Review: Money back guarantee promised. Was told refund would be processed in 6-8 weeks. CS operator said probably by end of November 2014. Then told by CS operator on 12/**/14 I would have it 12/**/14. This is 12/**/14 and still have not received refund. CS has been very uncooperative.Desired Settlement: Full refund of $645.00 ASAP.

Response:

We began reprocessing [redacted]'s returned unit in the first week of November. We indicate on our website (and in materials we sent with the device) that we have a 4-6 week period before refund checks are issued (returned devices are reprocessed by our manufacturer). Unfortunately, we required the 6 week period, and recently mailed out [redacted]'s check (prior to Christmas). If it has not already arrived, it probably will by the end of the week. She can voice any concerns to one of our directors, [redacted] by calling ###-###-####.

They did not mail the refund check before Christmas as they claimed. It was postmarked 12/**/14.

Sincerely,

Review: On 09/**/2014 I ordered a Fisher Wallace stimulator. I authorized a payment in the amount of $695, using my [redacted] account. The website advertising the product showed a 100% refund policy if the item was returned within 60 days. The stimulator was returned to Fisher Wallace on 10/**. I called to verify that they had received the item back and asked if I could be refunded electronically as my payment had been received. They said they only give refunds by check and I should receive it within 6 weeks of the return. I received a check on 12/**, dated 12/** in the amount of $575.05. The check references a "Discounts and Refunds: [redacted] - Re" fee of $69.95 which they deducted from my refund. When I called to ask what the charge was they said that it was a restocking fee. I pointed out to them that the restocking fee is not stated on their website. The [redacted] said they used to have a restocking fee but have since removed it from their site. I asked what date was the restocking fee removed from the site. The [redacted] said he did not know. There was no restocking fee listed on the website when I placed my order.Desired Settlement: I would like to receive the 100% refund that they advertise on the website.

Business

Response:

On October [redacted], 2014, Fisher Wallace Laboratories raised the price for the Fisher Wallace Stimulator and introduced a full refund policy. Prior to that, we offered a 90% refund. All of our patients' instruction manuals (which included the return form that is requested for a refund) clearly indicate our return/refund policy; so, there is no excuse for not knowing where she stood. The patient in question did not pay the new price or purchase our device under any different terms. Therefore, we refunded her as per our agreement.

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

I paid the current price advertised on the merchants current website. The price for the device was $699 which is the currently advertised price. The website offered a 100% refund if not satisfied and that's what they should honor. The site never mentioned a restocking fee and they did not offer me a lower price.
