I don't know rules and regulations I don't work for Merrick Bank I do expect their employees to be polite and inform me of what I can and can't do to solve my problem and yesterday was the first time I spoke with someone willing to do that

I am rejecting this response because: I did not have any addresses in Los Angeles CA or Atlanta GAThe only location I have ever had is in Philadelphia PA.Which would appear to me that the URGENT/SENSITIVE correspondence from Merrick was sent to another address (possibly in CA or GA)
I also called the number provided ###-###-#### where there are said "payment options" to bring my account current and I was transferred to the collection agency
Sincerely,

A review of the account was conducted. Ms*** made a payment on her account on August 12, that was returned by her bank unpaidThe payment was replaced on August 18, The account was closed on August 19, due to multiple returned paymentsMs*** called on August 20,
and requested that the account be re-opened the representative who spoke to her explained that the account would not be re-openedThe multiple returned payments are considered high risk behavior. The cardholder agreement that governs the account indicates that Merrick can close the account for any reason or no reason without additional notification. Merrick has re-opened the account as a courtesy. Ms*** should be aware that the account may be closed again in the future if Merrick continues to receive returned payments even if they are replaced promptly
A review of Ms***’s account was conducted. As part of that review Merrick requested copies of any recorded calls from or to Ms*** in the past days. There were no recorded calls on this account for that time period. There are no notes on the account regarding any contact
with Ms*** since July 26, Since Merrick is unable to verify the contentions made by Ms*** in her complaint there is little that Merrick can do to address the concerns she expressed. Merrick does conduct ongoing customer service training and it is the policy of the Bank to never discuss an account or personal information with anyone who is not authorized or fully verified by the representative
A review of Ms***’s account was conducted. Ms*** opened an account with Merrick in November and has used the account for the purchase of goods and servicesPayments on the account are due on 22nd of each month. On December 16, Ms*** made the first payment on
the account in the amount of $383.27. It is Merrick’s policy to implement a credit limit access hold on some accounts, including new accounts. This helps the bank detect possible fraud, understand the account holder’s usage on the account and reduce its credit risk. Under Section of the cardholder agreement title “About the Credit Limits on the Account” it states the following: [E]ven if we have posted a payment or credit to the Account, we still may in our sole discretion decline to permit use of a portion of the credit limit equal to the amount of the payment or credit for up to eleven days from the date postedMs*** may download a copy of the cardholder agreement at http://www.mbdot.com/docs-repository/merrick-bank/mb_unsecured%20agreement.pdfTh...⇄ hold will be released in days from the date the payment was received which was the 16thMs*** should have access to the additional credit line on December 23,
The error code came from the Federal Reserve not Merrick bank. The account holders bank told the Federal Reserve that it was not an account from which transactions could be made. He will need to contact the ACH department at his bank for an explanation of why they told the Federal Reserve that
Ms*** opened an account with Merrick in March 2016. The Bank of America account from which Ms*** was attempting to make payment was blocked by Merrick because it received correspondence from Bank of America on 11/15/stating that their customer, *** ***, had informed Bank
of America of unauthorized payments being made from her account to Ms***’s Merrick account. We have not received a follnotice from Bank of America claiming that the November notice was an error as Ms*** states in her complaintBecause Ms*** is not the accountholder of the Bank of America account, we need a letter from Bank of America stating that she is authorized to use that account in order to allow it to be used to make payments on her Merrick account againThat letter can be sent via fax to 516-576-
A review of the issue raised in Ms***’s complaint was conducted. Attached is an example of the exact solicitation that Ms*** received for a Merrick Bank card. She received a pre-screened firm offer of credit contingent upon her continuing to meet the credit criteria
Merrick obtained from a credit reporting agency in the pre-screen process prior to making the offerMs***’s application was provided an adverse action notice which described the reasons Merrick declined her applicationThe pre-screen process takes place two months prior to Merrick’s extending the firm offer of creditIn Ms***’s application submitted in response to the firm offer of credit, she authorized Merrick to obtain a full credit report as part of evaluating the application. Merrick will not remove the inquiry from her credit file
My minimum payment due is still reflecting $Not $again, they have carried the late fee over as they have done each month and adding it on to my minimum payment due

Merrick is unable to provide details regarding any account to Ms*** ***. She is not the authorized user or has permission from her husband to receive information regarding his account. If Mr*** *** wishes to discuss options regarding his account he can contact Merrick’s
Agent, TCI at 877-879-
Merrick has not provided any derogatory information on the account except to confirm that it was discharged in the BK case. The prior delinquency and statuses are part of the original file but are not resubmitted with the verification of the BK discharge
Merrick’s records show that Mr*** opened an account with Merrick in December Mr*** used the account to purchase goods and services until it became delinquent and charged off for nonpayment in November 2013. The date of first delinquency determines how long
an account will be reported by the credit reporting agencies. That date for Mr***’s account is May 8, 2013. Derogatory reports can remain on a file for 7-yearsMerrick does not continue to update its reporting on charged off accounts after the charge off unless there is some activity on the account The status of the account as reported is correct and accurate according to Merrick’s records and will not be deleted or modified. To do so would be a violation of the Fair Credit Reporting Act

