We regret any inconvenience or frustration that you may have experienced since your concerns arose and your concerns regarding your experience have been addressed internally. Please be aware that as per Electronic Fund Transfers Regulation E ("Reg E"), clients must consent to. "opt in" if they want.their bank to allow them to overdraw their account for ATM and everyday debit card transactions :.Please note that only ATM and everyday debit card transactions are affected by:Reg E. "Everyday! debit card transactions are typical transactions most people make with their debit card in daily.shopping "Recurring!' debit card transactions, such as automatic withdrawal's authorized On accounts using a debit card; are not affected by Reg E, Our records indicate that on December 23,:2013, you revoked your consent to overdraft services pursuant:to Reg E, thereby not authorizing KeyBank to assess overdraft fees in the event that an ATM or Everyday debit transaction is presented to the Account against: insufficient. funds. This does not, however, prevent all fees from being assessed to the Account. If a check or electronic withdrawal is presented to the Account against insufficient funds, a. Returned Item Charge will be assessed. I have:reviewed the Account and determined that the $77.00 in Overdraft Service Charges assessed to the Account,on October 16, 2017, were in accordance with the KeyBank Deposit Account agreement and Funds Availability Policy (the "Agreement'') and the Personal Checking Account Fees and Disclosures (the "Disclosures-"); which are provided to all clients at account opening. Our review found no bank error; however as a gesture of goodwill KeyBank has refunded $77.00 to the Account on November 1:1, 2017, which will reflect on your next statement. I would like..to take the: opportunity to explain why these fees were assessed to. the Account. KeyBank posts items to the Account Within prior-day and current-day posting categories, Within these:categories, we post ATM and debit card transactions based on the authorization date and time, and if the authorization date and time is not available; we use settlement date and time. We post checks in check number order. For.all other types of items within each posting category, we post items from lowest dollar to highest dollar amount. In assisting you in understanding KeyBank's pending transactions activity, I would like to explain that until a transaction authorization is requested: by the merchant, to whom you provide your debit card information, KeyBank has no knowledge of your purchase. KeyBank has no control over when a merchant requests a transaction authorization. When the transaction authorization is requested, a. pending transaction is placed on the Account. When the actual charge is received fi-om the Merchant, the transaction is removed from the pending activity and the actual charge is posted to the Account. That is the reason it is necessary. for the funds to be in the Account prier to making the purchase. For additional clarification, note that weekend transactions will be posted prior to posting the activity conducted during normal business hours on Monday. For example, on Monday night, any deposits made during the weekend will post before weekend debits, and then any credits made during. Monday business hours will post before debits from Monday business hours. You are responsible 62017 for having the funds available to cover'a transaction both when the authorization is Made and when it posts to the Account; however, an overdraft-related fee is not assessed twice for the same transaction. We are empathetic to the .fact that unforeseen circumstances can result in either an overdraft situation pr a returned item. As such KeyBank provides several resources to assist clients in balancing their account. This includes statements, automated telephone service, toll-free client representative support and Online Banking. KeyBank also offers Overdraft protection to those applicants that meet our qualification criteria. Please visit www.key.corn to: view accounts that May suit your needs. You should not rely on the "Transaction Balance" to determine how overdraft charges were :assessed or for your available balance for purchases. The "Cleared Activity" section of OLB is not intended to. chow your available balance at that moment in time It shows only posted transactions, for example checks that have been presented and paid, automated debits ("ACH") such as when your utilities are automatically debited from the Account. Availability of deposits made in a branch or at an ATM can be viewed in OLB on the day of deposit. The entire amount will be displayed in OLB in the "Pending Activity" section. However, only the amount that is available from the deposit will be added to the "Available Balance." Within OLB, you can click on the "Holds" link in the "Checking Account Details section and see how much of the deposit is unavailable along with the:date when the.funds Will 'become. available. Our records show that on October 16, 2017 the beginning balance in the Account was $130.65, which was decreased to $52.81 by three (3) Debit Card purchases. The current day Activity shows one (1) pending item in the amount of $30,71 which reduced the available balance to $22.111 Additionally, there were two (2) direct withdrawals from PayPal in the amounts of $24.90 and $29.99 which were paid into overdraft. Subsequently, there were two (2) overdraft fees assessed to the account the same business day. For your review, I have enclosed a copy of the Notice of Insufficient Funds and Charges to. No. [redacted]     Dear Mr. T[redacted]   KeyBank National Association (“KeyBank”) is in receipt of a complaint filed with your office by Ms. [redacted].  