We are contractors working on the porch of a homeowner whose mortgage serviced by FAY. The damage to the property is approximately $55,000 of which we have received about $8200. We are expected to completed 50% of the job on this initial payment of $8200. The payment process with Fay for an additional draw is rather lengthy, almost 3 weeks. So, effectively, we do about 2 months of work for $8200 before we are paid any additional funds. In an effort to streamline the process so we do NOT incur any more cost, I contacted Fay and reached an agreement whereby they promised to rush the second draw ($18,000): 3 day turn around with the inspector and then another 3 days to process the payment and overnight the check to the homeowner. They reneged on ALL OF IT: the inspector works a full time job in his 'real life' (his brother has the contract for inspections with Fay) and so he only does inspections on the weekends. Then the customer service people refused to follow thru with the committed timelines even though I had the dates, times and names of the people who had made those promises. So, we have completed 50% of the job on only 7% of the funds and will have to wait for almost 30 days to be paid after the request was submitted for the second draw. The failure to comply with the promised time line by Fay, has added considerable cost to us which cannot be recouped. I was promised a return call by a supervisor but have not heard from anyone. This seems to be the typical level of 'service' from Fay. Promises made by Fay but failure to keep by Fay has caused us PROBLEMS because we have made promises to subs and vendors based on the promises made to us by Fay.

I paid for plumbing work done on a Fay Servicing owned property - The total was $for Hydro-jetting from Almighty RooterThe property is located at *** S *** *** *** *** XXXXXCopy of the invoice and statement are located here- *** I submitted the complaint and bill to the listing agent - Heather *** with Remax and *** Servicing's Lawyer, Codilis & Associates After a few months of back and forth communications, I was informed that *** Servicing turned down my request for reimbursementI find it despicable that a Mortgage Firm is unwilling to pay for their responsibilitiesThis place does not even belong to me I was merely helping out a couple of friends because the place was no longer inhabitable with the backed up sewer line! According to Codilis & Associates- "The client has denied reimbursement, as you were not authorized or hired by the bank The occupant hired you themselves, you would need to seek reimbursement from them directly." Amazing! I am not a plumber, only a friend that was kind enough to cover the bill until the slumlord paid me back...or so I thought! Why in the world would a tenant have to pay for plumbing work themselves anyway!

Fay Servicing bought my home loan and it has been a complete nightmareThe charges lack of communication, extra feesSo I finally got my loan refinanced through another finance company and they added another $dollars to my loan to absorb the extra the bank paid themThis should be illegal for a servicing agency to overcharge a consumer and it becomes acceptableI will be filing a formal complaint to get understanding and justification about my chargesI think the attorney general in the states oils look into their business practiceI will also be submitting a letter to him also about their business practice

Dear Ms***:
We received your complaint to the Revdex.com regarding your escrow account, and I have been assigned to research and respondWe sincerely
apologize for any delays in paying all the parcels to your property
We have conducted a recent escrow analysis to refund you for your payment toward your taxesUnfortunately, we were collecting for one tax parcel and not four prior to this analysisThe addition of these parcels to your escrow payment may have lessened the amount of the refund you were anticipating; however, you benefitted from a lower payment amount during the time we were not collecting for these parcelsAdding these parcels to your payment also increased your total monthly payment amount
Effective with the October payment, your new payment amount will be $2,On August 4, 2014, a check in the amount of $was disbursed from your escrow account, representing the overage of escrow funds in your account
We trust this letter addresses the questions in your complaintIf you have any questions, please call us at X-XXX-XXX-XXXX

