I am rejecting this response because:
Holiday Motors responded to the complaint and during a subsequent phone call I was told by the Manager, ***, that they don't want to lose their good standing with the Revdex.com, and they were working on resolving the problemThey said the title would be ready the following weekThe week came and went and we still have no titleMy wife went to the Fort Sam Houston JAG office and spoke to a lawyer who recommended we refile a complaint with the Revdex.com since the matter was not resolvedWe have also filed a complaint with the Enforcement Division at the DMV, and filed a complaint with the Attorney Generals OfficeOur lawyer is going to begin communication with Holiday Motors next week via USPSIt has been days since we purchased the vehicle from Holiday MotorsAccording to the Texas DMV, the dealership has days from the date of sale to file the paperwork with the stateOn 08/20/we went to *** *** Ford Dealership and traded the Ford Focus in and purchased a new Ford Fusion through FordPart of the agreement with Ford was that they would wire the money to pay off the remainder of our auto loan to USAA (Used to purchase the Focus)However Ford cannot wire the money until they have a title in hand for the Focus

I am rejecting this response because: Mr*** purchased the Xterra from Holiday Motors on November 15th, with the agreement that Holiday Motors would install a radio since there was none installed, pass the inspection that had expired and have the Check Engine Light fixed. Mr*** and I were told to take the Xterra back on Monday to have the work done on it On November 17th, Mr*** dropped the Xterra off AT Holiday Motors with *** ***, Finance Manager before going in to work at 10:30AM. Mr*** was given a loaner car from Holiday Motors to get to work and back. After work on November 17th, Mr*** picked the Xterra up from Holiday Motors from *** *** since *** *** had already left for the day. On the drive home Mr*** noticed that the Check Engine Light was still on. Holiday Motors was now closed so he waited to call the following day. On November 18th, Mr*** called Mr*** and informed him of the check engine light not being fixed. Mr*** told Mr*** to bring the Xterra back and he would take care of it. At the time Mr*** was already at work so he could not take the Xterra in to Holiday Motors for the repairs. Mr*** did go by Mr***'s job at this time to pick the Xterra up for the repairs and drop off another loaner car. After work Mr*** DID NOT drop the Xterra off at Mr***'s job, Mr*** stopped by Holiday Motors on November 21st after work (after 7:00PM) to pick the Xterra up and deliver the loaner vehicle. Check engine light no longer on. Transmission started slipping. Contacted Mr*** on November 22nd informing him of the transmission slipping. Mr*** asked Mr*** to take the Xterra in to be worked on but Mr*** was already at work at his 2nd job in Kirby. Mr*** asked Mr*** to take the Xterra in on Monday, November 24th. On Monday, November 24th, before going in to work, Mr*** dropped the Xterra off with Mr*** and Mr*** was again given a loaner car. November 27th after MANY non returned calls from Holiday Motors and having to make a personal visit there, we find out the transmission was bad. That is when the threats began from Mr*** ***. Mr*** was only involved in the original sale and picking the Xterra up from Mr***'s work. Mr*** *** and Mr*** *** are the that we dealt with for everything else!!!

The vehicle came in looking like it had been driven off road covered in mud approximately a month after she took deliveryShe said the vehicle was for her son and when she brought it back it had a "death wobble." If you look on the internet there are many blogs about this issue happening when the
vehicles have been taken off-roadMrs*** signed a agreement that clearly states to get the vehicle checked out before purchase, because there is no cooling off period and all sales are finalWe had this Jeep in for a couple of months before she purchased it and we never experienced it driving badIf it had that "death wobble" before the purchase Mrs*** would not have bought it, this is obvious.Even after Mrs*** bashed us with a bad review on-line we still good-willed approximately $in expenses on suspension components on the JeepIn addition we agreed to send an additional $which we did mail outShe complained it hadn't arrived quick enough, so we offered to cancel it and issue her another cashiers check, but we would have to deduct the cancellation fee from the $or she could wait another day for it to arrive which I guarantee it has by nowMiss *** does not want to except any of the responsibility and even after $of Goodwill from Holiday Motors on a purchase, after a month owning the vehicle she still is continuing to complain

There was a lost title issue that we explained to Mr. [redacted] that we were having to contend with. It's the car business and sometimes these things happen. We have offered to buy the car back. The original asking price on this vehicle was $6,900 + TT&L. We reduced the price to
$5,000 drive out. The amount we discounted the vehicle is about $2,500 if you
include TT&L. This would cover the repair. Unfortunately we already
negotiated all the good will upon...

giving the customer a discount. It had over
180,000 miles upon purchase, therefore should have realized some maintenance
would be required. We did not sell a brand new car at a used car price.

