Pursuant to this dispute, this office has investigated the files and can find no evidence that there is any merit to the claims
This debt originated as a result of a breach of lease at *** *** Apartments. The file was forwarded to this office for collection on 12/1/where it
remains today. This account has never been sold, and has never been forwarded to any other agency. Please also be advised that there is no record of any prior written dispute. In fact, this office spoke with the consumer on 2/10/14. At that time, the consumer stated that she had no problem with any of the charges accept a portion of the rent. Attempt to communicate with the consumer after that time went unansweredPlease find attached a copy of the signature page of the lease, showing two lessee; this consumer and *** ***. Also, attached see a lease amendment form in which *** *** was released from the lease, and *** *** agreed to take full responsibility. Lastly, see the resident's notice to vacate form, signed by *** *** on 9/7/These documents serve as proof that Courtney Brown is the only liable party on this debtAt the time *** *** entered into the lease, a driver's license and social security card were provided as identification. There is a copy of the social security card attached herewith. along with a break down of the charges that comprise the balance dueFurther analysis by this office of consumer credit reports indicate that the name and address provided by the consumer in this complaint are a match to those provided by the original creditorAs such, this office will be unable to comply with the consumer's request to delete this account. Should the consumer be interested in discussing this further, it would be in her best interest to contact this office directly

This office denies the claims offered in this complaint and has documentation to support its position. This office received the account on 12/17/and sent a letter of notification to the consumer on 12/18/2015. In addition, this office placed telephone calls, and sent an
email to the consumer regarding the account. All attempts to contact consumer went unanswered until 1/5/16, when the consumer called this office to say that she wanted to pay the account, and that she would call by 5:PM that day. She did not call, and all attempts to contact her went unanswered. Consumer called again on 2/12/to say that she became aware that this was reported to the consumer reporting agencies and that she wanted to pay a small amount in exchange for having account delete from credit. That request was denied. She then offered to settle the account by the end of the month; February, 2016. No payments were received, and again, she did not respond to all efforts to contact her. To date, consumer has paid nothing. Consumer disputed this account several times with the consumer reporting agencies, and each time this office provided validation to affirm this as a true debtThere is no record of consumer ever requesting validation alternative to that provided to the consumer reporting agencies, and there is no indication that consumer ever disputed the debt with this office. Further be advised that this office does intend to resolve this account with the consumer in an amicable manner, but will be unable to comply with consumer's request to delete from credit ,as collection agencies are precluded from doing so under credit reporting guidelines. Please advise consumer to contact this office for additional information

Complaint: ***
I am rejecting this response because: It was my understanding that I would receive a commitment letter from *** ***, not a third party collection agency showing that I would pay the remaining balance owed to *** *** *** in thirty daysIt would show a month breakdown of a payment agreement that we discussed when I did a final walk thru and turned in my keysA letter which I never receivedI have always been a good tenant while there, never gave them any problems Instead, I receive a letter from a collection agency stating what I owe and had to pay it immediatelyI did speak with Josh, who became very unprofessional when I told him, a payment could not be paid that dayActually, he hung up the phone on meI called back twice and asked for his supervisor in which one young lady said, her name was *** and transferred me to her voicemailI left her a message on two occasions and with two phone numbers where she could reach me and she never called me backI am still disputing this because as stated, I do not owe this companyMy case is with *** ***, not a third party companyI never had any agreement with them (Financial Management Solutions)Therefore, they have no right to report this information to the credit bureaus.

The consumer, as stated in a prior response, has two accounts in this office. The first account was paid in full, and should be reflecting as such with the consumer reporting agencies. This office will follow up with eOscar to assure that it is reporting properly. The second account is age barred from reporting, and should not be reflected at the consumer reporting agencies any longer. As to the inquiry - this office will request a deletion of same

This office has never spoken to or received any written communication or request for validation of the debt from the consumer. This office does have an account for this consumer, and also does have a contract with the original creditor to collect said account on its behalf. As the
account in question is from a medical provider, this office is unable to provide any additional information as to the account, accept to confirm that the balance is correctly reported as 195.00. Please further be advised that this office does not report to *** as claimed in the complaint This office will forward validation of the debt directly to the consumer at the address provided in the complaint

