We would like to thank *** *** for bringing his concerns to our attention. Our hope is to bring clarity to this situation; while providing relevant details pertaining to the complaint. *** *** states he was lied to regarding the sale of the system and signing of the paperwork
He states in the initial complaint that he does not want the product, but in the outcome of his complaint he states he was “tricked in to signing for a product he has not received” I am including all copies of documents signed by *** *** for his convenience. On March 5, 2015; four days after *** *** signed the contract a call was placed to him to verify the terms of his loan. This is a standard procedure and the call is recorded. During this call we verified that *** *** had received the product he purchased and that it was working properly. This call was conducted after the Three Day Right to Cancel Period had ended. *** *** states in his complaint that Aqua Finance, Increfused to work with him on payments after he was medically discharged from the Army. We certainly empathize with his situation and are grateful for his service to our country. On April 19, *** *** sent an email to our office asking for assistance regarding his loan. We did tell him that he was unable to return the system, but that we would work with him on his monthly payment amount. We have several options for customers including refinancing and payment reductions. We unfortunately did not hear back from *** *** after we responded to his e-mail. We value *** *** as a customer and we are willing to work together with him if he needs assistance. He is welcome to contact our office and we will discuss a reasonable payment plan with him

We are in receipt of Mr***' complaint pertaining to the hard inquiry on his credit report from Aqua Finance, Inc We certainly empathize with Mr***' frustrations regarding his experience with Aqua Finance and Culligan I hope to provide clarity to the situation and bring this
matter to a close Mr*** is correct that Aqua Finance did make an inquiry on his credit report to extend credit to him for a Water Treatment System I have attached the signed credit application On this application signed by Mr*** and Victoria *** it does state we may request a credit report for any legitimate purpose associated with the application for credit, extending credit, modifying the terms of the credit agreement or collection on the account I have highlighted this information on the attached document Unfortunately we are unable to remove the inquiry, despite not extending credit to Mr*** If he has any further questions, he may contact our office at ###-###-#### extension *** Thank you Katie ***###-###-#### extension ***

We would like to thank Mr*** for bringing his concerns to our attention As the finance company we are unable to service his water treatment system, however we would be happy to assist him in reaching out to Dynamis, Inc We apologize that Mr*** feels he was harassed in to
purchasing his Water Treatment System Aqua Finance, Inctakes these complaints very seriously On June 24, Mrand Mrs*** signed the loan documents for their Water Treatment System Included in these documents is a Certificate of Completion This document does state that the owner should not sign the completion certificate until all services have been satisfactorily performed This certificate was signed by Mrand Mrs*** on June 29, As part of our standard Company procedures, a call was placed to Mrand Mrs*** to verify the terms of their loan This is done to verify the loan agreement and ensure the customer is satisfied prior to funding the loan This call is recorded and retained We contacted Mrand Mrs*** on July 5, and were informed that they had copies of their paperwork, understood the terms of the loan and that the system was functioning properly Had we been aware of these issues at that time; we would have not proceeded with the loan Upon notification of this complaint, we contacted Dynamis, Incto obtain service records We were informed that the sink was damaged and leaking prior to the Water Treatment being installed and it was repaired during the install Also the system had a small leak outside when it was connected, but that was repaired prior to the Certificate of Completion being signed They have informed us if Mror Mrs*** have any further concerns they may contact them directly to schedule an appointment If Mr*** wishes to discuss this further, he can also reach me directly at *** *** *** Thank you. Ricky *** I was informed by them that the checks were being used to satify the prior months if that was the case it would have never been behind the days nor the amount they have reported they where nasty and not willing to help at all I have since made and took care of any past due payments still do and beleave this was an attempt by the company to collect more money in late fees I feel they reported out of context and never made an attempt to contact me or give the respect to let me know I was informed by others from the same company and the day I made the catch up payment in full by the operator that they didnt know why that was reported I was never behind that amount and the second I filed my report with the Revdex.com and my dispute on my credit report it went away and was called by a very polite and eager employee from there company and was able to make headway and satify the deal thank you