Texas case law protects the third party innocent consumer, through UCC and state DMV governing laws. We have been working and in communication with the local DMV and our attorney to get this issue resolved as quickly as possible. Please contact your lien-holder and/or aforementioned floor plan direct to help expedite and push the process. We have all the included contacts for your assistance in the letter to the floorplan company. Texas case law protects the third party innocent consumer, through UCC and TX DMV governing laws the consumer is not suppose to be held victim of any grievances between merchant agent dealer and floorplan company. We have been working and in communication with the local DMV and our attorney, [redacted] to get this issue resolved as quickly as possible. Please contact the floorplan company at the number below and demand your title to help expedite and push the process though. According to the Texas DMV, the dealership has 30 days from the date of sale to file the paperwork with the state. On 08/20/2015 we went to [redacted] Ford Dealership and traded the 2012 Ford Focus in and purchased a new Ford Fusion through Ford. ** assures management that he picked up [redacted]'s vehicle and took care of the repair as of yesterday (May 12, 2014).

We would like to know what manager told Mr. [redacted] we would not accept his trade in. All managers have denied such communication ever happen. The vehicle does not have a bad carfax, we have been through this before with Mr. [redacted]. We would be happy to accept Mr. [redacted]'s trade in at fair market...

Ms. [redacted] signed paperwork on August 11, 2014 to finance the 05' [redacted] with
Quality Acceptance. She refused to do the interview with [redacted] to
complete the sale. The salesman and manager tried several times to get a hold
of Ms. [redacted] before we had to resort...

to repossessing the vehicle on August 20,
2014. The manager states we offered to switch vehicles and/or take the [redacted] to
our mechanic to diagnosis the problem. We had to repossess the vehicle due to
Ms. [redacted] being uncooperative. We now have repo fees along with administration
fees. We waited 9 days before we had to take action.

I am rejecting this response because: I did not drive the vehicle for two weeks. I drove the vehicle ONE DAY and other than that it was parked at the residence it was towed from. When my father took the vehicle back to them they said they would "fix the issues". So apparently they DID see something wrong with the vehicle as well.

CK#[redacted] for $400.00 was mailed out. Plates get mailed out differently. Warranty is through Go Financial. This is separate from Holiday Motors LLC. You may call them to find what shops will take this warranty.

I am rejecting this response because:First (in January), [redacted] initially told me that the check was going to be sent by Alpha Warranty and not Holiday motors. Second (now that I have their attention and they actually cancelled the warranty), I still haven't received a check. So yes, I filed a dispute on my credit card to get the money back for the warranty ($1750). Now that I have my money back for the warranty, I want my money back for the repairs on the vehicle they sold me knowing that it had these issues. Both Georgetown Mazda (service manager will testify), and Alpha warranty (the warranty service they sold me) will agree that Holiday motors knew of the issues the vehicle had when they sold it to me. I was told by both of them that basically, all they did before they sold it to me was reset the computer to temporarily shut off the check engine light. The check engine light turned on 15 miles after leaving the dealership! I didn't even make it home!I feel that if Holiday motors wants to make it right they should have paid for all the repairs. Instead they are playing this war of attrition and they hope I'll quit so they don't have to pay. I don't understand how it's so difficult for them to understand that: I wanted a car, bought a car, was sold the warranty, car was sold to me with known pre-existing issues, check engine light came on 15 miles after leaving dealership, warranty they sold to me didn't cover it because after investigation it was determined dealership knew of issues, they (Holiday motors) wouldn't cover all the repairs, I paid for some of the repairs out of pocket because it was my only means of transportation and had no choice, asked them to cancel warranty/send me refund, then took just under 4 months to cancel warranty, and still not send a check or pay for my out of pocket repair cost.I will accept a response when I receive a check for the repairs I paid for out of my pocket in the amount of $893.03.
