Initial Business Response / [redacted] (1000, 8, 2016/11/01) */ Escape Resolutions spoke with [redacted] regarding her multiple timeshares on 10/03/16. There is a discrepancy in the information that Escape Resolutions and [redacted] have regarding her timeshare memberships. [redacted] has submitted the information she has... regarding her memberships to Escape Resolutions. Escape Resolutions is now waiting on the information they have requested so that a comparison can be made and determine how best to resolve the membership discrepancy. At the end of the phone conversation [redacted] was told that she would receive a phone call from Escape to go over the facts and resolve, if any, remaining issues regarding her timeshare memberships. Escape Resolutions wants nothing more than to complete and close this file for the client. Thank you for your time.

The client contracted with Escape Resolutions the end of The contract they signed allows one year for completionWe are still well within the timeframeAlso, note per the attached contract all fees must remain current at all times and the client is in arrearsWe ask this complaint be void for these reasonsPlease see attached contract and proof of terms

To Whom it may concern: When I originally submitted this complaint Escape Resolutions had until June 26, 2017 to reply. Why has this date changed? Please call me or email me so that I know why. Thank you, [redacted] @yahoo.com [redacted]

Initial Business Response / [redacted] (1000, 14, 2016/06/16) */ The individual, Mr [redacted] ***, signed a cancellation service agreement with Escape Resolutions on April 2nd, The notes in his file stated his partner and co-owner, [redacted] Clay, would sign anything needed to cooperate with getting out of the timeshareOn April 6th, we received an email from Mr [redacted] stating he was exercising his right of rescission Escape Resolutions then acknowledged and communicated with Mr [redacted] regarding his rescissionThrough this communication Mr [redacted] requested additional paperworkEscape Resolutions sent the additional paperwork to Mr***'s attention to be reviewed by both Mr [redacted] and his partner, [redacted] Clay, and then be able to move forward with the file; a file that would be handled by a law firmEscape Resolutions was under the impression from Mr [redacted] that everything was good Please note, all phone calls for Escape Resolutions are on a recorded lineTherefore, all phone conversations between Mr [redacted] and Escape Resolutions are recordedAs previously stated Escape Resolutions did not know of Mr***'s dissatisfactionEscape Resolutions did just what the client asked us to do; send additional paperwork to him to go over with his partnerEscape Resolutions did not receive any information that Mr [redacted] did not want to move forwardEscape Resolutions is unsure whether the email(s) are actually from the client or the partner, [redacted] Clay, who initially was not willing to move forward with our serviceAfter the additional information was sent, Mr [redacted] never communicated to us his intentions with Escape Resolutions, instead Mr [redacted] has filed a complaint The last attempt to speak with Mr [redacted] was via a phone call made to Mr [redacted] by an Escape Resolutions representative on June 14th, which Mr [redacted] was unwilling to communicate with our Escape Resolutions representativeThis makes it very difficult to resolve the situation when the client will not communicate with Escape ResolutionsEscape Resolutions takes pride and care in alleviating the customer(s) from their timeshare obligations and ensures the client is kept informed and updated through the entire process A refund could not be issued to the client because the client placed a chargeback on our account without any notification to Escape ResolutionsIn order to remain compliant with the card service regulations Escape Resolutions could not issue a refund to the client until after the chargeback dispute had been settled

Our original response standsThis is our final response

To the Revdex.com:I just received a phone call from Escape Resolution management. (My threat to file with the Revdex.com seems to have put some fire under ER's feet). To make a long story short, with the updating of the Power of Attorney to the new condo owners, this transfer is almost complete &
should be done in the next few weeks. Therefore, I am withdrawing my complaint at this time, until further notice. If I continue to get jerked around and ER does not complete the transfer, as contracted, I reserve the right to re-instate this complaint.Sorry for any inconvenience this may have caused.*** ***

THE complaint against escape resolutions has been resolved Thanks *** ***

Attached is a file containing pages of which the first page is the Revdex.com email letter requesting further information of my business with Escape Resolutions. The last page is the cancellation contract that I signed. Pages 4-are what I sent to Escape Resolutions which
includes a cover letter of my experience with *** and the power of attorney. And pages 2-are some papers ER sent me in their request for my *** by *** paperwork. I paid Escape Resolutions in full on 7/1/via check and credit card. Should you need payment documentation or contact documentation or any other information, please do not hesitate to contact me. I will be sending Escape Resolutions a letter this week informing them that I have filed a complaint with the Revdex.com and the Missouri Attorney General's Office

