Review: Keep billing me after I cancelled 3 times! Fed up and want my money back!Desired Settlement: Refund

Review: I had contracted for personal training services in September of 2014. In February and March, I cancelled my appointments for the month stating that I could not afford to continue at this time.

Before my appointments took place for the month of April, I was billed $217.00. I was told that I should fill out a cancellation notice, which I did and applied for a refund. I stressed the fact that my financial obligations had not been met with my mortgage and emailed a copy of the front of the bill to them.

My refund was denied. I then asked for a copy of the Cancellation form that I had signed and requested a copy of my membership contract, which I had not retained. The Cancellation form was not complete until signed by a manager, henceforth I did not receive a copy at the time of signing.Desired Settlement: A refund for the training services.

Thank you

Review: They continue to bill me when I told the associate in novemeber that I would be moving to Pennsylvannia and to cancel my account. I signed up for my membership around August of 2012. I paid for my membership every month a month ahead of time even took personal training classes taht I paid for upfront. Around November 2012 I got a job offer in PA. I went into the gym a week before I left and informed the rep tha I would no longer be using my membership being that they did not have a location where I would be moving. I paid for DEC, I believe, and the girl said "not a problem I will notate your account you will be all set." I checked my credit report a couple of weeks ago and I noticed that I had a $403 collection for their collections agency. I tried calling The Edge and the people at the location keep telling me to call billing because they can't "CANCEL ACCOUNTS IN THE GYM" I called billing and billing says I have to speak with their condesending collection agency who says the only thing that I can do is PAY THE OUTSTANDING BALANCE. I haven't used the facility since the day that I told them I was moving I don't owe edge anthing whatsoever and it is werong for them to try to hold a contract against me when I informed them of the cancelation.

Desired Settlement: DesiredSettlementID: Refund

I would like the bill to be wiped clean. It is unfair for me to have to pay for something I have not used.

All cancellations are done through the billing company so there are never any issues like this. (Stating they cancelled in club.) We never accept cancellations in the club.

In order to maintain good customer service, we have asked that [redacted]'s name be removed from the collection company.

Review: If I lease a car for two years, it's over after two years, and I stopped getting billed. If I rent out a condo and sign a two year contract, after two years it's over, I stop getting billed. Why is it that after a two year contract with fitness edge they keep billing me? When I signed the contract with the rep for two years, I was not told this and I feel it is very important considering I haven't gone any of those days after the end date, I have to call to cancel? So, I did, but the billing still did not stop! AFTER I EMAILED AND ASKED FOR A REIMBURSEMENT OF FUNDS AND CANCELATION THE REP ACTED LIKE SHE WASENT TOLD WHAT TO DO AND STILL BILLED ME A WEEK LATER FOR ANOTHER MONTH!!!!!!!ARE YOU SERIOUS? I WANT A REFUND. TODAY!Desired Settlement: I sent a email on 7/20 for cancelation and reimbursement. A full refund for $125.27. I was than again billed on 7/28 for $27.58. Which brings the total to $152.85. I want a refund for dealing with this situation by not being under contract. I am not under contract, I do NOT owe you anything!

Response:

the life of [redacted] agreement was 24 months. On the 25th month, the membership continues month to month and [redacted] can cancel anytime with 30 days notice.

As I see [redacted] first attempt to cancel was on 7/21, we will refund his 7/27 payment and make sure his membership is cancelled.

Review: Repeated attempted collection after cancellation of membership halfway through.Desired Settlement: NO more attempt at collection or contact under ANY circumstances or I require all previous refunds at once from them in settlement.

Review: I cancelled my membership in May 2014, with [redacted], the outside billing company The Edge uses to process their monthly & annual fees, as I was advised by the Edge fitness staff. I sent a formal email to [redacted] regarding the cancellation, as they requested. They advised I would be charged for June on the account, since there is a 30 day cancellation period (point #1 I think is a little absurd. If I want to cancel, there should be no mandatory additional time added to my agreement). June went by & my card was not charged (great!) - but I also did not receive notification from the club that I was billed (point #2, if a bill is generated, why wouldn't that be mailed? How are consumers supposed to know they have pending payments to this club...) July is here, the month they charge their annual fees of over $40.00 and, my card was charged! I called [redacted] who confirmed it was not them, but the club. I called the club, advised them of my cancellation (which they know I started the process due to notes in their system - but [redacted] apparently never sent notification to them). I requested a refund based on my cancellation email sent in May - at which time, a rather arrogant staff member said he wasn't able to process anything until [redacted] confirmed the cancellation. (Point #3, I signed an agreement / contract with the gym NOT [redacted] - why was I waiting for them to cancel my membership). I am now in limbo, with an email sent to the club manager as well as a re-send of my formal cancellation email to [redacted] - hoping & waiting for someone to confirm my credit card will be refunded immediately & the charge for the annual fee will in fact be credited off the account. The practice of having (2) businesses charge your card for the same services ([redacted] & the Edge) is a little sketchy - furthermore, having the Edge charge my card without proper authorizarion seems a little negligent.Desired Settlement: I need a refund immediately for the charges processed by the Edge. Those are the ones in dispute at this time.

