on behalf of O’Connor & Associates, I would like to apologize for any inconvenience that Mr***’ may have experiencedAfter researching his account, we discovered that he was contacted to sign up for the services, but later stated he would protest himselfHowever, we inadvertently allowed the issues with his account to fall through the cracks and this is certainly not our standard procedureAgain, we sincerely apologize for our mistake. appreciate your loyalty and feel that we have done very well otherwise you would not have allowed us to continue to represent you for the past yearsUnfortunately, we experienced many issues with the Fort Bend County Appraisal District that affected many of our clients. Hearings were delayed for several reasons; we attempted to address this issue with the Appraisal District who in-turn stated that the delay was due to decisions we madeBecause we are still working to get many hearings resolved without involving the courts we are unable to provide the details
Your hearing was initially scheduled for 12/4/2014; we received the Appointment of Agent form, which was forwarded to the Appraisal District prior that hearing dateDue to circumstances that were beyond our control hearings that were not completed by December were resetThe Appraisal District allowed us to work files on a daily basis, many without a set hearing date, which did not allow us an opportunity to advise many of our clients of a definitive hearing date and timeNot only did we have the challenge of trying to complete hearings from the previous tax year, we were faced with many of our files being rejected due to expired authorization forms (this is the issue our customer service team attempted to inform you)We recently argued the fact that we were authorized prior to the initial hearing date therefore we should have been allowed to present the files although the authorization expired at the end of the previous yearWe also argued that since the Appraisal District was responsible for the rescheduling they should honor the authorization forms previously submittedWe are still fighting this issue!
We had every intention to represent your property for tax year but due to the circumstances we are left with trying to convince the Appraisal District to do the right thingOur Customer Service Team never had any intentions to mislead nor miscommunicate any information; they communicated the information that was made available to them at the time. Be advised that we have taken the appropriate action with regards to the customer service representatives who mishandled the account and failed to submit your initial gift card request and respond appropriatelyWe realize how your recent experience with our company may leave you concerned about future representation seeing as how we have fallen short of your expectationsOn behalf of O’Connor and the customer service department I want to sincerely apologize to you for how this incident affected youThe Appraisal District has told us that they have no plans to allow us to present the files with the expired authorizations although they never advised us that we needed to submit an updated form for the delayed hearingsWe have also been told that they are working with some property owner’s if they are contacted directly by those individuals

This message is in response to the complaint filed by *** *** stating that we missed his protestOn behalf of O’Connor & Associates, I apologize about the inconvenience that this has caused, but would like to explain my findings. We were not authorized to represent the property
located at *** *** ** for the July 15, property tax hearingWhen we received a signed Appointment of Agent Form from *** *** on June 29, we sent it to the *** *** *** *** so that they could authorize us as the agentOn July 12, we were notified by them that they would not accept the form since the signature did not match the owners’ name listedWe then requested via email on July 12th and July 14th another Appointment of Agent form with the correct owner’s signatureIt was not until July 19, we received the deed for the property supporting the signature on the Appointment of Agent formDue to this error we missed the chance to protest the value of *** *** property.The Appointment of Agent form, which is the legal document, required to negotiate on the property owner’s behalf, states in the instructions, “If someone other than the property owner is signing the form, there must be supporting documentation accompanying the form to establish the relationship between the signor of the form and the property owner.” Since *** *** *** *** lists only *** *** as the owner we were not authorized as the agent and by the time we received supporting documentation the hearing date and time had passed. This message is in response to the complaint filed by Mrs*** stating that we did not attend her hearing for and that we were not successful in achieving a reduction for On behalf of O’Connor & Associates, I apologize about the inconvenience that this has caused.We were authorized to represent the property located at *** *** *** *** in May of when we received a signed Property Tax Service Agreement and the Appointment of Agent Form for the above mentioned propertyFor the tax year in question we filed a timely protest and attended the protest hearing scheduled for the propertyFor the property tax year the sales and market trends considered from January 1, to January 1, supported the initial market value of $463,and the initial appraised value of $424,710. After reviewing the sale transactions through on page of the adjusted average against Mrs***’s property would place her valuation at $458,This would put her property slightly higher than the assessed valuationsAlso according to a Realist Report there were sales at an average of $477,within one mile of the propertyThe current trends are considerably higher than the assessed valuations.Mrs*** stated that her hearing was conducted via affidavit, but the hearing was completed by an agent from O’ConnorThe evidence package that was sent to Mrs*** was the information the agent presented at the hearing that was prepared by O’Connor & AssociatesEach year we also send out a Client Communication Package requesting hearing evidence documents that would support any issues with the propertyThis hearing evidence included comparable properties within the same neighborhood code, similar in size, and had the same extra featuresWe can’t address the protests for the neighboring properties since we do not know what took place at those hearings. On behalf of O’Connor & Associates, I apologize about the inconvenience that this has caused, but would like to rectify the matter. We were authorized to represent the property located at [redacted]. by Mr. [redacted]. We reduced the taxable liability for the 2016 tax year by filing a timely protest and attending the protest hearing scheduled for the property. Per our agreement “Tax savings and fee calculations for prior, current and future years are calculated without regard to agricultural exemptions, homestead exemptions, over 65 exemptions, timber exemptions, wildlife exemptions or any other exemptions”.  However, we adjust the contingency fee for property owners 65 years or over to take into consideration the exemption discounts charging only 25% of all property taxes saved. The 25% decrease in the fee was meant to replace the manual invoice process because we do not have the software to make such adjustments automatically. Again, the manual adjustment includes all exemptions discounts, and excludes your ISD since these taxes are frozen. We are simply invoicing for half of your true estimated tax savings, if we manually adjusted the invoice to include the exemption discounts as well as make an adjustment to the contingency fee we have taken into consideration your exemptions twice. So Mr. [redacted] was given a double discount on the invoice and instead of paying the fee of $86.72 the amount due was $68.66, in which he has paid in full. In an attempt to resolve this matter in good faith, we have enclosed for your review a copy of all pertinent documents which indicate that we simply upheld our part of the agreement.
