Several points made in Mapperarti's response are not correct. The day I signed and prior to signing the agreement, I spoke with *** *** of Mapperarti and he confirmed that no competitors would be in the publication and also confirmed several times that both publications would be completed in weeks Subsequent to signing the agreement, the only contact to or from Mapperarti
were discussions on how to upload graphics for the ad & review of proofs We have a log of each and every call to Mapperarti. Our initial conversation was with *** *** (no longer with the company) and all subsequent conversations were with *** *** (his replacement) *** was and *** is in the position to check the artwork, create proofs and upload the final proofs in the publication, not to discuss the sales agreement There were no discussions at any time regarding the terms *** promised. In addition, we met with *** *** a few times socially between the time the agreement was signed and the first ad published. He did not say anything about that fact that a direct competitor would be appearing in the maps or that Marina Del Rey would not be shown on the map as he previously communicated when making the saleSo Mapperarti's claims that “All of this information was repeatedly communicated to the client by a Mapperarti customer service representative with each phone call from the client.” or "All points of the agreement were confirmed by Mapperarti and the customer via a phone call between both parties within working hours after the signed agreement was received by Mapperarti The Mapperarti customer service representative clearly related the terms and conditions regarding publication deadlines and exclusivity to the client.” are not accurate
Regarding Mapperarti's claim that “The customer did not raise any concerns at this time and confirmed the purchase of one ad space on Fairmont Miramar Santa Monica map and DigiMapp for months, one ad space on the Viceroy Santa Monica app for months for a total of $$to be paid on singing and the remaining balance of $to be paid via the credit card details provided on the agreement by the customer on 08/14/15.”, we relied upon
statements by *** that: 1) *** *** would be the only boat
charter business represented in the maps, that 2) Marina Del Rey, our
business location, would be indicated on the maps and 3) that the publications would be complete in weeks. No one ever made us aware that an exclusivity charge would be required to ensure no competitors were on the publication or that it was even an option Had we understood that a competitor could be in the publication, we would have either inquired about the exclusivity charge or we would not have proceeded with the advertisement. Regarding Mapperart's claim that they have delivered per agreement and taken action accordingly, we disagree for the reasons aboveMapperarti has not
delivered per promises made by their sales representative and the Company fails to even take the time to communicate in any way with us. *** *** admitted that they had
reprimanded *** *** for not communicating clients’ requirements to
them. When we were provided a copy of
the first publication and saw two glaring problems with the ad (a competitor’s
ad and no indication of Marina Del Rey), we asked *** *** to put us in
touch with her supervisor. We also left
messages with Mapperarti’s receptionist, asking that the supervisor call to
discuss the discrepancies. The
supervisor never returned our calls. The
sales representative has not returned our calls
Mapperarti's sales representative misrepresented the agreement and Company management is completely unresponsive We have not received what was agreed. Regards,

The business's response is simply not true; their sales rep promised the placement that I was sold and was fully aware that my business was contingent upon it The hotel is not endorsing them reaching out to prospective clients on their behalf I have spoken with the hotel's management team (happy to provide a specific contact) and was informed that there are numerous complaints regarding their method of doing business and misrepresenting the manner in which Mapperarti says the hotel referred them - the hotel does not refer Mapperarti to prospective clients, so this point is also a lie Their "non-refundable deposit" was never addressed by the sales rep and is an outrageous $1, Mapperarti's reply is simply more lies attempting to justify their unethical business practices This company is conducting bait and switch tactics which is illegal and unethical I will continue dispute and seek full legal action against Mapperarti I have also attempted to contact their corporate office and have not received a response

Dear [redacted],I have attached the advertising agreement which was signed by Mr. [redacted] that states "Placement is not guaranteed and is subject to change at Mapperarti's discretion unless spot location fee has been paid." This agreement also shows 0 value under "Spot Location." As I stated previously, we were unable to place the advertisement in the requested spot, and Mr. [redacted] was quickly notified of the alternate placement via email.We do have documentation and correspondence from the the Hyatt Regency Huntington Beach stating their intent to distribute and support the publication, to which end Mapperarti is responsible for approaching businesses to enlist participation.

communicated to Mr. [redacted] that the placement would be given if available. Another advertiser had claimed the spot that Mr. [redacted] requested, so we notified him shortly after signing that his placement would be in another spot.When he told us that he wished to cancel the agreement, we informed him that we could refund all that he had paid except for the non-refundable deposit, as per the advertising contract.The hotel that we are working with has consented to have us contact local businesses for participation in the publication we are producing, as we have a signed contract to this effect.