Business

Response:

Since the member has spoken with [redacted], they have released a refund in the amount of $47.84 which covers the incorrect billing that took place on the members account. [redacted] researched the members account and found that the postmark date of the cancellation received should have been in enough time to avoid the enhancement fee payment. Therefore, they have refunded the amount of $47.84 as of July 11, 2014. This should resolve the issue at hand for this member and the member is not responsible for any further payment. If there is anything further that I can assist with, please do not hesitate to contact me directly.

The salesperson who dealt with this gentleman explained that he had originally come in the prior week regarding a membership inquiry. Review: In 2010 I attempted to cancel my contract with Edge, after speaking with [redacted] I was informed I had to send a certified letter, which I did. I assumed that the account had been closed. 3 years later, it turns out that the account is not only closed but that they have no record of the letter I sent being received. No one contacted me to alert me that the account was still active, or that it had lapsed ( I closed the account connected with the club). When I called to sort the confusion out I was transferred from the gym location to [redacted] who then referred me to [redacted], who having no record of me referred me back to [redacted]. [redacted] told me that I would have to contact the gym location, who then told me that I would have to speak with an account specialist at [redacted]. After several rounds of this, **C informed me they would have to "resurge" my account and I would hear from someone in 5 days about the state of my account, during which time my account was accruing further interest. Now I am waiting to find out what I owe and to whom, and whether or not I can negotiate a debt I wasn't even aware I still had.Desired Settlement: I would like to know, who and what I have to speak to FINALLY close my account, and to discuss what options there are for me to negotiate a lower balance.

Review: I had a month to month membership, which I cancelled in August. I was billed for September membership, as well as the October yearly maintenance fee. I was told that I had to pay this because I did not cancel within their thirty day policy cancellation window, and also had to pay yearly maintenance. I did not have a yearly or two year agreement so I want a refund. When I went to a month to month membership, I was given nothing to make may aware of this policy. Review: I received a "gift" of a gym membership that I didn't ask for or want. I did not step foot in this gym, I did not sign a contract. They have sent me to collections and their collections representatives have been harassing me EVERY SINGLE DAY for months. I spoke with [redacted] the assistant manager who acknowledged I did not sign a contract and told me he would stop the membership moving forward but that I owed for the past due balance. HOW IS THIS LEGAL? If this is legal, that means I can go and sign someone else up for a credit card, shop on it and have them pay the bill! This is beyond ridiculous to me and the credit collection people are nasty and rude. Please help.

Business Response /* (1000, 5, 2013/05/29) */

The Individual that signs for a membership and provides the billing information on file is ultimately responsible for fulfilling the terms of the membership, in this case a 12 month commitment. We have an electronic copy of the signed agreement on file with signatures.

Consumer Response /* (3000, 7, 2013/05/31) */

(The consumer indicated he/she DID NOT ACCEPT the response from the business.)

I never walked into the store, nor signed a contract. This is FRAUD. I hope you understand that. This is no less than FRAUD. This is as bad as identity theft. Reputation management is a very hard thing to handle when you break the law. The next correspondence will be from my attorney and local news stations. Have a great day.

Business Response /* (4000, 9, 2013/06/19) */

In this case a family member, the Husband of the complaintant signed for a membership. This was for his wife. If the wife chooses she does not want the gifted membership the husband then must fulfill the terms of the agreement. Someone is responsible for fulfilling the terms of this agreement. The signatures of the applicant then must be the one responsible for the payments.

Consumer Response /* (4200, 11, 2013/06/20) */

(The consumer indicated he/she DID NOT accept the response from the business.)

Irrespective of who filled out the paperwork - it wasn't me. Therefore, this is fraud on your part for allowing it to happen. Your representatives knew the person signing was not the person and allowed it to continue and you processed it with full knowledge the one you were obligating was not and never was present. The contract is not legal. I've also been harassed daily by collections. I'm pursuing charges.

