Golden Valley Lending, Inc. ("GVL") is in receipt of your letter dated July 31, 2015....

Based on GVL's careful review of [redacted] notes on [redacted] account, [redacted] recorded telephone calls, and [redacted] complaint itself, GVL does not agree with Ms. [redacted]'s claims and finds them to be without merit. Mr. [redacted] applied for his loan of $600, which was funded on January 30, 2015.
Ms. [redacted] approved all payments that GVL took out of her account prior to [redacted] payments going through. GVL did not have a glitch in its system causing duplicate payments, nor did any agent state that this was [redacted] case. Rather [redacted] payments were scheduled, valid, and approved by Ms. [redacted] on July 9, 2015 to come out on July 10, 2015 and July 24, 2015, which is when [redacted] payments were processed. Therefore, GVL denies Ms. [redacted]'s request for a refund as [redacted] payments made were owed and there is nothing to refund.
GVL, which is located on sovereign land of [redacted] Habematolel Pomo [redacted], a federally recognized Indian tribe, is licensed by [redacted] Habematolel Pomo [redacted] to make small loans. [redacted] GVL loan agreement and website contain all disclosures required by Habematolel Pomo [redacted] and federal law and make it clear that all transactions are governed by Habematolel Pomo [redacted].

GVL does not agree with Ms. [redacted]'s claim. Ms. [redacted] applied for a $600 loan, which was funded on [redacted] 12, 2015. [redacted] terms of [redacted] loan, [redacted] payment schedule, finance charges and [redacted] annual APR were disclosed to Ms. [redacted] in her loan contract, and she signed [redacted] contract and agreed to [redacted] terms of [redacted] loan before GVL issued [redacted] funds to her. Further, all GVL agents are required to inform customers that their loans are structured on a 20-payment schedule, and that they [redacted] pay additional principal or pay their loan off in full at any time without penalty.
GVL has removed ACH Authorization as requested by Ms. [redacted] in her e-mails to GVL dated July 15 and July 16, 2015. Although GVL disagrees with Ms. [redacted]'s assertions, GVL is committed to customer service and has marked [redacted] account paid in full and will not collect any further payment on Ms. [redacted]'s account. However, GVL will not issue a refund as payments made were in accordance with [redacted] customer's loan agreement.
GVL is pleased to be able to assist [redacted] customer in this manner, although it is under no legal obligation to do so. Mr. [redacted] claims that he did not take out [redacted] $700 loan that was funded on April 20, 2015. GVL has sent Mr. [redacted] an e-mail to [redacted] address listed in [redacted] complaint containing a copy of [redacted] contract and a copy of a complaint form to aid him with filing a police report.
When GVL receives [redacted] completed form and police report, then [redacted] following will happen:
[redacted] customer's name/account is flagged to prevent a new loan from being established.
Any existing ACH/EFT authorizations are cancelled and no further electronic funds transfers are made from customer's account.
[redacted] loan balance is written off.
A response is sent to [redacted] customer notifying them of [redacted] actions taken and confirming [redacted] loan balance has been written off.
Mr. [redacted]'s account has been placed on hold for 30 days in order to allow him time to complete [redacted] complaint form and file a police report and send it to GVL. While GVL cannot control [redacted] amount of fraudulent applications or identity theft, it does follow its procedures to minimize [redacted] impact to [redacted] consumer and correct [redacted] issues as soon as they are found.
GVL is pleased to be able to assist [redacted] consumer in this manner, although it is under no legal obligation to do so. In fact they did not send me [redacted] documentation stated above and upon receipt of documentation of said loan agreement as well as documentation that money changed hands(in other words, a cancelled check, wire transfer,etc.), then I will be happy to pursue this matter further. At this point, there seems to be no evidence whatsoever that any such loan ever occurred.

Additionally, a GVL agent explained [redacted] loan terms to Ms. [redacted] prior to funding [redacted] loan.
Therefore, GVL disagrees with Ms. [redacted]'s assertions, and considers [redacted] balance of [redacted] loan still outstanding. itself, it was determined that Mr. [redacted]'s information was submitted to GVL by application and a $1,000 loan in his name was funded on August 31, 2015. [redacted] loan contract was electronically signed on [redacted] same day. [redacted] application data contained his name, address, banking, and employer information. Upon receipt, GVL submitted [redacted] application data for verification which is part of [redacted] company's regular underwriting approval process. [redacted] information in [redacted] application passed [redacted] and verification. Because his data passed [redacted] verification process, [redacted] loan application was approved and funded.
When Mr. [redacted] notified GVL that he did not apply for a loan, GVL took immediate steps to rectify [redacted] matter, including placing [redacted] account on hold, sending an ID Theft report form and affidavit for him to complete and file with his local law enforcement, revoking all authorization, and placing [redacted] contact information on a do-not-call list. GVL has placed this account on hold for 30 days to provide Mr. [redacted] time to complete and return [redacted] ID Theft form and affidavit. Once this is received, GVL will investigate [redacted] matter. If it is determined that Mr. [redacted] is a victim of identity fraud, GVL will take [redacted] following steps:

GVL requires more than a customer simply stating that they did not apply for a loan to complete its investigation. 
Once GVL has received the additional information from the affidavit and police report, GVL will investigate the matter. If it is determined that [redacted] is a victim of identity fraud, GVL will take the following steps:

was determined that Mr. [redacted]'s information was submitted to GVL by application and a $1,000 loan in his name was funded on November 4, 2015. The loan contract was electronically signed on November 3, 2015. [redacted] application data contained his name, address, banking, and employer information. Upon receipt, GVL submitted the application data for verification which is part of the company's regular underwriting approval process. The information in the application passed [redacted] and verification. Because his data passed the verification process, the loan application was approved and funded.
When Mr. [redacted] notified GVL that he did not apply for a loan, GVL took immediate steps to rectify the matter, including placing the account on hold, sending an ID Theft report form and affidavit for him to complete and file with his local law enforcement, revoking all authorization, and placing the contact information on a do-not-call list. I filed a police report on January 8, 2016. Waiting for report to be completed and mailed to me. GVL sent me paperwork requesting my drivers license number and social security number. I do not feel comfortable in sending that info to them. How secured is their system or is it something that I have to do whether I want to or not. What if I send them the police report number. I am very concern about sending social security and drivers license numbers.

While GVL understands that victims of identity theft may be reluctant to share information, to make certain that they do not become responsible for the debts incurred by the identity thief, they must provide proof that they didn't create the debt.
If Mr. [redacted] does not wish to use [redacted] Complaint Form to support his claim, he may provide the following documents in its place:
(1) A copy of the filed report with his local police department confirming he have reported the identity theft to local law enforcement.
(2) A statement affirming that he did not apply for [redacted] loan, dated and signed by him, that is also signed by a witness or a public notary.

[redacted] should call GVL’s customer service department to set up a repayment schedule; per her states wishes she has been added to GVL’s do-not-call list.

After reviewing and investigating the complaint, GVL disagrees with [redacted] assertions. GVL does not report to Teletrack. GVL's attempts to contact Teletrack directly failed because GVL does not have a relationship with them.
 
GVL would be happy to investigate further if [redacted] would provide GVL with documentation of the report that she is referencing, or reach out to Teletrack and ask them to contact GVL. Without more information, there is nothing further that GVL can do to resolve this complaint. GVL acknowledges that [redacted] paid off her loan in full and was a good customer.
