I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below.Johnny's fitness breached their contract by denying me the right to cancell my membershipIn doing so all terms are breached Further there is no specific date for notice of club fee withdrawal No member can be held to an ambiguous standard As the businesses reply just stated, the maintenance fee is for club repairs and future equipment The response also acknowledged that I have been a member for two years (although seldom used the facilities) and have paid two club maintenance fees That seems reasonable and since I will not be a member for a third year, a third fee will not be appropriate Additionally, the harassment and hostility I received by the (yes, I sincerely apologize I got "***" name wrong, but I am happy you were able to identify the one regional manager) was atrocious He yelled at me, in front of other members, causing me undue anguish, emotional stress, humiliation, and embarrassment Further, the regional manager told me he was "more than happy to cancel me" although he refused and denied me access to do so In light of: me not having access to the benefit of FUTURE repairs and equipment, The harassment and public humiliation caused by Johnny’s fitness, The breach of contract by Johnny's Fitness, Johnny's Fitness having already received two years of club maintenance fees for the two years of membership I did have, and Per the contract, there is no specific date to hold one liableTherefore, we are squared up and reasonably there will not be a third service fee for services I will be bared from.Regards, [redacted]

After reviewing this and meeting with management we did not receive a letter via certified mail within days of sign up to justify that this member in fact wanted to cancel her accountMy general manager just spoke with her (2/13/at 4pm), and she said she would produce a receipt for the certified mail proofIf that is emailed and it falls within the days (end of business day on January 4th would of been the last day), then we will refund in full and cancel w/o penalty per contractual obligationsWe hope this finds you well and we look forward to receiving that receipt of certified mail proof so we can close this case and move forwardThank you! Dear [redacted] We have received complaint ID# [redacted] We have looked into the account and researched our emails for a paper trail, tracing back to JanuaryOur member was in a month agreement, purchased on May 1, 2014, as shown in my attachment of her agreementProof of move is part of our policy which is stated in the legal binding agreement, along with a written form of our cancellation agreement showing signatures on both parties endsWe show our member did make initial contact in January to cancel due to move and we have an email trail showing we responded in March with the cancellation formManagement was informed to call client back in January to inform the client that we needed our written form filled out, a day notice, ,and a document verifying her new address.We are willing to refund the client for months period, for the total of $(monthly dues $+ tax/month) if she can provide some sort of proof of move for our files to the billing company(Ex: utility bill, etc; showing her name and new address)If the client can provide this sometime today or tomorrow we can cancel her out immediately and get her a refunded check in the mail asapI called the client today on May 18th at 11:am and left a voice mail asking her to call back to provide this proof to the billing companyPlease let me know if there is any further questions or concerns regarding this account.Thank you, [redacted] Johnny's Fit Club

On October 15th we sent out a courtesy email to everyone as a reminder that the club maintenance fee will be coming in November Every membership agreement directly mentions the annual fee in November, and each member agrees to this annual fee as a condition of their membership Marsha’s agreement is attached with her signature and the policies highlighted in yellow.The maintenance fee is set to different dates depending on when the member signed up, some are due on the 1st, some on the 15th and some on the 25th of November We do not state a certain date in the mass email because not all members have their fees on the ***e dateBecause we are a 24/facility our gym gets a lot of wear and tear, the maintenance fee goes directly back into the club for repairs as well as new equipmentIn response to the reminder email our inbox was flooded the next few days with emails from forgetful members either saying thank you for the reminder, suggestions on what they wanted the fee to go towards, or that they are refusing to pay the maintenance fee Due to the overwhelming amount of replies we have been behind on correspondence but have been working as quickly as possible to stay on top of communication with our members[redacted] emailed on the 17th, not the 15th, then again on the 19th that she wished to cancel her membership and to please forward the forms to herThe emails are attachedHer email was responded to on the 19th stating that we are unable to do the cancellation via email, as has always been our company’s policyWe would gladly speak to her about her accountUnknown to the staff member helping with the incoming emails [redacted] was in earlier that dayEvery member comes in to fill out a cancellation form as their day notice [redacted] gave her day notice in person on the 19th to [redacted] our District Manager, there is no [redacted] employed by us, but we are willing to override company policy and accept her email from the 17th as her day noticeWhatever dues fall within the day period are the last dues that the member owes to the gymThe maintenance fee of $due on 11/15/as well as her last payment of $due on 11/8/fall within that daysBoth of these payments still fall within the day period beginning on the 17th [redacted] has been a member since with her maintenance fee being due on the 15th each year so there should be no surprise on what date her fee fallsCancellation is finalized once the fees are paidSince [redacted] refused to pay what dues fall within her days her membership was not cancelled by [redacted] and the cancellation paperwork would not be valid if she had filled it out.We encourage our members to use their gym memberships as much as possible so it is unfortunate that Mrs [redacted] did not use her membership, however it does not change the fact that the maintenance fee falls within the day period of her taking initiative to cancel her membership [redacted] can definitely come in and cancel her account anytime, but like any other member she has to fulfill her day notice