Business Response /* (4000, 13, 2013/06/27) */

[redacted] signed [redacted] up and signed the agreement that he was responsible for the payment of the membership. So, [redacted] is right, the company should have been calling [redacted] and not [redacted]. I have sent a request to the company requesting that they cease calling her immediately. Review: So I signed up for the edge gym in November of 2014 and I am now trying to cancel my membership - as I just live too far from any of the club locations. I live in [redacted], and the closest location is 16 miles away. I have contacted Edge, and they sent me directly to [redacted], as they are the billing company for the club. To my surprise, Edge's contract is apparently binding, and cannot be cancelled unless you move and any club location is 15 miles or more from place of residence. Apparently I don't qualify for this, since I have not moved at all, and I signed up with my current [redacted] address. I recently signed up for the [redacted] which is less than 2 miles from my house, and I can take advantage of additional services such as: a Pool, sauna, and other facilities which none of the EDGE gyms offer. This in fact is another reason why I like to cancel; Edge does not offer everything I am looking for in a gym; it did back in November 2014, but not any more.

I have talked to [redacted] multiple times about the issue, but they will not budge since they are going by EDGE contract. If I was ever told that the contract was binding, then I would have never signed up for such Gym. In reality I have not heard of such a contract style for any gym that I know off. Normally businesses require a early termination fee, which I am ok with doing, yet the edge does not have such policy.

I just think is ridiculous that you are forced to pay for something that you don't use at all; since I have found a better alternative to fulfill my physical activity ([redacted]), then I should be allowed to terminate services with EDGE.Desired Settlement: I want my account cancelled.

Review: I became a member of the fitness edge of [redacted] in March I enrolled in the personal training program. I recently had the activities suspended because I could not make my appointments. A week later I decided to cancel the personal trainer when I relized a charge on 21.26 on both of my cards. They claimed it was for classes that were supposed to be suspended. I went to the edge and the manager stated that I would still be charged $70 for an unknown reason in June due to not giving a 30 day notice while I was currently signing the 30 day notice. Besides that point the classes were not to continue till July so it was actually more then a 30 days notice. The manager did not make me aware I would still be charged for there classes nor should I be charged $70 when the contract states that if you give more then 30 days notice you will not be charged. When I stated this the manager proceeded to walk away from me and did not answer my questions because possibly or lack of knowlage or because she was wrong. No one will tell me why I will be charged $70 when I did not violate a contract also because I have followed the rules of the gym and filed a more then 30 days ahead notice and I did not nor ever approve or was aware of extra charges for classes I do not attend at the club.Desired Settlement: I would like to have the 21.27 refunded to my [redacted] credit card. And I would like the $70 to be waived since no one told me about the classes charge that I DO NOT attend. And for the $70 that will be charged wrongfully when I have signed a more then 30 days ahead notice. If a refund isn't supplied then I would at least like the $70 waived since they are violating there own 30 days notice contract. And did not make me aware of these extra charges.

Review: Myself and a family member joined the gym sometime in February 2015. At the initial sign up we were told we did not need a credit card number on file for billing as they billed through a third party company and paper billing could be forwarded to our homes. As a convenience I paid both enrollments on my credit card while we were there and we were to convert to paper billing through [redacted]. Sometime May 2015, my family member called to cancel her membership due to her being diagnosed with tachycardia and remove my credit card from her file as I continuously was being billed after we removed our credit card from the file and I was charged an addition 5$ fee for a late payment every month because the 3rd party company removed me from their system and they were now MANUALLY inputting my credit card through their systems (INSTORE)which individuals who I am unable to receive their titles authorized the transactions!!! After being yelled at and interrupted and cut off by the General Manager of the [redacted] gym I was told YES they do offer paper billing through this 3rd party company BUT HE WILL NOT remove my credit card from the file because he doesn't do business like this and wants to hold me responsible for an account that is NOT mine. At this time I will be cancelling my membership as well for the poor customer service and LACK OF SERVICE, I received from this individual and I am demanding a refund for all of the months I was charged for a membership that was cancelled and LATE FEES ASSESSED AFTER THE FACT and received paperwork from this third party company confirming the billing would be mailed to the hose. I will never recommend anyone to this gym and I am very upset I was spoken to in the manner this GM thinks is acceptable.Desired Settlement: REMOVE MY CREDIT CARD FROM THE SYSTEM AND CANCEL BOTH MEMBERSHIPS IMMEDIATELY!!!!!!!