Production on The [redacted] publication is still ongoing. However, production is now with our sister office overseas, and it is taking some time to receive a full update and timeframe. We appreciate your patience, and we will update as soon as possible.

Mapperarti has delivered as per agreement. The agreement (attached) signed by the customer clearly states that "no publication deadline can be guaranteed" and that "exclusivity can only be guaranteed upon payment of exclusivity fee" - which was not included in the total value of the agreement, also...

clearly outlined on the signed agreement. All points of the agreement were confirmed by Mapperarti and the customer via a phone call between both parties within 48 working hours after the singed agreement was received by Mapperarti. The Mapperarti customer service representative clearly related the terms and conditions regarding publication deadlines and exclusivity to the client. The customer did not raise any concerns at this time and confirmed the purchase of one ad space on Fairmont Miramar Santa Monica mapp and DigiMapp for 12 months, one ad space on the Viceroy Santa Monica app for 24 months for a total of $3000. $1500 to be paid on singing and the remaining balance of $1500 to be paid via the credit card details provided on the agreement by the customer on 08/14/15. The client was also reminded that their advertising term would not being until the maps were delivered to their respective hotels. The client will receive a full 12 months of advertising with the Fairmont, and a full 24 months of advertising with Viceroy regardless of publication print dates. All of this information was repeatedly communicated to the client by a Mapperarti customer service representative with each phone call from the client. Again, Mapperarti has delivered per agreement and taken action accordingly.

The attached contract states in the Special Instructions box that no deadline can be guaranteed. Though it is unfortunate that we were unable to meet the targeted release date, we are still within the terms established on the contract that was signed.Additionally the terms in the Special...

Instructions box state that the contract is for a minimum 12 month advertising term. As only 2 months have elapsed, the contract will not end for another 10 months. As has been explained to the client, we can cancel the contract after 12 months of advertising have elapsed. The automatic renewal noted on the contract will not go into effect as we have received prior notice of cancellation.

We have being speaking with the business directly about the issue.

Your ad does’t specify the address as well, and we have your approval on it. We added a pinpoint based on the google map search for your...

business, the screenshot was attached to the previous email.As for the map mistakes, design team went over your list today and confirmed that everything had correct address and location. We only had a [redacted] listed twice but one of them actually had a correct address."On April 2nd of 2015 we sent another email to [redacted]:"Dear [redacted],I hope you are doing great.It is our top priority to make our clients happy and satisfied.We would love to offer you an upgrade to a double spot ad on the [redacted] Chicago for the 2nd year of the publication. In addition, we will give you a double spot ad on the [redacted] publication for the 2nd edition for absolutely no charge.Please let me know if you accept our offer, so I can update our system for the future editions."We have never received any complaints from the hotel, and we successfully confirmed that they are happily distributing our maps. The agreement with the client was fulfilled and we offered some extra free advertisement to make client happy, that client denied.Thank you!

I have attached the email correspondence between myself and [redacted] from [redacted]. The only reason we agreed to proceed with this company is because we were promised that publication was to be sent out in July, per [redacted], specifically for the Summer which is our prime season. We our now entering September, Summer is over, and our publication would be for naught.

We would just like to cancel and not be billled for anymore months. We are completely dissatisfied. Although their contract states that there is no deadline, taking literally a year to get an ad up that I gave them a year ago, is ridiculous. No customer would be happy with this and the lack of integrity that their team has shown. The fact that they just keep referring to the contract and not to mention their lack of customer service and willingness to keep their customers happy is why we would like to cancel and we feel that an exception should be made.
