product after payment. Only excuses provided when contacted

I order a 5 product set on 10/18/2013 - release date for the product was 11/1/2013. Never got shipping confirmation, contacted seller. Was told wind storms knocked out their power and phones. Also told they didn't have enough stock to fulfill order and that they would send asap. All other attempts to contact have failed. Weather for the area do not collaborate wind storm story. Still have not received my order or shipping. Seller is no longer listed on squareup.com - their merchant portal.Desired Settlement: I want a full refund asap. No more games, my money back to me. That's all.

Response 11/7/2013:

Hi Mike,

Apologies for the delay in response - our area was hit with severely high winds recently and we were without power for the last 2 days. Our phones are still down, but we do have power now.

Unfortunately, we only received 50% of our Commander order - the demand is just tremendous. We do expect the balance to arrive within the next 7-10 days. Once we receive our delivery, we expedite the shipping and shipping orders as quickly as possible and you will received an email with tracking once your order is processed.

If you would simply rather have a refund, please let us know via email at [email protected].

Refund requests are processed within 24-48 hrs.

We appreciate your continued patience!

Review: I ordered a set of trading cards from Evolution Gaming Store on October 20th, 2013 and cancelled the order November 16th, 2013; 15 days after the product was supposed to be shipped. I received an email from Evolution Gaming Store that said I would be refunded for my cancelled order. It is December 6th and I still have not received a refund. I have tried to contact the company through email and have gotten no replies, and I have called their number dozens of times and no one has ever picked up the phone.

The order I cancelled was for $139.99 and I want the full amount refunded.

Review: I placed an online order with this company on October 10th, 2013. The order was a pre-order for MTG Commander 2013 Complete Box Set. My credit card was charged immediately for the cost of 139.99 and I received an email indicating the product would ship on November 1st which is the release date of the product. I did not receive any other emails. On November 19th, I sent an email to their order email ([email protected]) asking about the status of my order. I never received a response. I sent another email on December 2nd, and one final email on January 16th. I have not received any response from the vendor and the phone number listed goes straight to voicemail. Their website is now removed. I fear that I will now be out 139.99 and have no legal recourse as I am outside of the 60 day limit.Desired Settlement: At this point, I would just like my money back. It is obvious that this company has no intention of sending out the product, so if I could just get a refund it would be appreciated.

Review: Business failed to deliver product. Numerous attempts at communication, business claimed delays, but then stopped all communications.

I ordered a boxed set from the company on Oct 18, and then when another similar product came out I ordered another one on Nov 8, as they had a limit of 2 max. They said it would ship Nov 1 for the first batch, then they told me they over ordered, but that both orders would ship Nov 22. I was in contact with them, when early december came around, with no further contact from them, I again contacted them about why don't I have my product. They have not responded to my multiple e-mails, phone calls, or website contact forms in over a month.

On Dec 27 I went to my bank. Unfortunately due to a 60 day rule, I was only able to get 1 of the orders refunded. I tried to give this company time to reply, and doing so prevented me from easily getting my money back from my bank.Desired Settlement: I would like the product I ordered. Barring that I would like to actually purchase the product that I ordered, which after preorder period the price has risen from $140 to about $180 according to Ebay.

If that is not a possibility, simply getting my money back will I guess suffice. Better then nothing.

Review: I pre-ordered an item on October 23rd that should have shipped the first week in November. It has not arrived.

On October 23rd I pre-ordered a product that should have shipped the first week in November. I emailed the store on November 11th when I had not received any shipping confirmation. On the 12th I received an email back from [redacted], stating that they had been delayed, but that "We do expect the balance to arrive within the next 7-10 days. Once we receive our delivery, we will expedite shipping out orders as quickly as possible. You will received an email with tracking once your order is processed."

On November 23rd I had not heard anything else, so I sent another email asking for a status update. On the 25th I received this response: "

Our order is "en route" and should arrive any day now. Once it does arrive, we will get you order out to you right away :)"

On December 5th I emailed asking if the order had arrived, and did not receive an answer. On December 10th I emailed again, still no answer.

On December 18th I called and left a message, which was never responded to.

On December 19th I began disputing the charge with my credit card company.Desired Settlement: At this point I just want my money back.

Review: Preordered product thru their webstore. Product released, no tracking email. Contacted, they said not enough initially, next week 2nd wave. Silence.

Preordered Magic: the Gathering, Commander 2013 Complete Set from their webstore. Product released, other people who shopped elsewhere start receiving tracking emails. Nothing from Evolution Cards & Comics, 4 days after I contacted them they finally responded saying they only got half their shipment, this was 11/5/13. All remaining orders would be fulfilled in about two weeks when the restock comes in. I contacted them again on 12/4/13 and got no response. Tried several more times since, including the latest where I informed them I would escalate this, on 12/9/13Desired Settlement: I want the order fulfilled.

Review: I pre-ordered a product from this business in mid October. The product was released on November 1st. A couple weeks later, the product had not arrived and so I submitted a ticket inquiring about the arrival. They stated that they had not received all the products and it would be 7-10 days until they received the balance. Two weeks later, the product had still not arrived. I e-mailed them again inquiring about the delay. They responded saying that they had still not received all the products and that they would receive the balance by December 4th. On the 7th of December, I e-mailed them again as the product had still not arrived. They did not respond to me. I submitted another ticket through their website and called 3 times. The calls went straight to voice-mail and they never responded to my ticket. I then asked for a refund, which they had told me earlier would be processed in 24-48 hours, on December 22nd. They have yet to issue a refund. I went to submit another ticket earlier today (Dec. 27) to find that their website had been taken down. Desired Settlement: I want to get a refund of my money, $139.99, as I need the money for text-books.