We appreciate Mr*** sending us this documentation, however nowhere on the information provided does it say that Aqua Finance, Incaccessed Mr***'s credit report. The bureaus "may" have updated to show the account is paid in full or closed, but we have no way of knowing based on the information provided. We would like to thank Mrs*** for reaching out to us with her complaint regarding the sale of the Water Treatment System she purchased in May of Her complaint states that our company uses deceptive sales practices This is simply incorrect Aqua Finance, Incis the
finance company that lent the money to Mrs*** to purchase the water treatment system *** and *** *** signed the contract for their water treatment system on May 25, Their contract states that they had until May 29, to cancel the loan in writing On May 29, a representative from Aqua Finance, Inccontacted Mrand Mrs*** to verify the terms of their loan This is a standard procedure to ensure the customer is satisfied with their purchase and to ensure that everything is working correctly We spoke with both parties and confirmed they were satisfied and the system was functioning properly Ms***'s complaint states that we are using illegal practices that violate the Fair Credit Reporting Act Under Section of the Revolving Credit Agreement that Mrand Mrs*** signed, it states the following: "You authorize us to furnish information about your account to credit reporting agencies and anyone else who may lawfully receive such information." The complaint also states that we fraudulently filed a UCC Fixture Filing Lien on their residence Under Section of the Revolving Credit Agreement, it states the following: "You grant us a purchase money security interest under the Uniform Commercial Code in each household good purchased on account to the full extent permitted by lawTo the extent allowed by law, you will pay all offi cial fees and taxes, and on request, take anyreasonable action requested by us to preserve the collateral or to establish, determine priority of, perfect, continue perfected, terminate or enforce our interest in it or rights under this agreementIf you do not make payments as agreed, this security interest allows us to take actions in accordance with state laws governing the enforcement of security interests in collateralYou further agree to keep the goods installed at the address on the credit application and to not remove or materially alter them without our written consent." I would like to note that no payments were made on Mrand Mrs***'s account for approximately nine months after signing the contract In February 2015, Mrs*** was contacted by a representative of our office and arranged to begin making $monthly payments During that conversation on February 18, 2015, Mrs*** stated she would try to "pay the loan in full with her tax returns" the following year We understand MrsMccraay may have been experiencing a financial hardship that caused her to fall behind on payments and appreciate her working with us to get back on track If she would like to discuss the UCC Lien or a settlement arrangement, I would be happy to speak with her myself She may contact me at ###-###-####. *** ***AVP- Compliance & Recovery***

We would like to thank Ms*** for taking the time to reach out to us regarding the Billing issue complaint she filed with the RevDex.com. We certainly can empathize with her frustrations and wish to clarify any questions she may have so that we may assist her
in moving forward In regards to Ms***’s statement regarding the discussion between she and the salesman; Aqua Finance, Incwas unaware of this verbal representation and such information was not provided to us to factor in Ms***’s perception or payment practices. At the time of the sale, the salesman may present promotional options to the customer subject to approval and based on availability and credit The promotion extended to Ms*** offered a reduced interest rate and a reduced payment factor for one year This is a favorable option for many customers due to the lower rate than our standard 17.99% and also a reduced payment On November 25, Ms*** signed a Retail Installment Credit Agreement. This form indicates the date of installation and the date of sale were November 25, Ms*** also signed a certificate of completion dated November 25, certifying that the water treatment system was installed and that she was satisfied with the project. Lastly, on November 25, Ms*** signed the Promotional Credit Plan Addendum outlining the promotion program specific to her loanI have attached these documents for her review. Ms*** was also given the Revolving Credit Agreement which details the full description of her minimum monthly payment terms and that statements will be mailed to her On November 26, a representative from Aqua Finance contacted Ms*** to verify the terms of her loan. This is standard practice with our customers to ensure any issues are worked out prior to the loan being processed and to verify they are satisfied with the product On this call we confirmed with Ms*** that her first payment of $was due January 1, to which she agreed. On December 4, a statement was generated and sent to Ms*** indicating the first payment due date of January 1, 2015. Ms*** is correct that she has been paying over the minimum payment when she sends her monthly payment in. She did not however make a payment in July or August. Because this is a Revolving Credit Loan, the minimum monthly payment must be made each month and while making over the minimum monthly payment may aid in reducing the balance at a higher rate than making the minimum payment, she would still need to make a payment each month to avoid becoming delinquent. Ms*** has had nine billing accruals thus far on her loan. She has made seven payments, of which six have been delinquent We would be happy to speak with Ms*** to arrange potentially moving her payment due date to allow her to make her payments on time each month. We value Ms*** as a customer and welcome her to contact us to arrange payment on her loan. While we are sympathetic to Ms***'s complaint, little if any of her allegations are accurate First let me state that the relationship between her seller, Kinetico, and Aqua Finance is such that we accept applications to finance customer's purchases of their product, and this is how Ms
*** came to be a customer of Aqua FinanceAll terms and conditions of her loan were explained on the Revolving Credit Agreement that Ms*** makes reference to in her complaint Also, at no time is a customer ever refused copies of their signed agreement/contract, OR told not to pay and we will settle it in court Ms*** was sent copies of her signed documents not once, but twice, along with being told a verification call was made PRIOR to funding Kinetico for her purchase, in which all the terms and conditions were gone over to avoid any misunderstanding In addition, the same day Ms*** requested a statement of account, showing the breakdown of interest and principal for each of her payments, one was sent Ms***'s payments are being posted to her account and principal and interest is applied according to standard loan postings Ms***'s statement that "all payments are being paid to interest" is also incorrect as her statement of account sent to her will attest Ms*** was also told that if she wants to pay her loan off quicker, that she can always pay more than her minimum required monthly payment amount as there is no prepayment penalty, but at no time was told her minimum payment does not cover the interest accrued each month As with any loan with simple interest, when one goes well beyond the days in between payments, it is true that the minimum monthly payment may not cover the interest due, however, when one makes the minimum monthly payment each month, on or near their due date, it is more than sufficient to cover the interest accrued during that time period In summary, each and everything that Ms*** has requested, has been supplied to her in a timely manner, and all terms and conditions of her loan, were disclosed not only at the time of her application, but also in a verification phone call, and with each monthly statement/invoice Aqua Finance Inc's position is that the contract is legal and binding and will take the necessary steps to enforce it