Please be advised that this office received the same complaint from this consumer. The complaint contains non-factual information. The consumer claims that her telephone call was answered by Jeff Hausfeld. Please be advised that *** *** was not in the office on the date
the consumer called. The consumer further claims that she then spoke with Donna M***. I am Donna M*** and I have never spoken to this consumer. As to her statement that this office ran her credit without permission, please be advised that accessing credit for the purposes of collecting a debt is a permissible purpose under the FDCPA. Further be advised that the original client has rejected the consumer's offer to pay 50% of the balance to settle the account. AS such, we regret that we will be unable to comply with her requestShould you have further questions or concerns, please feel to contact me directly

I am rejecting this response because:
August 11, 2016I am not receiving this response because as a consumer I have not been given a fair chance I had not received a bill from the originally creditor nor the collection agency I received the bill when I requested it from FMS through Revdex.com I have a written statement from the Maintenance Supervisor of whom had the walls painted while living on the propertyI have no problem forwarding a copy to you I do understand that the original owner should contact me so many times and if no response, it goes to the collection agency Then the collection has so many days to contact me and they have not Even after pulling my credit twice I contacted them to see who gave them permission to run my credit and why I have not been given a chance to clear this matter I have also been disrespected by FMS, she never gave me a chance to talk to her, very rude As I see she has been with other consumers All I'm asking for is a fair chance to clear this debt As looking on the bill I am willing to settle this account with paying $114.04, $for hole in the wall, $for the electric bill and $for the gas bill All consumers should be treated equally and fair In this case I am not treated fairly. Regards,*** ***

The consumer is correct in that he does have payment arrangements for these two accounts , and they are set to be settled for the amounts shown in his complaintIt is the policy of this office to NOT reduce the balance on settled accounts until they have been paid in full (at the
settled amount). That said, this office does update the current balance every month with all of the consumer reporting agencies to which it reports. The upload to the consumer reporting agencies typically goes through between the 5th and the 7th of each month. The current balance on each account is as follows: *** *** - agreed upon settlement - 1,800. Amount paid to date 1,Remaining balance - 300.00. *** *** - Agreed upon settlement - 2,500. Amount paid to date - 1,355.35. Remaining balance - 1,144.65. In an effort to resolve this with the consumer amicably, this office will agree to reduce the balances to the amount shown herein. That action should update the consumer's credit within the December reporting cycle

I have contacted the consumer and explained our office policies in depth.  We are currently in the process of resolving this matter in a manner acceptable to all parties.

Please be advised that this office has received and responded to a prior dispute from this consumer.  The consumer's statement that there is no lease in her name is not true.  Please see the attached documents which include a copy of the breakdown of the charges, a copy of the signed...

lease, and a copy of the consumer's driver's license provided as identification to the rental office.   This is a valid debt.  This account has been forwarded to the Law Office of [redacted] for legal remedy.  All future contact should be directed to Mr[redacted]'s office at ###-###-#### - [redacted], Rockville, Maryland.

There are two accounts in our system for this consumer.  One of them is paid in full, and the other has a balance in the amount of 5,043.45.  When the consumer called the office, both accounts were accessed.  The consumer is correct in that this account is time barred from litigation,...

but that does not mean that this is no longer a valid debt.  Additionally, accessing a credit report for the purpose of collecting a debt is a permissible purpose, and does not require additional authorization from the consumer.

Revdex.com:
I spoke to Donna Meyers, operations director at FMS, and we came to a mutual and satisfactory resolution.

I am rejecting this response because:This account does not have a contract, I did not signed a contact with this company. it should be removed from my credit reports.
Regards,
[redacted]

Pursuant to the complaint filed by [redacted] (consumer), this office has completed a review of the file, and the records do not support her claims. This office is a third party debt collector and does not own this debt.  It collects on behalf of its client, [redacted]...

[redacted].  This office has never claimed that the consumer owed it directly.   The debt was received by this office on 8/10/2017, and a letter, dated 8/11/17 was mailed to the last known address for the client.   On 8/16/2017, the consumer called this office and discussed the debt with Josh H[redacted].  Consumer advised Mr. H[redacted] that she would be unable to make any payment on the account until September, 2017.   Mr. H[redacted], advised the consumer that this account would be reported to the consumer reporting agencies.  The consumer did not answer telephone calls made to her on 8/17/17 and again on 9/12/17, and has not made any payments.   In addition, there is no records that the consumer requested validation of the debt.  For the record, this office does not repot to [redacted] as stated in the consumer's complaint.   Please find attached, a copy of the breakdown of charges, the lease agreement signed by the consumer, the application completed by the consumer, and the ID provided by the consumer to the client.  As this is a validated debt, this office will be unable to comply with the consumer's request to remove same from the consumer reporting agencies.