Initial Business Response /* (1000, 9, 2016/07/15) */
Escape Resolutions agreed to assist the *** in transferring their timeshare propertyThe Liquidation Service Agreement signed by the *** reflects the terms and Escape Resolutions' promise to compete the transfer within twelve (12)
monthsParagraph L of the Liquidation Service Agreement addresses the time frame within which the services are to be provided by Escape ResolutionsIf the transfer does not take place within twelve (12) months, Escape Resolutions will refund the complete service cost
Escape Resolutions has, in the past, used *** as a closing company to assist in the transfer of timeshare propertiesEscape Resolutions has experienced a great deal of difficulty with this closing companyAs a result, Escape Resolutions has stopped doing business with that closing company but that DOES NOT stop Escape Resolutions from providing the services agreed to with the ***Escape Resolutions is eager and ready to complete work for the ***
Escape Resolutions has on-going business relationships with several other closing companies and has submitted the *** file to another closing companyHowever, the *** have failed to return document(s) required in the transfer of their propertySpecifically, the *** have failed to return the Special Limited Power of Attorney so that the transfer process can enter the final stageEscape Resolutions understands that the *** are upset, but it does not excuse the *** failure to be cooperative in the process of transferring their timeshare
On March 29, 2016, Escape Resolutions called the *** to let them know that Escape Resolutions was no longer doing business with the initial closing company and advised the *** that their file was being submitted to another closing company
Again, Escape Resolutions stands ready and willing to continue to assist the ***The *** should feel free to contact Escape Resolutions in regard to the transfer of the timeshare interest
Initial Consumer Rebuttal /* (3000, 11, 2016/07/18) */
(The consumer indicated he/she DID NOT accept the response from the business.)
These are the exact same words sent to the Attorney General's office in response to my AG complaint no*** to which I refuted nearly the entire correspondence sentence by sentenceSo I will repeat my response to the AG to youI said, NO this matter is NOT settledI feel threatened, intimidated, and abused by this company, Escape Resolutions (ER)They have repeatedly lied to me and I feel are out to steal my money because they have had more than ample time and opportunity to complete this promiseI even begged them at one point to simply send my $*** to the closing company so the deal could be completed, but they refusedThis correspondence is incorrect, incomplete, and in some areas in complete conflict with my complaintThat alone offends me, but then I guess that is what lawyers do, manipulate words to make the truth look like a lie, a lie look like the truth, wrong to look right, right to look wrong all for the good of their client no matter their guiltFirst off, I wish I had a video of that seminarIt seems to be about what I was promised and expected (everything), verses what I actually signed up to get (nothing)Anyway to the letter: first sentence in the first paragraph says, "Escape Resolutions (ER) agreed to assist the *** in transferring their timeshare...."Never at the seminar do I recall the words "assist" or "transferring" being usedWhat I do recall them saying is that they (ER) would liquidate my timeshare, get rid of it, make it go awayI was never told how that would happenAll I knew or cared about is that my name would be removed from the deedThe last sentence in this first paragraph says, "ER will refund complete service cost of #***." What about my $***? At the seminar it was ER's idea for me to pay them the closing cost also or "it may go up"Now I see why, so they can put it in their pocketI do not believe the second paragraph that ER severed ties with the closing company, but the other way around because ER was not paying the closing costsI know for a fact that ER was charging more than the closing company for the same service, not less as they claimThe third paragraph is what I expected from the start that ER would use to steal my money, "failed to return documents"The truth is, I faxed all documents required to *** *** on November 11, and received an email from her the very next day, November 12, saying they (ER) have all they need to complete my transactionsThen again on January 29, I faxed the same information to June Forrest who told my that *** no longer worked thereThen on May 26, I received a request for the same information for the third time plus a power of attorneyNow I know it is a scam and they are out to get my moneyNever did they request a power of attorney until after I filed my AG complaint on May 14, That tells me that ER intended to do nothing but steal my moneyBut then I am not a lawyerI also dispute "the *** failure to be cooperative" accusation and claim that ER has failed to provide any serviceThe fourth paragraph is simply a lieIt did not happenI did not receive a call from ER on March 29, to let me know they are no longer doing business with *** or any other advisementsIn fact, on May 11, *** himself told me that he paid this same closing company two weeks ago and doesn't know why they would say they haven't received paymentNor have I ever been told that my file was being submitted to another closing companyI know I have been wronged and all I want is my $*** back and nothing further to do with Escape Resolutions whatsoeverIf I had the time, money, and better health I would file suit against Mr*** and ER under Florida's Deceptive and Unfair Trade Practices Act, but I am too old for this ***

Initial Consumer Rebuttal /* (3000, 21, 2017/04/24) */
The response from the business is completely falseThe business was legally required to return the funds according to the terms of the contractThe business claims they paid to funds to a 3rd party who was supposed to forward the payment back to me, but that the 3rd party failed to forward the fundsThe business is now claiming that that relieves them of their responsibility to return the funds to meThis is not correctThe company has the responsibility to return the funds to me, NOT to a 3rd partyI have no contract with this 3rd partyThe company can seek recourse from the 3rd party to get back those fundsThe company cannot relieve themselves of their contractual responsibility by pawning their issue with this 3rd party off to me
Furthermore, the business has never provided any proof or evidence that they ever did pay the funds to a 3rd partyThis may be just their cover story they are hiding behindHowever, the business acknowledges their obligation to refund the funds back to me, Their attempt to use a 3rd party to forward the funds to me, does not relieve them of this obligationThey could refund the funds DIRECTLY to me without the need to go through a 3rd party
The business' claim that I am going after the wrong party is completely falseThey cannot absolve themselves of their legal obligation of refunding/returning the funds to me by a nefarious claim that they refunded the funds to a 3rd party and not to meThey cannot now claim that I would have to go after the 3rd party, since THEY have the recourse of recovering the funds back from the 3rd partyThe business still must refund the funds to me, regardless of the issue they have with this 3rd party
I believe the business is just using this claim as a cover story and has no intention of meeting their legal obligation to refund the funds back to meThis business is operating a scam and, as they have admitted to me, has done this (made this claim) with other customers of theirs also
The Revdex.com should not close this file by accepting this claim by the business and making the conclusion that I am going against the wrong companyI am going to follow your prior advice about contacting the Missouri Attorney General office and will be filing a complaint against this business for their illegal business practices
Final Business Response /* (4000, 23, 2017/04/28) */
This was an issue with a third party and it has since been rectified
