Our company did in fact send Ms*** Designation of Homestead to be filed at the Travis County Recorder's office. This documentation was mailed to the county on 1-12-and usually takes about to weeks for the county to return this filing back to the homeowner. If Ms* ***
called the county recorder's close to that date I wouldn't expect them to have the filing completed, but I would think it would be completed by now. We will go ahead and issue Ms* *** a refund for the $because we want her to be 100% satisfied. Please allow a few more weeks for the final recorded document to be returned.ThanksCustomer Care

and that we do not prepare a homeowner’s tax exemption. This information is located all over our solicitation so that a potential customer will not get confused. We see that Mr*** read our mail solicitation and saw he could also sign up for our service on our website. Once on our website Mr*** would see just like our mailing that we are not a government agency, that our website is an advertisement for service and that we do not prepare a homeowner’s tax exemption. During this process if Mr*** was still confused after reading this information on our website or solicitation he could have called the toll free number we print all over our marketing material and listened to our recorded message (available hours a day, days a week) or spoken to a customer service rep which would explain the details of our service, explained we are not a government agency nor do we prepare a homeowner’s tax exemption. Our company unlike our competitors has this information readily available with every communication that we offer a potential customer. We are sorry that Mr*** missed this and have refunded the credit card he originally used to sign up for our service the $as requested. Please allow to days for the credit to appear on his account

Thank you for the inquiry from Mr***. Included with our response is a copy of the solicitation that Mr*** received from our company. Our solicitation, website and pre-recorded message (available hours a day) all which Mr*** had used states several times in bold large font
that we do not prepare a homeowner’s tax exemption along with explaining we are not a government entity. This information is located on our solicitation, website and phone message so that a potential customer will not get confused. After reviewing Mr***’s account I also noticed that Mr*** spoke to our customer representative which explained all the same information. At the time of the call our customer service representative offered a refund of service which was submitted to Mr***’s credit card already. Mr*** paid a total of $35. He should see this refund in to days depending on his bank’s processing time.We realize Mr*** has concerns with our solicitation, but Homestead Recording Service has been in business and using the same form for over years in the state of Texas. This form has stayed the same except a few minor modifications that were required by Texas statute changes. Our form unlike our competitors uses large font, bold lettering, offer a toll free number, have a pre-recorded message to assist customer hours a day days a week and have a 100% customer satisfaction policy We are sorry Mr*** was confused

homeowner’s equity not the tax exemption. This filing is completed at their county recorder’s office not the tax assessor’s office. When Mr***contacted his appraisal district they of course would say we didn’t file his tax exemption because that is not the service we provide. Our form and website state this several times in bold, large font so as to not confuse homeowners. We have included a copy of the solicitation Mr.*** received for him to review. I am sorry Mr*** did not fully understand the information he read about our service. We would be more than happy to refund Mr***’s credit card the $35. We received your complaint from Mr*** and went ahead and issued him a refund. He should see this in to days. It's unfortunate that Mr*** didn't contact our office if he had questions in regards to our service. It states several times on our letter that we are a
private company and our letter is an advertisement of service. If he called our toll free number our voice messaging system would have explained this as well as went into more details on our service. If at this time Mr*** was still confused he could have spoken to our customer service representative who would explain everything to him as well

refund to his credit card on the day he spoke to Michelle our customer service

The refund for Mr. [redacted] was processed as stated in our earlier response.  It takes up to 7 days for his refund to show up on his credit card statement.  Based on Mr. [redacted]' second response he still hasn't fully read our solicitation.  We state in large, bold faced, that we are not a government entity, our service is optional and that our company does not file the Homestead Exemption. This is something our competitors do not do.We offer two services both being optional.  The second letter that Mr. [redacted] received was for an optional filing service for his Designation of Homestead.  This service is offered as a convenience to customers.  In order to complete the Designation of Homestead process the homeowner must file their paperwork with the county recorder's office not the tax assessors.  Most people don't have the time to drive to the county office that is why we offer the service of filing the document for them.  We charge $39 to do this.  From this $39 we pay the county recording fee of $25 to $30 and the additional monies is for our time to take care of the filing.I know that Mr. [redacted] has his mind made up about our company and unfortunately can't do anymore than give him the refund he has already received.

We researched Mr. [redacted] information and don't find where he signed up with our company.  If he has an online receipt or copy of a check that would have been mailed to us we would be happy to refund him.  We offer a 100% satisfaction guarantee.  We have also included with our...

response a copy of the solicitation Mr[redacted] would have received.  You will notice that no where on the form does is state "Official State Business".  Our form actual states in large bold font that we are not a government entity and that our service is an advertisement in several places.  Unfortunately we have several competitors who's solicitations aren't as clear as ours which at times causes confusion.  Please let us know if Mr. [redacted] is owed a refund.

I am rejecting this response because: This false representation confuses and misleads a new home buyer right after they purchase their home and looking into straighten out their homestead exception. Homestead Recording Services refers to Texas Constitution and bylaws aimed at inducing one to pay the unnecessary $35 and that is not right. Attached is a copy of the second letter along with a "Document of Designation" they request new home buyers to pay an additional $39 upon wasting their time to get the fake document notarized. Moreover, if Homestead Recording Services is not conducting illegal business, why would they offer to refund the $35 upon being questioned like they did when I called to get more clarification. Another indication that Homestead Recording Services is not being honest is because they said they refund the $35 when they did not. As I mentioned to Mr. [redacted], Investigator - even though I am unemployed at the moment, I am not worry about getting the refund as much as I want to have Homestead Recording Services stop doing this kind of business. I consider myself well educated and I still fail for this scam and I imagine how many people out there is falling for it and paying more and more money to the company because Homestead Recording Service comes for more money once you paid the first $35 like they did to me.

Thanks for your inquiry from [redacted].  Our company is one of five in Nevada that help people with the Declaration of Homestead.  Usually our company gets a positive reaction from customer's in Nevada as we are the only company that offers a toll free number for customer's to contact us...

with any questions or concerns.  Unfortunately these other companies have copied our mailing which has caused confusion for homeowner's and we are sorry for this.  We have been doing business in Nevada for well over 20 years and have dealt with many copy cats over the years.  If [redacted] has any further questions or concerns she can contact us at our toll free phone number directly if needed.[redacted]
