September 28, Via Online: http://odrcomplaint.Revdex.com.org Dispute Resolution Department Revdex.com [redacted] Revdex.com Case No.: [redacted] Consumer: [redacted] Dear Sir or Madam: Please accept this correspondence as Perry Homes, LLC’s (“Perry Homes”) response to the recent reply filed by Mr [redacted] on September 18, Granite is a natural stone product Every granite slab varies somewhat within any given color and pattern, which is why every granite countertop is unique A granite sample serves to only indicate the general color, markings, patterns, and the like Because of these unique qualities, Perry Homes cannot and does not guarantee that granite installed in a home will be identical to the sample or photos provided in the Design Center Perry has inspected the granite installed in the Consumer’s property and compared it to samples provided at the Design Center Perry believes the sample provided at the Design Center, which included small samples and a large slab on a kitchen island, indeed provided a reasonably general indication of the color, markings, and pattern of the granite installed in the Consumer’s home Perry Homes regrets the Consumer is not satisfied with the granite he selected for his property However, the potential for variations in color, markings, patterns were disclosed to him in Perry’s Earnest Money Contract and again at the Design Center Moreover, the consumer chose a granite for his property that is not only beautiful, but generally considered to be more “exotic” than many other granite patterns Naturally, the more “exotic” the granite pattern, the more variations from the sample one would expect to find Perry has again reviewed the emails referenced by the Consumer and respectfully disagrees with the Consumer’s characterization of those comments We trust this information is helpful to your investigation If you have any questions, please do not hesitate to contact me at [redacted] Sincerely, PERRY HOMES

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint I would like to first address the Company's comments regarding my experience at the Perry Home Design Center and the flawed nature of their response.The Company states in their response that their granite sample "included a large slab on a kitchen island" This assertion is 100% false! I was given a piece of granite which was less than one square foot in size and the Design Center employee proceeded to assist with suggestions for selecting floor tile, backsplash, paint color, et cetera, while referencing how well she thought our selections would go well with our granite selection It is a reasonable expectation that if my granite selection was installed on a large island, that the designer would encourage me to take a look - never happened! The color, markings, and pattern of the granite sample in no manner resemble what was installed in my house As reference, I have attached a picture of the granite sample that was provided to me at the Design Center, as well as several pictures of the granite installed in my home When comparing these photos, there is undeniable evidence that the granite sample that was selected at the Design Center shows no red, pink, or yellow colors The sample included shades of grey, white, and black only In terms of markings and pattern, the pictures clearly support that the Company's claim within their recent response is not true While I understand the nature of natural stone, Perry Homes should not have the option to have their contractor install a granite that comes nowhere close to resembling the sample they provide to home buyers There are ample steps Perry Homes could take to ensure this dose not happen Further, when I had a face-to-face to discussion with David S [redacted] , Perry Homes Manager of Builders, he stated that this is not the first time he has had to deal with this issue He went on to tell me that he, on multiple occasions, had communicated to his superiors that the current process for buyers to select granite at the Design Center and for the buyer to receive a product that remotely resembles their selection was a constant issue for the construction group Apparently, I am just another victim of a system that fails the consumer After paying for standard granite through the base price of the home, they charged me an additional $3k+ for the Level upgrade I made the decision to upgrade based on my assumption that the builder would make an effort to install granite that somewhat resembled my selection I never expected an exact match.Secondly, the Company's response to my comment's regarding their employees, discounts a consumer's ability to document correspondence I have emails from Becca P [redacted] , my salesperson, stating exactly what I claimed in my original complaint (excerpt shown below) I am not sure how one could characterize her comments in any other fashion, other than what is clear stated below Based the assertion of Perry Homes' own construction office that my salesperson has a laundry list of complaints, the corporate office should not be surprised by my experience with their salesperson In December 2014, it was clear that Perry Homes sales knew they had me on the hook for the remainder of the process and make it clear to the construction office in the email below, thus creating an environment where there was no incentive to correct the granite issue that transpired in January 2015.All in all, the focus of the matter is the granite I am over the poor professionalism of my salesperson There isn't anything Perry Homes or myself can do to rectify that experience However, Perry Homes does have the ability to correct the result of flawed granite selection process which has been recognized by construction management and went unchanged prior to my Design Center selections My claims are factual and not subjective The Company has the means and ability to correct this issue and I trust that the right steps will be taken.Regards, [redacted] On Dec 5, 2014, at 5:PM, Becca P [redacted] < [redacted] wrote:Never got a response on this? Perry Homes will not return our phone calls because we hired an attorney to discuss our legal rights My kitchen and master bathroom are still an issue and the work is shoddy at best We had another meeting scheduled for last week and again Perry Homes was a no show I am confused on how you can report you are in contact with me when you don't show up for scheduled meetings, answer emails or return phone callls
