We are now well past the "target close date" of July 30, I have lost my ability to use the unit as I want, that being to rent it outCheck in for the unit is in a week, and this transaction is still not closedPlease complete the transactionThis excessive delay in completing the deal has cost me $(rental fee for the week) already, not to mention countless phone calls to follow up and try to get them to fulfill their legal obligation to close the deal in a timely manner.Thank You,*** ***

I talked to Mr*** last week about this situation. He was very understanding and he is correct. This was a mistake on our end and was our fault completely. I apologized, personally, and have talked to the staff that was involved in the mistake. We transfer several
thousand timeshares a year and occasionally mistakes happen. The deed has been recorded and I emailed a copy of it to Mr*** for his records. The transfer is being completed now and we are just waiting for resort confirmation. Please feel free to contact me if there are any questions,Andy H***

about Nov3, This transfer has been submitted to the resort and we expect that it will close within our agreed target dateI have included an email response from the resort verifying this.Mr*** called in on 5/touch base and we told him that we had everything we need.Mr*** called in on 10/and was very angry about this not being closed yetOur staff let him know that everything was on schedule and reminded him of his closing dateHe, at that point got very angry and began to, what would consider, verbally abuse two of my employeesone to the point of tears.At that point I told them that they no longer had to deal with him and that I would contact Mr***.At no point had he ever brought up any guest reservation request.I called Mr*** on 10/and had, what I thought, was a pleasant conversationHe told me that he was upset that he had requested a guest reservation months earlier and it was never madeI told him that if we dropped the ball on anything we would certainly make it rightI was not at my office to be able to get into the database while we were speakingI let him know that we keep all email threads and would look at itI also asked him, just in case something happened on our side to forward to me the email where he requested the guest reservationAt that point he said he could forward airline ticket receipts to prove that he had made a reservation requestI explained to him that a receipt for a plane ticket isn't really proof of a reservation request and that most people wouldn't book an airline ticket until they actually had a place to stayHe said he would look for the emailHe has not forwarded anything to me as of yet.Again, If Mr*** would like us to make a reservation request within the time frame that the contract he signed lays out we would be happy to do so.Per our purchase contract, Mr*** owes GroupWise Incthe maintenance fee, regardless of whether he chose to use it or not, and the $service fee he agreed to pay.Cordially,Andy H***OwnerGroupWise Inc

How convenient that they say it was a mistake and that they abide by the Do Not Call registry where my number has been on file since the inceptionthey call all the time and spoof the numbers from which they are calling, also do not use caller ID as required by law

I do understand Mr***'s frustration and we try to make all of our clients happy clients. I'm not sure that he opened both attachments that I included in my original response, but the worksheet that he attached was the same as the one that I attached. The file was opened after a verification call from my office on 4/18/2017. That puts us on day as of today but that is nether here nor there. The reason that we cannot refund maintenance fees is because he retained usage of the weeks that corresponded with those maintenance fees. This is the case with all of our clients which is why it is spelled out in several places in the paperwork and explained clearly when we sit down with our clients. If we had usage of the weeks in question we would absolutely pay the maintenance fees, but we did not. It is kind of like asking us to pay for a client's vacation.
