Revdex.com:
I have reviewed the response made by the business in reference to complaint ID 10605490, and have determined that this proposed action would not resolve my complaint [Provide details of why you are not satisfied with this resolution.]
Regards,
No matter what you said about my signature, my signature just for the price agree before the add on extend warrantyI have the plain to made payment and pay off amount with the price before the add on, now the add on broke my plainso what you think about thisis customers satisfactions are your policy ? Any way I just want to cancel the extend warranty and I already sent the cancelation

*** *** spent over two hours on Monday, Labor Day, in finance while numerous other customers were waiting to do their paperwork, as it was extremely busy that day. He read the front and back
of every form before signing it. Then after signing, he sat on the showroom reading the forms again, thinking of questions**, his finance manager, stepped out from the deal he was with to go and answer all of his questions. *** *** left satisfied and he told ***, the sales manager, on his way out that everything was great. He came back the next day after talking to other people, according to him, and told a vastly different story to ***, a different finance manager, about how the salesman told him that the paint and fabric protection and data dots were included for five years. This is and not at all the way things happened, as evidenced b his signatures and the amunt of time he spent looking over every piece of paper he signed. We offered to cancel the Gap Life And Disability and provided him with the necessary paperwork to be competed and sent directly to *** for the VSC cancellationThe paint fab and data dots are non-cancellable products and the paperwork was done correctlyWe had him initial on the buyers order under the total amount to make sure he couldn’t say he missed it or didn’t understand, per new procedures to avoid complaints and misrepresentations such as this. He also signed each form individually detailing the cost of each coverage. Given that *** *** spent times the norm in finance reading his contracts and another block of time in the showroom doing the same and had all questions answered and expressed satisfaction before leaving to three different people, we ask that he stand by his contractual obligations made free from duress, time contraints and pressureHe has complete control over the cancellation process on the cancellable items, as he was given the forms to do so, he simply need send them in

When *** *** was here negotiating, he repeatedly told us he wanted to put $down and wanted us to cut him a check back for $3000.00, as the equity in his trade was $5000.00 Realizing it made no sense for him to give us $down and then us give him a check for $3000.00, the
salesmanager broached this with him and said rather than do that, why don't we just cut you a check for $1000.00, as it amounts to the same thing with less paperworkHe then said no, he wanted to apply $of his equity as down payment towards the vehicle and the rest given back to him in the form of the checkWe explained that that was not money down, but trade equityHe said ok, he understoodWe wrote instructions to finance to that end, and *** *** indicated that he understoodOnce he got to finance, however, he again stated that he was putting $down and wanted a check back for $The finance manager said that made no sense, why was he putting down $in cash for us to give him a check for $It still amounted to $in his pocket without passing checks back and forth** *** agreedHe later called and asked *** when he was getting his $back, and ***, now thouroughly confused, called **, and ** said *** *** had elected to apply $of his equity to the deal and get a check back for $1000.00, rather than apply the of equity, write us a check for $and get a check back for $Realizing that *** *** referring to his trade equity as money down had confused the finance manager, *** then told *** *** we would get the deal back from the bank and recontract him giving him a check for $and applying only $of his equity to the dealIt makes no difference to our gross profit how he applies the equityHe clearly states $was applied to the deal and $is coming back to himIf some of that money was missing, he would be justifed in his belief that we did something shadyRather, it was *** ***'* wording, despite our attempts to correct it, that resulted in thisDespite that, we have gotten the deal back from the bank to contract it the way he requests, as we told him we wereI don't know how this could have gotten so confused, as he signed off on the bottom dollar, and everything was clearly disclosedBut again, we're happy to do it however he wants

This has been resolvedThe customer received a check for cancellation last week

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint
Whoever is responding in behalf of *** of Katy, no name is ever given, obviously is not reading my responsesAs I had stated the price was suppose to be plus the $shipping, less the $owner loyaltywith no extras i.epaint sealant, etcAs for the running boards if Rob Wooten said he told me no to the running boards, he needs to rethink that statement, He said" let me pull your deal jacket, and Ill get back to you" can we at least be truthful in these statements?
As for the cross bars, when I ask about them from one of the many people I have talked to since purchasing the vehicle, I was told they were included in the price. Again I told them I did not want or need them, and certainly would not
have bought themAlso, they are not listed on my copy of the buyers orderThe $was showed as down payment, after the sales price was raised by a $Example, sale price of $37048, instead of the $Again, what I am seeing is the same old redirect *** of Katy has been sending since I bought the vehicle. That was a decision I sorely regret, now knowing what type of people I am dealing with at the timeWould someone at *** of Katy have Chris *** respond and lets settle this. He seems to be the only one that has any authority to get anything done there
Next response, please include the name of the person, or persons that will be served. The small claims court needs them
Regards,
*** ***

Regards,
Yes that was the price we sit there and agree upon that is why when I went inside to sign I didn't bother to look over the paper before I sign they sent you that why didn't the also send the financial part or the final Bill of sales if you want I could fax or send a copy to Revdex.com my Bill of sale surely don't have any of that price on it

