Golden Valley Lending, Inc("GVL") is in receipt of your letter dated February 19, in reference to the complainant identified aboveAfter reviewing the notes on the account and the complaint itself, it was determined that Mr***'s information was submitted to GVL by application and a $1,loan in ***'s name was funded on December 9, The loan contract was electronically signed the same dayThe application data contained ***'s name, address, banking, and employer informationUpon receipt, GVL submitted the application data for verification which is part of the company's regular underwriting approval processThe information in the application passed *** and verificationBecause his data passed the verification process, the loan application was approved and funded
GVL takes the security and privacy of its customers' information very seriouslyIt has a company policy not to discuss the status of a customer's account unless the person calling in has been verified to be the customerThis is why Mr*** was asked for some personal information when he called in to inquire about his account
GVL has sent Mr*** our Identity Theft Victim's Complaint and Affidavit Form (the "Complaint Form") for completion and to file with local law enforcement and has revoked all authorization, and placed the contact information on a do-not-call listAdditionally, we provided Mr*** with a copy of the Loan Agreement that was signed in his name for his records
We realize this circumstance can be an unsettling experience, and that individuals may not be comfortable completing our Complaint FormWhile GVL understands that victims of identity theft may be reluctant to share information, to make certain that they do not become responsible for the debts incurred by the identity thief, they must provide proof that they didn't create the debt
If Mr*** does not wish to use *** Complaint Form to support his claim, the following documents may be provided in its in its place:
(1) A copy of the filed report with his local police department confirming the identity theft was reported to local law enforcement, and
(2) A statement affirming that he did not apply for *** loan, dated and signed, that is also signed by a witness or a public notary
We have emailed Mr*** and asked them to return the completed Complaint Form or the alternative documents by mail or emailOnce received, we will investigate this matter as quickly as possible to complete the investigationIf it is determined that Mr*** is a victim of identity fraud, GVL will take the following steps:

To date GVL’s investigation of this matter does not indicate that the customer was defrauded or that this loan was obtained through identity theftGVL has a documented process in place for identity theft allegations, however, and has placed the account on hold, sent *** *** an ID Theft report form and affidavit for her to complete and file with her local law enforcement, revoked all authorizations, and placed the contact information on a do-not-call listWhile GVL cannot prevent fraudulent applications or identity theft, it has implemented and follows the above procedures to minimize the impact to the consumerGVL requires more than a customer simply stating that they did not apply for a loan to complete its investigation.

When *** notified MLF that they did not apply for a loan, MLF took immediate steps to rectify the matter, including placing the account on hold, sending an ID Theft report form and affidavit for completion and file with local law enforcement, and revoked any authorizations on the accountSince receiving this complaint, MLF has reached out to *** directly to discuss the matter

We realize this circumstance can be an unsettling experience, and that individuals may not be comfortable completing our Complaint FormWhile GVL understands that victims of identity theft may be reluctant to share information, to make certain that they do not become responsible for the debts incurred by the identity thief, they must provide proof that they didn't create the debt
If Mr*** does not wish to use the Complaint Form to support his claim, the following documents may be provided in its in its place:
(1) A copy of *** filed report with local police department confirming the identity theft was reported to local law enforcement
(2) A statement affirming that they did not apply for the loan, dated and signed, that is also signed by a witness or a public notary
We have emailed Mr*** and asked him to return the completed Complaint Form or the alternative documents by mail or emailOnce received, we will investigate this matter as quickly as possible to complete the investigationIf it is determined that Mr*** is a victim of identity fraud, GVL will take the following steps:
Mr***'s name/account will be flagged to prevent a new loan from being established
The loan balance will be written off
A response will be sent to the customer notifying them of the actions taken and confirming the loan balance has been written off

Let me first clarify to GVL and MFL that I am a Mrs., not a MrI can certainly ensure them that I did not apply for a loan with them, nor did I give anyone approval to apply for a loan on my behalf
Secondly,the information sent to me regarding the loan application by GVL shows that an application for $was advanced to the person who borrowed; however, GVL's response to the Revdex.com states that the person borrowed $I am concerned with the ethics of this CVL amd MLFcording to the application, a license number and birth date was obtained along with an employerHow would anyone conceive that a year old would be employed by an Optical company or ANY employer?! Truly, there was not a legitimate or detailed verification process that I can see to prevent fraudThis was negligence!
I am not well and have suffered great stress from this ordeal that could have been easily prevented
I have consulted an attorney and I am considering legal action against GVL/MFL

itself, the following determination was made.
Mr. [redacted]'s information was submitted to GVL by application and a $1,000 loan in his name was funded on May 28, 2015. The loan contract was electronically signed on May 28, 2015. The application data contained his name, address, banking, and employer information. Upon receipt, GVL submitted the application data for verification which is part of [redacted] company's regular underwriting approval process. The information in the application passed underwriting and verification. Because his data passed the verification process, the loan application was approved and funded.
When Mr. [redacted] notified GVL that he did not apply for a loan, GVL took immediate steps to rectify [redacted] matter, including placing the account on hold, informing the customer to file a police report, revoking all authorization, and placing the contact information on a do-not-call list. Unfortunately, GVL's notification system automatically sent a second reminder e-mail when payment was not received. GVL is reviewing this process to prevent the error from happening again.
Mr. [redacted] provided GVL with an incident report and an ID Theft Affidavit. In response to this information, GVL has taken [redacted] following steps:
His name/account was flagged to prevent a new loan from being established.
Any existing ACH/EFT authorizations were cancelled to prevent electronic funds transfers from his account.
The loan balance was written off.
A copy of the loan agreement has been provided to Mr. [redacted].
While GVL cannot prevent fraudulent applications or identity theft, it has implemented and follows these procedures to minimize [redacted] impact to [redacted] consumer and correct the issues as soon as they are found.