Business

Response:

After being yelled at and sworn at my this customer I polity told her a card has to be on file in our system and that it does not allow use to take a card off file without another form of payment. She signed the agreement for the membership and was held responsible for the payments. She was upset with this out come and came down to our club and started yelling at all of our staff, the police were called and she was later asked to leave the club by them. I also spoke with her husband and I explained the situation to him and explained that I was willing to help them in anyway I could. I let him know that we would be glad to take the charges off of the current card and put them on another card so that we could remove the card on file and replace it with another one.

Review: To whom it may concern; I have a membership with the fitness edge of [redacted]. my member ID is [redacted]. In September $345.64 was debited out of my checking account. Prior to that there was a a debit my account on August 28 for $207.38. I have canceled my membership and no longer a member. There is a total of $492.29 due to me. I have requested a refund. I was told by the manager that I can use it on something else and will not refund my money. That's money I earned. I will spend it as I choose. He can spend his money as he chooses but not mine. Still to this day I have not received my monies due to me. This is bad business practice. They want to keep to keep my money without providing me a service. If I can provide you any more information I can be reached at ###-###-####

Response:

On January 7th, 2013, [redacted] came into our Fairfield club and joined our club on a 2-year agreement. There is no wrong-doing on The Edge's part. We ask that all members sign off and acknowledge that they are in a committment and that there are 2 ways of cancelling: medical or a move outside of the area.

We try to take all customer service issues on a case by case basis. I do not show any notes that [redacted] reached out to [redacted] or The Edge to try to resolve the issue first. If there is some sort of "hardship", move or medical case, than we would be willing to cancel [redacted] membership. If she could reach out to me directly, then I can help her.

8 September 2014
The Edge Fitness Clubs [redacted] To Whom It May Concern:
Based on past interactions with your organization, I don’t expect this letter to result in any resolution nor is a resolution sought-after. However, as a once paying and loyal patron of your gym, I feel the need to express the pure disgust with the treatment I’ve received from your company—to be specific those in the ownership roles of your company. The interactions I’ve had with this company nearly eight months ago and today have been completely unprofessional and outright unfair. Nearly eight months ago, I was approached by an individual—the owner or one of the owners, not certain of your company’s ownership structure—who: in plain clothes, without identifying himself as an employee and/or representative of The Edge Fitness Clubs, approached me, verbally reprimanded me for making a simple mistake—accidentally hitting a ceiling joist over the “[redacted] to the wall” area with a medicine ball. He then proceeded to walk to the front desk and point me out to the staff members. This is the equivalent of being pulled over and reprimanded by a police officer that fails to identify himself as such. As an individual who at one point loved your facilities, to the point I sought employment as a sales agent of your company because I had a personal vested interest in seeing growth in the organization, I was thoroughly insulted. In attempt to make it clear that it was not in my intentions to damage or mistreat the facility I later approached the still unidentified individual. This individual—who I’m assuming was intimidated and/or insulted by my interaction immediately took a defensive stance and in extreme unprofessionalism and arrogance replied first stating I was breaking rules—rules that were posted nowhere in the club—by having a bench on the turf. He then continued to inform me he’s the owner of the establishment and if I don’t like the way he does things I can, in turn—in his exact words—cancel my membership because he has a thousand members and he could careless about losing myself as one. I am certainly no owner of a fitness club brand with multiple locations or any other business for that matter; however, I know such a statement is completely unprofessional when speaking on behalf of an organization. At that point I gladly obliged and canceled my member, which was no longer under contract. For the past few weeks under the influence of a few of your gym’s current members—who after hearing of the treatment I’ve endured, will soon be canceling their memberships as well—and also because I do enjoy the equipment of the facility; I have been using your Hamden, CT facility, each time paying the ten dollar single-day club use fee. However, today, nearly eight months after the before mentioned incident with the owner of this establishment, I was, at the front desk in front of assumed employees and other members, approached by the manager or acting representative of the owner and informed I was not wanted on the property. This came as a complete shock to me being that I’ve used the facility multiple times within the last month, without incident, but because the owner—a supposed business man, who’s goal, or at least one would believe to be, is to maximize profits and minimize cost, that is the sole purpose of for-profit businesses, correct? —Has a personal grudge my patronage is no longer wanted. As a once supporter of you company, I am beyond disgusted and offended by the actions of this company. As I said, I don’t expect or want any resolution or apology from your organization. Furthermore, to avoid being a defendant of a possible civil case, I can’t tell anyone to not be a customer of yours. However, I can certainly and will certainly share my experience with as many people as I possibly can, leaving the decision up to them. In my personal-uneducated opinion, your company—specifically the owner—should heavily invest in customer interaction, relationship management training and maybe even invest in a procedure to interacting with customers in situations as such. I will also take this opportunity to relay to you, one of the biggest lessons learned in my military experience, a company, business, organization, team, etc. is only as good a those in leadership roles. The owner, an assumed leader of this organization, has in my opinion proven himself to be an—for lack of better words—arrogant, unprofessional and demeaning [redacted]. With that in mind, what does that render his company?
God Bless,
An Extremely Dissatisfied Customer