However, I'm not sure how they received my work number which was never provided to them unless when I provided proof of income the copied down that number. I did not give permission to contact me at this number. Any area code can not be called as this is for law enforcement purposes only and this needs to be understood

*** *** opened an account with Merrick in March and has used the account for the purchase of goods and services. The due date on the account is the 22nd of each month. On June 20, *** *** called Merrick regarding the status of the accountThe representative who took
the call explained that the account was days past due. *** *** disagreed with that status and requested a supervisor who agreed to review a call with another representative and *** *** from May 22, 2017. Upon reviewing that call the supervisor attempted unsuccessfully to contact *** *** by phone and received no answer, and the cell phone number indicated the voice mail was full. After the supervisor reviewed the May 22, call it was determined that the representative gave incorrect information to *** *** on that callAs a result, Merrick has waived the May and June payments due on the account along with the late fee that had previously been assessed to the account. The account is due for the July 22, payment in the amount of $35.00. There has been no negative credit reporting on the account
Merrick conducted a review of the issue raised in Mr***’s complaint. The payment history of the account indicates that Mr*** made all of the payments on the account via a Capital One account ending in *** with the exception of the November payment. This payment was made from
a Citi Bank account ending in ***. This was the payment that was returned unpaid. Merrick has not experienced any issues with its mobile application of the nature that Mr*** indicated he experienced. However, we have escalated the concerns expressed in Mr***’s complaint to the appropriate level of Management so that further research can be done to ensure issues like this are not occurring. In an effort to address Mr***’s concerns regarding the November payment Merrick has waived the late fee as a courtesy and the subsequent interest charged to the account balance in the total of $36. Mr*** should see this adjustment to the account on his next account statement. We hope that this resolves Mr***’s concerns
Ms*** opened an account with Merrick in April and has used the account for the purchase of goods and services. In April Ms*** requested a payment plan on the account and was approved for that plan on April 13, 2017. Ms*** was to make payments of $each month
on the plan. On August 24, Ms*** contacted Merrick regarding the charge-off of the account. It was explained that no payment under the plan had been received since April and that was the reason for the charge off. Ms*** explained to the representative that she believed that the payments were set up to be paid automatically and requested a reversal of the charge off of the account. On August 25, the charge off was reversed from the account and a representative contacted Ms*** to tell her of that action on the account. The representative also helped Ms*** set up recurring payments for the payment plan amount and the credit reporting for the account was updated to remove the charge off notation Merrick apologizes to Ms*** for the issues she experienced with the account. From the notes on the account it appears that all of those concerns have been addressed to her satisfaction

Mr*** opened a Merrick Visa account in January 2012. He used the account for the purchase of goods and services. The account became delinquent and subsequently was charged-off in February Merrick does not continue to report charged off accounts once the charge off has
been submitted to each of the credit reporting agencies. The reporting status can change if there is a payment made or the borrower updates any of their information with the reporting agenciesThe date of first delinquency is the date that drives how long a derogatory report will remain on a credit file. The credit reporting history of the account is maintained by the credit reporting agencies. Good credit information can remain on a file indefinitely; derogatory information can remain on a file for 7-years. Merrick has never received any correspondence regarding this account, nor have we received any type of credit bureau dispute regarding the account until this complaint. Merrick is required under the Fair Credit Reporting Act (“FCRA”) to accurately report the status of accounts it reports to the credit bureaus. After reviewing the original credit application information, the identity and address, including email, and other details associated with the account, we have found it remains consistent with the credit bureau’s database file associated with Mr*** as of this dateThere has been no additional information provided by Mr*** that supports the inaccuracy of the account relationship to himself or the account usage or payment historyThe various status’ reported on Mr***’s account were and are accurate and Merrick is unable to remove correct information. To do so would be a violation of FCRA
Mr*** opened an account with Merrick in December 2014. The account information sent to him included a disclosure regarding the amount of credit being offered and the fees that would be charged on the account.
Mr*** has used the account and the associated credit for the
purchase of goods and services. At the time he received the card a pricing appendix was also sent to him outlining the fees and costs associated with the account.
Mr*** made late payments or sent payments for less than the minimum payment due on several occasions since May 2015. This is the reason why the account incurred late fees
Merrick fully complied with the requirement regarding the disclosure of the fees and costs of the account. It is Merrick’s policy to waive one late fee in a month period as a courtesy. Mr*** received that fee waiver in October. Merrick will not waive any additional fees assessed to Mr***’s account.
I have enclosed copies of statements for the account and a copy of the pricing appendix that was sent to Mr*** when the account was opened
