Our Member Services representative spoke with [redacted] , and all is resolvedWe are not sure why her credit union had any issue with the Member Rewards check we had sent to [redacted] [redacted] chose to remain as a Member in our wonderful program for homeowners, and has cashed her first Member Rewards check we sent to herWe appreciate [redacted] letting us know her credit union had an issue with the checkThank you [redacted]

The registration for our free program which provided $to $10,to each of our members, for which they pay us $0, has been cancelled

To whom it may concern:Despite the [redacted] ' request to cancel being made two months after they registered to join the program, which is long after the three business day right to cancel, nonetheless, we have conditionally cancelled their registration which they now claim to have not completedWe have conditionally canceled their registration subject to their home not showing up as being for sale in the next two yearsIf the home shows up as being for sale in the next two years, this would cause us to think that the request to cancel is not legitimate, and could possibly be due to unethical behavior, and if so, we will pursue our rights under the law.The [redacted] ' should be aware that their statement about our program being a scam is both ludicrous, and libelous, and we have referred this matter to our lawyers to consider filing a lawsuit against the [redacted] ' for making numerous unsupported statements about us which could damage our reputation.The [redacted] ' complaint to the Revdex.com contains multiple and dishonest statementsOne such statement is that Exceed is not a Revdex.com Accredited Business, which indeed it is, enjoying, and quite proud of, its A+ rating with the Revdex.comAnother statement by the [redacted] ' is that our website [redacted] .com 'proved to be invalid'It surely seems odd, and dishonest, that they claim our website URL 'proved to be invalid' when every other Internet user in the world is able to enter [redacted] .com and arrive at our website.Homeowners pay us $to join our program, $to be in our program, $if they never sell their home, and $if they sell their home in the future using their choice of any of our many cooperating brokersIt is completely illogical, and without merit, for anyone to ever suggest we are a scamWhen, from time to time, someone makes such a foolish and unsupportable claim, we always ask 'how could this possibly be a scam', and to date, no one has ever provided an answer, which causes us to continue to know, as we have always known, that our program is wonderful for homeowners, and could never be a scamIf the [redacted] ', or anyone else, can give us any reason how our program could be a scam, please be sure to let us know.Thank you

For what reason? The letter that I received also indicated that I MUST contact this company before I sell my houseThis seems like a threat - if I do not call this company (which I have no intention of doing) what will happen? Will I be sued? Will I have to pay a fine? Will I have to pay back all this money they have sent me? It doesn't make sense I fear what will happen to me if I cash this checkI worry if it is some sort of virus that will steal my information or bind me to some unknown contract In short, I have only ever received one single piece of correspondence from a company I have never heard of (nor had my lender) - a letter stating I signed up, with a live check for $telling me that I have to contact them if I want to sell my houseI do not trust this at all, which is why I went online to do some diggingSeveral sites mentioned this to be a scam and they had over complaints on Revdex.com I am satisfied with the response because I received an email yesterday from someone stating that my "membership" had been canceled Sincerely, [redacted]

And they can keep it even if they never sell their home! Obviously, as the [redacted] s know, they did receive their first $payment, pursuant to the terms of their agreement with Exceed, which they cashed or deposited into their bank account, as evidenced by our bank records, or why else would they be offering to “refund the initial upfront payment of $200” we paid to them? The [redacted] s e-signed the homeowner agreement to which they are a party, and they have always had access to the agreement before and after they joined the programThe [redacted] s were provided three business days to cancel their agreement with us, which is clearly communicated to all of our members multiple times IN BOLD CAPSAdditionally, upon registration, we provide all members a completed cancellation notice for them to mail to usWe also accept cancellations by email within that three-business day periodThe [redacted] s joined the program 2/9/They cashed their first $reward check 4/7/16, and are welcome to cash their second $reward checkOf interest, Mr [redacted] just left a phone message for us, in which he claims he never signed our agreement, which may suggest that his wife forged his signature? However, when looking at our bank records, they BOTH signed the first $check we sent to them when they cashed or deposited our check into their account (further ratifying their agreement with us) The [redacted] s violate the law by stating our service is a scam, which is impossibleTo the contrary, we value our relationships with our homeowner membersSadly, from time to time we come across a real estate agent who puts themselves above the needs of their clients, which is what seems may have occurred in this caseBased on what we have been told, it seems the agent involved in this case thinks they own their past clients (even though there was no agreement between them regarding the future sale of their home) and that it is proper to take money out of the clients’ pockets and put it in the agent’s pocketThe [redacted] s’ home, if they sell it soon as seems to be their desire, will sell for approximately $440,000, according to independent 3rd party estimate of the value of their homeIf the commission they pay for the sale of their home is as sometimes occurs on Long Island 5%, the sell side commission would typically be 2.5%, in this case, $11, of which the agent would typically receive an amount in the range of $8,So, if we were to be paid our contracted referral fee, using the preceding figures as the basis for the example, the agent would instead receive a commission of $5,720, which it seems in this case has made the agent angry, due to the agent thinking they own the client, and the agent would rather put an extra $3,in their pocket (in the agent’s pocket), while depriving the client, the [redacted] s, of the $1,we pay to the [redacted] s The question is, who is looking out for the [redacted] s’ best interest here? Exceed, who pays them $1,for which they pay $0, or the agent who it seems is more concerned with making $8,instead of $5,720, another $3,080, for helping the [redacted] s to sell their home? Obviously, Exceed is putting the [redacted] s’ best interest firstIt seems that the [redacted] s have been misinformed by whoever they claim to have spoken to at [redacted] , out of ignorance or making statementsThis is out of character compared to most of our interactions with [redacted] brokers, agents and management over the past near ten yearsWe value our long-term relationship with many [redacted] franchisees and company owned [redacted] regions, brokers, and agents throughout the USAAssuming the [redacted] s sell their property through [redacted] , as they desire, or with the help of any other contracted broker that is a part of Exceed’s network, and they retract their libelous complaint and make no further or libelous statements about Exceed, they will have no liability to Exceed, or responsibility for making payment to Exceed of any amount arising out of the sale of their propertyFollowing their closing with any broker in Exceed’s network, Exceed will send them the balance of the $1,member benefits We were provided May 4, a written acknowledgement of [redacted] ’s acceptance of the referral It would be a shame for the [redacted] s to incur legal fees unnecessarily should they continue to libel us or otherwise cause us any additional harm beyond the harm they have already caused usMrand Mrs [redacted] , we pay you $1,000, $of which you’ve already received and signed for you have paid us nothing you are arguing with the wrong party! In conclusion, the agreement the [redacted] s entered into with Exceed LLC (“Exceed”) remains in effect and has not been cancelledPlease note that in accordance with the terms of the agreement, it may only be modified in writing with our acceptanceExceed has not agreed to, and will not agree to, any modification We remain willing to continue to provide any assistance desired to support the sale of the [redacted] s’ home, with whichever of our Cooperating Brokers they choose, pursuant to their agreement with us We look forward to providing them the balance of their $1,member rewards immediately following the sale of their home!