Response:

On Tuesday, October 14th, ABC billing company received an email to cancel this membership. As we require 30 days notice to cancel all memberships, the 10/30/2014 dues should have been drafted, however, I have waived that. We do not issue membership refunds, like in this case, where the request to cancel came after the last bill date. The enhancement fee is a once/year fee that was agreed upon at the time of join.

Review: I singed up for personal fitness sessions at the gym. When I signed up I was told that when I wanted to change or cancel the sessions what I needed to do was call the gym a week before my payment for the following month would be due and the changes would take affect without any issues. Well I did as instructed...on 12/17/13 (payment was due 12/26/13 for my Jan. sessions). I contacted the gym and spoke with my trainer about changing my sessions from 4 a month to 2 a month. He processed to give me 2 sessions (1/7/13 and 1/21/13). Now based on what I was told when I signed up I thought I'm good....the billing changes would change as well. Upon my return from Christmas vacation I found that Fitness Edge charged my account $194.59 for the sessions, so I contacted the gym and spoke with the General Manager which apologized for the confusion and stated I should have spoken to a manager to make the changes....if that was the case why didn't the training let me know that I should speak with a manager at the time he was making the changes. She then stated I was not able to get a refund because training sessions are none refundable which I was not told. She also told me that it takes 30 days for any billing changes to take affect which is something I was not told upon signing up either. I followed the instructions that were given to me by the club to change my sessions but they are refusing to refund the $194.59 back to me. I refuse to pay for this or any more training sessions....and would like to cancel my membership without any futher financial obligation to Fitness Edge.Desired Settlement: I would like a refund for the training sessions that was charged in the amount of $194 and cancel all future traing sessions as well as my membership with Fitness Edge. This experience with the club has left a bad taste in my mouth for this culb and all clubs like it.

Business

Response:

- I have

already removed her sessions going forward but she never came to the front to

make any changes to her schedule so she was still booked in for her steady

times hence why she was billed the amount she stated. I told her once her

school schedule free's up I am happy to help schedule sessions but at that

point she started getting very rude and told me she wanted a refund and I told

her her sessions are not refundable and she can apply it towards another in club

service. I pulled her contract and she signed for 1x week training with

Joe. Again, we would be happy to apply the amount she was billed to any other service or membership in the club.

Review: The Contract terms for the Edge Fitness Club are onerous. What should have been a $200 charge to catch up with dues turned into a $645 nightmare to clear. Back charges, full contract charges, 18% interest on everything and 10% of the entire bill to pay by debit card, so I had to share my checking account information to avoid an additional $60 charge. The account was for my daughter, who just turned 18 and did not understand the full ramifications of the contract. The late fee is not detailed in the contract, nor is the 18% interest. Cancellation of the contract is also onerous, requiring certified notification 30 days in advance. Membership should come with a giant BUYER BEWARE sign!Desired Settlement: I would like a refund of all late charges, interest and processing fees.

Review: My name is [redacted] and my membership has been up since July 25th. I never intended on rolling over my membership but due to the lack of training on the Edge Fitness Clubs, I was charged with another monthly fee for the month of August. What I am concerned about is how both [redacted] and [redacted] Edge staff members did not tell me that I was suppose to go about this process to cancel my membership. I asked both clubs if there was anything that I needed to do in order for the membership to not roll over, and I was always told the same thing. I was assured that the membership would not roll over, the contract was canceled after the 25th, and that no further action was needed from me. I try talking to a supervisor at [redacted] so I can get my money back for this month, but I was told that there was nothing they can do. I also tried to plea my case with the Edge Fitness club but I was met with a manager that did not want to take any blame and was rather offensive. Again, I asked the clubs numerous times if I needed to do anything to cancel my membership completely but they both said no further action was needed from me.Desired Settlement: The exact refund I would like to receive is $26.58. If a bank statement is needed to prove the amount, I am more than willing to provide this statement.

Response:

On August 26, 2014, [redacted] received their first call from [redacted]: it was the first attempt to cancel the membership. This was after his August 25th payment had been taken. I have now cancelled [redacted] membership with nothing further due.
