Please be advised that this office has never had any direct communication with this consumer This office has, however, received two disputes via eOscar the liaison between credit furnishers and consumer reporting agencies; one in June, and another is April, 2017, both of which were answered promptly The consumer was also sent a packet of documentation in April, 2017, validating the debt.Included in that packet was a copy of the Statement of Deposit, from the original creditor showing the break down of the charges, a copy of the lease agreement signed by the consumer, the electric bill, and the rental application completed by the consumer A copy of that packet in attached herewith In addition, a judgment was issued on behalf of the original creditor on 5/6/ A copy of that judgment is also attached herewith.As this is a true debt, supported by a judgment, this office will be unable to comply with the consumer's request to remove this from the credit reporting agencies At this time, the account is being handled by the law office of [redacted] It would be in the best interest of the consumer to contact [redacted] directly to discuss a repayment arrangement, and/or to negotiate a settlement [redacted] may be reached at [redacted]

This office does not collect student loans, nor does it have any record of the consumer in its data base There are several agencies with similar sounding names I believe this consumer is referencing an agency in Oklahoma There is also a division of the federal government located in Takoma Park, Maryland called FMS - [redacted] that is involved with student loans It is likely one of these two entities that has this consumer's debt

As a collection agency, FMS does not have the ability to report an account as pays as agreed It would be in the consumer's best interest to pay off both of these accounts, and have them shown as such In the meanwhile, the reporting will have to remain as it is

I have contacted the consumer and explained our office policies in depth We are currently in the process of resolving this matter in a manner acceptable to all parties

This office has many accounts with this name, and many if those do not have social security numbers In order to find the appropriate account, we must have additional information As we are unable to match via the social security number, we would require the amount shown on the credit file and the name of the original creditor and/or the account number listed We are unable to take any action in this account until we can identify which account belongs to the consumer The consumer may feel free to contact me directly to discuss further

Please be advised that this office received this complaint verbatim from the *** The issue seems to be that the consumer is confused as to whom the balance is owed She is disputing that she has an agreement with this office or owes a balance to this office (FMS) She is correct in that she does not have a debt with FMS FMS, acts as a third party debt collector for, [redacted] *** The debt is actually due to [redacted] and being collected by FMS Unfortunately, as he has requested via this complaint that FMS not contact her, we are precluded from explaining this directly to her As we have already stated in our response to the ***, if [redacted] , wishes to discuss this further, she will have to contact FMS FMS will be unable to comply with her request to delete from the consumer reporting agencies as this is a legitimate debt It would be in [redacted] 's best interest to contact this office directly

Pursuant to the complaint filed by [redacted] (consumer), this office has completed a review of the file, and the records do not support her claimsThis office is a third party debt collector and does not own this debt It collects on behalf of its client, [redacted] *** [redacted] This office has never claimed that the consumer owed it directly The debt was received by this office on 8/10/2017, and a letter, dated 8/11/was mailed to the last known address for the client On 8/16/2017, the consumer called this office and discussed the debt with Josh H*** Consumer advised MrH [redacted] that she would be unable to make any payment on the account until September, MrH***, advised the consumer that this account would be reported to the consumer reporting agencies The consumer did not answer telephone calls made to her on 8/17/and again on 9/12/17, and has not made any payments In addition, there is no records that the consumer requested validation of the debt For the record, this office does not repot to [redacted] as stated in the consumer's complaint Please find attached, a copy of the breakdown of charges, the lease agreement signed by the consumer, the application completed by the consumer, and the ID provided by the consumer to the client As this is a validated debt, this office will be unable to comply with the consumer's request to remove same from the consumer reporting agencies

Pursuant to receipt of this complaint, a full investigation of this file has been completed The consumer was included on a lease with three others including her ex-husband The lease was allegedly signed by the four in the presence of a notary - and was delivered to the rental office with the notarization attached This office attempted to contact the Notary shown on the document to no avail In addition, the signature shown on the lease is considerably different from that provided by the consumer with her dispute As such, this office has agreed to remove the consumer from any obligation to this lease, and to delete the information provided to the consumer reporting agencies Both actions have been completed This office will provide the consumer with documentation advising of sameShould you have any further questions or concerns, please feel free to contact me directly

I one again confirm that I never spoke with *** ***. I know that the consumer offered a 50% settlement because it was stated in her dispute. The original creditor did not approve her settlement request. The amount due is 401.54. Please see the attached list of charges that make up the total due

Max P***, a representative of the company, rudely cursed me out and hung in my earWhen I would call back to resolve my issue, he would instantly hang up upon hearing my voiceMy husband calls to speak to him and he gave him the upmost respect calling him sir and everythingMax has no respect for women or his place of employmentAnd, he knew that all calls were recorded!

The consumer is correct in that he does have payment arrangements for these two accounts , and they are set to be settled for the amounts shown in his complaintIt is the policy of this office to NOT reduce the balance on settled accounts until they have been paid in full (at the settled
amount). That said, this office does update the current balance every month with all of the consumer reporting agencies to which it reports. The upload to the consumer reporting agencies typically goes through between the 5th and the 7th of each month. The current balance on each account is as follows: *** *** - agreed upon settlement - 1,800. Amount paid to date 1,Remaining balance - 300.00. *** *** - Agreed upon settlement - 2,500. Amount paid to date - 1,355.35. Remaining balance - 1,144.65. In an effort to resolve this with the consumer amicably, this office will agree to reduce the balances to the amount shown herein. That action should update the consumer's credit within the December reporting cycle
