Golden Valley Lending, Inc. (GVL) is in receipt of your communication dated February 23, 2017 in reference to the complainant identified above. GVL apologizes for the delay in its response After reviewing the notes on the account and the complaint itself, GVL disagrees with Ms. [redacted] assertions. [redacted] applied for a $600 loan, which was funded on October 13, 2016. The terms of the loan, the payment schedule, finance charges, and terms and conditions for paying the loan off early were disclosed to [redacted] in the loan contract; [redacted] had the opportunity to review the loan contract and payment schedule before it was signed, and it was signed before before GVL issued the funds. An investigation of ACH records also revealed that GVL was not responsible for the charges indicated on December 29 and 30, 2016; pursuant to the payment schedule, GVL made no debits between the scheduled payments of December 23, 2016, and January 6, 2017.
 
GVL is committed to customer service, so it has marked the account paid in full and will not collect any further payment on her account. 
 
GVL is pleased to be able to assist the consumer in this manner, although it is under no legal obligation to do so. GVL is located on sovereign land of the Habematolel Pomo of Upper Lake, which is a federally recognized Indian tribe. It is licensed by the Habematolel Pomo of Upper Lake to make small loans. The GVL loan agreement and website contain all disclosures required by Habematolel Pomo of Upper Lake and federal law and make it clear that all transactions are governed by the tribal law of the Habematolel Pomo of Upper Lake. 
 
In responding to this complaint, GVL notes and reserves these objections, as well as all others. GVL has not and does not intend to waive its sovereign immunity. Nothing contained herein is intended, or shall be construed as, an admission or waiver of any rights that GVL and the Habematolel Pomo of Upper Lake possesses, all of which are expressly reserved.

Based on GVL's careful of [redacted] notes on [redacted] account and [redacted] complaint itself, GVL does not agree with Mr. [redacted]'s claim that GVL is illegal in his state. GVL is located on sovereign land of [redacted] Habematolel Pomo [redacted], which is a federally recognized Indian tribe. It is licensed by [redacted] Habematolel Pomo [redacted] to make small loans. [redacted] GVL loan agreement and website contain all disclosures required by Habematolel Pomo [redacted] and federal law and make it clear that all transactions are governed by [redacted] tribal law of [redacted] Habematolel Pomo [redacted].
Mr. [redacted] applied for a $1,000 loan, which was funded on April 22, 2015. [redacted] terms of [redacted] loan, [redacted] payment schedule, finance charges and [redacted] annual APR were disclosed to Mr. [redacted] in his loan contract, and he signed and agreed to [redacted] terms of [redacted] loan before GVL issued [redacted] funds to him. Further, all GVL agents are required to inform customers that their loans are structured on a 20-payment schedule, and that they may pay additional principal or pay their loan off in full at any time without penalty.
However, GVL is committed to customer service and therefore agrees to waive [redacted] finance fees for [redacted] remainder of [redacted] loan. GVL's complaint resolution [redacted] has contacted Mr. [redacted] via e-mail and informed him of its decision and encouraged him to contact customer service at XXX-XXX-XXXX to arrange a payment plan. GVL is pleased to be able to assist [redacted] consumer in this manner, although it is under no legal obligation to do so.

The terms of the loan, the payment schedule, finance charges and the annual APR were disclosed to [redacted] in the loan contract, and it was signed and the terms of the loan were agreed to before GVL issued the funds. Further, all GVL agents are required to inform customers that their loans are structured on a 20-payment schedule, and that they may pay additional principal or pay their loan off in full at any time without penalty.
