The homeowner reached out directly to us and we are already in the process of making corrections to the HVAC system.  The system was sized correctly, but it did have some issues that needed to be corrected by the HVAC installer. We believe that the homeowners concerns will be resolved by the end of today.

Our Sales Manager has spoken with [redacted] on Tuesday, September 6 and reached an outcome that is agreeable to both the customer and our company.  This should resolve the buyers concerns.

On September 24th, [redacted]t were contacted by [redacted] legal counsel retained by Gehan Homes, and was informed that the Timeline expressly stated in their contract with Gehan Homes that the "construction dates are projected and are...

subject to changes due to conditions both beyond and with (Gehan Homes) Control. However, Gehan Homes is willing to refund  [redacted] earnest money in the amount of $3,000.00, plus one-half of the option deposits ([redacted]/2 = $[redacted]), for a total of $[redacted].  This settlement offer represents Gehan Homes best and final settlement offer. Should the Crist's choose to decline this offer, Gehan Homes shall retain the $3,000.00 earnest money as well as the full $[redacted] in other deposits as allowed under the express terms of the Contract.

Gehan's proposal to repairs my floors does not meet the replacement cost.  The written proposal prepared by the flooring specialist recommended by my insurance company met the requirements.

Gehan Homes has responded in writing to both letters
referenced in Ms. [redacted]' statement and we have received confirmation that
those letters have been received. After reaching out to the [redacted], we have confirmed that [redacted] does have a commercial
license that is currently active and in good standing.  Gehan Homes has received no written
documentation from experts in the respective field showing that the cause of
death of the trees along the common property line were caused by anything other
than boring insects or bacterial and fungal infections.

We received Ms [redacted]’s recent comments stating that the
drainage is still not resolved.  We completed repairs to the side yard,
and we had the survey company create a new topographical survey to verify the
modifications are acceptable for drainage.   We also inspected the
home this morning, after a large rain event last night, and the yard is
draining properly.
 
Our warranty guidelines state that a swale should not have
standing water after 48 hours, and we are meeting this standard.  There is
no action needed at this time.
 
If it is found that water is standing 48 hours after a rain
event then we will gladly review it under warranty again.

his concern with the island previously at which time our Area Construction
Manager and Division Sales Manager both...

spoke with him about his concern. 
 
We regret that there may
have been some misunderstanding as to what the island would look like, but we
have verified that we did build the island according to what [redacted]
contracted for and what all marketing diagrams and blueprints showed it to look
like.  The island in the home that we are building for him is not the
standard island as he mentions in his letter to you, but is in fact the upgrade
that we charged for.
 
Our Division Operations Manager
spoke with [redacted] on December 17th and we have reached an agreement concerning
the island which is agreeable to [redacted] and Gehan Homes.

Today we completed the repairs on the following at the
[redacted] home, as per our agreed upon schedule with the homeowner:
 
Repaired 3 areas of drywall damaged during the
investigation phase
Reinstalled the tub skirt
 
The painting of the drywall repairs is on schedule for
[redacted].
 
[redacted] still disagrees with the offer we made for the
wood floors replacement, but our offer remains.

We did receive a call from seller [redacted] on 9/6/16 we have come to a agreement, they will refund the ernest money ( 3,000 ) but not the design center money (1,578) she send the agreement to sing on 9/8/16, we now are only waiting for the authorization of corporate to release this money, this will come from [redacted]  say it will take couple of weeks.

Our Area Manager met with Mr. [redacted] at his home and reviewed
his complaints with him.

He showed us an area on the right side of his
home which he says holds water, but there was a heavy rain event within the
past 12 hours of the meeting and there was no standing water found.  The
warranty states  that “Builder will correct water which stands for more
than 24 hours, or more than 48 hours in swales”.  There was no evidence of
standing water here only 12 hours after a rain, so there is no repair needed.
We looked at the staircase and upstairs floor
where he told us there were multiple squeaks.  We found no evidence of
floor squeaks needing repair.  Our manager did explain to the homeowner
that he needs to maintain his air conditioning system at a more consistent
temperature to control the humidity in the home because humidity levels rising
during the day, and reducing at night, can cause problems with the wood systems
in a home.
 
There are no warrantable repairs to be made on this home at
this time.

We were scheduled to meet with this homeowner on 4/14 and
review their concerns.  The homeowner rescheduled the meeting for the
afternoon of 4/17, at which time we will assess the...

situation and decide on any
necessary warrantable repairs.  We will update you after we evaluate the
situation.

We have completed all the repairs
as agreed:
 
drywall damaged during
the investigation phase
tub skirt reinstall
painting of repaired drywall
We
have made an offer to reimburse [redacted] for the damaged wood floors, in
lieu of actual repairs.  [redacted] is not satisfied with the amount of
the offer and is considering her options at this time.

I purchased a new home from Gehan Homes in [redacted]. The moisture barrier was not applied to my home before the hardie siding was applied. Additionally the windows were installed late thus omitting the required moisture barrier (moisture wrap) which allowed water (moisture) to enter the several rooms within my home. Needless to say, my wood floors are now destroyed. Gehan has repaired my home by repairing the areas mentioned above. I received written communication from Gehan (late [redacted]) stating that I would be reimbursed to replace my wood floors. I continue to receive random emails from Gehan stating that I will be reimbursed. I have communicated with the area manager (via email) NINE times since [redacted]. As of [redacted], I received another request to come to my home and view my floors again. Several Gehan representatives have been to my home several times during a period of four months ([redacted] through [redacted]). I simply want to receive reimbursement so that I can repair my floors!
Honor the written commitment to replace my wood floors by providing me with a cash settlement (check). I would also like for Gehan to repair the walls where Sheetrock was removed in an effort to locate the water penetration. Repair is also required for the area when a panel was removed from my garden tub.
