This office does not collect student loans, nor does it have any record of the consumer in its data base.  There are several agencies with similar sounding names.  I believe this consumer is referencing an agency in Oklahoma.  There is also a division of the federal government located...

in Takoma Park, Maryland  called FMS - [redacted] that is involved with student loans.  It is likely one of these two entities that has this consumer's debt.

Pursuant to receipt of this complaint, a full investigation of this file has been completed.  The consumer was included on a lease with three others including her ex-husband.  The lease was allegedly signed by the four in the presence of a notary - and was delivered to the rental office...

with the notarization attached.  This office attempted to contact the Notary shown on the document to no avail.  In addition, the signature shown on the lease is considerably different from that provided by the consumer with her dispute.  As such, this office has agreed to remove the consumer from any obligation to this lease, and to delete the information provided to the consumer reporting agencies.   Both actions have been completed.  This office will provide the consumer with documentation advising of same. Please be advised that this office has never had any direct communication with this consumer.  This office has, however, received two disputes via eOscar the liaison between credit furnishers and consumer reporting agencies; one in June, 2016 and another is April, 2017, both of which were...

answered promptly.  The consumer was also sent a packet of documentation in April, 2017, validating the debt.Included in that packet was a copy of the Statement of Deposit, from the original creditor showing the break down of the charges, a copy of the lease agreement signed by the consumer, the electric bill, and the rental application completed by the consumer.   A copy of that packet in attached herewith.    In addition, a judgment was issued on behalf of the original creditor on 5/6/2013.   A copy of that judgment is also attached herewith.As this is a true debt, supported by a judgment, this office will be unable to comply with the consumer's request to remove this from the credit reporting agencies.  At this time, the account is being handled by the law office of [redacted]  It would be in the best interest of the consumer to contact [redacted] directly to discuss a repayment arrangement, and/or to negotiate a settlement.   [redacted] may be reached at [redacted]

October 15, 2014Dear Ms. Horne:Pursuant to the recent complaint filed by [redacted], please be advised that this office has reviewed the file and offers the following response.On May 9, 2014, a collector contacted the consumer at his place of employment to provide information...

about a debt. Upon learning the purpose of the call, the consumer requested that he not be called at work and hung up. Immediately following that telephone conversation, the collector mailed a letter of explanation to the consumer.This office received no response to that letter nor did the consumer contact this office to discuss the account during non-working hours. As this office received no communication from the consumer and was prohibited from calling his place of employment where it is assumed he would be during regular Working hours, the account was reported on June 16, 2014 to the credit reporting agencies. On October 9, 2014, once the consumer learned that the account was reported to credit, he called this office and claimed that he had never been contacted. He said that it wasn't him that requested that he not be called at work, a statement that is contradictory to his complaint herein.The consumer's allegation that he was not afforded an opportunity to request validation of the debt is not supported by the data. Having said that, in an effort to resolve this amicably, this office will accept this complaint as a request for validation and will send same directly to the consumer. Unfortunately, this office will be unable to comply with the consumer's request to remove from the credit reporting agencies as this is a legitimate debt, and the records show that the consumer was notified of same.Should the Consumer wish to resolve and/or discuss this debt further, please advise him to contact this office directly. Pursuant to this dispute, this office has investigated the files and can find no evidence that there is any merit to the claims. This debt originated as a result of a breach of lease at [redacted] Apartments.  The file was forwarded to this office for collection on 12/1/13 where it remains...

today.  This account has never been sold, and has never been forwarded to any other agency.   Please also be advised that there is no record of any prior written dispute.   In fact, this office spoke with the consumer on 2/10/14.  At that time, the consumer stated that  she had no problem with any of the charges accept a portion of the rent.   Attempt to communicate with the consumer after that time went unanswered. Please find attached a copy of the signature page of the lease, showing two lessee; this consumer and [redacted].  Also, attached see a lease amendment form in which [redacted] was released from the lease, and [redacted] agreed to take full responsibility.  Lastly, see the resident's notice to vacate form, signed by [redacted] on 9/7/13. These documents serve as proof that Courtney Brown is the only liable party on this debt.At the time [redacted] entered into the lease, a driver's license and social security card were provided as identification.  There is a copy of the social security card attached herewith.  along with a break down of the charges that comprise the balance due.Further analysis by this office of consumer credit reports indicate that the name and address provided by the consumer in this complaint  are a match to those provided by the original creditor.As such, this office will be unable to comply with the consumer's request to delete this account.    Should the consumer be interested in discussing this further, it would be in her best interest to contact this office directly.

As a collection agency, FMS does not have the ability to report an account as pays as agreed.   It would be in the consumer's best interest to pay off both of these accounts, and have them shown as such.  In the meanwhile, the reporting will have to remain as it is.

Please be advised that this office received this complaint verbatim from the [redacted].    The issue seems to be that the consumer is confused as to whom the balance is owed.  She is disputing that she has an agreement with this office or owes a balance to this office (FMS) . ...

She is correct in that she does not have a debt with FMS.  FMS, acts as a third party debt collector for, [redacted].  The debt is actually due to [redacted] and being collected by FMS.    Unfortunately, as he has requested via this complaint that FMS not contact her, we are precluded from explaining this directly to her.     As we have already stated in our response to the [redacted], if [redacted], wishes to discuss this further, she will have to contact FMS.     FMS will be unable to comply with her request to delete from the consumer reporting agencies as this is a legitimate debt.   It would be in [redacted]'s best interest to contact this office directly.
