In August of 2016, Ms [redacted] signed a contract to replace her shingle roofing system along with a few flat roof repairsThe flat roof repair portion per our contract was to flash around HVAC unit with roof cement and asphalt saturated fabric, install new pipe flashings and flash with roof cement and asphalt saturated fabric The work was completed as contractedThe "black mess" that she stated was around the new boot flashing is the roof cement and asphalt saturated fabric flashing that she agreed to in the roof contractThe pipes were on a modified bitumen roofing system and this is Industry standard to flash as suchIn January of Ms [redacted] called into the office stating that there was a leak in her kitchenWhen we do roof repairs there is a guarantee that if there is leaking in the same area within days we would perform a service call to ensure that we took care of the leakWithin that time period a leak was never reportedAfter she reported the leak in January of we dispatched the estimator to take a look at the roof to find that the shingle roof that was newly installed in August was not the cause of the leak and gave her a price to repair a leaking area that was not under warranty as it was not a new roof section I have tried to reach Ms [redacted] by phone as soon as this complaint was received to see when we can come out to troubleshoot the leak area and see what we can do to make sure this customer is happy

Initial Business Response / [redacted] (1000, 16, 2015/08/06) */ I appreciate [redacted] being a customerUnfortunately, we cannot bend the return policy per our franchise agreement with GNC corporateThe policy specifically states (posted at the register and on the back of the receipt) "If you are not satisfied, return your purchase to any GNC store with your sales receipt and valid photo ID within days from the date of purchase" "No exchange or refund will be offered on a non GNC brand product without a receipt" Mr ***'s product was not a GNC brand product and therefore could not be returned, per policy as defined in my franchise agreementThere are penalties to a franchise store for not following the franchise agreement and policiesI cannot lose my stores because a customer did not keep his receiptI would love to help him out but I cannot disregard my franchise agreement or the return policyThe correct step for Mr [redacted] would have been to contact GNC Customer Service to discuss their return policy or see what they could do since I am not able to do the return at my store per policyI am sorry he is not satisfied with his product and would ask him to read and follow the GNC return policy (just as other retails have a return policy they have to follow)If he had his receipt, per policy, we could have given him a full refund Initial Consumer Rebuttal / [redacted] (3000, 18, 2015/08/07) */ (The consumer indicated he/she DID NOT accept the response from the business.) We have been in contact with *** via telephone conversation on Monday 10/3/We have agreed to meet him at his home to do watertest etc to determine the cause of, and resolve his moisture issuesHe has provided several dates when he will be available, and we have agreed to have this meeting in the near future

Our men met with him this past SatOctober 15th. Between *** and our men a plan of action was developed. We are currently scheduled to perform the repairs next Thursday the 27thFollowing is the response after Satmeeting. We did install the roof in March of We have been called several times for leaks, but have always responded with service calls. We have not always been able to get in touch with ***, and also not always able to meet with *** We do, however, always dispatch a service crew,
generally within a reasonable amount of time. The last contact we had from *** was an email we received on Sunday evening August 28th 2016. I saw the email on Monday morning the 29th. We dispatched a service crew on Wednesday the 31st of August. The email we received was a photo of a mushroom growing on his ceiling. While I don't know the rate at which mushrooms grow, I would think the size of this mushroom wouldn't have been attained in a day or two. There was no indication of watermarks, only the mushroom. When our service tech went out, there were no problems seen on the roof. There were still some cracks seen on the top of the chimney and some minor fascia issues at the perimeter. I know that on the 12th of August, the *** area received over 1" of rain. maybe he got some moisture in then. Regardless, if *** does have an actual roof leak, we would have to schedule an actual meeting when he can be present, then perform a water test to ensure the roof is not the culprit. *** is certainly free to contact us anytime if he has a roof leak. On 18May18, I dropped into the Monroe GNCI was in a hurry as I was taking my wife to a doctor's appointmentI have purchased the same or similar types of protein powder from that store for far over a decade, maybe twoThe size and shape of the container had changed, and the clerk, a large, slovenly man in his mid-thirties, assured me it was the same composition, though in a different containerWhen I questioned the price differential, he then said it actually had a different protein in itWith time running short, I chose it anyway, and went to the desk to check outThe clerk started asking questions about my phone number and other superfluous information, I told him my elderly wife was not well, and asked him to please just ring it upHe became visibly upset, yelled, "Go, go go," into my face, and then told me it was his job to ask those questions and, "I'm going to ask them." I am not completely satisfied with their responseI did not hear any apology from neither the advisor nor the service managerThe service manager could not even find my address nor phone number from their fileHe kept making all kind of excuses
Although they did come and pick my vehicle up and complete the serviceI will give them credit for that***

I would not recommend this company to anyone as I see this as a scam to get extra money out of consumers for the leasing company Our lease is ending this month and had AutoVIN inspect the car requested by *** *** Finance This car, Toyota Corolla has come to the end of the lease and we are returning it back to Toyota This Corolla was taken care with extreme care for the last years with all tuand repairs documented The AutoVIN report came back with $charge for excess wear and tear which does not exist They are charging me $for the lower section of the front bumper scratch that is not a scratch, but only paint chips that come from dirt and road debris This section sits only inches from the ground The other charge is for one new tire that they say is 3/16" which they require 4/16" The picture shows the tool they used had a crack glass on the meter and was very old All four tires are fine and I wonder if the calibration is up to date on this tool We now have to buy new tires to return the lease car which has tires that are fine?
I have no problem repairing any issues that need to be repaired, but there is absolutely NO excess wear on this car at all Very upset and will not pay these charges This company is a scam

Our inspector cannot assign charges to any damages, nor can he apply the “Further Diagnosis” descriptor to damages he reports. These parameters
are determined by individual leasing companies and programmed into our inspection software. “Further Diagnosis” items indicate possible issues with a vehicle that go beyond the scope of the inspection that the leasing company might want to look into when the vehicle is turned in. The leasing company’s diagnosis would determine if there is a chargeable issue with the vehicle at that time
According to the leasing company, they spoke with the customer on 10/and advised him of his options regarding any potential charges and repairs. They also spoke with him on 10/and let him know that charges for the item mentioned would be waived
As AutoVIN does not advise customers on whether or not to have repairs/diagnosis done before the vehicle is turned in and cannot speak to charges or fees, our company does not reimburse customers for actions taken in these areas. If the customer has further questions, AutoVIN has been advised to refer him to his leasing company

We are aware of the situation. It should be noted that the roof is not leaking, and this is not a warranty situation. This would fall under preventative action. As such we suggested a product for Mr *** to tryThat product did not work, as the product lit
indicates it has a curing time. The rain came before the curing time finished. Regardless, we are providing Mr *** with a specialized product. Regardless, I’m going to send you out a tube of the black lap sealant.
