I have pictures of my home from the front and side with the empty lot next door for the last two yearsIt shows the grading on my yard as well as the elevation of the empty lotNever in two years was there an issue with drainage other than poor grading that Perry Homes had to correct in other areasWith a rain a week and half ago that lasted maybe an hour, it was backing water up into my back yard like a retention pond on one side for the new construction, Perry Homes project manager stated that they can do this and are allowed hours for it to drain awayAlso in the front where they graded the new construction to drain across my driveway and landscaping on that side, even with pictures showing the damage potential (almost inches of water flowing across my lot in areas), their project manager just said water has to flow downhill and the fact that even after hours of no rain that area is now a mud hole and not draining properly, Perry claims that is okState law says that they cannot increase the runoff burden or cause damage by the changes to their property and have it affect mineIt does not say it is subjective to the builders wishes. I can always video the next really heavy rain and post it on youtube for all for reference if they would likeCurious how they plan on justifying this

Sent: Tuesday, December 08, 11:AM To: drteam Subject: RE: Complaint ID: *** To Whom it may concern: Perry was informed the consumer had previously canceled contracts with other builders in the neighborhood. In an effort to manage expectations upfront, the Consumer was invited to walk the home and inspect it before the earnest money contract was executed. During this inspection, Perry offered to replace some of the tiles the Consumers were unhappy with, but generally believed the tiles were in acceptable condition. The Consumers eventually agreed and signed the Earnest Money Contract. After several tiles were replaced, the Consumers continued to raise concerns regarding the tile. Perry offered to replace a few more as a courtesy and as a result of the delay this would cause, extended the closing date. After these additional tiles were replaced as a courtesy to the Consumers, Perry believed the home more than satisfied the terms and conditions of the Earnest Money Contract, the Perry Homes Express Limited Warranty, applicable building codes, and Perry’s own policies and procedures. The consumers disagreed and asked for price reductions and upgrades to the home at Perry’s expense. Because the tile satisfied the conditions previously listed, Perry respectfully declined their request. After Perry declined their demand for free upgrades and a price reduction, the Consumers refused to close, principally citing concerns regarding the tile. Even assuming the Consumers were entitled to a refund, which Perry denies, the Consumers have continued to attempt to purchase the same home, even after they cancelled the contract and demanded the Revdex.com provide assistance to obtain a refund to the allegedly defective tile. The tile in the home is no different today then on the day they were scheduled to close in late October. This raises some questions regarding their tile concerns, which were cited to the Revdex.com as the principal reason they cancelled the contract. Perry Homes has explained this to the Consumers both in person and in its prior correspondence to the Revdex.com. The consumers have not disputed any of this and have provided no new information for Perry to consider. As a result, Perry has no new information to provide to the Consumer and is unsure why the Consumer is waiting for Perry to contact them. I am available to answer any further questions. Perry Homes has spoken to the individuals involved and determined the house met model home quality and was ready to close. No lengthy list of items required for the completion of the home remained unperformed. On the closing date, the consumers identified some very small areas they desired to have touched up. Perry attempted to review with the consumers, but the consumers did not believe they had time to review. They left the home after less than five minutes and refused to close on the home. It’s unclear to Perry why the consumers decided not to close on their beautiful home over a few minor touch ups. Interestingly enough, after they verbally cancelled their contract with Perry on the day of closing, they toured homes of competing builders in the same neighborhood within thirty minutes of their cancellation. Since the foundation damage was very
extensive and we didn’t get any response from Perry sale professional Donnie
B*** we wrote the official letter to Perry Homes “not to proceed with the
further construction of this building” and demanded that Perry either (1) build the same plan on a
different lot, or (2) issue a full refund(If Revdex.com like to have our correspondence copy please let us know we are more than happy to send Revdex.com all our correspondence copies)If Perry home conducted any third party inspection after my complaint I should get a copy right?
Unfortunately Perry Homes declined all our options
We did not ask Perry Homes to cancel the contract; instead we gave these two
optionsIf Perry opted the option (2) then they must have paid the full
refundNow the only option we have is to request for the full refund since
they cancelled unilaterally our contract and sold this house to someone
Hence
with this letter we are giving you few more days’ time to resolve this issue
amicably by giving our remaining deposit of $ If some reason Perry
home decided not to pay our money then please state it clearly rather than
extending days by doing nothing
We
request RevDex.com to get a final word from Perry Homes whether they are paying
our money or notIf they are not paying, this issue will remain resolvedSo
please find out the facts early and close this case as "UNRESOLVED”, So
this information will be reflected in the company’s report for the next three
years or until we get the payment

Granite is a natural stone product.  Every granite slab varies somewhat within any given color and pattern, which is why every granite countertop is unique.  A granite sample serves to only indicate the general color, markings, patterns, and the like.  Because of these unique qualities, Perry Homes cannot and does not guarantee that granite installed in a home will be identical to the sample or photos provided in the Design Center. 
Perry has inspected the granite installed in the Consumer’s property and compared it to samples provided at the Design Center.  Perry believes the sample provided at the Design Center, which included small samples and a large slab on a kitchen island, indeed provided a reasonably general indication of the color, markings, and pattern of the granite installed in the Consumer’s home. 
Perry Homes regrets the Consumer is not satisfied with the granite he selected for his property.  However, the potential for variations in color, markings, patterns were disclosed to him in Perry’s Earnest Money Contract and again at the Design Center.  Moreover, the consumer chose a granite for his property that is not only beautiful, but generally considered to be more “exotic” than many other granite patterns.  Naturally, the more “exotic” the granite pattern, the more variations from the sample one would expect to find.   
Perry has again reviewed the emails referenced by the Consumer and respectfully disagrees with the Consumer’s characterization of those comments.  We trust this information is helpful to your investigation.  If you have any questions, please do not hesitate to contact me at [redacted].

Please accept this correspondence as Perry Homes, LLC’s (“Perry Homes”) response to the Complaint filed by the Consumer on December 2, 2015.
In conversations with Perry personnel and in no less than two letters sent to Perry Homes, the Consumer requested Perry “not to proceed with the further construction of this building” and demanded that Perry either (1) build the same plan on a different lot, or (2) issue a full refund. This cancellation was communicated to Perry both in person and in written correspondence dated February 26, 2015 and March 6, 2015.
After an inspection of the Consumer’s concerns was performed by a third-party engineer, Perry Homes’ provided a response to the Consumer on July 30, 2015 that addressed the same concerns he has now raised to the Revdex.com. A copy of Perry’s July 30th correspondence and the third-party engineer’s report were provided to the Consumer and now to the Revdex.com. The engineer’s report more than addressed the concerns raised by the Consumer. The July 30th correspondence from Perry attached a copy of this report, addressed his concerns regarding the construction of the subject property, confirmed his cancellation of the contract, and responded to his request for a refund by outlining the remedies available to him under the contract. The remedies requested by the Consumer in the previous paragraph were not available to him and therefore were not applicable.

I have tried contacting the point of contact person at Perry Homes to get the refund, and I also sent a written letter in explaining my issue and situation. I have left several messages with no return phone call or response. I feel like they are just putting me off. I want my refund and I need it in a short amount of time. The longer they take on this issue the harder it is for me to move ahead. I feel they are not being fair or professional about this issue.