This customer came back to the dealership and recontracted without the warrantiesThis has been resolved and customer advised they would notify the Revdex.com of the resolutionThank you

Recordings are only kept for a month as the few issues dealers have of this nature are realized long before then, and are mainly kept as visual proof of signing or for the purposes of identiy questions and trainingThat month expired on 4/ Mr*** can certainly refer to his numerous signatures and initials on the contracts he signed as proofContracts were invented to keep this very thing from happening and are considered final proof, unless there was coersion, diminished mental capacity or identity theft involved, none of which Mr*** has claimedIn fact, Mr*** has yet to offer an explanation as to how he signed fully disclosed contracts and was unaware of their contentsHonda Cars of Katy again rejects his assertion that he was uninformed of the terms and prices he agreed to and endorsed with his signature, and considers this matter closed. Thank you

Regards,
Greetings,
The proposed action WILL resolve my complaint
However, I would like to respond to *** *** and her comments I never said that the $*** check "Bounced" What I said was; "As a result of that check going through, it caused other items to bounce which left me with multiple NSF fees for those items" *** *** has a selective memory I was never upset as she indicated I was actually impressed how cool I was through the entire conversation She was very hyped up and angryI actually asked her to pay for these NSF fees and she laughed and said; "There's no way that I am going to pay for your NSF fees" (In all truth, I agree with her on that one)
I can provide proof that the $*** check did in fact clear It's other items that did not clear and that is what I mentioned to *** *** had bounced
Now, at this point some truths need to be stated
The Honda of Katy dealership receives my complaint and *** *** responds But yet she felt compelled to send me an additional message directly to my personal email In my opinion, this is another way to prove her forceful personality and natureSending me a personal email regarding this situation was crossing the line But I'm going to keep this complaint and response with the Revdex.com and not respond to your personal email message you sent to me
You did tell me you could push the contract through and wanted too You went on to tell me that you could let that vehicle sit in the Honda parking lot until *** *** came to repossess the vehicleAnd, that you could make sure I had a repossession on my credit I looked at you in total amazement and ask; "Why would you do that? You said; because "You can't just go around signing your name to contracts and then think you could walk away without any obligation" I knew you were right but I still needed this money back
I went on to ask you "Why were you so angry?" and "How did this whole transaction become so personal?" You quickly retorted "Because you never gave me the chance to counter-offer on another vehicleYou went and bought another vehicle, you bought a *** *** I have * ***s, why didn't you give me the chance to counter-offer?" I didn't have an answer for you
At that point, I tried to use the sympathy card of "I'm a single *** ** *** *** *** That didn't phase you either You still kept barking at me about the entire scenario And yes, before you finished drilling me about all of this, you did say you will have to talk to your GM about possibly getting a refund to me but that I needed to be aware that I had wasted so much time at your dealership and so much time from the salesman I said noI was at your dealership for approximately hours waiting for your service department to re-install the sun roof and all the seals around the doors and back hatch of the vehicle
I left your dealership feeling helpless and not sure of what to do.
I called and talked with *** *** the next day asking for a copy of the contract (You see, I was never given a copy of the contract and was told that once I obtained full coverage insurance for the vehicle, then I will get copies of the contract and the keys to the vehicleI never bought insurance on the vehicle in question) *** *** then told me no and that the contract no longer exists I explained that my attorney wanted a copy of it*** *** said; "Then have your attorney call me and ask for it" then *** *** hung up on me
Advice was given to contact the Revdex.com and as a result of that advice, the Honda of Katy dealership is now ready to "Gladly refund her down payment"
I could go on and on regarding what I discovered over the weekend about the overall opinion of Honda of Katy from the many people I encountered and talked with, but I will not because it's truly nothing positive and that is a real shame I am very grateful that Honda of Katy is now going to refund the $*** to me.
Thank you for your help and time,
*** ***

The agreed upon price of $DID and DOES include tax, title and license, as can be seen on page #of the attachmentWe never agreed upon the final pricing including .9%, although the customer said they wanted itWe could not, due to the either or $500/being offered at the timeThe text stating $otd, all the same, meant all the same as far as year coverage included on data dots, nitrogen, tint warranty, and diamon fusion, all products and warranties, oil changes and paint and fabric protectionAnd that agreement was honoredThe customer elected to purchase coverage beyond year for of those items, an extended warranty and gap insuranceThe customer also DECLINED credit life and disability. The attachement also includes the customer's signature on those items, both declined and purchased, with full price disclosureThe customer can come in and cancel the gap and extended warranty, there is no cancellation fee for those itemsThe rest of the coverage is non cancellable

*** *** was was issued a check for the refund of credit life and accident and health. *** came into the store and picked up the check on **-24-14. This has been resolved

I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint I dont understand the document says 8% and *** did a favour for me by cutting it to half at 4.05%? this doesn't make any sense to meSimple math why should I close 1.9% loan and borrow % loan from ***? it was definitely a mind game played at the time of closingI have to take delivery as my son was sleeping on the chair and have to get him home as soon as possible.
I really don't like the way it was dealt at finance deptIts completely unprofessionalI am not happy with the dealership and I dont recommend it to anyone any more.
Regards,

Please see the attached internet quote [redacted] is referring to. It was exclusive, as all our quotes are, of any dealer installed accessories. Please refer to the worksheet which has the quoted internet price and the line by line dealer installed accessories the customer elected to...

purchase, fully disclosed, and initialled. This agreement was made upfront, before the customer went to finance. This is also exactly what the customer paid, as agreed, in the finance office. She also purchased additional warranties in the finance office, as well. Internet selling price quotes are for the vehicle only, not any additional warranties or options purchased by the customer. If you need the worksheet where the customer chose and signed off on the additional warranties, please advise. I will send it, as well, but did not, as the customer is saying the internet quote was not honored. Thank you.

