I am rejecting this response because: It is untruthful I called this business at the end of MAY, and told the representative to stop auto drafting from my account They told me that if I unenrolled in the auto draft, that they would sue me I told him that would be just fine, because I know as a paralegal that as long as I am paying my bill- they can't sue me They have harassed me, lied to me, and illegally drafted my account AFTER I revoked permission Also, the phone call that the business is referring to happened on July 5th after I looked at my bank account and shockingly saw that they had continued with the draft I spoke with the supervisor informing her about my previous request to cancel the auto draft in MAY What they did was illegal, immoral and distinctly distasteful I don't deserve a $** refund I deserve a $*** dollar refund

The original creditor informed us this debt is valid, we have sent his concerns to AT&T to investigate furtherWe have mailed Mr *** a validation notice as well as we have marked his credit as disputed as required by law. Thank you

FCSI received the account of *** * *** from the original creditor AT&T on 10-4-in the amount of $for the number of *** *** at the service address of *** ** *** ** *** *** ** *** **Since
receipt of this complaint FCSI reached out to original creditor, AT&T and was informed that the account was investigated by AT&T for fraud and it was concluded that the charges are sustained and the debt is valid and due. We have requested that a final bill be sent to the consumer for their review, it appears there are returned check charges and fees that make up the majority of the outstanding debt Thank you

I am rejecting this response because: Television service was provided through Direct TV. AT&T contracted with DirecTV to provide that serviceDirecTV sent me a final bill and I paid it and I paid AT&T for the telephone and internet service that was provided to my house. I am not going to pay for television service twice which what will happen if I pay AT&T for same service that I paid to DirecTV when they sent me a final bill.

The payment the consumer references making a week ago was made on 8-22-16, days ago and didn't post to her account until 8-23-16, days agoShe paid a portion of the debt in a settlement agreement and the protocol is to get a response from our client agreeing to the settlement before we send
any confirmation of settled in fullThe manager directed the supervisor to go ahead today and email the settlement letter to the consumerThat was done and the consumer should have that information in her emailThank you

We have several *** * *** in our database and they are all in many different states , I can not locate one with the address or telephone number given by Mrs ***Please provide our account number and or his social security number so I may better locate the account in

Complaint: ***
I am rejecting this response because:
The response from the business does NOT address the issues that I described. The main issue is as follows:
1. The collections agency lied about receiving information from ATT stating that the delinquent bill is valid. The lie was perpetuated by the collections agency sending me a letter stating they had validated the debt with ATT when in fact they had not. I was informed that they had not heard back from ATT when I called the collections agency to again dispute the debt (this was the second time I called). Therefore, the business lied about validating the debt2. The agent I spoke to during the first call I made to the collections agency stated that they had sent me several letters regarding this debt since 2014. I ensured the address they had on file was correct, which it was. I have received around a total of letters since reference this matter, the first being in and the third this year, 2016.
I am seriously questioning the integrity of this collections agency. I never stated that anyone with the company threatened me or anything of that nature. Therefore, their response does not address the issues at hand.
The remedies that I requested still stand:
1. I do not want the collections agency to contact me via mail, phone, email, fax, telegram, stool pigeon, etcunless and until they have spoken with ATT. (I for a fact know that this debt is no longer valid because I paid it in and I have spoken to ATT myself)
2. I request that the collections agency send me a letter stating that they have contacted ATT and that they have discovered that the debt is no longer valid3. I request that this be immediately removed from all of my credit reports as if this never happened because the debt was paid in and should have never been placed on my credit report. I request that the collections send me a letter stating that this debt will be wiped off of all of my credit reports.

We have the accounts referenced, of the accounts have been removed from the credit reporting agencies and the other are valid and due and we have sent the consumer a validation letter and service invoices for these accounts which will remain on the credit reporting as disputed
Thank you

As of the date of this complaints answer, the account was paid in full to the original creditor AT&TWe spoke with our client AT&T and was informed that no one informed the consumer we could
remove the debt from the credit, they stated that the consumer would have to speak to us about that issueWe work for our client and if their policy is not to remove valid items from the credit upon payment of the debt, in full or otherwise, we have to honor their policiesWe have no authority to have this debt removed from the credit reporting agenciesThank you

We were not aware that we were calling the wrong number, upon receipt of this complaint we have removed the number givenWe have had no communication prior to this one to let us know it was a wrong number, our client referred the number to us as a valid contact numberIt has been
removed
Thank you

FCS was first notified of any dispute on the consumers account on 4-6-and was responded to as well as another on 4-7-which was responded to as well, every dispute we have received has garnered a responseWe reached out to the original creditor, AT&T, and they informed us this debt
is valid and dueThey have forwarded a final bill that will be sent to * ***We have responded to every dispute sent and in a timely mannerEach time we validated the debt to be valid and due and we have noted * ***'s credit file of the disputeThank you

Again - I would like the agency to remove negative information on my credit reportAs indicated, when I finally got a hold of *** and called them, they communicated a debt that I resolvedFranklin falsely represented that they made attempts to reach me from March until August and merely had to leave a message or any informationThe first time I heard from them was to inform me of a credit actionI am not sure why *** did not contact me by phone or letter but if they had I would have done what they did which is paid themPer the fair credit reporting act requirements, Franklin misrepresented their actions to myself and ***, and acted illegally in effecting action without first contacting me In fact their response doesn't deny this.

I am rejecting this response because:I would like to keep this open until I get the letter from ATT which after talking to them before, they had informed me that the issue was resolved. So, I'm confused on this company's response saying that ATT told them it is valid and due. Where's the documentation that shows this proof. The lack of any evidence before impacting somebody's credit is exactly what I am disputing. And, the lack of any type of resolution shows once again that this company fails the customer. So, this matter can be closed once I get the letter from ATT and need an explanation on why they told me before this matter was closedRegards,

I have reviewed Ms *** account and she was told we would keep the auto payments we have on her account like she has been doing for almost a year and we would waive the $** for herShe did not want us to do that, she wants to set it up her payments through her own financial
institution for it to be paid every monthWe did stop all transactions scheduled in our system for July and forward and I have requested the last payment of $** she paid for June be refundedWe still have her set up on payment arrangements of $*** to be paid by the 4th of each month, if she will insure the payments are received in the same time frame monthly, she can make her payments to us through her bank as desiredThank you

Thank you for transmitting the complaint. FCSI was assigned collection responsibilities for this consumer debt on or about 01/25/13. The relevant account data was lawfully transmitted to the
Credit Reporting Agencies (CRAs) on or about 03/08/13. The three (3) year statute of limitations for the consumer debt expired on or about 10/06/14. Franklin Collection has not sought payment of the debt from the consumer since that time. Upon FCSI's receipt of Mr***'s call about the account in June of 2016, we requested that the CRAs mark the account as "disputed." FCSI is not aware of any requirement promulgated by the FCRA, or other Federal of State Law, mandating deletion of transmitted account information after the expiration of the applicable statute of limitations. Thank you