We understand the importance of our client’s financial wellness. Please be assured that KeyBank is committed to providing excellent service. On November 24, 2017, KeyBank verbally delivered our resolution to Ms. C[redacted]’s concerns.   Our review found that Ms. C[redacted] made a deposit at one of our ATM’s on November 17, 2017. In regard to the extended holds which may be placed on a deposited check, our general policy is to allow a withdraw of the funds deposited no later than the business day after the day we receive your deposit; however, in some cases we may delay the availability to withdraw those funds.  KeyBank’s Deposit Account Agreement and Funds Availability Policy (the “Agreement”), which is given to all account holders upon account opening, details this policy.    Part II, Section 6, of the Agreement states in part:   “Exception Holds. In addition, funds you deposit by check may be delayed for a longer period under the following circumstances: We believe a check you deposit will not be paid. You deposit checks totaling more than $5,000 on any one day. You redeposit a check that has been returned unpaid. You have overdrawn your account repeatedly in the last six months. There is an emergency, such as failure of computer or communications equipment or other conditions beyond our control.  “We will notify you if we delay your ability to withdraw funds for any of these reasons, and we will tell you when the funds will be available.  They will generally be available for withdrawal no later than the fifth business day after the day of your deposit.” On November 20, 2017, the client was notified by US Postal Service of this hold and the expiration date of said hold. This notice also states that if any fees for overdrafts or returned checks that result solely from the additional delay of this deposit will be refunded to the client when the client presents said notice to one of our KeyBank branches. In review of Ms. C[redacted]’s account, an overdraft fee that was assessed to the client’s account has been refunded.   We appreciate the opportunity to respond to Ms. C[redacted]’s concerns with quality and integrity. Their actions have nothing to do with my relationship with them. They had no history of my missing any payments or being delinquent on my account. In point of fact while other companies had reason to close my accounts Key Bank did not. I made a significant payment in August 2015. I have no Key Bank branches in my area that I can go into to make payments. The other damage Key Bank has done to me is because of their unwarranted actions they have damaged further my credit reputation. To illustrate plainly... Key Bank closed my account without merit. They report to the credit reporting agencies I am a bad risk but they created their part of that with their own actions. Seems like arrogance in a big way on their part.Regards,

"Loan")  Dear Mr. [redacted]: We received your complaint that you filed through the [redacted] and the Revdex.com serving Greater Cleveland in regards to your questions and concerns about the banking service KeyBank National Association ("KeyBank") provides to you. I would like to take this opportunity to apologize on behalf of KeyBank for any inconvenience you experienced and for the frustration you felt as a result of this matter. We at KeyBank strive to provide great service that helps you make confident financial decisions. I have reviewed your concerns and would like to offer the following: Our review of the Loan found that the Loan Agreement (the Agreement) was signed on May 3, 2013 (copy enclosed). Section Thirty Four (34) states the following: "If the initial credit limit shown at the beginning of this agreement is $15,000 or more and you cancel your account within four years afier the date we open it, you must reimburse us for any appraisal fee, search fee, mortgage recording fee, mortgage tax or flood certification fee shown at the beginning of this agreement. " The total amount of the fees paid on your behalf as indicated on page one (1) of the Agreement and subject to early termination was $526. Our review found that while the Agreement was signed on May 3, 2013 the date that the loan was fully funded and opened was May 10, 2013 and as such the early termination period per the signed Agreement would correctly expire four (4) years after that date. KeyBank received a payment in the amount of $31,068.83 on May 4, 2017, directed to KeyBank from [redacted]. Our records show that a document sent to KeyBank along with payment from [redacted] was missing the required signatures (copy enclosed) to close the Loan, and a letter indicating this was mailed to you on May 6, 2017 (copy enclosed). In order to close the Loan and release anyiall liens on the property that is collateralized by it, we need signed authorization. We have since received the signed authorization and have closed the loan, back dated the closure to May 4, 2017 and sent the lien release for the property. As a gesture of goodwill, we have waived the early termination fee. Our review found that the payment made to the Loan resulted in an over payment, we have credited your Key Advantage Checking Account ending in # [redacted] a total of $563.25. The credits) will be viewable on your next deposit statement. In closing, please know that KeyBank values your feedback and the opportunity to address your concerns. We appreciate your business and look forward to continuing to work with you.
