Mrs. [redacted] was not on the loan, nor was she the individual purchasing the car. We did in fact trade Mr. [redacted] out of the Xterra into a 2005 Escape.Tell us why here...

We have included in this letter correspondence we have e-mailed and sent via mail to your finance company/lien-holder title department. We are in mediation with a floorplan company, Next Gear, over some losses on vehicles, as a result the floorplan company has been  incorporative in sending Holiday Motors your title so we may perfect the lien. Texas case law protects the third party innocent consumer, through UCC and TX DMV governing laws the consumer is not suppose to be held victim of any grievances between merchant agent dealer and floorplan company. We have been working and in communication with the local DMV and our attorney, [redacted] to get this issue resolved as quickly as possible. Please contact the floorplan company at the number below and demand your title to help expedite and push the process though. You may also want to contact your finance company after demanding title from floorplan company. Again thank you for your patience and undeserving understanding. We hope and trust you know we are working to get this issue resolved as quickly as possible. If your paper plate is expired we may get you another 30-day temporary tag for $25 at the DMV. I am rejecting this response because:I have not received any money from Holiday Motors, LLC as of this morning.  The whole time you had my jeep you said you were trying to get it done through the warranty, but as soon as I put a negative review on your website, you told me that you would no longer help me and I had to do it on my own.  You act like you are the only one that has put money into this jeep.  I made a large down payment, drove it for 5 days, almost wrecked twice because of the problems, have paid 4 months of payments, have paid 4 months of full coverage insurance, paid for a rental car for 4 months (because you don't do loaners), paid a mechanic to replace parts, front end alignment, rotate and balance the wheels and paid [redacted] for the diagnosis fee (that didn't fix anything).  I have paid out too [redacted].  I tried to get you to find me another Jeep and I kept getting the run around or lie after lie.  I finally got tired of it and told you I was going to take action if you didn't do something about it...so here you go.  As soon as the jeep is repaired, I will send you a copy of the bill and you can send me a check for that, however, I'm sure I will get a lie about that check being mailed too.  Just do the right thing and take care of this problem..be honest for once.

Dear Mr. [redacted]: I am available to discuss your situation at any given time. Holiday Motors has a paid reciept where out of the $1800 bill we paid $1300 towards the repair of your CX7 at the Mazda dealership in Georgetown to show good will. The reason the credit card fee was disputed was, because it...

was combined with your downpayment. The reimbursemnet of the warranty was suppose to come to directly from the 3rd party warranty company. I may certainly follow up on that to make sure you get the money ASAP. The reimbursement of that money from the warranty will more then cover the repair of the water pump and $500 you put towards the initial repair we assisted you with. So in retrospect you will actually be saving money from what you initially spent on the warranty. Please call me at the number below if you would like to discuss further. There was no mechanical issues with the vehicle. Ms. [redacted] wanted to unwind the deal
because of a tow hitch that her Dad noticed on the vehicle. They stated it
looked like the previous owner was towing something and the motor may go out.
The customer received a signed receipt...

stating the down payment was
nonrefundable if approved. The only reason the transaction did not fund was
because the customer would not do the bank interview. We may refund $600.00 of
the $1,200, we need to cover the repossession fee Holiday Motors had to pay to
get the vehicle back from Ms. [redacted]. The customer drove the car for two weeks,
so apparently it was driving just fine. We are not charging for the mileage Ms.
[redacted] put on the vehicle.

A check was sent out for the refund of the warranty ( CK #[redacted]). It took about a week longer to process because Mr. [redacted] disputed his down payment with his credit card company. He had the credit card company credit him $1.750.00, which was part of his down payment. He is requesting his cancelled warranty money, which was sent with ck #[redacted] in the amount of $1,672.20. If it hasn't been received it will this week. However Mr. [redacted] is trying to dispute the $1,750.00 again. We cannot be out the down payment and the warranty.

I am rejecting this response because:The warranty shows that it was canceled on May 5th and I still haven't received payment. The warranty company says that Holiday Motors has to cancel the warranty and then Holiday Motors will reimburse me! Which is it??? With the history of lies and half-truths from Holiday Motors, I assume they are still dragging their feet in order to win a war of attrition. I feel that they are just trying to outlast me so that I'll just give up. I won't stop until I am reimbursed.