We are in receipt of Ms***'s complaint and regret the confusion surrounding the situation On March 14, Aqua Finance, Incwhich is a sister company to *** *** Company, received an application for credit for an alarm system for MsBrenda *** Ms*** was approved
for credit and a representative contacted her on March 27, to verify the terms of her loan for the alarm system She agreed to the terms and confirmed the equipment had been installed at her homeHer loan was transferred to *** *** Company on March 29, and was then sold to *** *** *** on April 4, She was notified of this sale via a letter that was sent to her on April 4, On April 10th, Ms*** contacted our office, twice, questioning what company owned her account We explained the process to her and she stated she understood We apologize for the confusing circumstance surrounding Ms***'s loan, but we'd like to assure her that this loan is not a scam and we believe Ms*** now is aware of the chain of events on her loan as she contacted our office yesterday to make her first payment We cannot attest to the circumstances surrounding the sale of the system, but we do have a signed credit application and a recorded call where Ms*** states she agrees to the terms of the loan We hope this clarifies the situation If she has any further questions, she is welcome to contact our office at ###-###-#### Thank you. We thank Mr*** for his additional comments He is correct in his statement that loan must be canceled within three days He is no longer able to cancel his loan As a consumer he is within his rights to cease making payments, but may be subject to late fees and additional interest charges if he does not continue to make his minimum monthly paymentAdditionally, failure to make payment may adversely affect his credit report If Mr*** is experiencing a financial hardship, we welcome him to contact our office as we have many options for our customers to assist them We would also suggest he consider obtaining a low interest loan to pay off his loan with Aqua Finance, Inc That may result in lower payments along with a lower interest rate Again we sincerely regret that Mr*** wishes to cancel his loan and are willing to assist in any way we can Per the terms and conditions of the agreement signed which was included with the previous response, this is a legally enforceable loan that will need to be repaid Katie ***AVP - Compliance***

I have reviewed Ms. [redacted]'s complaint and our file in great detail and will offer the following findings. Ms. [redacted] is correct in her statement that the loan was obtained jointly with her spouse at the time; Mr. Richard [redacted]. In 2012 we had...

several conversations with Mr. [redacted] as we were unable to reach Ms. [redacted]. An agreement was then made with Mr. [redacted] to remove him from the loan for $1000.00, but the letter explicitly stated the UCC Fixture Filing lien would not be removed. Due to privacy reasons I can't release full details of the letter or provide a copy. I certainly empathize with Ms. [redacted] and this has been a frustrating situation for her. As a gesture of good faith Aqua Finance, Inc. will agree to negotiate a settlement in the amount of $1,800.00 with Ms. [redacted]. Aqua Finance, Inc. has received the complaint filed by Mr. [redacted].  We sincerely apologize for any confusion caused and hopes this response provides clarity and brings clarity to this matter.  Mr. [redacted] states that a check was lost in July 2017.  Mr. [redacted]’s payments are due on the...

15th of each month.   On July 24, 2017 a call was placed to Mr. [redacted] because the monthly payment was not received.  He stated that the payment had been mailed, but did not state the specific date.  The July 15th payment was received on August 2, 2017.  The August 15th payment was received on September 12th, 2017.  On October 4, 2017 a call was placed to Mr. [redacted] because the September payment was outstanding.  At that time he indicated he had been mailing payments each month and would check with his bank. On October 10, 2017 a payment was received in the amount of $200.00; $60.00 over his minimum monthly payment that was due on September 10th.  The October 16th payment was received on November 29th.  The next payment due November 15th, was not received until January 5, 2018 in the amount of $160.00.  Because no payment was received in December 2017 and the July 2017 payment was still outstanding, the loan was reported to the credit bureau as late.  Aqua Finance, Inc. has an obligation under the Fair Credit Reporting Act to accurately report this information. Because Mr. [redacted] had made $80.00 in additional payments in October 2017 and January 2018, the payment received on January 12, 2018 in the amount of $60.00, satisfied his January payment.  He currently owes his minimum monthly payment for the January 15th payment.  We hope this explanation assists Mr. [redacted] in understanding the history on his loan.  For his convenience I have attached a Statement of Account showing all payments made.  We apologize that Mr. [redacted] feels we were unwilling to resolve this situation.  We unfortunately have no record of the “missing check”, but are certainly willing to assist any way we can.  If Mr. [redacted] has further questions, he may contact our office at ###-###-####.  Thank you.