[redacted]'s reference to an accident was a dent on the vehicle. I told her that we take in many cars that have cosmetic issues, but we do not sell a car that had frame, core support or subframe dmage from an accident without full disclosure. She at no point said she did not want the vehicle,...

she in fact continued to try to get insurance that evening. She called me the next morning and said that she was having trouble with her insurance agent and that he was going to cancel her policy and asked for advise. I referred her to another agent. She at no time told me she did not want the car. She contracted on the vehicle the day she was here and did not put down hold money, but a down payment. As she had contracted on the vehicle it was legally hers. We would have no reason to take hold money, because we were unable to sell it to anyone else. She also signed an agreement to provide insurance. She did ask us to hold the check until the [redacted], which we did. She never contacted us after that to say anything else. Her salesman called her [redacted] to see when she was picking the car up, and she said she needed to discuss the transaction with him and would be in that night. We deposited her check, per her request, that morning, not knowing she had purchased another car. She never came that evening, either. [redacted] morning [redacted] told the used car manager that he thought she didn't want the car, but since the contract she signed was legally binding to both parties, we could not relist it. On [redacted], [redacted] came in and said she had purchased another car and that the check we deposited had caused her account to bounce. Had she notified us of her intent to breach the contract before [redacted], we would have known not to deposit. The dealership voided her contracts, but as the check she gave for down payment bounced, we had no money to return to her.
Further, [redacted]'s "advisor," [redacted], accessed Honda Cars of Katy's Facebook page and posted that the vehicle was having every seal replaced and was in a flood.  These statements are patently untrue and can be proven as such. [redacted] referrered to the car as a "piece of crap." on our Facebook page. The vehicle is far from that. We replaced the sunroof and the seal because the track was broken. We did not replace every seal on the car, and in fact, other than the dent and sunroof, it needed little else done to it, because it was in such good shape. There is absoultely no indication that water ever saw the inside of the car. We take many cars in with very low miles. [redacted] also stated that we were pushing the contract thorugh to [redacted] and it was going to be a repossession. That is also patently untrue and the opposite was told to [redacted]. We told her we could have pushed the contract through, because it was legally binding, and if we had, it would have resulted in a repossession, but that we were NOT going to do that. [redacted]'s comments amount to libel, and if she continues to post her wrong impressions as fact, we will seek remedy. It's our belief that [redacted]'s friend talked her into breaching the contract with her erroneous conclusions.
We incurred an NSF fee as a result of [redacted]'s faliure to uphold the contract or notify anyone of her intention to do so before the [redacted] she instructed us to deposit her down payment check. We would like a reimbursement for this NSF fee in the amount of $[redacted]. Would also demand a cease and desist from posting false information about this transaction in a public venue. Any further correspondence regarding this matter needs to be directed to our attorneys.

American Honda's offer of .9 is in lieu of $500.00 dealer cash. The consumer is able to choose which they want. The 25500.00 out the door price did not iclude warranty, which is sold in the finance department. Ms. [redacted] admittedly signed all documents knowing we could not offer both the out...

the door price and the subvented finance rate. She had the opportunity to leave at that point and not contract on the car. She is welcome to cancel the warranty, all she needs do is come in and get the form to do so. We are certainly sorry she feels the way she does, but again, the rate was fully disclosed before she chose to sign up on it. The $25500.00 out the door price never changed, and the cancellation of the extended warranty will agian bring the financed amount down to that price. We do not record conversations between sales associates and customers. We do record some transactions in the finance department, but Ms. [redacted] states that she was well aware of the rate before she signed on it, and if the session was recorded, I'm sure it will reinforce what Ms. [redacted] has stated, that we could not offer both the rate and price, that she knew that, and contracted regardless. If she had chosen to get the rate, the price would have gone up $500.00. Feel free to refer to the incentives publicly offered, but not advertised, by Honda to well qualified buyers.  Ms. [redacted]'s contention that we offered $26000.00 out the door at the special rate is not true. She wrote down that she wanted that, but we never agreed to it, and we never put it writing She left before it was discussed. [redacted] simply told her at the beginning of negotiation that it was offered. When he texted her the next day, he never said anythong about the rate, only that we would do $25500.00 out the door with all the delaer ads the same as discussed the day before.

Please contact htis customer. They came in two weks ago and this issue has ben resolved with them. Thank you.