Ms[redacted] became a member with us back on 3/9/17, she chose to be set up on a month to month agreement, where she could cancel at anytime with a cancellation fee of $39, back in August she sent in a via email that she had moved to Canada and would like to cancel out her membership, our policy and terms in her agreement state that if you move miles past our club we will cancel you out without any fees as long as you provide a current utility bill or valid proof of move, we let Ms[redacted] know this, we emailed her multiple times letting her know that we could not cancel her out until we have the proof of move or she must pay the cancellation fee, she submitted a hotel bill which is not a valid form of cancel proofIn order to cancel as it states in her agreement we will need valid proof of move We never heard back from her, then email her again she said that she was in a session that she would call me back with her credit card to pay the cancellation fee and would like the two months when she was not here to be reimbursedI told her I am sorry until Until the cancellation is processed and verified we explained she would continually be bill every month for her membership, and several emails I sent her I told her I would like to resolve this and get this done quickly as possible but she's very hard to communicate with, We need some verification of moving proof and we will waive this $cancel fee and cancel her account out asapThank you

Mrs [redacted] , all regular cancellation policy rules must be followedWe have all clients sign a digital copy and also for our protection a Manual copy (both are attached in the response email to the Revdex.com on 2/17/16)The manual copies can be viewed under "bank letter"This ensures not only that our clients receive an email of exactly what their contract states, but they also physically walk out with a manual contract so they have that for their records toWe would be happy to meet with you and help you with your fitness goalsAt this time if this does not satisfy your needs we must turn this over to our Legal team, [redacted] Law offices in BoiseWe have contacted them and made them aware of the situationThey also have both the PDF of the Digital copies of the signed agreements and the manual agreements that were filled out at point of enrollmentBased on the contract agreement they each have more payments of due on the 28th of each monthFit Club trainers are nationally certified; they can and will be happy to work with any condition including lupusThe staff can set them up with any trainer, and the two may train together as wellAll sessions will still be available to useThese sessions will not expire We hope to help you and figure out a solution to this matterThank you!

*** Signed up with us on June 30th, for a membership then after months downgraded to the membershipHe called in to our staff letting us know of his injury at which point we told him to come in to fill out his cancellation form*** is on a Month-to-month membership which has a
cancellation fee of $and a day noticeAll membership must come into the gym and fill out their paperwork and get a signature of manager that way the gym has record of the cancellation as well as the memberMembers also can freeze their membership for any amount of time with medical injuries*** was very upset that we couldn't come in to do it because of his injuryHe mentioned that he was upset for the amount he has paid over time for him and his partner. We have not been able to find out who this is because no name has been given at any point during contactDuring this phone call staff repeatedly let him know that another person, family member or significant other could come on his behalf to fill out his paperwork for him, before hanging up on the staff *** demanded that he be charged and cancelledRight after this phone call our staff called him back with no answer we left a message for him reminding him that someone could come in for him, that he could also freeze with just a day notice that way he wouldn't have to pay any further, and also that he could still cancel but paperwork is requiredWe have not heard back until this complaintWhat we have done for *** is frozen his account for months so he has time to come in, or send someone in, to take care of his account*** may also extend this freeze until his foot injury is healedContact with the gym is necessary

HelloThank you for contacting Johnny's Fit Club on my behalfThey have been unwilling to speak with me and did not accept the certified letter that I sent to themMy issue regarding their unscrupulous service was not reflected in the letter that CHASE sent to themI am aware that I signed the contractI was unaware that there was a three day return policyThey did not tell meTheir contract was written in such small type that it is not visibleThe return policy was not on display anywhereWhen I tried to downgrade the service to our original request before we were talked into the extended contract, the manager told me that he would not do it and that he did not have to tell me about the return policyI am a disabled older woman who plainly told the manager in our initial meeting that I suffer from confusion as an effect of my lupusI sent a letter from StLuke's Rheumatology attesting to that fact to both CHASE and to Johnny's Fit ClubI live on social security disability payments because I can no longer work due to my illnessesThe manager of Johnny's took advantage of me because I am old and impairedPlease read my initial complaintJohnny's is not responding to the issueThank you for helping me