Review: I pre-ordered a gaming product in October and this order was not sent to me. I was supposed to receive an email saying it was shipped, when I emailed asking about my product I was told they were having a delay due to a storm. I inquired later about my product and was told the order was en route and I would to contacted when they were sending out the product. This never happened. I inquired again and received no response. I waited for the holiday season to pass and canceled my order by email and by phone. I have still heard nothing from Evolution Gaming and I have not been refunded.Desired Settlement: I would like the $139.00 I paid refunded. I paid using my [redacted], I would like my account refunded the amount I was charged. I have not received my product or been told it has been shipped.

Review: Unable to deliver on promise, lack of contact, deceptive sales practices taking money from unsuspecting customers while not delivering product.

I preordered a set of Commander 2013 cards at a charge of $139.99 to my bank account that this business debited from my account on October 15th, 2013. The product released on November 1st 2013 and was supposed to be shipped to me at that time. I have contacted them multiple times by phone and email and they have last stated that they had issues and expect the product in 7-10 to days from November 8th; it's now December 1st and they have not contacted me or responded to me since November 8th. The reason I am filing a complaint about unethical practices is that these release products end up selling over the counter well above the listed MSRP due to demand. What this vendor is doing is inflating their sale numbers to tell the distributor that we sold X copies so they can receive more product and sell it at a higher than msrp profit to in store other/buyers. They have offered me a refund which is also unfair considering they kept my money for two months and the suggested retail from mainstream suppliers is now listed $179.99 or higher so my issue also is that I don't want a refund for a product I will not be able to purchase anywhere else for that refunded amount. I have seen multiple reviews everywhere from many customers who have experienced the exact same treatment and its not right. My order number was [redacted] thru square up marketplace on Oct 13th 2013. My correspondence with them is as follows:

So any update whatsoever for my commander product? Been 12 days since your last contact with me. Too busy selling all your sets higher than msrp to other people while keeping my money or what? Feel free to call or write.

Hi [redacted],

Please accept our apologies for the delay. Our area was recently hit with severely high winds and we were without power for a couple of days. Our phones are still having some trouble and as a result, we have had delays updating customers' order status.

Unfortunately, your order has not shipped yet. Although we have shipped over 100 of our preorders, we are still waiting on the rest of our initial order to arrive. The only explanation we have received is to wait patiently - the demand for Commander is tremendous and orders are being filled as quickly as possible. We do expect the balance to arrive within the next 7-10 days. Once we receive our delivery, we will expedite shipping out orders as quickly as possible. You will received an email with tracking once your order is processed.

If you would rather have a refund at this point, simply reply to this email and let us know. Refunds are processed within 24-48 hours.

Thanks for understanding,

Desired Settlement: I just want my product to be honest. Shouldn't be hard to deliver a readily available product to its customers if the business even made the slightest attempt to honor its customers purchases. I will not accept a refund because the aforementioned msrp is now well above my purchase price. I may consider a refund of no less $179.99 if its within a timely fashion as the retail price may only continue to inflate leaving me further underwater.

Review: Placed a preorder for all 5 C13 decks and have not seen the product nor a refund after multiple email exchanges over 6 weeks ago. After checking into the place more thoroughly, it seems they had done this before with Gatecrash preorders as well. Their website has also been recently taken down.

Review: My product was never shipped, and all communication from the business stopped.

Preordred a set of Commander 2013 Magic cards on 10/17/13. They were supposed to ship out on the street date of 11/2/13. A week later I had not received the item and emailed them. They responded and said they ran out and would send mine as soon as they got their next shipment, which was due by 11/30/13. When. I didn't receive my shipment confirmation by then I emailed again, this time with no response. A couple days later I emailed again through their website, which I has to search out on Google, as the website link in their email had been removed sometime after my initial email. I still got no response. I tried calling twice, during business hours, and got their voicemail (which is a generic recorded message) and never got a call back. At this point I feel I have been defrauded and have contacted my credit card company to recover the money. Despite numerous attempts, I have not had any contact with them in 4 weeks.

My order number was [redacted]Desired Settlement: Getting my product free of charge would be nice, but it's rather expensive so I understand if this doesn't happen. Otherwise a refund seems the least they could do.

Review: On October 18th, I placed a pre-order of the MTG Commander 2013 decks with Evolution Gaming Store, under the impression - based on their advertising - that my order would be shipped on the day of release, November 1st. Two weeks after the release date, I still had not received my product. I had tried to contact them after the first week, and it took them a week to get back to me. They told me that due to the high volume of pre-orders that they took, they couldn't fulfill them all with the first shipment that they received and were waiting for another. I asked for a refund, and they said that would be fine. A week later (now), and I still have yet to receive my refund, and once again my attempts at communication with them are being ignored - emails, messages, and phone calls alike. After doing some research online, I found that I wasn't the only person to experience these troubles, and some people had/have waiting over three months for their products without any communication from the company. While I'm not here to voice other's complaints, I want to alert people to this company's dirty and immoral practices.

Product_Or_Service: Magic: the Gathering Commander 2013

Desired Settlement: DesiredSettlementID: Refund

Along with the refund, I would like them banned from being able to take pre-orders online, but barring that, I would like them to be forced to change their advertising to reflect the fact that they take pre-orders in such a volume that they can't possible fulfill them, leaving their customers in the lurch. This practice is dishonest, and I don't want anyone else to have to go through this rigmarole.

Review: Evolution Gaming Store takes orders and processes payment for products they do not have and cannot get. They then do not ship out these products, and do not communicate with customers. I have attempted to resolve the issue but I have not heard from them in months.Desired Settlement: I would prefer to receive the products that I ordered, but I would settle for a refund at this point. I do not think it's fair that they were able to hold onto my money for as long as they have, and not be accountable to paying customers.