Dear Mr***:
We received your complaints submitted to the Consumer Financial Protection Bureau (CFPB), RevDex.com (Revdex.com), and U.SSenator *** ***, and I have been assigned to research and respond
Our records indicate Fay acquired your account for servicing from *** of *** on February 3, At the time your loan boarded our system, we learned that you were approved for the Home Affordable Modification Agreement (HAMP) trial period planThe trial period plan was effective from December to February at a total monthly payment of $2,After reviewing the payment history with *** of *** we determined you successfully completed the trial payment plan and are eligible to be permanently modified via the HAMP program
On February 18, your Account Manager contacted you to discuss the terms of the permanent HAMP Loan Modification AgreementAfter discussing the terms, your wife had indicated the payment is still unaffordable even after you successfully completed the trial payment planAt this time she rejected the permanent modification and advised she would consult with a bankruptcy attorneyAs a result of declining the permanent modification, we issued the enclosed non approval notice
After you declined the permanent modification, you contacted our office to make a payment on March 13, Please note that we are unable to accept payments when an account is more than days past due and not active on a workout planWe advised that we can accept payment if it will bring the account at least days past dueAs such, when we received $5,on March 20, 2014, we applied the funds to your accountThe account now displays due for the February 1, installment
In an effort to assist, we are providing you another chance to accept the permanent HAMP Loan Modification Agreement that was approved by the prior servicer*** determined a total monthly payment of $2,was affordable given your monthly gross income amount of $9,HAMP Tier program guidelines target a payment amount 31% of your monthly gross incomeIf you are interested in accepting the HAMP modification that was previously offered, please contact your Account Manager
If you do not accept the HAMP modification, we are unable to offer an alternative modification as you have the financial means to continue making payments in accordance with the modification approved by *** of *** in January I have enclosed a copy for your referenceThe modification reduced the interest rate to 2.0% and decreased the monthly payment to $1,

We are in receipt
of your correspondence submitted to the Revdex.com (Revdex.com) on October 12, regarding the above referenced account and propertyIn your correspondence, you request we review the account for available loss mitigation assistance options
Please understand that after careful review, the most recent loss mitigation application was denied for incompletenessAn application submission was received; however, the package was deemed incomplete as financial information and documentation was provided for *** *** and not the co-borrower, *** ***, as well
After speaking with your Account Manager, you advised *** *** does not reside in the property and also signed a Quit Claim DeedHowever, the Quit Claim Deed does not remove *** *** from the Note as an accompanying divorce decree or court order was not executed to solely grant you the propertyAs such, the application was considered incomplete because *** *** did not provide financials
However, in an effort to provide as much assistance as possible, we are currently re-reviewing the application based on your financial information onlyOnce we have reached a determination, a new evaluation letter will be sent providing the updated outcome of our loss mitigation evaluationWe confirm no further information or documentation is needed at this time
Further, a previous loss mitigation program was previously offered but you have since defaulted on this planA Trial Modification Agreement was implemented with an effective first due date of October 01, All three trial payments were made in a timely manner and the permanent modification was implemented for a start date of January 01, A first modified payment was applied to satisfy the January installment; however, the payments received for February 2015, March 2015, April 2015, May 2015, and June were returned as your bank account did not hold sufficient funds to support the withdrawalsThus, the account remains due for February

I received a call from my boyfriends father todayHe said a Nohemi *** called his home phone and asked for my boyfriend by his first and middle nameNohemi never told my boyfriends father where she was calling fromShe told him who she was really wanting to talk to, my parents, after he told her my boyfriend wasn't homeShe left only her name and phone number and said that they (my parents) would know who she wasI text my mother and asked her if she knew this lady after my boyfriend's dad had called meMy mother said yes, that every month Nohemi calls her, even after they have made a paymentMy mother also went on to say that Nohemi is never very pleasant and tells them awful thingsMy mother told me that Nohemi told her that my parents don't deserve their home and they should be living in their carNO ONE should EVER be told this, EVER! My parents work really hard for what they have, and they struggle just like everyone elseMy father works as much as he can to make ends meet after my mother suffered a heart attack and two heart stintsThis Nohemi *** lady needs to lose her job for saying stuff like thatThen when I told the Donna or Debbie lady what Nohemi said she says, "I assure you no one here says that stuff"I told her, "I assure you they do and she did"I asked for a supervisor and this lady took it personallyI told her it wasn't her, I wanted to talk to a supervisor about NohemiShe kept trying to make comments like, "I'm sorry you're having a bad day", which I was notI told her to please not comment and to just get me a supervisor, she continued to commentThen she asked for the account number, I told her I didn't have it and she kept saying stuffFinally I yelled at her to just give me a supervisor and she said, "well maybe that's why Nohemi said that stuff to your parents"But if you recall, she said earlier on that she "assures me no one there says stuff like that", but then makes comments like thatI finally got transferred to a supervisor and SURPRISE it was the voicemail of a man named ChrisWhat crappy customer service Fay Servicing, maybe you should review your call recordings more oftenI am now going to do everything in my power to help my parents get their house financed through some other company that doesn't let their customer service people tell their customers they "don't deserve their house and should live in a car"I hope Nohemi *** gets awful karma she most likely deserves for saying awful things like that to people
